A moving exploration of the place of hope in the world today, drawing on agrarian principles In this series of meditations, Norman Wirzba recasts hope not as something people have, like a vaccine to prevent pain and trouble, but as something people do. Hope evaporates in conditions of abandonment and abuse. It grows in contexts of nurture and belonging. Hope ignites when people join in what Wendell Berry calls 'love's braided dance'--a commitment to care for one another and our (...) world. Through personal narratives and historical examples, Wirzba explores what sustains hope and why it so often seems absent from our vision of the future. The vitality of hope, he maintains, depends on a collective commitment to care for the physical world (its soils and waters, plants and animals, homes and neighborhoods) and to promote the moral, aesthetic, and spiritual ideals that affirm life as good, beautiful, and sacred. This chapter examines Norman Malcolm’s account of “groundless believing,” and argues that it does not plausibly apply to religion. It then proceeds to subject related appeals to religion as a “world picture” or “system of reference” to critical scrutiny. Once again, the argument is made that these both illegitimately extend Wittgenstein’s very brief remarks, and fail to make a case for regarding religion as instances. Some parallels between Wittgenstein and the “common sense” philosophy of Thomas Reid are drawn and (...) explored. This further connects Wittgenstein with the philosophers considered in Chapter 1. This chapter moves to consider three approaches to “Wittgenstein on religion” that pursue a different kind of line. These are found in the work of Norman Malcolm, Phillip R Shields, and James C. Edwards. All three aim to find an analogical relationship between religious faith and Wittgenstein’s understanding of philosophy. The chapter examines the structural analogies that these philosophers have identified between religion and both the _Tractatus_ and the _Investigations_. The chapter concludes by following a clue in Peter Winch’s (...) criticisms of Norman Malcolm, and sets out one way in which there is a bridge to be built between the task of understanding religion and Wittgenstein’s distinctive philosophical method. This article examines the notorious mid-nineteenth-century American trial of Amelia Norman, who was acquitted - very much against the weight of the evidence - of attempting to kill the man who seduced her. In particular, we explore the role in the trial and its aftermath of the affective energies and cultural expectations set in motion by best-selling American sentimental novels like Hannah Foster's "The Coquette" and Susanna Rowson's "Charlotte Temple." In Norman's case, once newspapers, defense lawyers, and reformers (...) such as Lydia Maria Child recast the defendant as a sentimental heroine, the trial became about seduction, not attempted murder. The sentimental emplotment of Norman's life marshaled a powerful set of emotional responses and moral judgments on her behalf. For example, Norman claimed insanity. And since sentimental heroines are supposed to go mad when they are seduced and abandoned, the jury was prepared to interpret her symptoms according to her lawyers' very strategy for establishing her innocence. Ultimately, however, Norman embodied the plight of the sentimental heroine at the same time that she contested her fictional counterpart's fate. In this way, her trial spectacularized the disparity which the sentimental novel conjures up and displaces but never resolves. Going further, the common law theory of coverture, which severely limited the legal personhood of married women, has received a great deal of scholarly attention. Cases like Norman's remind us that unmarried women were also subject to draconian constraints on their legal personhood. The tort of seduction is a key example. Legal historians trace the development of the seduction tort from its common-law origins, when men's property interest in women's bodies formed the basis of the cause of action, to 1851, when Field Code authors (including Norman's lawyer, David Graham) persuaded several states to grant seduced women standing to bring their own cause of action. Consequently, courts were forced to reckon with the seduced woman as a moral agent capable of consenting to sex. As trials like Norman's demonstrate, sentimental novels helped lay the groundwork for this shift in the law by elucidating a subjectivity for the seduced woman. Yet the doctrinal implications of Norman's precedent-setting trial had a second, more ambiguous strain. Other women facing similar charges used the same legal strategy to gain acquittals in a substantial number of cases. Indeed, Norman's sentimental strategy proved so powerful that men on trial for killing their wives' seducers appropriated it to bring their own stories before juries and to reinforce male sexual norms through the so-called honor defense. In the end, then, Norman's trial fostered legal reform, but it also suggested - as Lydia Maria Child's fictionalization of the case in "Rosenglory" recognized - that only sustained and multifaceted efforts to change cultural as well as legal norms could improve the sexual status of women. In addition to its legal, literary, and historical insights that it provides, we also intend this article to contribute to debates on the nature of scholarship in law and literature. Scholars such as Wai Chee Dimock have argued for a focus on the historical and historically shifting relations between law and literature - a view we endorse. Where we differ from Dimock is in our diversion of attention away from abstract ideas of law laid out by treatise writers and philosophers in favor of law experienced and manipulated by individuals. So, too, we are interested less in representations of concepts such as justice in legal and literary texts than we are in the ways in which literature (broadly conceived) can create provisional and fragile opportunities for concrete instantiations of justice and even generate legal change (for good or ill). We would argue that to the extent legal change motivates rather than simply mirrors cultural change, it needs literature to be effective. This project, then, responds to Gregg Crane's call for attention to the complex and slippery historical interactions of law and literature that shape and are shaped by an ever changing cultural idiom of justice. The extended story of Amelia Norman, in short, not only constitutes a case study in the inescapable interaction between the overlapping and interdependent discourses of law and literature, but also reveals the literary and legal consequences of that interaction. The paper examines two recent arguments, by Keith Graham and Richard Norman, to the effect that a liberal individualist foundation is insufficient for a socialist conception of democracy and needs to be replaced or supplemented by collectivist notions [I]. It concludes that these arguments are unsound and that a defensible education for democratic citizenship on socialist lines should be based on liberal values, not least that of personal autonomy. At the same time it concedes to collectivism that socialist (...) democracy needs to operate within a social framework, but sees national communities rather than social classes or smaller-scale groupings as the most promising candidates for this. Our paper explores how the affective energies and cultural expectations set in motion by best-selling American sentimental novels like Hannah Foster's The Coquette and Susanna Rowson's Charlotte Temple informed the notorious mid-nineteenth-century American trial of Amelia Norman, who attempted to kill the man who seduced her. Once newspapers, defense lawyers, and reformers such as Lydia Maria Child recast the defendant as a sentimental heroine, the trial became about seduction, and Norman was acquitted against the weight of the evidence. In lieu of an abstract, here is a brief excerpt of the content:Philosophy and Literature 25.1 (2001) 171-173 [Access article in PDF] Book Review Literary Lives: Biography and the Search for Understanding Literary Lives: Biography and the Search for Understanding, by David Ellis; ix & 195 pp. New York: Routledge, 2000, $35. In his discussion of biography as a form, Ellis points to his study as a response to the scarcity of "monographs on biography... and [that] none of them are (...) particularly satisfactory" (p. 2). He further points out that "the comparative dearth of analytic enquiry into biography is surprising" (p. 3). In short, his first pages get off to a rocky start in their tatty justification of a critical study. Though a critic of D. H. Lawrence, Ellis uses the English writer sparingly, pointing out in his "Preface" what he feels is a need "to keep illustration involving Lawrence to a decent minimum" (p. viii) while concentrating on those problems which face the biographer. That said, he sets about to characterize biography as an integration of "a disinterested enthusiasm for information... [fashioning a]... compelling story in which many details with no direct relevance to the life of his subject can be considered as contributing successfully to a period atmosphere" (p. 35). Ellis is thinking specifically of Norman Sherry's biography of Graham Greene through which he has brought to the discussion his intent of pointing to an approach which concerns itself with chapters on "Ancestors," "Primal Scenes," "Body Matters," "the Sociological [End Page 171] Imagination," "History, Chance and Self-determination," "Compatibility, Sartre and Long Biographies." All are aspects of biography.As well as the approach he suggests by these areas of concentration, Ellis draws broadly from many subjects of biography, always keeping a critical eye on its form. Anne Stevenson's approach "is towards psychological determinism" (p. 135); Ackroyd in his biography of Dickens raises "through a degree of intellectual play" the questions of when "lineage" is appropriate, that is, the extent to which it has any productive consequence. He also uses Hawthorne and Virginia Woolf as examples. Writing of the role of the historian raises difficulties for writers creating biographies from such an early period as that of Chaucer; Ellis points to Derek Pearsall's "excellent Life of Geoffrey Chaucer" (p. 121).Ellis neither can nor should ignore Lawrence and what better chapter to include him in than "Body Matters" in its concentration on illness. Here Ellis draws on Lawrence's concern with the harm of his health on his work (p. 78). He also considers Flaubert, Sartre, and Woolf. Briefly he mentions Stendhal's imagination of his "future audience" after his death (p. 109), sensibly rejects the long ago depleted and so, parenthetically, apparently permanent speculation on what Keats's might have become had he lived a full life "in a time of drugs for treatment of tuberculosis" (p. 123) and the equally mined issue of what prompted Hemingway's suicide (pp. 132-33). Certainly he is aware of the danger that such a use of material may pander to the pleasure of mere name-hunters (what if there were no index!). At the same time, if the effect of his range of examples invites additions of our own, while keeping before us that his study is about biography as form, it is successful.In "Primal Scenes," the fourth chapter of his book, Ellis gives what he feels is necessary space to Freud, the creator of the term. He points to Wordsworth's "spots of time" as only one indication of the difficulty--if not impossibility--of capturing biographically those moments in childhood by which the individual written about might be defined (p. 57). (Such an impossibility should not be surprising to those of us readers who recognize the nearly impossible task for ourselves in our own lives.) Surely both the biographer and autobiographer share this ignorance and frustration. In a very interesting move, Ellis points to Compton Mackenzie's discussion of a critical event in his six-year old life surrounding the interruption of an Easter evening with his parents and siblings, interrupted by the arrival of friends. How should medical services be distributed within society? Who should pay for them? Is it right that large amounts should be spent on sophisticated technology and expensive operations, or would the resources be better employed in, for instance, less costly preventive measures? These and others are the questions addreses in this book. [Michael Friedman] This paper considers the extent to which Kant's vision of a distinctively 'transcendental' task for philosophy is essentially tied to his views on the foundations of the mathematical and physical sciences. Contemporary philosophers with broadly Kantian sympathies have attempted to reinterpret his project so as to isolate a more general philosophical core not so closely tied to the details of now outmoded mathematical-physical theories (Euclidean geometry and Newtonian physics). I consider two such attempts, those of Strawson and McDowell, (...) and argue that they fundamentally distort the original Kantian impulse. I then consider Buchdahl's attempt to preserve the link between Kantian philosophy and the sciences while simultaneously generalizing Kant's doctrines in light of later scientific developments. I argue that Buchdahl's view, while not adequate as in interpretation of Kant in his own eighteenth century context, is nonetheless suggestive of an historicized and relativized revision of Kantianism that can do justice to both Kant's original philosophical impulse and the radical changes in the sciences that have occurred since Kant's day. /// [Graham Bird] Michael Friedman criticises some recent accounts of Kant which 'detach' his transcendental principles from the sciences, and do so in order to evade naturalism. I argue that Friedman's rejection of that 'detachment' is ambiguous. In its strong form, which I claim Kant rejects, the principles of Euclidean geometry and Newtonian physics are represented as transcendental principles. In its weak form, which I believe Kant accepts, it treats those latter principles as higher order conditions of the possibility of both science and ordinary experience. I argue also that the appeal to naturalism is unhelpful because that doctrine is seriously unclear, and because the accounts Friedman criticises are open to objections independent of any appeal to naturalism.
