BackgroundCommonly applied measures of symptoms of anxiety are not sensitive to disease-specific anxiety in patients with chronic obstructive pulmonary disease. There is a need for validated instruments measuring COPD-specific anxiety. Therefore, we translated the COPD-Anxiety Questionnaire into Danish and performed an initial validation of the psychometric properties in a sample of patients with COPD.Materials and MethodsTranslation procedures followed the World Health Organization guidelines. Participants with COPD completed questionnaires measuring COPD-specific anxiety, general psychological distress as well as variables related to COPD, (...) quality of life, and socio-demography.ResultsA total of 260 patients with COPD completed questionnaires. The Danish version of CAF-R-DK demonstrated acceptable Cronbach’s α values that were comparable with those of the original CAF. As expected, the CAF-R-DK showed positive correlations with convergent constructs and negative correlations with discriminant constructs. However, the results for specific subdomains of the CAF-R-DK indicated inconsistency in the underlying concept of disease-specific anxiety, which was also suggested based on the subsequent confirmatory and exploratory factor analyzes.ConclusionThe CAF could serve as an important supplement to generic psychological distress screening of patients with COPD in somatic health care settings, and the questionnaire is now available in Danish. Translation into other languages is needed with the purpose of obtaining data for further testing the psychometric properties of the questionnaire. (shrink)

IntroductionRheumatologists are the primary healthcare professionals responsible for patients with rheumatic diseases and should acquire medical ethical competencies, such as the informed consent process (ICP). The objective clinical structured examination is a valuable tool for assessing clinical competencies. We report the performance of 90 rheumatologist trainees participating in a station designed to evaluate the ICP during the 2018 and 2019 national accreditations.MethodsThe station was validated and represented a medical encounter in which the rheumatologist informed a patient with systemic lupus erythematosus (...) with clinically active nephritis about renal biopsy. A trained patient–actor and an evaluator were instructed to assess ICP skills (with a focus on kidney biopsy benefits, how the biopsy is done and potential complications) in obtaining formal informed consent, delivering bad news and overall communication with patients. The evaluator used a tailored checklist and form.ResultsCandidate performance varied with ICP content and was superior for potential benefit information (achieved by 98.9% of the candidates) but significantly reduced for potential complications (37.8%) and biopsy description (42.2%). Only 17.8% of the candidates mentioned the legal perspective of ICP. Death (as a potential complication) was omitted by the majority of the candidates (93.3%); after the patient–actor challenged candidates, only 57.1% of them gave a clear and positive answer. Evaluators frequently rated candidate communications skills as superior (≥80%), but ≥1 negative aspect was identified in 69% of the candidates.ConclusionsEthical competencies are mandatory for professional rheumatologists. It seems necessary to include an ethics competency framework in the curriculum throughout the rheumatology residency. (shrink)

Despite emphasis on public, ritual-centered aspects of ancient practice, Greek images and objects attest to private and personal encounters with divinities. This paper uses archaeological evidence to explore personal, lived features of ancient Athenian religious life. Although sometimes described as ‘transactional’, the development of personal relationships with the gods, together with the manipulation of material things, appears to be one of the most prominent elements in Greek religious experience. This paper examines religious materiality and devotional behavior as it existed outside (...) of organizing systems, ritual, and sacred space. Greek evidence suggests that material culture was ‘religion’ in physical form, part of devotees’ methods for developing remarkably intimate relationships with holy figures in a process termed ‘devotionalism.’ Athenian women used a commonplace item from daily life as a form of religious media: the tainia (ribbon). Women employed them in all the places of their lives, including homes, festival sites, and shrines. Pottery also suggests that Athenians employed such devotional media to interact with the deceased in cemeteries. (shrink)

On one day in 2009, in 38 countries around the world, 4,000 ordinary citizens gathered to discuss the future of climate policy. This project, 'WWViews', was the first-ever global democratic deliberation - an attempt to enable normal people to reach informed decisions on and impact the global policy process.This book, written by the international practitioners and scholars who facilitated the project, analyses the experiences and lessons from this ground-breaking event. Despite the apparent success of the individual deliberations, the recommendations had (...) little impact within the media or the policy process at Copenhagen. The authors examine these successes and failures, and the challenges and opportunities of such deliberative events. Through this they explore important themes for participatory approaches from the local to the global: the role of deliberation within global governance; methodology and practice; participant selection; policy impacts; engaging the media; how policy culture affects deliberation uptake; capacity building and knowledge transfer; process evaluation; content and argumentation analysis; and gender, race and class aspects.The global aims of the WWViews project, along with the opportunity to evaluate the same process in different national and cultural contexts, makes this a hugely valuable and informative study for all those interested in democratic deliberation and environmental governance from the small to the international scale. The present paper focuses on the nurse–patient relationship in forensic psychiatric care. From research in the field six categories of nurse–patient interactions are identified: ‘building and sustaining relationships’, ‘supportive/encouraging interactions’, ‘social skills training’, ‘reality orientation’, ‘reflective interactions’ and ‘practical skills training’. The content of each category of interaction in the context of forensic psychiatric care is described. A conceptual model is presented together with an empirical, philosophical and theoretical foundation for the use of verbal and social interactions in nurse–patient interactions (...) in forensic psychiatric nursing care. This article argues that the globalization of law is not collapsing under contemporary pressures but is instead being reconfigured through intensified contestation and shifting political alignments. While post-Cold War scholarship often portrayed legal globalization as a linear expansion of liberal legality, anchored in human rights, rule of law, and international institutions, recent developments have defied that narrative. Challenges to the legitimacy of courts and organizations, growing backlash against rights-based frameworks, and the rise of illiberal state projects have led many scholars (...) to diagnose a crisis of the global legal order. Against this view, the article conceptualizes legal globalization as a contested transnational field, structured by struggles over authority, symbolic capital, and competing visions of legitimacy. Drawing on Pierre Bourdieu’s field theory and world society theory, the article shows how global legal vocabularies and institutions continue to operate, but increasingly as arenas of polarized conflict rather than vehicles of normative convergence. Empirically, it highlights how new actors, including autocratic governments and transnational religious and far-right movements, mobilize rights and sovereignty claims to reshape global legality. The article concludes that the central question today is not whether legal globalization will survive, but what kind of global legal order is emerging through these “street fights” over international law. The European Convention of Human Rights system was originally created to sound the alarm if democracy was threatened in the member states. Yet, it eventually developed into a very different system with a focus on providing individual justice in an ever growing number of member states. This transformation has raised fundamental questions as to the level of difference and diversity allowed within the common European human rights space. Was the system to rest on minimum standards with room for domestic differences, (...) or was it to create uniform standards? These questions have come up as increasingly contentious issues over the past years and have triggered a number of reforms seeking to introduce more subsidiarity in the system, striking a different balance between the European and national oversight of human rights. The article analyses this turn to subsidiarity by exploring whether the reform process has introduced new forms of difference and diversity within the common space of European human rights. Covering the period from 2000 to the end of 2019 and using a dataset of all judgments of the period, the article provides a structural analysis of developments in reference to the margin of appreciation which is the European Court of Human Rights’ long-standing tool for balancing the common standards, yet leaving space for individual member states to find local solutions to implementing those standards. It concludes that recent developments have contributed to a more federal-style construction of European human rights with more space for differences within the common general standards. (shrink)

Law and the Formation of Modern Europe explores processes of legal construction in both the national and supranational domains, and it provides an overview of the modern European legal order. In its supranational focus, it examines the sociological pressures which have given rise to European public law, the national origins of key transnational legal institutions and the elite motivations driving the formation of European law. In its national focus, it addresses legal questions and problems which have assumed importance in parallel (...) fashion in different national societies, and which have shaped European law more indirectly. Examples of this are the post-1914 transformation of classical private law, the rise of corporatism, the legal response to the post-1945 legacy of authoritarianism, the emergence of human rights law and the growth of judicial review. Erik Wielenberg [2014] and Mark Murphy [2017], [2018] have defended a series of arguments for the conclusion that creatures are not good intrinsically. In response, I take two steps. First, I introduce a conception of intrinsic value that makes created intrinsic value unproblematic. Second, I respond to their arguments in turn. The first argument is from the sovereignty-aseity intuition and an analysis of intrinsicality that makes derivative good extrinsic. I challenge the analysis. The second comes from a conception of perfection (...) where God exhausts all possibilities for goodness. I challenge this conception. The third comes from the contingency of creation and the internal logic of intrinsic value. I challenge the assumption that connects the two. I then present an argument from reference magnetism that the only conception of God, God's perfections, and religious language that makes it plausible that the sentence "God is intrinsically good and creatures are not" is true involves a strongly univocalist position. A view that is either unstatable or places strong demands on our conception of God, God's perfections and religious language thereby loses plausibility. (shrink)

This chapter will amount to a detailed exposition and exploration of one of the most prominent arguments against the existence of an unsurpassable world: the argument from addition. Endorsed by a variety of thinkers such as St. Thomas Aquinas, Alvin Plantinga, and William Rowe, the argument from addition uses the possibility of adding good things to a candidate unsurpassable world to argue that every world is surpassable. While widely endorsed, the argument has come under recent criticism. By carefully working through (...) a targeted version of the argument, I set out to establish the following: (i) that a world can always contain more good things; (ii) that a suitably restricted additive aggregation principle allows us to say that adding more good things in a certain way is an improvement, and (iii) that objections to the argument from widespread value incomparability fail. It is now the majority view amongst philosophers and theologians that any world could have been better. This places the choice of which world to create into an especially challenging class of decision problems: those that are discontinuous in the limit. I argue that combining some weak, plausible norms governing this type of problem with a creator who has the attributes of the god of classical theism results in a paradox: no world is possible. Recent work in the philosophy of religion has resurrected Leibniz’s idea that there is a best possible world, perhaps ours. In particular, Klaas Kraay’s [2010] construction of a theistic multiverse and Nevin Climenhaga’s [2018] argument from infinite value theory are novel defenses of a best possible world. I do not think that there is a best world, and show how both Kraay and Climenhaga may be resisted. First, I argue that Kraay’s construction of a theistic multiverse can be resisted from (...) plausible assumptions about set theory. Next, I argue against the value-theoretic assumptions that underlie Climenhaga’s argument and show how to give an infinite value theory where there is no best world. (shrink)

Jim Sterba’s Is a Good God Logically Possible? looks to resurrect J. L. Mackie’s logical argument from evil. Sterba accepts the general framework that theists seeking to give a theodicy have favored since Leibniz invented the term: the search for some greater good provided or greater evil averted that would justify God in permitting the type and variety of evil we actually observe. However, Sterba introduces a deontic twist, drawing on the Pauline Principle (let us not do evil that good (...) may come) to introduce three deontic side constraints on God’s choice of action. He then splits the possible goods into four categories: first- vs. second-order goods, goods to which we have a right, and goods to which we do not have a right. He argues that his deontic constraints rule out each combination, thereby showing that no God-justifying good is on offer. To defuse the argument, I draw on a pair of ideas from Marilyn McCord Adams: (i) God is outside the bounds of morality, and (ii) God can defeat evils by incorporating them into an incommensurately valuable friendship with each human. Properly appreciated, these show that the new logical argument relies on a false premise that is not easily repaired. (shrink)

Quine taught us the difference between a theory’s ontology and its ideology. Ontology is the things a theory’s quantifiers must range over if it is true, Ideology is the primitive concepts that must be used to state the theory. This allows us to split the theoretical virtue of parsimony into two kinds: ontological parsimony and ideological parsimony. My goal is help illuminate the virtue of ideological parsimony by giving a criterion for ideological innocence—a rule for when additional ideology does not (...) count against parsimony. I propose the expressive power innocence criterion: if the ideology of theory one is expressively equivalent to that of theory two, then neither is ideologically simpler than the other. In its favor I offer the argument from accuracy, showing that any account of a theoretical virtue that is supposed to make theories that have it more likely to be true than theories that do not must respect it. Next I consider its ramifications, eliminating rival views and passing judgment on some arguments from parsimony that can be found in the literature. Finally, I consider two objections. First: I address an objection arising from the possibility of languages with a ‘primitive’ operator that allows us to list a theory’s primitives in the object-language. Second: I address an objection raised by Nelson Goodman against attempts to reckon simplicity by expressive power. Both objections fail. (shrink)

Molinists offer a tempting bargain: accept divine middle knowledge, and reap solutions to a number of philosophical/theological problems. The prime benefit we are meant to reap from middle knowledge is a solution to the problem of freedom and providence. I argue that they cannot deliver. Even if we make metaphysical and semantic assumptions that have generally been considered friendly to Molinism, Molinism is in danger of undermining divine providence altogether. A pragmatic account of referential communication is developed which presents an alternative to traditional Gricean accounts by focusing on cooperativeness and efficiency, rather than informativity. The results of four language‐production experiments support the view that speakers can be cooperative when producing redundant adjectives, doing so more often when color modification could facilitate the listener's search for the referent in the visual display (Experiment 1a). By contrast, when the listener knew which shape was the target, speakers did not produce redundant color (...) adjectives (Experiment 1b). English speakers used redundant color adjectives more often than Spanish speakers, suggesting that speakers are sensitive to the differential efficiency of prenominal and postnominal modification (Experiment 2). Speakers were also cooperative when using redundant size adjectives (Experiment 3). Overall, these results show how discriminability affects a speaker's choice of referential expression above and beyond considerations of informativity, supporting the view that redundant speakers can be cooperative. Der von ChatGPT generierte Text gibt wesentliche Inhalte in Bezug auf die Call Center Arbeit korrekt wieder, und weist beispielsweise die niedrige Autonomie in der Call Center Tätigkeit aus. Der Text muß aber durch prompten konkretisiert werden. Diese Arbeitsteilung zwischen Mensch und KI weist darauf hin, dass bei zunehmendem Einsatz von generativer KI für berufliche Zwecke die Anforderungen an Menschen eher steigen.

In the last 30 years, the key issue in developmental Theory of Mind has been if and when children are capable of representing false beliefs. Moving away from this research question, the aim of this study was to investigate the role of attentional processes in false-belief tasks. We focused on the design of the test phase and investigated two factors that may be critical for 3-year-old children’s success: the form of the wh-question and the salience of the target object. The (...) results of two experiments confirmed that 3-year olds are able to explicitly choose the correct answer in a false-belief task provided that they are allowed to focus on the protagonist throughout the task. The salience of the target object, however, was a critical factor in the design of the test phase, as increasing it had a negative effect on children’s performance. These results suggest that the experimental record of the last 30 years may be skewed since standard false-belief tasks do not control for the relative salience of the wrong response, potentially hindering the performance of children under 4. We conclude that a careful investigation of performance factors in false-belief tasks has the potential to reveal deep insights into the development of Theory of Mind skills, even if not directly focused on children’s representation of beliefs. The aim of this article is to theorize how materials can play an active, constitutive, and causally effective role in the production and sustenance of cultural forms and meanings. It does so through an empirical exploration of the Museum of Modern Art of New York (MoMA). The article describes the museum as an “objectification machine” that endeavors to transform and to stabilize artworks as meaningful “objects” that can be exhibited, classified, and circulated. The article explains how the extent to which (...) the museum succeeds in this process of stabilization ultimately depends on the material properties of artworks and, more specially, on whether these behave as “docile” or “unruly” objects. Drawing on different empirical examples, the article explores how docile and unruly objects shape organizational dynamics within the museum and, through them, the wider processes of institutional and cultural reproduction. The article uses this empirical example to highlight the importance of developing a new “material sensibility” that restores heuristic dignity to the material within cultural sociology. (shrink)

This paper compares the concepts of “spirit” and “dialectic” in Hegel’s Phenomenology of Spirit and Kierkegaard’s The Sickness unto Death respectively. For this purpose, I delve into the way in which both philosophers understand these two concepts. The aim of this comparison is to detect whether there is some kind of relationship between the two concepts that could bring Hegel and Kierkegaard closer to each other.

In his work on the open future, Patrick Todd outlines three models of how to deal with future contingents. These models must answer two questions: one metaphysical, about what facts there are in the world; one semantic, about how to deal with sentences involving ‘will.’ Model 1 has a privileged timeline. Model 2 has an actual future timeline but leaves it indeterminate which timeline that is. Model 3 has no future timeline. All three give will-sentences a modal treatement, as a (...) box over available futures. I will argue that Todd’s second model has problems and should be improved. The first is that it denies what Todd labels as the basic metaphysical intuition behind open-futurism. The second is that indeterminacy about the facts that characterize the actual timeline breaks through into indeterminate identity. I propose a fix to model 2 eliminating its actual future and resolving an issue that arises in applying the neutral semantics Todd endorses to indeterminate sentences. This improved model, I suggest, may even compare favorably to Todd’s preferred model 3. (shrink)

This work analyzes how the internal point of view, which represents the perspective of the participant in the legal domain, can be understood within a Hartian framework. It critically examines how legal conventionalism has dealt with this issue. In particular, it criticizes the way in which contemporary conventionalists represent the perspective of participants in legal practice on the basis of cognitive mental states. It also criticizes the way in which they understand how the rule of recognition constitutes the practice. Language and Theory of Mind come together in communication, but their relationship has been intensely contested. I hypothesize that pragmatic markers connect language and Theory of Mind and enable their co-development and co-evolution through a positive feedback loop, whereby the development of one skill boosts the development of the other. I propose to test this hypothesis by investigating two types of pragmatic markers: demonstratives and articles. Pragmatic markers are closed-class words that encode non-representational information that is unavailable to consciousness, but (...) accessed automatically in processing. These markers have been associated with implicit Theory of Mind because they are used to establish joint attention and mark shared knowledge. Here I develop a theoretical account of how joint attention is the basis for children’s later tracking of common ground. The developmental path from joint attention to common ground parallels language change, with demonstrative forms giving rise to definite articles. This parallel opens the possibility of modelling the emergence of Theory of Mind in human development in tandem with its routinization across language communities and generations of speakers. I therefore propose that, in order to understand the relationship between language and Theory of Mind, we should study pragmatics at three parallel timescales: during language acquisition, language use, and language change. Ascriptivists such as H.L.A. Hart, J.L. Austin, and Joel Feinberg defended a conceptual link between agency and normativity by putting forward the thesis that the attribution of an action is also an attribution of responsibility. This thesis has been heavily criticised for not providing an accurate model of what is signified by action statements and attributions of responsibility. In this chapter, I explore two ways of supporting it philosophically. The first is based on the constitutivist view, developed by Philippa Foot (...) and Michael Thompson, according to which the concept of agency is dependent on the concept of life-form. The second is founded on the Hegelian idea of recognition as part of the human form of life. According to this second idea, recognition shows how the sociality of agency creates the conditions for normativity. It is argued that the sum of both strategies makes it possible to explain some basic normative notions. The result is a weak social constitutivism that shows how the interpersonal meaning of our actions makes us responsible for them and allow us to build the normative landscape. (shrink)

Those who wish to resist this conclusion must identify the harm of death. But not any old harm will do. In order to resist both the claim that death is not harmful and the claim that our standard reactions to it (...) are irrational, we must identify a harm associated with death that rationalizes our standard reactions. We can divide the potential harm properties death might have along two axes: intrinsic/extrinsic and instrumental/final. This gives us four places to search for the harm of death. In standard Relevance Theory, hyperbole and metaphor are categorized together as loose uses of language, on a continuum with approximations, category extensions and other cases of loosening/broadening of meaning. Specifically, it is claimed that there are no interesting differences between hyperbolic and metaphorical uses. In recent work, we have set out to provide a more fine-grained articulation of the similarities and differences between hyperbolic and metaphorical uses and their relation to literal uses. On présente, en premier lieu, le débat actuel sur l’image dans le cadre de cette Bildwissenschaft. En second lieu, on expose les principaux moments de la réception de Jonas dans ledit contexte et on analyse les positions fondamentales de Jonas à propos de l’image et de l’imagination. Enfin, on évalue les avancées et les limites de la réception de Jonas (...) et on prend en considération quelques positions jonassiennes qui peuvent représenter un apport au débat actuel sur l’image. Die Fallbeispiele zeigen die vielfältigen Veränderungen auf, die durch Digitalisierung und den Übergang zum Homeoffice entstehen. In Bezug auf das Lernen deuten die Analysen in allen Fällen auf positive Effekte hin, die aus den veränderten Arbeitsmerkmalen resultieren. So wird berichtet, dass die vermehrte Nutzung digitaler Technologien die Aneignung von neuen Fähigkeiten erfordert, was sich in der gesteigerten wahrgenommenen Komplexität und Aufgabenvielfalt widerspiegelt.

Sandra Field, Jeffrey Flynn, Stephen Macedo, Longxi Zhang, and Martin Powers discussed Powers’ book China and England: The Preindustrial Struggle for Social Justice in Word and Image at the American Philosophical Association’s 2020 Eastern Division meeting in Philadelphia. The panel was sponsored by the APA’s “Committee on Asian and Asian-American Philosophers and Philosophies” and organized by Brian Bruya.

El 10 de octubre de 2016 se celebró, en la Facultad de Filosofía de la Universidad Complutense, un encuentro titulado Ramón enseñó en público su Arte - Raimundus Artem suam publice legit. Coloquio 700 aniversario de Ramon Llull, auspiciado por el Departamento de Filosofía y Sociedad (UCM), y organizado por José Luis Villacañas y José Higuera Rubio. En el marco de esa jornada, José Luis Villacañas sugirió la posibilidad de publicar los resultados de este encuentro en una entrega especial (...) de la revista ASHF, y encargó a los editores del monográfico un estudio bibliográfico de la obra de Llull y de la historia del lulismo. Debido al gran número de compromisos asumidos durante el aniversario luliano (2015-2016) algunos de los participantes de aquella reunión postergaron su contribución. Por lo tanto, ofrecemos en este número especial los resultados del coloquio, enriquecidos con otras aportaciones que surgieron en el contexto del aniversario luliano celebrado en Santa fe de Bogotá durante la exposición bibliográfica que la Biblioteca Nacional de Colombia dedicó a la figura de Llull y a las ediciones que conserva de su obra recogidas por las bibliotecas coloniales neogranadinas. La convergencia de estos trabajos y de sus autores ha tomado algún tiempo, percance agravado por las contingencias ocurridas el año anterior. Sin embargo, esperamos que este volumen permita al lector aproximarse tanto a la obra luliana como a su variada y prolongada recepción. (shrink)

Thomas Aquinas wrote a text later known as Quaestio de attributis and ordered it inserted in a precise location of his Commentary on the Sentences of Peter Lombard more than a decade after composing this work. Aquinas assigned exceptional importance to this text, in which he confronts the debate on the issue of the divine attributes that swept the most important centres of learning in 13th Century Europe and examines the answers given to the problem by the representatives of the (...) four mainstream schools of his time: the Greek mystic Dionysius Areopagita, the Latin Saint Anselm of Canterbury, the Jewish rabbi Moses Maimonides and the Muslim philosopher Ibn Sina. This in-depth study of Thomas Aquinas’ Quaestio de attributis (In I Sent., d. 2, q. 1, a. 3) binds together the findings of previous research on the unique history of this text by reconstructing the historical circumstances surrounding its composition, shows that the Quaestio contains Aquinas’ final answer to the dispute on the divine attributes, and thoroughly examines his interpretation of Maimonides’ position on the issue of the knowledge of God by analysing this and other texts related to it chronologically and doctrinally. The examination of the Quaestio reveals the background of Thomas Aquinas’ renewed interest in Maimonides’ position on the issue and brings to light elements of Aquinas’ interpretation that are absent from his earlier references to Maimonides. Moreover, the chronological and doctrinal connection of the Quaestio de attributis to other Thomistic works with explicit references to Maimonides enables a reconstruction of his comprehensive approach to Maimonides’ teaching on the possibility and extent of the knowledge of God in the Guide of the Perplexed and highlights the place of Maimonides’ philosophical teachings in Thomas’ own thought in issues like "Being" as the proper name of God, the multiplicity of the divine names, the beatific vision in the afterlife, the causes that prevent the instruction of the multitude in divine matters and the role of faith and prophecy in the acquisition of the true knowledge of God in this life. The last chapter examines the reasons behind Aquinas’ silencing of Maimonides’ name when introducing his Five Ways for the knowledge of the existence of God, in spite of the evident relation between these and Maimonides’ Four Speculations. The study is completed with an extensive appendix that includes the text of the Quaestio de attributis with an English translation and the critical edition of several chapters of the 13th Century Latin translation of the Guide of the Perplexed known as Dux neutrorum. That a constitution should express the will of 'the people' is a long-standing principle, but the identity of 'the people' has historically been narrow. Women, in particular, were not included. A shift, however, has recently occurred. Women's participation in constitution-making is now recognised as a democratic right. Women's demands to have their voices heard in both the processes of constitution-making and the text of their country's constitution, are gaining recognition. Campaigning for inclusion in their country's constitution-making, women have adopted innovative (...) strategies to express their constitutional aspirations. This collection offers, for the first time, comprehensive case studies of women's campaigns for constitutional equality in nine different countries that have undergone constitutional transformations in the 'participatory era'. Against a richly-contextualised historical and political background, each charts the actions and strategies of women participants, both formal and informal, and records their successes, failures and continuing hopes for constitutional equality. This article examines the application of the ought‐implies‐can principle in the legal domain, especially in the relationship between obligations and responsibility. It addresses the challenge of cases in which an agent cannot do what is required of her, and yet it seems plausible to say that she has an obligation. To deal with these cases, two parallel distinctions are made: between rules of conduct and rules of imputation, and between doings and things done. It is proposed that these distinctions show (...) that the principle operates in two different but complementary ways: as part of prescriptive relations and as part of responsibility practices. It has been generally assumed in the Theory of Mind literature of the past 30 years that young children fail standard false-belief tasks because they attribute their own knowledge to the protagonist. Contrary to the traditional view, we have recently proposed that the children's bias is task induced. This alternative view was supported by studies showing that 3 year olds are able to pass a false-belief task that allows them to focus on the protagonist, without drawing their attention to the (...) target object in the test phase. For a more accurate comparison of these two accounts, the present study tested the true-belief default with adults. Four experiments measuring eye movements and response inhibition revealed that adults do not have an automatic tendency to respond to the false-belief question according to their own knowledge and the true-belief response need not be inhibited in order to correctly predict the protagonist's actions. The positive results observed in the control conditions confirm the accuracy of the various measures used. I conclude that the results of this study undermine the true-belief default view and those models that posit mechanisms of response inhibition in false-belief reasoning. Alternatively, the present study with adults and recent studies with children suggest that participants' focus of attention in false-belief tasks may be key to their performance. (shrink)

THIS ESSAY EXPLORES THE POSSIBILITIES FOR RETRIEVING THE CONCEPT OF moral cooperation with evil for Christian social ethics. It begins with an exploration of the history of the concept and then argues that while discussions of social sin in political and environmental ethics correctly identify the problem of complicity, they fail to provide a way to distinguish among competing goods.
