Machine intelligence already helps medical staff with a number of tasks. Ethical decision-making, however, has not been handed over to computers. In this proof-of-concept study, we show how an algorithm based on Beauchamp and Childress’ prima-facie principles could be employed to advise on a range of moral dilemma situations that occur in medical institutions. We explain why we chose fuzzy cognitive maps to set up the advisory system and how we utilized machine learning to train it. We report on the (...) difficult task of operationalizing the principles of beneficence, non-maleficence and patient autonomy, and describe how we selected suitable input parameters that we extracted from a training dataset of clinical cases. The first performance results are promising, but an algorithmic approach to ethics also comes with several weaknesses and limitations. In 1966, Stanford psychiatrist Kenneth M. Colby published one of the first conceptual accounts of a chatbot for psychotherapy. It was the same year in which, at MIT, computer-science pioneer Joseph Weizenbaum released his famous natural-language processing program ELIZA, which many regard as the world’s first chatbot. The two concurrent publications marked the starting points of a fierce controversy about the moral limits of automating psychotherapy. With the advent of generative AI, many of the same questions are now reappearing. Good physical experiments conform to the basic methodological standards of experimental design: they are objective, reliable, and valid. But is this also true of thought experiments? Especially problems of personal identity have engendered hypothetical scenarios that are very distant from the actual world. These imagined situations have been conspicuously ineffective at resolving conflicting intuitions and deciding between the different accounts of personal identity. Using prominent examples from the literature, I argue that this is due to many of these thought experiments (...) not adhering to the methodological standards that guide experimental design in nearly all other disciplines. I also show how empirically unwarranted background assumptions about human physiology render some of the hypothetical scenarios that are employed in the debate about personal identity highly misleading. The COVID-19 pandemic has been overwhelming public health-care systems around the world. With demand exceeding the availability of medical resources in several regions, hospitals have been forced to invoke triage. To ensure that this difficult task proceeds in a fair and organised manner, governments scrambled experts to draft triage guidelines under enormous time pressure. Although there are similarities between the documents, they vary considerably in how much weight their respective authors place on the different criteria that they propose. Since most (...) of the recommendations do not come with ethical justifications, analysing them requires that one traces back these criteria to their underlying theories of distributive justice. In the literature, COVID-19 triage has been portrayed as a value conflict solely between utilitarian and egalitarian elements. While these two accounts are indeed the main antipodes, I shall show that in fact all four classic theories of distributive justice are involved: utilitarianism, egalitarianism, libertarianism, and communitarianism. Detecting these in the documents and classifying the suggested criteria accordingly enables one to understand the balancing between the different approaches to distributive justice—which is crucial for both managing the current pandemic and in preparation for the next global health crisis. In November 2022 ChatGPT rang in the age of generative AI. Since then, conversational AI bots have been developing at an enormous pace. Unless specifically prompted otherwise, the models often default to principlism when analysing cases in medical ethics. We reflect on the journey of Beauchamp and Childress’ influential framework from an ‘analogue’ methodology into the era of artificial intelligence, discuss why the approach lends itself so well to automation, and provide an outlook on what the digital future of principlism (...) might look like. Integrating artificial intelligence (AI) into critical domains such as healthcare holds immense promise. Nevertheless, significant challenges must be addressed to avoid harm, promote the well-being of individuals and societies, and ensure ethically sound and socially just technology development. Innovative approaches like Embedded Ethics, which refers to integrating ethics and social science into technology development based on interdisciplinary collaboration, are emerging to address issues of bias, transparency, misrepresentation, and more. This paper aims to develop this approach further to enable future projects (...) to effectively deploy it. Based on the practical experience of using ethics and social science methodology in interdisciplinary AI-related healthcare consortia, this paper presents several methods that have proven helpful for embedding ethical and social science analysis and inquiry. They include (1) stakeholder analyses, (2) literature reviews, (3) ethnographic approaches, (4) peer-to-peer interviews, (5) focus groups, (6) interviews with affected groups and external stakeholders, (7) bias analyses, (8) workshops, and (9) interdisciplinary results dissemination. We believe that applying Embedded Ethics offers a pathway to stimulate reflexivity, proactively anticipate social and ethical concerns, and foster interdisciplinary inquiry into such concerns at every stage of technology development. This approach can help shape responsible, inclusive, and ethically aware technology innovation in healthcare and beyond. (shrink)

Lockean views of personal identity maintain that we are essentially persons who persist diachronically by virtue of being psychologically continuous with our former selves. In this article, I present a novel objection to this variant of psychological accounts, which is based on neurophysiological characteristics of the brain. While the mental states that constitute said psychological continuity reside in the cerebral hemispheres, so that for the former to persist only the upper brain must remain intact, being conscious additionally requires that a (...) structure originating in the brainstem—the ascending reticular activating system—be functional. Hence, there can be situations in which even small brainstem lesions render individuals irreversibly comatose and thus forever preclude access to their mental states, while the neural correlates of the states themselves are retained. In these situations, Lockeans are forced to regard as fulfilled their criterion of diachronic persistence since psychological continuity, as they construe it, is not disrupted. Deeming an entity that is never again going to have any mental experiences to be a person, however, is an untenable position for a psychological account to adopt. In their current form, Lockean views of personal identity are therefore incompatible with human neurophysiology. (shrink)

Fifty years have passed since brain death was first proposed as a criterion of death. Its advocates believe that with the destruction of the brain, integrated functioning ceases irreversibly, somatic unity dissolves, and the organism turns into a corpse. In this article, I put forward two objections against this assertion. First, I draw parallels between brain death and other pathological conditions and argue that whenever one regards the absence or the artificial replacement of a certain function in these pathological conditions (...) as compatible with organismic unity, then one equally ought to tolerate that function’s loss or replacement in brain death. Second, I show that the neurological criterion faces an additional problem that is only coming to light as life-supporting technology improves: the growing sophistication of the latter gives rise to a dangerous decoupling of the actual performance of a vital function from the retention of neurological control over it. Half a century after its introduction, the neurological criterion is facing the same fate as its cardiopulmonary predecessor. (shrink)

For forty years Kant used the Excerpts as the basis of his lectures on logic making extensive notes on his copy of the text. More than a text on formal logic, Excerpt from the Doctrine of Reason covers epistemology and the elements of thought and language Meier believed (...) made human understanding possible. Working across the two dominant intellectual forces in modern philosophy, the rationalist and the empiricist traditions, Meier's work was also instrumental to the introduction of English philosophy into Germany; he was among the first German philosophers to study John Locke's philosophy in depth. This complete English translation of Meier's influential textbook is introduced by Riccardo Pozzo and enhanced by a glossary and a concordance correlating Meier's arguments to Kant's logic lectures, the related Reflexionen and the Jäsche Logic of 1800 - the text considered of fundamental importance to Kant's philosophy. For scholars of Kant, Locke and the German Enlightenment, this valuable translation and its accompanying material presents the richest source of information available on Meier and his 18th-century work. Under which conditions may physicians who are requested to treat permanently unconscious patients refuse to do so? Wasserman et al. (2023) maintain that refusals on the basis of supposed futility are unethical as they amount to passing off personal value judgments as medical expertise. Instead, unwillingness to carry out an intervention should be framed as conscientious objection. I argue that referring to futility with regard to a patient’s presumed quality of life is appropriate if – and only if – a (...) total and irreversible loss of consciousness has been diagnosed with adequate certainty. The diagnosis turns a graded notion into a binary affair: conscious awareness is a necessary condition of any degree of quality of life to be meaningfully ascribed to an organism. Consequently, the complete absence of consciousness precludes such an ascription; further treatment is then indeed futile from a quality-of-life standpoint. (shrink)

Recent publications on digital health technologies highlight the importance of ‘responsible’ use. References to the concept of responsibility are, however, frequently made without providing clear definitions of responsibility, thus leaving room for ambiguities. Addressing these uncertainties is critical since they might lead to misunderstandings, impacting the quality and safety of healthcare delivery. Therefore, this study investigates how responsibility is interpreted in the context of using digital health technologies, including artificial intelligence (AI), telemonitoring, wearables and mobile apps. We conducted a scoping (...) review with a systematic search in PubMed, Web of Science, Embase, CINAHL and Philosopher’s Index. A total of 34 articles were included and categorized using a theoretical framework of responsibility aspects, and revealed two main findings. First, we found that digital health technologies can expand and shift existing ‘role responsibilities’ among caregivers, patients and technology. Second, moral responsibility is often equated with liability or accountability, without clear justification. Articles describe new ways in which physicians can be held accountable, particularly in the context of AI, and discuss the emergence of a ‘responsibility gap’ where no-one can be fully responsible for AI-generated outcomes. The literature also shows that m-Health technologies can increase patients’ accountability for their own health. However, there was limited discussion in the reviewed literature on whether these attributions of accountability are appropriate. We conclude with implications for practice and suggestions for expanding the theoretical framework of moral responsibility, recommending further study on responsibility of collectives and artificial entities, and on the role of virtue in digital health. This study examines to what extent different types of CEOs in family firms influence external and internal stakeholder-related CSP as compared to CEOs in nonfamily firms. Linking family CEO and nonfamily CEO with CSR outcomes, we provide evidence that family CEOs are positively associated with both external and internal CSR, whereas nonfamily CEOs within family firms tend to be negatively associated with both external and internal CSR. This book is the culmination of Heinrich Meier's acclaimed analyses of the controversial thought of Carl Schmitt. Meier identifies the core of Schmitt's thought as political theology--that is, political theorizing that claims to have its ultimate ground in the revelation of a mysterious or supra-rational God. Although machine intelligence is increasingly employed in healthcare, the realm of decision-making in medical ethics remains largely unexplored from a technical perspective. We propose an approach based on fuzzy cognitive maps (FCMs), which builds on Beauchamp and Childress’ prima-facie principles. The FCM’s weights are optimized using a genetic algorithm to provide recommendations regarding the initiation, continuation, or withdrawal of medical treatment. The resulting model approximates the answers provided by our team of medical ethicists fairly well and offers a high degree (...) of interpretability. In 1932, Wolfgang Pauli was a world-renowned physicist and had already done the work that would win him the 1945 Nobel Prize. He was also in pain. His mother had poisoned herself after his father's involvement in an affair. Emerging from a brief marriage with a cabaret performer, Pauli drank heavily, quarreled frequently and sometimes publicly, and was disturbed by powerful dreams. He turned for help to C. G. Jung, setting a standing appointment for Mondays at noon. Thus bloomed an (...) extraordinary intellectual conjunction not just between a physicist and a psychologist but between physics and psychology. Eighty letters, written over twenty-six years, record that friendship. This artful translation presents them in English for the first time. Though Jung never analyzed Pauli formally, he interpreted more than 400 of his dreams--work that bore fruit later in Psychology and Alchemy and The Analysis of Dreams. As their acquaintance developed, Jung and Pauli exchanged views on the content of their work and the ideas of the day. They discussed the nature of dreams and their relation to reality, finding surprising common ground between depth psychology and quantum physics. Their collaboration resulted in the combined publication of Jung's treatise on synchronicity and Pauli's essay on archetypal ideas influencing Kepler's writings in The Interpretation of Nature and the Psyche. Over time, their correspondence shaped and reshaped their understanding of the principle they called synchronicity, a term Jung had suggested earlier. Through the association of these two pioneering thinkers, developments in physics profoundly influenced the evolution of Jungian psychology. And many of Jung's abiding themes shaped how Pauli--and, through him, other physicists--understood the physical world. Is inpatient psychiatric hospitalisation a proportionate intervention to prevent harm in non-psychotic adolescents? Analysing the effects of inpatient psychiatric hospitalisation and comparing them to outpatient settings, we argue that when adolescents do not suffer from disorders of a psychotic nature, care providers should balance the expected benefits and potential negative consequences associated with inpatient psychiatric hospitalisation. In particular, the decrease in autonomy that comes with hospitalisation is associated with an increased risk of harm and suicidogenic effects, which are lower in (...) outpatient settings. Consequently, psychiatric hospitalisation – particularly of an involuntary nature – with the aim to prevent harm to self or others is likely not a proportionate measure for non-psychotic adolescents. Introspecting subjects are widely believed to enjoy some form of epistemic privilege with regard to their mental states. While it is unclear if introspective knowledge is indeed infallible, our authority in the mental realm derives much of its force from the sheer absence of persuasive competing interpretations. With the advent of brain-decoding technology, such competition is now being introduced. While the literature sees the danger of decoding mental states in their revelation to third parties, I argue that divulging them to (...) the subjects themselves is equally problematic: in addition to the introspective viewpoint, subjects will henceforth take on a third-personal, supposedly objective perspective on the same mental events that they are simultaneously observing from the inside. I shall analyse what it means to let oneself in via another route and explore the psychological effects that the ensuing confrontation is likely to have on our perceived introspective authority. Psychologists are increasingly interested in embodiment based on the assumption that thoughts, feelings, and behaviors are grounded in bodily interaction with the environment. We examine how embodiment is used in social psychology, and we explore the ways in which embodied approaches enrich traditional theories. Although research in this area is burgeoning, much of it has been more descriptive than explanatory. We provide a critical discussion of the trajectory of embodiment research in social psychology. We contend that future researchers should engage (...) in a phenomenon-based approach, highlight the theoretical boundary conditions and mediators involved, explore novel action-relevant outcome measures, and address the role of individual differences broadly defined. Such research will likely provide a more explanatory account of the role of embodiment in general terms as well as how it expands the knowledge base in social psychology. (shrink)

This book, by one of the most prominent interpreters of Leo Strauss's thought, was the first to address the problem that Leo Strauss himself said was the theme of his studies: the theologico-political problem or the confrontation with the theological and the political alternative to philosophy as a way of life. In his theologico-political treatise, which comprises four parts and an appendix, Heinrich Meier clarifies the distinction between political theology and political philosophy and reappraises the unifying center of Strauss's philosophical (...) enterprise. The book is the culmination of Meier's work on the theologico-political problem. It will interest anyone who seeks to understand both the problem caused by revelation for philosophy and the challenge posed by political-religious radicalism. The appendix makes available for the first time two lectures by Strauss that are immediately relevant to the subject of this book and that will open the way for future research and debate on the legacy of Strauss. When an individual is comatose while parts of her brain remain functional, the question arises as to whether any mental characteristics are still associated with this brain, that is, whether the person still exists. Settling this uncertainty requires that one becomes clear about two issues: the type of functional loss that is associated with the respective profile of brain damage and the persistence conditions of persons. Medical case studies can answer the former question, but they are not concerned with the (...) latter. Conversely, in the philosophical literature, various accounts of personal identity are discussed, but usually detached from any empirical basis. Only uniting the two debates and interpreting the real-life configurations of brain damage through the lens of the philosophical concepts enables one to make an informed judgment regarding the persistence of comatose persons. Especially challenging are cases in which three mental characteristics that normally occur together—wakefulness, awareness and memory storage—come apart. These shall be the focus of this paper. Which is better at doing medical ethics: conversational artificial intelligence bots like ChatGPT or tools based on fuzzy cognitive maps? The article compares the performance of chatbots that rely on large language models to that of our own METHAD algorithm. While both tools approach dilemmas in medical ethics through the lens of Beauchamp and Childress’ mid-level principles, ChatGPT and METHAD differ considerably in the format of their inputs and outputs, in their interpretability, and in the kinds of mistakes that they (...) make. The concept of coherence is attractive but vague. In an attempt to make it more precise, some, including Alexy and Peczenik, have proposed long lists of elaborate, formal criteria. However, their criteria can be trivially satisfied. This renders their formal apparatus idle; it has no part in generating any outcomes. The most serious problem troubling all coherence accounts is known in philosophy of science as the tacking problem a. k. a. the problem of belief individuation. It undermines all coherence accounts (...) that make maximising or minimising demands and thereby require counting elements (sentences, norms, cases, hypotheses etc.) or relations amongst them. This includes ‘constraint satisfaction’ theories of coherence such as Thagard’s and Amaya’s, but also those of Dworkin and MacCormick. I offer a thorough critique, pars pro toto, of Alexy-Peczenik and a solution to the tacking problem in terms of relevant deduction. As a corollary, I recover from their account a notion of logical relevance that might have applications in the analysis of causation. (shrink)

His so-called Symmetry Argument has been attacked in various ways, but all of these strategies are themselves problematic. In this paper, I propose a new approach to undermining the argument: when Parfit’s distinction between identity and what matters is applied, not diachronically but across possible worlds, the alleged symmetry can be broken. Although the pre-vital and posthumous time spans (...) that we could have experienced are indeed analogous with respect to our identity, they are not analogous with respect to psychological continuity, which forms the basis of prudential concern. Lucretius even anticipated the Parfitian distinction. He did not, however, notice the significance that it has for his Symmetry Argument. (shrink)

Some medical interventions have the potential to interfere with patients’ future healthcare decision-making. We identify two types of such influences: affecting whether a patient has decision-making capacity in the first place; and influencing which treatment option a patient ends up selecting. Using the example of deep brain stimulation, we argue that one should utilise this effect to obtain more authentic treatment preferences. In patients with implanted deep brain stimulators who do not meet the capacity threshold, the device state should be (...) reverted as there is a chance that doing so has a positive effect on their capacity. In patients who are already deemed decision-competent, the same approach can reveal on/off-discrepancies in the selection of treatment choices. We propose five cross-checking strategies to deal with such discrepancies and call for a revision of current procedures for obtaining consent following any interventions whose psychotropic influences can be reversed within clinically reasonable time frames. Queuing to receive a desired good is a method of allocation deeply entrenched into our lives – be it waiting for housing, to become a member of certain clubs, or to receive promotion. We therefore often take it for granted that, other things being equal, those who have been waiting the longest enjoy priority. But should this always be so? In this comment, we respond to the suggestion of replacing waiting lists in medical settings with a last-come-first-served approach. Dobbs furthers a longstanding ideology of individual responsibility in public health, neglecting collective responsibility for better health outcomes. Such an ideology on individual responsibility not only enables a shrinking of public health infrastructure for reproductive (...) health, it facilitates the rise of reproductive coercion and a criminal legal response to pregnancy and abortion. This commentary situates Dobbs in the context of a long historical shift in public health that increasingly places burdens on individuals for their own reproductive health care, moving away from the possibility of a robust state public health infrastructure. The 2024 U.S. election will shape the future of global health policy, with crucial implications for continuing U.S. leadership in global health. The United States has long played a critical role in global health governance, through multilateral institutions under the United Nations (UN) and bilateral assistance to advance U.S. priorities. However, political shifts have challenged U.S. engagement in global health, with the politicization of global health policy threatening global governance under the World Health Organization (WHO) and dividing global health support (...) across political parties. This political polarization in global health proved catastrophic in the COVID-19 pandemic response and influential in the 2020 Presidential Elections. With the United States again seeking to advance global health policy, the 2024 Elections present a clear contrast in global health visions across U.S. political parties – with sweeping impacts on global governance, health funding, sexual and reproductive health, corporate regulations, tax equity, humanitarian challenges, and climate change. The future of U.S. leadership in global health hangs in the balance of this election, raising an imperative for candidates to highlight their global health positions and for voters to consider the global health implications. During the COVID‐19 pandemic, national triage guidelines were developed to address the anticipated shortage of life‐saving resources, should ICU capacities be overloaded. Rationing and triage imply that in addition to individual patient interests, interests of population health have to be integrated. The transfer of theoretical and empirical knowledge into feasible and useful practice models and their implementation in clinical settings need to be improved. This paper analyzes how triage protocols could translate abstract theories of distributive justice into concrete material and (...) procedural criteria for rationing intensive care resources during a pandemic. We reconstruct the development and implementation of a rationing protocol at a German university hospital: describing the ethical challenge of triage, clarifying the aspirational norms, and summarizing specific norms of fair triage and allocation for developing an institutional policy and practice model and implementing it. We reflect on how critical topics are seen by clinicians and what helped manage the perceived burdens of the triage dilemma. We analyze what can be learned from this debate regarding the difficult issues around triage protocols and their potential implementation into clinical settings. Analyzing the ought‐to‐is gap of triage, integrating abstract ethical principles into practical concepts, and evaluating those should clarify the benefits and risks of different allocation options. We seek to inform debates on triage concepts and policies to ensure the best possible treatment and fair allocation of resources as well as to help protect patients and professionals in worst‐case scenarios. Carl Schmitt was the most famous and controversial defender of political theology in the twentieth century. But in his best-known work, _The Concept of the Political_, issued in 1927, 1932, and 1933, political considerations led him to conceal the dependence of his political theory on his faith in divine revelation. In 1932 Leo Strauss published a critical review of _Concept _that initiated an extremely subtle exchange between Schmitt and Strauss regarding Schmitt’s critique of liberalism. Although Schmitt never answered Strauss publicly, (...) in the third edition of his book he changed a number of passages in response to Strauss’s criticisms. Now, in this elegant translation by J. Harvey Lomax, Heinrich Meier shows us what the remarkable dialogue between Schmitt and Strauss reveals about the development of these two seminal thinkers. Meier contends that their exchange only ostensibly revolves around liberalism. At its heart, their “hidden dialogue” explores the fundamental conflict between political theology and political philosophy, between revelation and reason­and ultimately, the vital question of how human beings ought to live their lives. “Heinrich Meier’s treatment of Schmitt’s writings is morally analytical without moralizing, a remarkable feat in view of Schmitt’s past. In this paper, I provide a compositional semantics for sentences with enough and too followed by a to-infinitive clause and for resultative constructions with so... that within the framework of possible world semantics. It is proposed that the sentential complement of these constructions denotes an incomplete conditional and is explicitly or implicitly modalized, as if it were the consequent of a complete conditional. Enough, too, and so are quantifiers that relate an extent predicate and the incomplete conditional (expressed by the (...) sentential complement) and are interpreted as comparisons between two extents. The first extent is the maximal extent that satisfies the extent predicate. The second extent is the minimal or maximal extent of a set of extents that satisfy the (hidden) conditional, where the sentential complement supplies the consequent and the main clause the antecedent. This approach permits to predict (a) the context-dependent interpretation of these constructions and (b) the duality relations between the degree words. (shrink)

The most serious objection to Beall and Restall’s case-based logical pluralism is the so-called collapse argument. According to the collapse argument, logical pluralism is not genuinely pluralistic and collapses into a single privileged relation of logical consequence. In response, Caret offered an account of logical contextualism that supposedly maintains the merits of Beall and Restall’s case-based logical pluralism while circumventing the collapse argument. In this paper, I first point out a gap in the collapse argument in that it does not (...) affect pluralists who assume that there is no uniquely strongest admissible consequence relation. This gap, then, is closed by an improved version of the collapse argument, which makes use of Eklund’s classification of types of pluralism. Finally, I discuss how Caret’s logical contextualism cannot hold up against this new formulation of the collapse argument unless implausible assumptions about the contents of normative operators are made. Moreover, by reformulating the collapse argument, I determine the extent to which logical monism and pluralism oppose each other, paving the way for fruitful future discussion. (shrink)

In their Target Article, Rahimzadeh et al. (2023) discuss the virtues and vices of employing ChatGPT in ethics education for healthcare professionals. To this end, they confront the chatbot with a moral dilemma and analyse its response. In interpreting the case, ChatGPT relies on Beauchamp and Childress’ four prima-facie principles: beneficence, non-maleficence, respect for patient autonomy, and justice. While the chatbot’s output appears admirable at first sight, it is worth taking a closer look: ChatGPT not only misses the point when (...) applying the principle of non-maleficence; its response also fails, in several places, to honour patient autonomy – a flaw that should be taken seriously if large language models are to be employed in ethics education. I therefore subject ChatGPT’s reply to detailed scrutiny and point out where it went astray. (shrink)

The "Rêveries" show the fire of philosophy in the mirror of the water; in the reflections of the unlimited, needing more precise determination; of the inconspicuous, needing careful inspection; and of the surface, needing in-depth Interpretation.

Philosophy of science offers as yet untapped potential to inform legal theory. This paper explores some of it. Drawing on and adapting logical tools from the semantic and structuralist views of scientific theories, I propose a formal framework for analysing legal norms. I illustrate how it works by applying it to a simple yet realistic tort case pursuant to Swiss law. The formalism allows reconstructing the subsumption of a case under a norm as isomorphic embedding. Legal norms and connections between (...) them are captured using functions. The reconstruction helps clarify some questions about interpreting and applying legal rules, their interactions in legal systems, the phenomenon of normativity, what a court should say to justify its verdicts, and connects to contemporary metaethics since the resulting formalism suggests a feasible method to write out the Ramsey-sentence which Jackson-style moral functionalism promises. By representing legal doctrine using meta-theoretical methods apt to represent scientific theories, the study also contributes to locating jurisprudence in the universe of rational enquiry as at least in some ways on a par with science.
