This code outlines the city's regulations concerning the collection of solid waste. This includes guidelines on the placement, timing, and types of containers used for waste disposal to ensure efficient and sanitary collection services. The section also addresses the responsibilities of residents and property owners in maintaining proper waste disposal practices. Timely and correct placement of waste containers ensures that trash is collected promptly, reducing the risk of odors and contamination. Leaving or placing the containers in incorrect spaces impacts the aesthetics of the neighborhood and creates a nuisance.

Violation

The code states that solid waste containers shall not be placed at curbside earlier than one (1) hour before sunset on the day prior to collection and shall be removed from curbside by sunset the day of collection. It further states that broken containers where the cause was through resident negligence shall be remedied by the resident paying for a replacement container (containers damaged by the city will be replaced by the city). A residence may have a maximum of two (2) containers, and all waste items must be placed inside the container (bags or items outside the container will not be picked up).

Corrective Action

Ensure that waste containers are placed at the curbside and removed within the designated window for your scheduled pickup (no earlier than one hour before sunset the night prior through sunset of collection day). Ensure that receptacles are cared for appropriately and that damaged containers are reported. Place all waste items inside the containers to ensure prompt pickup.

Section 22-340 - Collection practices for residential waste.

The following practices for curbside collection of residential solid waste are hereby established:

(1) Solid waste containers. The city shall collect solid waste in city-issued 95- or 65-gallon containers. Only city-issued containers will be serviced in an amount not to exceed two (2) containers per residence. The director shall have the authority to refuse collection service for failure to comply with this section.

(2) Broken or damaged containers. If a container is damaged by a city sanitation truck or by normal wear and tear, the damaged container will be repaired or replaced by the city at no charge to the resident. Any container that is damaged due to negligence or abuse by the resident will be replaced by the city upon the resident paying the city for a replacement container.

(3) Hazardous waste. Hazardous waste shall not be placed in containers for regular collection nor collected by the city for disposal.

(4) Biohazardous/medical waste. Biohazardous/medical waste shall not be placed in containers for regular collection nor collected by the city for disposal.

(5) Solid waste removal. It shall be the city's policy to collect all solid waste two (2) times each week per residence commencing at 7:00 a.m., Monday through Friday, with the exception of weeks in which a city holiday falls. Collection of solid waste missed because of a weekday holiday shall resume on the next regularly scheduled pickup day. All solid waste must be placed in city-issued containers and placed at the curb by 7:00 a.m. on the scheduled day of collection. Any garbage and/or other debris that is placed outside the container will not be picked up and must be placed inside the container for collection on the following scheduled service day.

(6) Solid waste collection. Solid waste containers shall not be placed at curbside earlier than one hour before sunset on the day prior to collection and shall be removed from curbside by sunset the day of collection.

(7) Exceptions. Exceptions to these requirements shall be considered for approval after contacting the public works department.
