The demand for organ transplants, both globally and in South Korea, substantially exceeds the supply, a situation that might have been aggravated by the enactment of the Life-Sustaining Treatment Decision Act (LSTDA) in February 2018. This legislation may influence emergency medical procedures and the availability of organs from brain-dead donors. This study aimed to assess LSTDA’s impact, introduced in February 2018, on organ donation status in out-of-hospital cardiac arrest (OHCA) patients in a metropolitan city and identified related factors. We conducted (...) a retrospective analysis of a regional cardiac arrest registry. This study included patients aged 16 or older with cardiac arrest and a cerebral performance category (CPC) score of 5 from January 2015 to December 2022. The exclusion criteria were CPC scores of 1–4, patients under 16 years, and patients declared dead or transferred from emergency departments. Logistic regression analysis was used to analyse factors affecting organ donation. Of the 751 patients included in this study, 47 were organ donors, with a median age of 47 years. Before the LSTDA, there were 30 organ donations, which declined to 17 after its implementation. In the organ donation group, the causes of cardiac arrest included medical (34%), hanging (46.8%), and trauma (19.2%). The adjusted odds ratio for organ donation before the LSTDA implementation was 6.12 (95% CI 3.09–12.12), with non-medical aetiology as associated factors. The enactment of the LSTDA in 2018 in South Korea may be linked to reduced organ donations among patients with OHCA, underscoring the need to re-evaluate the medical and legal aspects of organ donation, especially considering end-of-life care decisions. This study focuses on CEO hubris and its detrimental effect on corporate financial performance along with an examination of critical corporate governance contingencies (CEO power and board vigilance) that may moderate the negative effect. From 654 observations of 164 Korean firms over the years 2001–2008, we found that CEO power exacerbated the negative effect of CEO hubris on corporate financial performance, whereas board vigilance mitigated it. This study provides empirical evidence that entrenchment problems arising from CEO hubris would be exacerbated (...) as CEOs become more powerful, but weakened as board of directors become more vigilant. Theoretical contributions and practical implications will be discussed. (shrink)

Koonin argues that CRISPR-Cas systems present the best-known case in point for Lamarckian evolution because they satisfy his proposed criteria for the specific inheritance of acquired adaptive characteristics. We see two interrelated issues with Koonin’s characterization of CRISPR-Cas systems as Lamarckian. First, at times he appears to confuse an account of the CRISPR-Cas system with an account of the mechanism it employs. We argue there is no evidence for the CRISPR-Cas system being “Lamarckian” in any sense. Second, it is unclear (...) whether the mechanism is more “Lamarckian” than many other forms of genetic change already well-characterized in Darwinian terms. We present three conceptually distinct senses in which the mechanism of IAC may be considered Lamarckian and argue that only the strongest sense of goal-directed IAC would be difficult to accommodate in a Darwinian account. As the CRISPR-Cas mechanism does not qualify as “Lamarckian” in this strong sense, we argue there is no conceptual value in calling it “Lamarckian”. Finally, we suggest that CRISPR-Cas systems do hold the potential for genuinely non-Darwinian, directed evolution in a way that Koonin did not discuss, involving their potential use as a human gene-editing tool. This paper highlights the potential harms in the current state of business ethics education and presents an alternative new model of business ethics education. Such potential harms in business ethics education is due largely to restricted cognitive level of reasoning, a limited level of ethical conduct which remains only responsive and adaptive, and the estrangement between strategic thinking and ethical thinking. As a remedy for business ethics education, denatured by these potential harms, a new dynamic model of business ethics education (...) is proposed. The new model is composed of a basic foundation for business ethics education and three practical components of business ethics education. The basic foundation comprises of ethical reasoning, moral sentiments, and ethical praxis. Three practical components of business ethics education are, respectively, to intensify moral imagination, to develop ethical wisdom and courage, and to enhance meta-strategic competences. The ultimate purpose of these practical components is to help moral subjects to conduct ethical leadership, to actualize integrity between individuals and organization, and to fulfill the social responsibility of business firms. This new model is expected to attract attention to the effective business ethics education both in college and in industry, and to be used as a benchmark for new curriculum designs and development of teaching methods. Finally, some teaching methodologies and pedagogical experiments are introduced and discussed according to this new model of business ethics educaiton. (shrink)

Brain-computer interfaces (BCIs) show enormous potential for advancing personalized medicine. However, BCIs also introduce new avenues for cyber-attacks or security compromises. In this article, we analyze the problem and make recommendations for device manufacturers to better secure devices and to help regulators understand where more guidance is needed to protect patient safety and data confidentiality. Device manufacturers should implement the prior suggestions in their BCI products. These recommendations help protect BCI users from undue risks, including compromised personal health and genetic (...) information, unintended BCI-mediated movement, and many other cybersecurity breaches. Regulators should mandate non-surgical device update methods, strong authentication and authorization schemes for BCI software modifications, encryption of data moving to and from the brain, and minimize network connectivity where possible. We also design a hypothetical, average-case threat model that identifies possible cybersecurity threats to BCI patients and predicts the likeliness of risk for each category of threat. BCIs are at less risk of physical compromise or attack, but are vulnerable to remote attack; we focus on possible threats via network paths to BCIs and suggest technical controls to limit network connections. A book review of Sam Rose, Art and Form: From Roger Fry to Global Modernism. University Park: Pennsylvania State University Press, 2019. 208 pp. ISBN 9780271082387.

The epistemic account and the noetic account hold that the essence of scientific progress is the increase in knowledge and understanding, respectively. Dellsén (2018) criticizes the epistemic account (Park, 2017a) and defends the noetic account (Dellsén, 2016). I argue that Dellsén’s criticisms against the epistemic account fail, and that his notion of understanding, which he claims requires neither belief nor justification, cannot explain scientific progress, although it can explain fictional progress in science-fiction.

This volume examines the psychological basis of moral judgments and what theories of concepts apply to moral ones. It considers what mental states not only influence but also constitute our moral concepts and judgments by combining philosophical reasoning and empirical insights from the fields of moral psychology, cognitive science, evolutionary psychology, and neuroscience. On this basis, Park proposes a novel pluralistic theory of moral concepts which includes three different cognitive structures and emotions. Thus, our moral judgments are a hybrid (...) that express both cognitive and conative states. -/- In part through analysis of new empirical data on moral semantic intuitions, gathered via cross-cultural experimental research, Park draws on this to reveal that the referents of individuals’ moral judgments and concepts vary across time, contexts, and groups. Healey (2019a) makes four comments on my (Park, 2019a) objections to van Fraassen’s positions. The four comments concern the issues of whether ‘disbelief’ is appropriate or inappropriate to characterize van Fraassen’s position, what the relationship between a theory and models is for van Fraassen, whether he believes or not that a theory is empirically adequate, and whether destructive empiricism is tenable or not. I reply to those comments in this paper.

Bridging the gap between feminist studies of motherhood and queer theory, Mothering Queerly, Queering Motherhood articulates a provocative philosophy of queer kinship that need not be rooted in lesbian or gay sexual identities. Working from an interdisciplinary framework that incorporates feminist philosophy and queer, psychoanalytic, poststructuralist, and postcolonial theories, Shelley M. Park offers a powerful critique of an ideology she terms monomaternalism. Despite widespread cultural insistence that every child should have one—and only one—“real” mother, many contemporary family constellations do (...) not fit this mandate. Park highlights the negative consequences of this ideology and demonstrates how families created through open adoption, same-sex parenting, divorce, and plural marriage can be sites of resistance. Drawing from personal experiences as both an adoptive and a biological mother and juxtaposing these autobiographical reflections with critical readings of cultural texts representing multi-mother families, Park advocates a new understanding of postmodern families as potentially queer coalitional assemblages held together by a mixture of affection and critical reflection premised on difference. From uttering a prayer before boarding a plane, to exploring past lives through hypnosis, has superstition become pervasive in contemporary culture? Robert Park, the best-selling author of Voodoo Science, argues that it has. In Superstition, Park asks why people persist in superstitious convictions long after science has shown them to be ill-founded. He takes on supernatural beliefs from religion and the afterlife to New Age spiritualism and faith-based medical claims. He examines recent controversies and concludes that science is (...) the only way we have of understanding the world. Park sides with the forces of reason in a world of continuing and, he fears, increasing superstition. Chapter by chapter, he explains how people too easily mistake pseudoscience for science. He discusses parapsychology, homeopathy, and acupuncture; he questions the existence of souls, the foundations of intelligent design, and the power of prayer; he asks for evidence of reincarnation and astral projections; and he challenges the idea of heaven. Throughout, he demonstrates how people's blind faith, and their confidence in suspect phenomena and remedies, are manipulated for political ends. Park shows that science prevails when people stop fooling themselves. Compelling and precise, Superstition takes no hostages in its quest to provoke. In shedding light on some very sensitive--and Park would say scientifically dubious--issues, the book is sure to spark discussion and controversy. (shrink)

Change in scientific practice and its implications for the status of scientific claims, examined through an analysis of three episodes at a synchrotron laboratory. After World War II, particle physics became a dominant research discipline in American academia. At many universities, alumni of the Manhattan Project and of Los Alamos were granted resources to start programs of high-energy physics built around the promise of a new and more powerful particle accelerator, the synchrotron. The synchrotron was also a source of very (...) intense X-rays, useful for research in solid states physics and in biology. As synchrotron X-ray science grew, the experimental practice of protein crystallography, garnered funding, prestige, and acclaim. In Velvet Revolution at the Synchrotron, Park Doing examines the change in scientific practice at a synchrotron laboratory as biology rose to dominance over physics. He draws on his own observations and experiences at the Cornell University synchrotron, and considers the implications of that change for the status of scientific claims. Velvet Revolution at the Synchrotron is one of the few recent works in the sociology of science that engages specific scientific and technical claims through participant observation--recorded evocatively and engagingly--to address issues in the philosophy of science. Doing argues that bureaucratic change in science is neither "top-down" nor "bottom-up" but rather performed in and realized through recursively related forums of technical assertion and resistance. He considers the relationship of this change to the content of science, and the implications of this relationship for the project of laboratory studies begun in the late 1970s. (shrink)

In this essay, I propose a standard of practical rationality and a grounding for the standard that rests on the idea of autonomous agency. This grounding is intended to explain the “normativity” of the standard. The basic idea is this: To be autonomous is to be self-governing. To be rational is at least in part to be self-governing; it is to do well in governing oneself. I argue that a person's values are aspects of her identity—of her “self-esteem identity”—in a (...) way that most of her ends are not, and that it therefore is plausible to view action governed by one's values as self-governed. This is also plausible on independent grounds. Given this, I say, rational agents comply with a standard—the “values standard”—that requires them to serve their values, and to seek what they need in order to continue to be able to serve their values. Chapter 1 What Do Zen Masters Teach Us Today? The Case of Sŏn Master Hyeam Sŏnggwan Jin Y. Park Introduction Korean Sŏn Master Hyeam Sŏnggwan (慧菴性觀, 1920–2001) is a relatively unknown figure within English-language scholarship.1 However, among Korean Buddhists, his rigorous Zen practice has been well recognized. One-meal-per-day (K. ilchongsik 一種食), no-meal-in-the-afternoon (K. ohu pulsik 午後不食), and staying-sitting-in-meditation-without-lying-down (K. changjwa purwa 長坐不臥) are all well-known practices that frequently appear when describing Hyeam as a Zen master. What is less frequently (...) asked is what these rigorous Zen practices might mean to us commoners who live in a secular world or to monastics whose practice might not be as rigorous as Hyeam’s. Should Zen masters such as Hyeam who appear to exhibit superhuman capacity for religious practice be only an object of awe and admiration in our secular modern times? Even if so, what do the awe and admiration indicate? In this chapter, I try to bridge the gap between the rigorous practice typically seen in Korean Zen masters’ lives and its meaning for people living in modern times. What questions does a Zen master like Hyeam raise for us, and how should scholars address these issues? These are the inquiries with which I hope to engage. (shrink)

Elsewhere I discussed analogies and disanalogies between Avicenna’s ideas on estimative faculty of animals and Peirce’s and Magnani’s views on animal abduction Park (2011). There are analogies between them (1) at the level of the problems, (2) at the level of the diagnosis, and (3) at the level of prognosis. Both Avicenna and Peirce-Magnani address their views on the problem of intuition and intelligence of animals. Also, they detect the main cause of the problem in the false dilemma usually (...) posed by the participants of the controversy. Finally, they seek the solution in estimation and abduction in animals respectively that have both intuitive and intelligent elements. On the other hand, some of the disanalogies are also manifest. Park argues that there are surprisingly pervasive and stubborn myths about diversity on college and university campuses, and that these myths obscure the notable significance and admirable effects that diversity has had on campus life. _ Based on her analysis of extensive research and data about contemporary students and campuses, Park counters these myths and explores their problematic origins. Among the major myths (...) that she addresses are charges of pervasive self-segregation, arguments that affirmative action in college admissions has run its course and become counterproductive, related arguments that Asian Americans are poorly served by affirmative action policies, and suggestions that programs and policies meant to promote diversity have failed to address class-based disadvantages. In the course of responding to these myths, Park presents a far more positive and nuanced portrait of diversity and its place on American college campuses. In Matthew’s passion narrative, the ethnoracial identity of Jesus comes into sharp focus. The repetition of the title “King of the Judeans” foregrounds the politics of race and ethnicity. Despite the explicit use of terminology, previous scholarship has understood the title curiously in non-ethnoracial ways. This book takes the peculiar omission in the history of interpretation as its point of departure. It provides an expanded ethnoracial reading of the text, and poses a fundamental ideological question that interrogates the pattern in (...) the larger context of modern biblical scholarship. Wongi Park issues a critique of the dominant narrative and presents an alternative reading of Matthew’s passion narrative. He identifies a critical vocabulary and framework of analysis to decode the politics of race and ethnicity implicit in the history of interpretation. Ultimately, the book lends itself to a broader research agenda: the destabilization of the dominant narrative of early Christianity’s non-ethnoracial origins. (shrink)

The Grand Contraption tells the story of humanity's attempts through 4,000 years of written history to make sense of the world in its cosmic totality, to understand its physical nature, and to know its real and imagined inhabitants. No other book has provided as coherent, compelling, and learned a narrative on this subject of subjects. David Park takes us on an incredible journey that illuminates the multitude of elaborate "contraptions" by which humans in the Western world have imagined the (...) earth they inhabit--and what lies beyond. Intertwining history, religion, philosophy, literature, and the physical sciences, this eminently readable book is, ultimately, about the "grand contraption" we've constructed through the ages in an effort to understand and identify with the universe. According to Park, people long ago conceived of our world as a great rock slab inhabited by gods, devils, and people and crowned by stars. Thinkers imagined ether to fill the empty space, and in the comforting certainty of celestial movement they discerned numbers, and in numbers, order. Separate sections of the book tell the fascinating stories of measuring and mapping the Earth and Heavens, and later, the scientific exploration of the universe. The journey reveals many common threads stretching from ancient Mesopotamians and Greeks to peoples of today. For example, humans have tended to imagine Earth and Sky as living creatures. Not true, say science-savvy moderns. But truth isn't always the point. The point, says Park, is that Earth is indeed the fragile bubble we surmise, and we must treat it with the reverence it deserves. (shrink)

Introduction The following two works were produced by visual artist Jonas Staal and writer Vincent W.J. van Gerven Oei during a visit as artists in residence at The Bag Factory, Johannesburg, South Africa during the summer of 2010. Both works were produced in situ and comprised in both cases a public intervention conceived by Staal and a textual work conceived by Van Gerven Oei. It was their aim, in both cases, to produce complementary works that could (...) be read “through each other,” in which the movement of artistic construction would be imitated by textual deconstruction and vice versa. Both works deal with the way in which capital, apartheid, and monumentality are interwoven in South-African society. The Missing Link addresses a monument for democracy, erected on the premises of a private corporation running both an amusement park and the Apartheid Museum franchise. The textual intervention accompanying this public intervention investigates the limits of the inclusiveness of the anti-discrimination section in the South-African constitution, itself a monumental work of democracy. The Monument for the Distribution of Wealth deals with the history and eventual dissolution of a monumental square, commemorating the Soweto Uprising, in one of the poorest townships of Johannesburg. The history accompanying this public dismemberment of memory is equally fragmented, which is expressed by the many voices recounting uncertain and perhaps even irrelevant “facts” about the genius loci, the way in which the memorial space has actually entered into the memory of the inhabitants surrounding it. Next to their individual practices, Staal and Van Gerven Oei have worked together on a number of projects ever since 2007, including several art residencies. Their work involves an investigation of the different interfaces between art, politics, and public space in media ranging from theater and public interventions, to video installations and (co-authored) textual works. The Missing Link Missing Link (1) Missing Link (2) Missing Link (3) Intervention on the monument entitled The Seven Pillars of the Constitution , part of the Apartheid Museum in Johannesburg, South Africa. The Seven Pillars represent the constitutional values propagated in South Africa since the abolition of the apartheid regime. The monument and museum were built by the Gold Reef Resorts corporation, which is also responsible for the theme park and casino next to it. By placing the word “capitalism” on the wall surrounding the museum, the capitalist system and the constant social divisions that it implies are interpreted as sophistic continuations of apartheid politics. Through the capitalist system, apartheid is still operational within South African society. Whereas during the apartheid regime, the separation clearly ran along race divisions, in the current, “democratic” system, the same actual separation is sustained without it being an explicit element of the foundations of the country, i.e. the constitution. This intervention foregrounds the constant role of capitalism is both periods. At the same time the intervention acknowledges that contemporary Western artisthood is a mirror of the privileges that are offered by the capitalist system, and the type of artist that it produces. The intervention initiates a critical discourse concerning the capitalist system situated within the disaster of capitalism itself, in other words: through the desire to break with the presumption that art would be able to operate outside the capitalist system and to confirm that art—and the artist himself—is in fact modeled on this system. The public intervention by Staal was supplemented by a textual intervention by Van Gerven Oei: a proposition to alter the seventeenth amendment of the South African constitution. Even though the anti-discrimination legislation in South-Africa is one of the most stringent and inclusive in the world, one factor—wealth—remains outside its scope, thus continuing the schisms along racial lines produced during the apartheid regime: §9.3. The state may not unfairly discriminate directly or indirectly against anyone on one or more grounds, including race, gender, sex, pregnancy, marital status, ethnic or social origin, colour, sexual orientation, age, disability, religion, conscience, belief, culture, language, birth, and wealth. Monument for the Distribution of Wealth Intervention concerning the June 16 Memorial Acre in Central Western Jabavu, one of the poorest townships of Johannesburg. The monument comprises a park on which different are placed recalling an important protest the black population against the former apartheid regime. In 1976, from a school adjacent to the park, they started a massive protest against the introduction of Afrikaans in the school curriculum. The police reacted violently, and shot several hundreds of students. The construction of the June 16 Memorial Acre was started in 2005, and from the start was the paragon of corruption. Coordinated by local politicians, some family members of the protest leader from 1976 gained control of the realization of the monument, outside the regulation through external institutions. The available budget of 41 million rand (at that time well over 5 million euro) was largely embezzled. In the meantime, the monument has become fully dilapidated and defaced. The park has become overgrown with weeds and covered in a layer of dirt, and the local population is slowly plundering the square to use the material for the construction and decoration of their own houses. The Monument for the Distribution of Wealth develops the dynamics already existent around the June 16 Memorial Acre. Without obtaining official permission in advance, several local inhabitants were hired to break down the monument, sort the materials, and offer it to the neighborhood. Thus, the redistribution of wealth after the fall of the apartheid regime is finally taking place, albeit from the mere remains of the capital that was once invested in the community. The words “monument” and “for free” are spray-painted on the stacks of material, both in English and Zulu, as these are locally the most common languages. Van Gerven Oei supplemented Staal’s public intervention with an account of the history of the monument based on a series of interviews. The account clarifies how the different interests within the protest 1976 are reflected in the exceeding decay of the park, and how in the end those interests were represented by the June 16 Memorial Acre. The idea for the transformation of the park into a memorial site has its source in the events of June 16, 1976: the start of the the student uprising in Soweto. The development of the park was started in the early 1980s, and the actual transformation into a memorial site, the June 16 Memorial Acre, was initiated in 2005. Over the last few years, several monumental additions have been made to the park: A marble monument with three pillars was revealed on June 16, 2006. A sculpture of a book and several billboards on June 16, 2008. A sculpture of student leader Tsietsi Mashinini on June 16, 2010. The park was transformed into the Monument for the Distribution of Wealth on August 3, 2010. According to the entry “Youth Struggle” on the website South African History Online, the Bantu Education Act was introduced in 1953 . In 1954 , Dr Verwoerd, Minister of Native Affairs, stated: “What is the use of teaching the Bantu child mathematics when it cannot use it in practice? That is quite absurd.” According to the entry “Soweto uprising” on Wikipedia, the Afrikaans Medium Decree was issued in 1974 , forcing all black schools to use Afrikaans and English in a 50-50 mix as languages of instruction. The Regional Director of Bantu Education (Northern Transvaal Region), J.G. Erasmus, told Circuit Inspectors and Principals of Schools that from January 1, 1975 , Afrikaans had to be used for mathematics, arithmetic, and social studies from standard five (7th grade). English would be the medium for general science and practical subjects. Indigenous languages would be used for religion instruction, music, and physical culture. According the entry “Soweto uprising” on Wikipedia, on April 30, 1976 , students from the Orlando West Junior School in Soweto went on strike, refusing to go to school. Their example was followed by other schools in Soweto. A student from Morris Isaacson High School, Toboho “Tsietsi” Mashinini, proposed a meeting on June 13, 1976 to discuss further action. According to Weizmann Hamilton’s article “The Soweto Uprising 1976,” which appeared in the September 1986 edition of Inqaba Ya Basebenzi (Fortress of the Revolution), on June 13, 1976 , the South African Students’ Movement called a meeting at the Donaldson Community Center in Orlando. 300-400 Students representing 55 schools decided to hold a mass demonstration on June 16. According to Brian Mokhele, member of the Joint Community Safety Forum, Dr Edelstein was the first victim of the Soweto uprising and killed the day before the march on June 15, 1976 . Edelstein was an administrator at the pass office in Jabavu and gave golf courses to the local community. Edelstein was put in a garbage bin and pierced by pickaxes. The garbage bin was left at the very spot of the murder for many years. A few years ago, a child was beheaded at the same spot, and the basketball court next to it has been abandoned since. According to Marcus Neustetter, founder of the Trinity Session, this story is untrue. According the entry “Soweto uprising” on Wikipedia, on June 16 , Tsietsi Mashinini led students from Morris Isaacson High School to join up with others who walked from Naledi High School. A crowd of between 3,000 and 10,000 eventually ended up near Orlando High School. According to Raymond Marlowe, a local photographer, Tsietsi Mashinini was heading the march. According to the entry “Hector Pieterson” on Wikipedia, Dr Edelstein died on June 16, 1976 , stoned to death by mob and left with a sign around his neck proclaiming “Beware Afrikaaners.” The first child to die that day was called Hastings Ndlovu. According to Pat Motsiri, Orlando West is claiming struggle heritage through the Hector Pieterson Museum, while Hector Pieterson was from Jabavu. According to Pat Motsiri, his generation effectively struggled between 1980 and 1991, forcing the release of Nelson Mandela and negotiations with the apartheid regime while the 1976-generation was safely in exile. Nevertheless, this has not been recognized in any monument. After the abolition of apartheid, the generation from 1976 returned from exile, occupied important government and ANC positions, creating an abundance of 1976 memorials and refusing to acknowledge that this was only possible because of the younger generation’s struggle. He calls this a generational conflict. According to Archibald Dlamini, the park officer responsible for the Memorial Acre, he started working for the municipality in 1978. In 1981/82 , Isaac Makhele from Pimville, who used to work in the cemetery business, was the first developer of the park. It used to be just a normal park until City Parks decided to develop the Memorial Acre in 2006. In 2007 the work was stopped by the community. According to Brian Mokhele, he left the country in 1989 after he participated in the riots of 1986. But when he returned in 1999 he found that nothing had changed. He says that they were promised to be protected by the Constitution, but that reality is different. The police uses fear to suppress them so that they don’t come out to talk openly. He has been arrested twice, both times harassed and tortured by the police, but in the end always released without indictment. He says that this is their way to threaten communities to back off from politics. According to Moses, who is sitting outside rolling a joint, Brian knows everything. He tells Brian to tell me everything he knows. According to Brian Mokhele, Tsietsi Mashinini was possibly murdered in 1990 during his exile in New York. Two weeks before he was supposed to return to South Africa, his papers in order, he was found dead under mysterious circumstances. His coffin was sealed when he was buried. According to Pat Motsiri, he came up with the idea for the Memorial Acre in 2003 . He submitted the documents for the proposal to the council, which sidelined him as soon as the budget came out in 2005 . According to Brian Mokhele, there was on estimation R 41,000,000 spent to redesign the park and turn it into the Memorial Acre. The millions were divided by Amos Masondo, the mayor of Soweto, the local councilor Bongani D. Zondi, and the director of the city of Johannesburg, Pat Lephunya. They were dividing the money between several contractors: Tsietsi Mashinini’s brothers were involved in the development of the park, they got the tender to do the green areas, the landscaping. Construction was done by other companies, some did the paving, the toilets, etc. EMBA, a private company appointed by the municipality was in control of the money flow, but the money was quickly gone. According to Raymond Marlowe, the contractor bought a BMW with the money. According to Archibald Dlamini, the Mashinini brothers got the tender, so the space would look more like the other places around in Soweto. It was agreed that after they were done, they would return the property to the municipality. They did whatever they could do. According to Mafaisa, a member of the Jabavu business community, he was one of the contractors for the landscaping and the pavement under Mpho Mashinini, one of the brothers. He says that I should contact Mavi for information on Mpho. According to Poi Stuurman, a local youth worker, Mafaisa is one of the guys who ran away with the money. According to Mavi, Mpho Mashinini was never a contractor. The contracts were organized by Sbu Butelezi, the former head of the Gauteng Department for Public Works. The June 16 Foundation and the Mashinini brothers will be the beneficiaries of the park when it is finished. According to Brian Mokhele, City Parks did not accept the Memorial Acre because it was not finished. The rest of the year, the unfinished park is not maintained, as should have happened. This was done deliberately so that in the end they can just clean the whole thing up and have a reason to redo the whole park. According to Brian Mokhele, the Mashinini brothers now work for the government. People that manipulate for money purposes always come from the government’s side. Because the park was left unfinished, the people from the neighborhood are taking away the stones to decorate their own homes with. According to Archibald Dlamini, because City Parks doesn’t accept responsibility of the park, he officially has nothing the guard, except for his cottage, which is municipal property. The thieves come at night and destroy the park, but he cannot do anything because he is sleeping. According to the website of the Thanda Foundation on June 16, 2006 a bronze statue of Hector Pieterson, the first child to die in the 1976 protests, made by Kobus Hattingh and Jacob Maponyane was unveiled in the Maponya Mall in Soweto. The statue is sculpted after the famous image shot by Sam Nzima of Mbuyisa Makhubo carrying the dead body of the boy. The sculpture was sponsored by the Thanda Foundation, founded by the Swedish entrepreneur Dan Olofsson and South-African entrepreneur Matthews Phosa. According to the official website of the City of Johannesburg, the Memorial Acre and Artwork were unveiled in 2006. According to a blog post on sowetouprisings.com, the Memorial Acre was still under development on July 24, 2006. According to Archibald Dlamini, City Parks only cleans up the park once a year just before the June 16 celebrations. Everybody is waiting for the Mashinini brothers to finish their job. The last time he talked with them was in 2007 . According to a sign on the school grounds of the Morris Isaacson High School, the June 16 Trail will be finished in 2008 . According to a blog post on sowetouprisings.com, the Memorial Acre contains another monument erected in Tsietsi’s honor. The monument was created as part of the Sunday Times Heritage Public Art program. Its physical form resembles a giant book which symbolizes the crisis in education experienced in 1976. On the face of the book is the map of the route taken by the students from Morris Isaacson High School in Central Western Jabavu to Phefeni Junior Secondary in Orlando West (currently the site of the Hector Pieterson Museum), while the back cover of the ‘book’ is inscribed with a tribute to Tsietsi Mashinini. The monument was revealed on June 16, 2008 . According to Marcus Neustetter, the billboards on the Memorial Acre were part of a school project realized in 2008. Following several workshops, the students from different high schools along the June 16 Trail were invited to work with artists on the billboards, while the neighborhood community was invited to watch the process during the festivities on June 15 and 16, 2008 . The billboards were supposed to be removed because of construction works on the Memorial Acre, which never ended up happening. According to Brian Mokhele, the former toilet facilities were converted into a house for the park officer. This park officer has been working for city parks for more than 12-15 years, but does nothing here, because the park, including the new toilet buildings, is not finished. The government is now moving around looking for people to take this job because they stopped it. They confronted everybody who was going in and chased them away. According to John, in 2009 , some girls, around 16 or 17 years old, were raped by four men who had been drinking in a local shebeen. When the bar quit they said that they would go home by car, but instead raped the girls on the Memorial Acre nearby. This happened in the unfinished toilets, because the doors couldn’t be closed. According to Brian Mokhele, there used to be some fences around the park because of the construction work that was eventually stopped, but these were also stolen. According to Archibald Dlamini, people from the neighborhood started about two and a half years ago, and the last piece was stolen near the end of 2009 . Sometimes he would catch someone with a roll of fence, and then use it for his own cottage. According to the official website of the City of Johannesburg, a statue of Tsietsi Mashinini by Johannes Pokhela was revealed on June 16, 2010 , “Youth Day.” According to Shirley Makutoane, deputy principal of Isaac Morrison High School, the statue of Tsietsi Mashinini, funded by the June 16 Foundation, has temporarily been placed within the school perimeter. The statue will be moved to the Memorial Acre when it will be finished, in 2011 . According to Brian Mokhele, beside the June 16 Foundation, there is also a June 16 Memorial Acre Foundation. Both foundations are quarreling about the money involved in the Memorial Acre project. Nobody knows who’s involved in them. According to Marcus Neustetter, the June 16 Foundation consists of people that were part of 1976 protest movement, local government officials, representatives of the Hector Pieterson Museum, and the council. According to students from the Isaac Morrison High School, the statue of Tsietsi Mashinini is on the school ground because on the Memorial Acre it would be vandalized by youths from White City, an adjacent neighborhood. Accorcing to Brian Mokhele, the statue of Tsietsi should eventually be mounted on the Memorial Acre. It is wrong that the statue is in the school at the moment, because it is not a public school. He wants the statues to depict the massiveness of the force that was coming into Soweto after the protests. According to Brian Mokhele, City Parks, City of Jo’burg, City Lights, and SAPS are making some sort of plan to take the plan back. They want to remove the trees from the Memorial Acre, and redesign the Memorial Acre into a relaxing park, without political content. They want to depoliticize the square. In doing so,they will have their own employment and not use local workforces. According to Brian Mokhele, the community wants to remove the monuments, amphitheater, and sculptures from the Memorial Acre because they do not resemble anything. The sculptures should be depicting the truth of what happened, because the Memorial Acre is a political heritage site. He wants to involve the people that actually participated in the struggle to make the monument so that everyone can enjoy it and get a better understanding of the struggle heritage. Therefore, he proposes collective ideology in which everyone has a say. This would prevent future vandalization of the monument. According to Pat Motsiri, the sculptures must depict the event around June 16, 1976. Like the story of Dr Edelstein, who was pierced by pickaxes, forced into a garbage bin and burned alive. According to Jonas Staal, the Memorial Acre should be destroyed, its elements stacked on pallets, thus forming the Monument for the Distribution of Wealth . According to Mafaisa, his men can do the work quickly. He has about twenty men working under him. (shrink)

In a knowledge-based economy of the globalizing economic order, the role of regions is very significant in order to create and to disperse knowledge. Particularly, geographical clusters of firms in a single sub-national region may contribute to transmitting certain kinds of knowledge between and among firms. In addition, markets prefer to favor specialized firms with a coherent body of knowledge when knowledge creation and the use of new knowledge become increasingly important for maintaining and improving a firm’s competitiveness. Therefore, regional (...) policy makers may not interfere directly with markets and firms when the process of globalization pushes national economies into a world of learning and innovation. The reason is that the institutional framework for market exchange favors knowledge exchange in a globalizing economic system. This paper argues how East Asian science cities such as Tsukuba Science City in Japan, Daedeok Innopolis in South Korea, Hsinchu Science-based Industrial Park in Taiwan, and Zhongguancun Science Park in China have been developed in order to create technology innovation as well to contribute to national and regional economic growth. Moreover, it also focuses on their competitiveness and the further development strategy that aims to become global science cities. Finally, it also discusses whether their competitiveness as innovative clusters is based on global or local levels. (shrink)

The original position together with the veil of ignorance have served as one of the main methodological devices to justify principles of distributive justice. Most approaches to this topic have primarily focused on the single person decision-theoretic aspect of the original position. This paper, in contrast, will directly model the basic structure and the economic agents therein to project the economic consequences and social outcomes generated either by utilitarianism or Rawls’s two principles of justice. It will be shown that when (...) the differences in people’s productive abilities are sufficiently great, utilitarianism dominates Rawls’s two principles of justice by providing a higher level of overall well-being to every member of society. Whenever this is the case, the parties can rely on the Principle of Dominance (which is a direct implication of instrumental rationality) to choose utilitarianism over Rawls’s two principles of justice. Furthermore, when this is so, utilitarianism is free from one of its most fundamental criticisms that it ‘does not take seriously the distinction between persons’ (Rawls 1971 [1999]: 24). (shrink)

One of John Rawls’s major aims, when he wrote A Theory of Justice, was to present a superior alternative to utilitarianism. Rawls’s worry was that utilitarianism may fail to protect the fundamental rights and liberties of persons in its attempt to maximize total social welfare. Rawls’s main argument against utilitarianism was that, for such reasons, the representative parties in the original position will not choose utilitarianism, but will rather choose his justice as fairness, which he believed would securely protect the (...) worth of everybody’s basic rights and liberties. In this paper, I will argue that, under close formal examination, Rawls’s argument against utilitarianism is self-defeating. That is, I will argue that Rawls’s own reasons, assumptions, and the many theoretical devices he employs demonstrably imply that the representative parties in the original position will choose utilitarianism instead of justice as fairness. A well-ordered society faces a crisis whenever a sufficient number of noncompliers enter into the political system. This has the potential to destabilize liberal democratic political order. This article provides a formal analysis of two competing solutions to the problem of political stability offered in the public reason liberalism literature—namely, using public reason or using convergence discourse to restore liberal democratic political order in the well-ordered society. The formal analyses offered in this article show that using public reason fails completely, (...) and using convergent discourse, although doing better, has its own critical limitations that have not been previously recognized properly. Hobbes’s own justification for the existence of governments relies on the assumption that, without a government, our lives in the state of nature would result in a state of war of every man against every man. Many contemporary scholars have tried to explain why universal war is unavoidable in Hobbes’s state of nature by utilizing modern game theory. However, most game-theoretic models that have been presented so far do not accurately capture what Hobbes deems to be the primary cause of (...) conflict in the state of nature – which is uncertainty, rather than people’s egoistic psychology. Any game- theoretic model that does not incorporate uncertainty into the picture is, therefore, I claim, the wrong model. In this paper, I use Bayesian game-theory to show how universal conflict can break-out in the state of nature - even when the majority of the population would strictly prefer to cooperate and seek peace with other people - due to uncertainty about the other person’s type. Along the way, I show that the valuation of one’s own life is one of the central mechanisms that drives Hobbes’s pessimistic conclusion. (shrink)

Inspired by impossibility theorems of social choice theory, many democratic theorists have argued that aggregative forms of democracy cannot lend full democratic justification for the collective decisions reached. Hence, democratic theorists have turned their attention to deliberative democracy, according to which “outcomes are democratically legitimate if and only if they could be the object of a free and reasoned agreement among equals” (Cohen 1997a, 73). However, relatively little work has been done to offer a formal theory of democratic deliberation. This (...) article helps fill that gap by offering a formal theory of three different modes of democratic deliberation: myopic discussion, constructive discussion, and debate. We show that myopic discussion suffers from indeterminacy of long run outcomes, while constructive discussion and debate are conclusive. Finally, unlike the other two modes of deliberation, debate is path independent and converges to a unique compromise position, irrespective of the initial status quo. (shrink)

Suppose we assume that the parties in the original position took Kahneman and Tversky's prospect theory as constituting their general knowledge of human psychology that survives through the veil of ignorance. How would this change the choice situation of the original position? In this paper, I present what I call ‘prospect utilitarianism’. Prospect utilitarianism combines the utilitarian social welfare function with individual utility functions characterized by Kahneman and Tversky's prospect theory. I will argue that, once prospect utilitarianism is on the (...) table, Rawls's original arguments in support of justice as fairness as well as his arguments against utilitarianism are, at best, inconclusive. This shows that how implausible a choice for utilitarianism in the original position is heavily depends on what one assumes to be general knowledge of human psychology that the original contracting parties know. John Rawls’s most mature notion of political order is “stability for the right reasons.” Stability for the right reasons is the kind of political order that Rawls hoped a well-ordered society could ideally achieve. In this paper, I demonstrate through the tools of modern game theory, the instability of “stability for the right reasons.” Specifically, I will show that a well-ordered society can completely destabilize by the introduction of an arbitrarily small number of non- compliers whenever individuals fail to achieve (...) full common knowledge ever so slightly. Public reason liberalism takes as its starting point the deep and irreconcilable diversity we find characterizing liberal societies. This deep and irreconcilable diversity creates problems for social order. One method for adjudicating these conflicts is through the use of rights. This paper is about the ability of such rights to adjudicate disputes when perspectival disagreements—or disagreements over how to categorize objects in the world—obtain. We present both formal possibility and impossibility results for rights structures under varying degrees of perspectival diversity. (...) We show that though perspectival diversity appears to be a troubling problem for the prospect of stable social order, if rights are defined properly then disagreements can likely be resolved in a consistent manner, achieving social cooperation rather than conflict. Robert Nozick recognized that calls for distributive justice represented the most salient justification for extending the state beyond his preferred minimal form. He therefore made it his project to demonstrate that distributive justice could be achieved under the minimal state. Achieving distributive justice, however, requires the effective functioning of the rectification principle: rectification represents the only mechanism that can correct distributions resulting from past injustices that deviate from repeated historical applications of the principles of justice in acquisition and transfer. This (...) makes Nozick’s principle of rectification the linchpin of the minimal state: the success of the minimal state entirely depends on whether it can successfully implement the rectification principle without expanding its state apparatus. In this paper, we demonstrate that under traditional understandings of the minimal state, the rectification principle fails to correct historical injustices even in maximally simplified and charitable scenarios. We propose, and model, a solution—the state as a fractional-reserve lender—that would render the rectification principle many-fold times more effective and robust. This is, however, a consequential modification: while this improved operation of the rectification principle does defend against wholesale extensions of the minimal state, it requires a reconceptualization of the minimal state as consisting of a central bank in addition to its police, courts, and army. In a recently published paper entitled, “The Difference Principle Would Not Be Chosen behind the Veil of Ignorance”, Johan E. Gustafsson attempts to demonstrate that the parties in Rawls’s original position would not choose the difference principle. Gustafsson’s main strategy was to show that Rawls’s difference principle in both of its ex post and ex ante versions imply counterintuitive distributional prescriptions in a few contrived examples. The purpose of this paper is to precisely demonstrate exactly how Gustafsson’s arguments have failed (...) to show that the difference principle would not be chosen behind the veil of ignorance. Locke rejected anarchism. Locke defended the universal necessity of political governments on the grounds that the state of nature will occasionally generate the inconveniences of war. The standard interpretation of Locke identifies three main causes of war in the state of nature: the lack of a common judge, moral disagreement over the law of nature, and self-love. In this paper, I argue that the combination of these three factors does not guarantee that war will occur in every plausible scenarios of (...) Locke’s state of nature. Instead, in order for war to occur at least sometimes in every plausible scenario of Locke’s state of nature, there has to be some sort of epistemic deficit. In this paper, I show via the tools of modern game theory, how Locke’s state of nature may occasionally generate war by two kinds of epistemic problems implied by Locke’s own epistemology: disagreements in subjective probabilities, and uncertainty in other people’s moral motivation to use force to enforce the law of nature. The fact that war occurs primarily because of such epistemic problems suggests a role for a very limited form of government; namely, the ultra-ultra-minimal state, whose role is confined to solving such epistemic problems. Ever since the publication of Harry Frankfurt’s “Equality as a Moral Ideal” :21–43, 1987), the doctrine of sufficiency has attracted great attention among both ethical theorists and political philosophers. The doctrine of sufficiency consists of two main theses: the positive thesis states that it is morally important for people to have enough; and the negative thesis states that once everybody has enough, relative inequality has absolutely no moral importance. Many political philosophers have presented different versions of sufficientarianism that retain the (...) general spirit of what Frankfurt had proposed in his seminal work. However, all of these different versions of sufficientarianism suffer from two critical problems: they fail to give right answers to lifeboat situations, and they fail to provide continuous ethical judgments. In this paper, I show a version of utilitarianism that solves these problems while retaining the major attractions of sufficientarianism. I call it “prospect utilitarianism.” In addition, I show that prospect utilitarianism can avoid standard objections to utilitarianism and has aspects that can appeal to both prioritarians and egalitarians as well. A defining characteristic of a liberal democratic society is the assignment of basic rights and liberties that protect each person’s private sphere. Hence, social choice made in a liberal democratic society must at the very least be consistent with the exercise of each person’s basic rights. However, even when everybody agrees to this basic principle, there could still remain irreconcilable social conflict and disagreement when it comes to the specific assignment of basic rights. This is especially so in a pluralistic (...) society where there is a clash among radically different and incompatible world views. Philosophers have now started to focus on this issue, which now goes by the name “perspectival diversity.” This paper extends the basic social choice theoretic framework of liberal rights by extending the domain to include individual perspectives alongside individual preferences. In this new framework, different individuals are able to see or perceive the same social alternative differently based on their own unique perspectives. The formal results of the paper imply that generating a viable social choice that is consistent with the assignment of basic rights can quickly break down once we start to increase the level of perspectival diversity in society. In Book 1 of Plato’s Republic, Thrasymachus contends two major claims: (1) justice is the advantage of the stronger, and (2) justice is the good of the other, while injustice is to one’s own profit and advantage. In the beginning of Book II, Glaucon self-proclaims that he will be representing Thrasymachus’ claims in a better way, and provides a story of how justice has originated from a state of nature situation. However, Glaucon’s story of the origin of justice has an (...) implication that justice is the advantage of the weak rather than the stronger. This is inconsistent with Thrasymachus’ first claim which states that justice is the advantage of the stronger. This is a problem for Glaucon since Glaucon is supposed to be representing Thrasymachus’ original claims in a better way. In this paper, I provide two solutions to this puzzle with the help of elementary game theory. (shrink)

This book explores the interrelated concepts of representation and grammar in the philosophy of Ludwig Wittgenstein. Throughout his life, Wittgenstein was obsessed with the problem of the nature of language and the relationship between language and the world. His intellectual journey, one of the most compelling in twentieth century thought, is the detailed adventure told by Gordon Hunnings in The World and Language in Wittgenstein’s Philosophy. This book surveys Wittgenstein’s elucidation of how the world is represented in language, including the (...) posthumously published material of his middle period. Early in his career, Wittgenstein’s answer to the problem explored the representational connection between language and the world through the analogy of propositions as logical pictures of facts. Later, his mature answer elucidated the concept of the world as a construction of logical grammar. Hunnings shows how these shifting images of reality reflected in language also mirror the changes in Wittgenstein’s philosophy. (shrink)
