This article seeks to address the manner in which we should conceptualise the duties of directors in making decisions where fundamental rights are at stake.

A pointwise definable model is one in which every object is \loos definable without parameters. In a model of set theory, this property strengthens $V=\HOD$, but is not first-order expressible. Nevertheless, if \ZFC\ is consistent, then there are continuum many pointwise definable models of \ZFC. If there is a transitive model of \ZFC, then there are continuum many pointwise definable transitive models of \ZFC. What is more, every countable model of \ZFC\ has a class forcing extension that is pointwise definable. (...) Der Sammelband umfasst Aufsätze zu den Grundfragen, Anwendungen und Grenzen des Unterrichts des Argumentierens, in allen Fächern und mit Fokus auf die Fächer Philosophie und Ethik. Dabei werden Fragen wie diese behandelt: Welchen Zielen dient das Argumentieren und welche verfolgt der Unterricht des Argumentierens? In welchem Verhältnis stehen diese zu anderen Zielen des Unterrichts? Welche Kenntnisse, Fähigkeiten und Tugenden des Argumentierens sollen eingeübt werden und wie? Die vorgeschlagenen Antworten sind nicht nur für Personen aus der Fachdidaktik, sondern auch aus der (...) Philosophie und der Schullehrpraxis aller Fächer interessant. Der Band trägt damit auch zur stärkeren Etablierung des Felds der Argumentationsdidaktik bei. (shrink)

Zusammenfassung Diese Studie hatte das Ziel, das Competence Assessment Tool for Advance Directives (CAT-AD) zu validieren. Dieses Instrument wurde entwickelt, um das klinische Urteil der Einwilligungsfähigkeit einer Person bei der Erstellung einer Patientenverfügung zu unterstützen – insbesondere bei kognitiven Defiziten, wie einer beginnenden Demenz. Im Rahmen einer Querschnittsstudie wurde das CAT-AD anhand des MacArthur Competence Assessment Tool for Treatment evaluiert. Die Untersuchung fand in 2 Gedächtnis-Ambulanzen statt. Insgesamt nahmen 31 Patienten teil. Das CAT-AD bewertet 4 Subskalen: Informationsverständnis, Einsicht, Urteilsvermögen und (...) Kommunikation einer Entscheidung. Diese Subskalen wurden daraufhin untersucht, inwieweit sie klinische Urteile zur Einwilligungsfähigkeit vorhersagen können. Die divergente Validität wurde anhand von Messungen der kognitiven Beeinträchtigung, Depression, Gesundheitskompetenz und des Bildungsniveaus bewertet. Die interne Konsistenz wurde mittels Cronbachs α bestimmt. Alle CAT-AD-Subskalen erwiesen sich als signifikante Prädiktoren für das klinische Einwilligungsfähigkeitsurteil – mit höheren Werten stieg die Wahrscheinlichkeit einer positiven Beurteilung (Odds Ratio 2,5–6,9). Die Subskalen zeigten keine Korrelation mit Depression oder Bildungsniveau, was darauf hinweist, dass das CAT-AD ein eigenständiges Konstrukt erfasst. Alle Subskalen korrelierten mit Gesundheitskompetenz, während nur Urteilsvermögen und Einsicht keine Vorhersagekraft für kognitive Defizite hatten. Die interne Konsistenz war zufriedenstellend (Cronbachs α > 0,70). Das CAT-AD ist ein zuverlässiges und valides Instrument zur Beurteilung der Einwilligungsfähigkeit bei der Erstellung einer Patientenverfügung. Zukünftige Forschung sollte seine Validierung auf unterschiedliche rechtliche Rahmenbedingungen und klinische Kontexte ausweiten, um die Generalisierbarkeit zu verbessern. (shrink)

Background This study aimed to validate the Competence Assessment Tool for Advance Directives (CAT-AD), designed to support the assessment and clinical judgment of an individual’s competence to complete an advance directive, particularly in cases of cognitive impairment such as early-stage dementia. Methods A cross-sectional study was conducted to evaluate the CAT-AD, based on the MacArthur Competence Assessment Tool for Treatment framework. The study was conducted in two memory clinics, focusing on patients with cognitive impairments. Thirty-one memory clinic patients with varying (...) levels of cognitive impairment participated. The CAT-AD assesses four subscales: Understanding, Appreciation, Reasoning, and Expressing a choice. These subscales were tested for their ability to predict clinical judgments of competence. Divergent validity was assessed against measures of cognitive impairment, depression, health literacy, and education level. Internal consistency was measured using Cronbach’s α. Results All CAT-AD subscales significantly predicted competence, with higher scores increasing the likelihood (odds ratio 2.5–6.9) of being judged competent. Subscales were unrelated to depression or education, suggesting the CAT-AD assesses a distinct construct. All subscales correlated with health literacy, and only Reasoning and Appreciation did not predict cognitive impairment. Internal consistency was satisfactory (Cronbach’s α > 0.70). Conclusion The CAT-AD is a reliable and valid tool for assessing competence to complete an advance directive. Future research should expand its validation across different legal standards and clinical settings to enhance its generalizability. (shrink)

BackgroundThe UN Convention on the Rights of Persons with Disabilities, and the reformed guardianship law in Germany, require that persons with a disability, including people with dementia in Alzheimer’s disease (PwAD), are supported in making self-determined decisions. This support is achieved through communication. While content-related communication is a deficit of PwAD, relational aspects of communication are a resource. Research in supported decision-making (SDM) has investigated the effectiveness of different content-related support strategies for PwAD but has only succeeded in improving understanding, (...) which, although one criterion of capacity to consent, is not sufficient to ensure overall capacity to consent. The aim of the ‘spatial intervention study’ of the DECIDE project is to examine an innovative resource-oriented SDM approach that focuses on relational aspects. We hypothesise that talking to PwAD in their familiar home setting (as opposed to a clinical setting) will reduce the complexity of the decision-making process and enhance overall capacity to consent. MethodsPeople with a suspected or confirmed diagnosis of dementia in Alzheimer’s disease will be recruited from two memory clinics (N = 80). We will use a randomised crossover design to investigate the intervention effect of the decision-making place on capacity to consent. Besides reasoning capacity, which is part of overall capacity to consent and will be the primary outcome, various secondary outcomes (e.g., other aspects of capacity to consent, subjective task complexity, decisional conflict) and suspected moderating or mediating variables (e.g., meaning of home, demographic characteristics) will be assessed.DiscussionThe results of the study will be used to develop a new SDM strategy that is based on relational resources for PwAD. If a change in location achieves the anticipated improvement in capacity to consent, future research should focus on implementing this SDM strategy in a cost-effective manner in clinical practice.Trial registration: DRKS00030799. BackgroundEverybody has the right to decide whether to receive specific medical treatment or not and to provide their free, prior and informed consent to do so. As dementia progresses, people with Alzheimer’s dementia (PwAD) can lose their capacity to provide informed consent to complex medical treatment. When the capacity to consent is lost, the autonomy of the affected person can only be guaranteed when an interpretable and valid advance directive exists. Advance directives are not yet common in Germany, and their (...) validity is often questionable. Once the dementia diagnosis has been made, it is assumed to be too late to write an advance directive. One approach used to support the completion of advance directives is ‘Respecting Choices’®—an internationally recognised, evidence-based model of Advance Care Planning (ACP), which, until now, has not been evaluated for the target group of PwAD. This study’s aims include (a) to investigate the proportion of valid advance directives in a memory clinic population of persons with suspected AD, (b) to determine the predictors of valid advance directives, and (c) to examine whether the offer of ACP can increase the proportion of valid advance directives in PwAD.MethodWe intend to recruit at leastN = 250 participants from two memory clinics in 50 consecutive weeks. Of these, the first 25 weeks constitute the baseline phase (no offer of ACP), the following 25 weeks constitute the intervention phase (offer of ACP). The existence and validity of an advance directive will be assessed twice (before and after the memory clinic appointment). Moreover, potential predictors of valid advance directives are assessed.DiscussionThe results of this study will enhance the development of consent procedures for advance directives of PwAD based on the ACP/Respecting Choices (R) approach. We introduce and consider the inner-model reflection principle, which asserts that whenever a statement \varphi(a) in the first-order language of set theory is true in the set-theoretic universe V, then it is also true in a proper inner model W \subset A. A stronger principle, the ground-model reflection principle, asserts that any such \varphi(a) true in V is also true in some non-trivial ground model of the universe with respect to set forcing. These principles each express a form of width (...) reflection in contrast to the usual height reflection of the Lévy–Montague reflection theorem. They are each equiconsistent with ZFC and indeed \Pi_2-conservative over ZFC, being forceable by class forcing while preserving any desired rank-initial segment of the universe. Furthermore, the inner-model reflection principle is a consequence of the existence of sufficient large cardinals, and lightface formulations of the reflection principles follow from the maximality principle MP and from the inner-model hypothesis IMH. Objective: Deficits in affective processing are associated with impairments in both mental and physical health. The role of affective processing in patients with functional somatic complaints such as irritable bowel syndrome remains unclear. Most studies have focused on the capacity for emotional awareness and expression, but neglect other dimensions of affective processing. Therefore, this study aimed to systematically analyze differences in six different dimensions of affective processing between patients with IBS and healthy controls. Additionally, we exploratively investigated the impact of (...) IBS symptom severity, psychological distress, and attachment styles on affective processing in IBS. Methods: A controlled cross-sectional multi-center study was conducted. Overall, 127 patients with IBS were compared with 127 matched HCs using multivariate analysis of variances. Affective processing was operationalized in line with the affect cascade model on six specific dimensions: emotional experience, emotional awareness, affect tolerance, affect differentiation, affect regulation, and emotional communication. They were measured using two subscales of the Mentalizing Questionnaire and four subscales of the Operationalized Psychodynamic Diagnosis–Structure Questionnaire. Linear regression analysis was used to investigate the influence of IBS symptom severity, depression, anxiety, and anxious and avoidant attachment styles on the different dimensions of affective processing in IBS. Results: Patients with IBS compared to HCs showed deficits in all six dimensions of affective processing. Deficits were largest for affect tolerance and lowest for emotional experience and emotional awareness. Moderate effect sizes were found for affect differentiation, emotional communication, and affect regulation. Moreover, explorative analyses indicated that affective processing in patients with IBS was significantly influenced by levels of anxiety and insecure attachment. Conclusion: The results indicate a specific pattern of affective processing abilities in patients with IBS. The deficits in affective processing are more prominent in the area of understanding and tolerating difficult affective states than experiencing affective states. This opens interesting perspectives for the development of specific psychotherapeutic interventions. (shrink)

Language is ruled by conventions. In order to understand how language functions we need to know what conventions are. According to David Lewis conventions are regularities in action or in action and belief, that perpetuate themselves because they serve some common interest. Ruth Millikan has criticized this analysis for being too complex. She claims to offer an analysis in simpler terms that does neither rely on regularities nor rationality. She defines what she calls “natural conventions” as patterns that are (...) reproduced due partly to weight of precedent. After brief outlines of the two proposals it is shown in this article that Millikans argument against Lewis’ analysis is based on a misconception of regularities, that her own analysis does itself rely on regularities and that she cannot do without rationality if she wants to explain the conventionality of language. Central to this discussion is the question of how it is possible for human testimony to convey information about the limit experiences of 20th century history. Given that the credibility of testimony is assessed by appealing to our previous understanding of what is credible, testimony to limit experiences risks being dismissed as unbelievable or implausible. This issue has recently been addressed in the (...) work of Paul Ricoeur, Hayden White and Gert-Jan van der Heiden among others. In the first part of this essay, I show that the current idea of a crisis of testimony is a consequence of focusing too exclusively on the content of extraordinary testimony. I argue that such a focus has affinities with David Hume’s reductionist understanding of testimonial knowledge; even though the authors discussed cannot properly be labelled reductionists themselves. In the second part of the essay, I open up the issue of extraordinary testimony from a perspective that places the relationship between the speaker and the addressee at the heart of testimonial knowledge. My aim is to show that if we attend to the way in which testimonial knowledge involves dependence on the authority of another person, then the current idea of a crisis of testimony will dissolve itself. In conclusion, I argue that there is an important ethical dimension to the question of understanding extraordinary testimony. (shrink)

In the academic debate on infrastructures in the Global South, there is a broad consensus that (post)colonial legacies present a major challenge for a transition towards more inclusive, sustainable and adapted modes of providing services. Yet, relatively little is known about the emergence and evolution of infrastructures in former colonies. Until a decade ago, most historical studies followed Daniel Headrick’s (1981) “tools of empire” thesis, painting—with broad brush strokes—a picture of infrastructures as instruments for advancing the colonial project of exploitation (...) and subordination of non-European peoples and environments. This paper explores new research perspectives beyond this straightforward, ‘diffusionist’ perspective on technology transfer. In order to do so, it presents and discusses more recent studies which focus on interactive transfer processes as well as mechanisms of appropriation, and which increasingly combine approaches from imperial history, environmental history, and history of technology. There is much to gain from unpacking the changing motives and ideologies behind technology transfer; tracing the often contested and negotiated flows of ideas, technologies and knowledge within multilayered global networks; investigating the manifold ways in which infrastructures reflected and (re)produced colonial spaces and identities; critically reflecting on the utility of large (socio)technical systems (LTS) for the Global South; and approaching infrastructures in the (post)colonial world through entangled histories of technology and the environment. Following David Arnold’s (2005) plea for a “more interactive, culturally-nuanced, multi-sited debate” on technology in the non-Western world, the paper offers fresh insights for a broader debate about how infrastructures work within specific parameters of time, place and culture. Critics like Matt Bedke, Terence Cuneo, and David Enoch have recently argued that an error theory that targets irreducible normativity has deeply problematic ramifications for hypothetical reasons, epistemic reasons, and deliberation. These challenges can all be viewed as versions of the companions-in-guilt response to the argument from queerness. It is argued that although Mackie and other error theorists have overlooked or not taken seriously enough the challenges discussed here, they can in the end be overcome. Philosophers and cognitive scientists address the relationships among the senses and the connections between conscious experiences that form unified wholes. In this volume, cognitive scientists and philosophers examine two closely related aspects of mind and mental functioning: the relationships among the various senses and the links that connect different conscious experiences to form unified wholes. The contributors address a range of questions concerning how information from one sense influences the processing of information from the other senses and how unified states (...) of consciousness emerge from the bonds that tie conscious experiences together. Pour y parvenir par une voie différant, sur le plan de la méthode, (...) d’un raisonnement a priori de type kantien, l’apport épistémologique de la phénoménologie de la vie de Michel Henry et la philosophie de la biologie de Hans Jonas font l’objet d’une réinterprétation associée aux travaux de Dominique Lambert sur l’hylémorphisme aristotélicien. Une fois repensée en régime darwinien et en tenant compte des apports critiques d’Henry et Jonas, une réactualisation contemporaine de la théorie des formes permet de mettre en évidence les raisons pour lesquelles, d’un point de vue anthropologique et ontologique, l’attention existentielle aux membres plus vulnérables de nos sociétés peut être considérée comme un indice majeur de la découverte par l’homme de la dignité de son être spécifiquement inachevé et vulnérable. |: The field of ethics dominates a significant part of the philosophical activity in these early years of the 21st century. In this contemporary context, the goal of the author is to demonstrate that both the thesis of the very essence of humanity and that of the unconditional value of any human being — whatever the degree of human vulnerabilities — remain philosophically robust from an evolutionary perspective. In order to achieve this demonstration, the author resorts to a different methodology as opposed to a Kantian a priori argument. A dialectic articulation is built so that the epistemology of Michel Henry and the phenomenology of biology of Hans Jonas may be critically revisited. Such work is made in the light of the Aristotelian theory of hylemorphism, which is restored within a Darwinian framework by Dominique Lambert in his philosophical works. When it is combined with Henry and Jonas’s insights, a contemporary renewal of the “theory of the forms” sheds light on the reasons why behaviors of care toward vulnerable persons in human societies are so important. Indeed, they may be considered as a major sign of the discovery by humans of the dignity of their specifically unaccomplished and vulnerable being. (shrink)

Lucio Baccaro and Jonas Pontusson make a significant contribution to comparative political economy with their approach to analyzing growth in advanced economies, which focuses on the demand side of the economy and distributive conflict. In contrast to Baccaro and Pontusson, however, we view their approach as reinforcing recent developments in varieties of capitalism rather than undermining them. We also believe that the type of modern macroeconomics used by Carlin and Soskice is better placed than their post-Keynesian framework to analyze growth (...) models, and that their approach is not inconsistent with it. Modern macroeconomic models incorporate, as they do not, a role for the state—including monetary and fiscal policy—and provide a coherent framework within which to analyze both the supply and demand sides of the economy; they also enable us to understand the interactions between economies and hence the role of growth models in global imbalances. It is widely agreed that clinical research should satisfy a number of ethical requirements. These include requirements to address a valuable question, to select subjects fairly, and to pose appropriate risks. In contrast, there remains considerable debate over the ethical relevance of investigator intentions: Does it matter ethically whether investigators intend to collect generalizable knowledge or to benefit subjects, or both? Some commentators do not mention investigator intentions when evaluating what makes clinical research ethical (Emanuel, Wendler, and Grady 2000). Celebrated for disproving the traditional view that lack of oxygen at birth (perinatal asphyxia) contributes significantly to cerebral palsy, a 1986 New England Journal of Medicine article by Karin Nelson and Jonas Ellenberg engineered a new consensus in the medical community: that lack of oxygen at birth rarely causes cerebral palsy. We demonstrate that the article's central argument relies on straightforwardly fallacious statistical reasoning, and we discuss significant implications -- e.g. how carefully fetuses are monitored during labor and delivery, expert (...) testimony in malpractice cases, and public policy decisions. This chapter discusses eight alternatives to ethical naturalism. Some are realist but not naturalist. Some are irrealist. Some are difficult to categorize, but since they are not clear examples of naturalism, this chapter also considers them. The theories discussed are standard nonnaturalism (e.g., G. E. Moore, David Enoch, William FitzPatrick), Meinongian theories (e.g., John Skorupski, T. M. Scanlon), non-ontological success theories (Derek Parfit), error theory (e.g., J. L. Mackie, Jonas Olson), fictionalism (e.g., Richard Joyce), expressivism (e.g., Simon Blackburn, Allan (...) Gibbard), constructivism (e.g., Christine Korsgaard, Sharon Street), and constitutivism (e.g., Michael Smith, David Velleman). These theories are evaluated primarily on the basis of whether they are able to provide a plausible objectualist account of robust normativity. The chapter argues that none of them can do this. Das Fach Philosophie ist ein ausgezeichneter Kontext für die Vermittlung und den Erwerb argumentativer Fähigkeiten – so der Ausgangspunkt von David Löwenstein, Donata Romizi und Jonas Pfister in dem von ihnen herausgegebenen Sammelband Argumentieren im Philosophie- und Ethikunterricht. Schließlich umfasse die Philosophie, insbesondere in Form der Argumentationstheorie, sowohl die logischen Grundlagen für die Praxis des Argumentierens als auch Möglichkeiten zu deren Reflexion. Der Band zielt darauf ab, die Argumentationsdidaktik als eigenständiges Themengebiet zu etablieren, indem Fragen nach deren Stellenwert, Anspruch, (...) Grenzen sowie Umsetzung beantwortet werden. Demgemäß richtet er sich gleichermaßen an Personen aus Fachdidaktik, -wissenschaft und Schule. Behandelt werden neben Kompetenzen des Argumentierens im engeren Sinne ebenso weiterführende Aspekte der hierfür nötigen Einstellung, Haltung und Motivation.
