Intellectual property (IP) can internalize positive externalities associated with the creation and discovery of ideas, thereby increasing investment in efforts to create and discover ideas. However, IP law also causes negative externalities. Strict IP rights raise the transaction costs associated with consuming and building on existing ideas. This causes a tragedy of the anticommons, in which valuable resources are underused and underdeveloped. By disincentivizing creative projects that build on existing ideas, IP protection, even if it increases original innovation, can inadvertently (...) reduce the rate of iterative innovation. The net effect of IP law on innovation and welfare depends on the relative magnitude of these positive and negative externalities. We argue that the current regime probably suffers from excessive, and excessively rigid, IP protection. This motivates the search for institutional alternatives and complements. We suggest that a monocentric IP rights regime may not be the only, or the most efficient, way to internalize the positive externalities of innovation. The knowledge economy supports the emergence of diverse, polycentric forms of bottom-up self-governance, both market and community led, that entail the citizen coproduction of the norms and practices of intellectual creation and discovery. In Explaining Technology, Koppl et al. (2023) argue that “recombination is the essential driver of technological evolution” (p. 3). Modelling combinatorial innovation as a self-propelling, “autocatalytic” process raises the question of what explanatory role, if any, is left for institutional analysis. Although the authors grant institutions only an auxiliary explanatory role, they hint at the functional importance of market institutions, trade networks, patent law, and entrepreneurship. Our paper argues that institutions matter because they crucially affect aggregate levels and rates of (...) recombination and innovation, as well as shaping patterns of recombination and innovation that occur. This paper builds upon Koppl et al.’s acknowledgement of these institutional effects by integrating combinatorial evolution within recent developments in commons theory and institutional economics. Specifically, we argue the burgeoning literature on Governing Knowledge Commons offers a fruitful framework and body of empirical case studies that illuminates the diverse institutions individuals use to facilitate and steer combinatorial innovation. Whilst healthy institutional diversity may incentivize more recombination than any single monocentric institutional arrangement, the non-teleological aspect of recombination means that innovative processes can exude either productive, unproductive, or destructive effects. The institutional diversity fostered by flourishing knowledge commons may allow people to put combinatorial innovations into more productive uses while internalizing their complex externalities. At the same time, it may generate socio-cultural resistances to some forms of innovation processes. We illustrate our theory using cases related to several applied topics including intellectual property, competition policy, and the development of unmanned aerial vehicles. (shrink)

Classical liberals argue that economic, political, and social freedoms complement and reinforce one another. This chapter engages with this “systems complementarity” hypothesis by illustrating how freedom of association in civil society enables citizens to defend freedom of association in economic and commercial life. Classical liberal arguments for free trade do not merely rest upon efficiency considerations but are grounded in conceptual and normative claims surrounding the desirability of freedom of association for persons interacting across political borders. One of these claims (...) is that commercial freedom of association increases opportunities for interpersonal contact through markets, promoting peace. Given the history of states using militarism and protectionism not only to generate rents for preferred political interests, but as reasons to restrict free association within commercial life, an array of associations and movements emerged in Europe, and elsewhere, challenging the hegemonic political ideologies and governance practices biased toward mercantilism and war. Using the life and work of French liberal, and inaugural Nobel Peace Prize recipient, Frederic Passy as an illustrative case, we show how free association among international peace activists enabled them to advance complementary economic, political, and social freedoms. Passy and the nineteenth-century peace movement generated pro-trade economic frames in political discourses about peace and used their social networks to build significant organizational and resourcing capabilities for the peace movement. Passy was an ideological and organizational entrepreneur showing how social movement activism constitutes an important enabling activity promulgating free association within the commercial, political, and social arenas. It is now more than 50 years that the Goodman paradox has been discussed, and many different solutions have been proposed. But so far no agreement has been reached about which is the correct solution to the paradox. In this paper, I present the naturalistic solutions to the paradox that were proposed in Quine (1969, 1974), Quine and Ullian (1970/1978), and Stemmer (1971). At the same time, I introduce a number of modifications and improvements that are needed for overcoming (...) shortcomings of the solutions. The discussion of this improved version suggests that the Goodman paradox actually embodies three different problems; yet, one of them is not Goodman’s but Hume’s problem. The discussion also suggests that the naturalistic approach is probably the best for basing on it a theory of confirmation. Finally, I analyze one of Hume’s insights that seems to have been largely ignored. This insight shows a surprising similarity to a central feature of the naturalistic solutions. (shrink)

Summary With the help of psychological and biological concepts it is possible todescribe adequately a fundamental class of inductive inferences that are intuitively correct. Moreover, by relying on evolutionary theories it is possible tojustify them, because they reflect innate, hence useful, capacities. These inferences, however, refer to the past, i.e. the inferred generalization is of the form All Awere B . The reason is that evolutionary theories only claim that innate capacitieshad survival value. With respect to inductive inferences about the (...) future the situation is different. In particular, they are affected by the Goodman paradox. In the article, a method is proposed which enables us to describe adequately a basic class of inductive inferences about the future which are intuitively correct. These inferences can also be justified, but their justification requires a very specific assumption. The conclusions arrived at in the article can be viewed as a satisfactory solution to the Goodman paradox. (shrink)

The Goodman paradox presents us with the problem of selecting the hypotheses that are confirmed by their positive instances. In a recent paper, Stephen Hetherington proposes a criterion that enables us to specify the hypotheses that are subjectively confirmed by these instances. But there is also an objective aspect to be considered here because, as a matter of fact, the hypotheses selected by the criterion have often been highly reliable even if they were based on the observation of only (...) a few positive instances. In the present note, I examine this aspect and I point out that Hume not only dealt with the reliability phenomenon but also gave a plausible explanation of the phenomenon. I also point out that Hume's explanation is surprisingly similar to the explanation given lately by a number of naturalistic philosophers to the reliability phenomenon. (shrink)

Many solutions of the Goodman paradox have been proposed but so far no agreement has been reached about which is the correct solution. However, I will not contribute here to the discussion with a new solution. Rather, I will argue that a solution has been in front of us for more than two hundred years because a careful reading of Hume's account of inductive inferences shows that, contrary to Goodman's opinion, it embodies a correct solution of the paradox. Moreover, the account even includes a correct answer to Mill's question of why in some cases a single instance is sufficient for a complete induction, since Hume gives a well-supported explanation of this reliability phenomenon. The discussion also suggests that Bayesian theory by itself cannot explain this phenomenon. Finally, we will see that Hume's explanation of the reliability phenomenon is surprisingly similar to the explanation given lately by a number of naturalistic philosophers in their discussion of the Goodman paradox. In the burgeoning literature on thought experiments, examples are drawn from almost all areas of philosophy, one exception, however, being aesthetics. There are good reasons why this is so: there are very few interesting theory-oriented thought experiments in aesthetics, which is unsurprising since there are few well-developed theories to test in this field. After evaluating some aesthetic thought experiments in light of some general epistemic questions regarding thought experiments, we argue that theory-centred thought experiments are not the only kinds of (...) thought experiments, and that the practical and productive thought experiments that are prevalent in aesthetics are also worthy of some attention. Professor Geoffrey Hellman's introduction gives a sustained analysis and appreciation of the major themes and the thrust of the book, as well as an account of the ways in which many of Goodman's problems and projects have been picked up and developed by others. We use the normality framework of Goodman and Salow (2018, 2021, 2023b) to investigate of dynamics of rational belief. The guiding idea is that people are entitled to believe that their circumstances aren’t especially abnormal. More precisely, a rational agent’s beliefs rule out all and only those possibilities that are either (i) ruled out by their evidence or (ii) sufficiently less normal than some other possibility not ruled out by their evidence. Working within this framework, we argue that the (...) logic of rational belief revision is much weaker than is usually supposed. We do so by isolating a natural family of orthodox principles about belief revision, describing realistic cases in which these principles seem to fail, and showing how these counterexamples are predicted by independently motivated models of the cases in question. In these models, whether one evidential possibility counts as sufficiently less normal than another is determined by underlying probabilities (together with a contextually determined question). We argue that the resulting probabilistic account of belief compares favorably with other such accounts, including Lockeanism (Foley, 1993), a ‘stability’ account inspired by Leitgeb (2017), the ‘tracking theory’ of Lin and Kelly (2012), and the influential precursor of Levi (1967). We show that all of these accounts yield subtly different but similarly heterodox logics of belief revision. (shrink)

Some people have supposed that utility is good in itself, non-in-strumentally good, as distinct from good because conducive to other good things. And in modern versions of this view, utility often means want-satisfaction, as distinct from pleasure or happiness. For your want that p to be satisfied, is it necessary that you know or believe that p, or sufficient merely that p is true? However that question is answered, there are problems with the view that want-satisfaction is a non-instrumental good. (...) What if you want something only because you have a false belief? What if the time at which you want that p is fifty or five hundred years before the time to which p itself refers? To meet these difficulties, qualifications have to be introduced, and much has been written about how exactly these qualifications are to be framed.1 There is however what may be a rather more serious objection to the view that want-satisfaction is a non-instrumental good, or rather to the combination of that view with the principle that it is sufficient for your want that p to be satisfied simply that p is true. The objection is that this combination forces you to give undue weight to the mere acquisition of desires when you come to make judgements about changes in the value of things. It forces you to say that for any true proposition p, which initially you do not want to be true, your mere acquisition of a desire that p will, other things being equal, make the world better. Non-instrumental value can be increased merely by multiplying desires, even though everything else remains the same. Surely, however, improving the world is not as easy as that. (shrink)

Arthur Schopenhauer ranked the several arts in a hierarchy, with literary and dramatic arts at the top, music soaring in a separate even higher heaven, and architecture sinking to the ground under the weight of beams and bricks and mortar.1 The governing principle seems to be some measure of spirituality, with architecture ranking lowest by vice of being grossly material.Nowadays such rankings are taken less seriously. Traditional ideologies and mythologies of the arts are undergoing deconstruction and disvaluation, making way for (...) a neutral comparative study that can reveal a good deal not only about relations among the several arts2 but also about the kinships and contrasts between the arts, the sciences, and other ways that symbols of various kinds participate in the advancement of the understanding.In comparing architecture with the other arts, what may first strike us, despite Schopenhauer, is a close affinity with music: architectural and musical works, unlike paintings or plays or novels, are seldom descriptive or representational. With some interesting exceptions, architectural works do not denote—that is, do not describe, recount, depict, or portray. They mean, if at all, in other ways.On the other hand, and architectural work contrasts with other works of art in scale. A building or park or city3 is not only bigger spatially and temporally than a musical performance or painting—it is bigger even than we are. We cannot take it all in from a single point of view; we must move around and within it to grasp the whole. Moreover, the architectural work is normally fixed in place. Unlike a painting that may be reframed and rehung or a concerto that may be heard in different halls, the architectural work is firmly set in physical and cultural environment that alters slowly. 1. The acknowledged difficulty and even impossibility of finding a literal paraphrase for most metaphors is offered by [Donald] Davidson1 as evidence that there is nothing to be paraphrased - that a sentence says nothing metaphorically that it does not say literally, but rather functions differently, inviting comparisons and stimulating thought. But paraphrase of many literal sentences also is exceedingly difficult, and indeed we may seriously question whether any sentence can be translated exactly into other words in the same or any (...) other language. Let's agree, though, that literal paraphrase of metaphor is on the whole especially hard. That is easily understood since the metaphorical application of terms has the effect, and usually the purpose, of drawing significant boundaries that cut across ruts worn by habit, of picking out new relevant kinds for which we have no simple and familiar literal descriptions. We must note in passing, though, that the metaphorical application may nevertheless be quite clear. For just as inability to define "desk" is compatible with knowing which articles are desks, so inability to paraphrase a metaphorical term is compatible with knowing what it applies to, And as I have remarked elsewhere,2 whether a man is metaphorically a Don Quixote or a Don Juan is perhaps easier to decide than whether he is literally a schizoid or a paranoiac. · 1. Obviously, subject is what is said, style is how. A little less obviously, that formula is full of faults. Architecture and nonobjective painting and most of music have no subject. Their style cannot be a matter of how they say something, for they do not literally say anything; they do other things, they mean in other ways. Although most literary works say something, they usually do other things, too; and some of the ways they do some of these things are (...) aspects of style. Moreover, the what of one sort of doing may be part of the how of another. Indeed, even where the only function in question is saying, we shall have to recognize that some notable features of style are features of the matter rather than the manner of the saying. In more ways than one, subject is involved in style. For this and other reasons, I cannot subscribe to the received opinion that style depends upon an artist's conscious choice among alternatives. And I think we shall also have to recognize that not all differences in ways of writing or painting or composing or performing are differences in style. Eric Santner offers a radically new interpretation of Marx's labor theory of value as one concerned with the afterlife of political theology in secular modernity. What Marx characterized as the dual character of the labor embodied in the commodity, he argues, is the doctrine of the King's Two Bodies transferred from the political theology of sovereignty to the realm of political economy. This genealogy, leading from the fetishism of the royal body to the fetishism of the commodity, also suggests a (...) new understanding of the irrational core at the center of economic busyness today, its 24/7 pace. The frenetic negotiations of our busy-bodies continue and translate into the doxology of everyday life the liturgical labor that once sustained the sovereign's glory.
