Resumen: Durante la comisión de un crimen, testigos o víctimas, expuestos al habla del agresor pueden ser llamados, en forma posterior, a reconocer la voz de quien se sospecha es el autor del delito, con el fin de establecer si ellos la reconocerían como la voz del delincuente. Un ejemplo de esta situación, donde se vio involucrado el testimonio de testigos auditivos, fue durante el proceso del caso de Emilio Berkhoff, el joven universitario que fue declarado culpable de los delitos (...) de porte ilegal de armas y municiones y condenado a cinco años y un día de cárcel. El caso no estuvo exento de cierta controversia debido a las declaraciones públicas del imputado sobre supuestas violaciones al debido proceso. En este trabajo se revisa el procedimiento ocupado para la recolección de la evidencia auditiva a la luz de los criterios más ampliamente compartidos sobre la materia.: During the commission of a crime, witnesses or victims, exposed to the speech of the aggressor can be called, later, to recognize the voice of the person suspected of being the perpetrator of the crime, in order to establish whether they would recognize it as the voice of the offender. An example of this situation, where the testimony of hearing witnesses was involved, was during the case of Emilio Berkhoff, the young university student who was found guilty of the crimes of illegal bearing of arms and ammunition and sentenced to five years and one day in jail. The case was not exempt from some controversy due to the public statements of the accused about alleged violations of due process. In this paper we review the procedure used to collect the auditory evidence in light of the most widely shared criteria on the subject. (shrink)

Resumen: El objetivo de este trabajo es describir la situación actual y las proyecciones de la comparación forense de la voz en Chile, a la luz de los estándares internacionales que se enfocan en la producción de evidencia confiable, que pueda ser utilizada en los tribunales de justicia. Para ello, en principio, se dan a conocer los fundamentos científicos que caracterizan esta rama de las ciencias forenses y, luego, sobre esa base se analiza y comenta la situación de Chile y (...) sus proyecciones, tanto en la práctica como en la investigación forense. Abstract: The objective of this work is to describe the current situation and the projections of forensic voice comparison in Chile, in the light of international standards that focus on the production of reliable evidence that can be used in the courts of justice. To do this, first, the scientific foundations that characterize this branch of forensic sciences are disclosed and, then, on that basis, the situation in Chile and its projections are analyzed and discussed, both in practice and in the forensic research. Resumen Auditores chilenos no entrenados y sin conocimientos del alemán deben identificar dentro de una secuencia de voces en alemán la voz de una mujer alemana que habló previamente en español con un retardo de 2 horas. Los enunciados fueron emitidos por estudiantes alemanas nativas de la Universität Regensburg. Los resultados muestran que los auditores identifican la voz original, pero con imprecisión al otorgarle, dentro de una escala de 1 a 7, el mayor puntaje a la voz objetivo por sobre (...) las demás, pero con un promedio general de 6,1. Esto refuerza la idea de que la evidencia auditiva solo debe tener un valor orientativo. El presente texto se basa en un manuscrito presentado en el congreso INGEACUS 2010 celebrado en Valdivia, Chile.Untrained Chilean auditors and without knowledge of German must identify, within a sequence of German voices, the voice of a German woman who previously spoke in Spanish with a delay of 2 hours. The statements were spoken by native German students from the University of Regensburg. The results show that the auditors identify the original voice, but inaccurately, by giving, within a scale of 1 to 7 the highest score to the target voice above the others, but with an overall average of 6.1. Consequently, this book will be ideal for a wide-range of upper level undergraduate and postgraduate courses. The author interprets consciousness as a property that can be possessed by many creatures lacking a language faculty and comprises all of the following: awareness of the surrounding world; awareness of the self as an entity; and awareness of such things as thoughts and feelings. He argues that a biological approach can achieve both the necessary conceptual clarifications and a joint explanation of these divisions of awareness in terms of just two accurately defined concepts of 'internal representation' and two empirically supported assumptions about the functional architecture of a specific set of brain processes. Despite this striking simplicity, his model covers these divisions of awareness both as objective faculties of the brain and as subjective experience. To cover the essence of what is commonly meant by the word ‘consciousness’, and to avoid confusion through a selective or theoretically biased interpretation of that word, the paper addresses the dimensions of awareness which the word denotes according to the dictionaries of the English language, viz., an awareness of the surrounding (...) world, of the self, and of one's thoughts and feelings. An increasing number of learning goals refer to the acquisition of cognitive skills that can be described as ‘resource-based,’ as they require the availability, coordination, and integration of multiple underlying resources such as skills and knowledge facets. However, research on the support of cognitive skills rarely takes this resource-based nature explicitly into account. This is mirrored in prior research on mathematical argumentation and proof skills: Although repeatedly highlighted as resource-based, for example relying on mathematical topic knowledge, methodological knowledge, mathematical strategic (...) knowledge, and problem-solving skills, little evidence exists on how to support mathematical argumentation and proof skills based on its resources. To address this gap, a quasi-experimental intervention study with undergraduate mathematics students examined the effectiveness of different approaches to support both mathematical argumentation and proof skills and four of its resources. Based on the part-/whole-task debate from instructional design, two approaches were implemented during students’ work on proof construction tasks: (i) asequential approachfocusing and supporting each resource of mathematical argumentation and proof skills sequentially after each other and (ii) aconcurrent approachfocusing and supporting multiple resources concurrently. Empirical analyses show pronounced effects of both approaches regarding the resources underlying mathematical argumentation and proof skills. However, the effects of both approaches are mostly comparable, and only mathematical strategic knowledge benefits significantly more from the concurrent approach. Regarding mathematical argumentation and proof skills, short-term effects of both approaches are at best mixed and show differing effects based on prior attainment, possibly indicating an expertise reversal effect of the relatively short intervention. Data suggests that students with low prior attainment benefited most from the intervention, specifically from the concurrent approach. A supplementary qualitative analysis showcases how supporting multiple resources concurrently alongside mathematical argumentation and proof skills can lead to a synergistic integration of these during proof construction and can be beneficial yet demanding for students. Although results require further empirical underpinning, both approaches appear promising to support the resources underlying mathematical argumentation and proof skills and likely also show positive long-term effects on mathematical argumentation and proof skills, especially for initially weaker students. Following these ideas, Borges weaves several narratives in which the infinite and the absolute are discussed. An example of such narratives is the collection of stories compiled under the title The Aleph, which opens with "The Immortal" and closes with the story that gives the collection its title. The objective of this paper is to study "The Immortal" under the Cantorian lens to discuss one particular absolute, the self, and to suggest that it is impossible to establish a final vocabulary, or a definite definition, about this topic. This impossibility, Borges proposes, is in part due to the apparent finitude of language while at the same time the fallible attributes of human memory also is crucial when it comes to defining anything. However, as the ironist Borges is, he is capable of providing through "The Immortal" a re-description of these issues by means of a transfinite language that resolves some paradoxes while at the same time reveals others. By this way of writing, I propose, Borges fosters the continuation of the dialogue among the different disciplines. Though I will center my analysis on "The Immortal", to develop these ideas I also revisit other stories contained in The Aleph departing from a theoretical approach rooted in the philosophy of language. At present, there are at least two set theories motivated by quantum ontology: Décio Krause’s quasi-set theory (Q) and Maria Dalla Chiara and Giuliano Toraldo di Francia’s quasi-set theory (QST). Recent work [Jorge-Holik-Krause, 2023] has established certain links between QST and Pawlak’s rough set theory (RST), showing that both are strong candidates for providing a non-deterministic semantics of N matrices that generalizes those based on ZF. In this work, we show that the new atomless quasi-set theory Q^− , recently (...) introduced to account for a quantum property ontology [Krause-Jorge, 2024], has strong structural similarities with QST and RST. We study the level of extensionality that each theory presents, its relation to the Leibniz principle and the rigidity property. We believe that developing common features among these three theories can motivate common fields of research. By revealing shared structures, the developments of each theory can have a positive impact on the others. (shrink)

This is the first book-length study of Descartes's metaphysics to place it in its immediate historical context, the Late Scholastic philosophy of thinkers such as Suárez against which Descartes reacted. Jorge Secada views Cartesian philosophy as an 'essentialist' reply to the 'existentialism' of the School, and his discussion includes careful analyses and original interpretations of such central Cartesian themes as the role of scepticism, intentionality and the doctrine of the material falsity of ideas, universals and the relation between sense (...) and understanding, causation and the proofs of the existence of God, the theory of substance, and the dualism of mind and matter. Jorge Portilla criticizes the practicality of sociological notions of community, which conceive of it as an “organic association” in which one finds oneself at birth, and binds one “by a solidarity of which [one] is not the author,” by an “unconscious emotional ground” of those who make it up. These conceptions seem to think of society in terms of its instrumental reality, or lack thereof, and thus do not reflect social reality. He suggests that one think of community in (...) its everydayness, or pre-ontologically. Ultimately, for Portilla, the only account of community that resonates with the Mexican experience is one in which the community, like a person, has a face, which is responsive and can be held accountable. In this sense, the Mexican is neither a collectivist nor an individualist about community, since he seeks a responsive concept of community, a dialogical community. (shrink)

This article considers some scientific questions addressed, with varying degrees of depth and scope, in the literature of Jorge Luis Borges. We present nine texts commented and scrutinized in their scientific essence (The fearful sphere of Pascal, The library of Babel, Tlön, Uqbar, Orbis Tertius, The secret miracle, The Aleph, Funes the memorious, The garden of forking paths, The house of Asterion, and The perpetual race of Achilles and the tortoise) advancing in in some cases new conjectures and observations (...) to interpret and contextualize these subjects within the Borgean stories, as an invitation for follow-up analysis of the work of the Argentinean writer. We show that Borges can be considered a singular case of erudite fusion that does not separate human and scientific aspects, although his understanding and familiarity with the latter was actually quite shallow. In a quite uncommon fashion, Borges based a large part of his texts on fantastic possibilities suggested to him by Mathematics, Metaphysics and Sciences as the stunts for a free literary creation, within a structured form and a style we could call “self-consistent alternative realities”. This paper uses tools of philosophical analysis critically to examine accounts of the nature of racism that have recently been offered by writers including existentialist philosopher Lewis Gordon, conservative theorist Dinesh D'Souza, and sociologists Michael Omi and Howard Winant. These approaches, which conceive of racism either as a bad-faith choice to believe, a doctrine, or as a type of 'social formation', are found wanting for a variety of reasons, especially that they cannot comprehend some forms of racism. I propose an (...) account that conceives racism chiefly as a motivational/volitional matter, in short, as a form of moral viciousness. I show how this approach offers a unified account that comprises inter alia individual and institutional racism, expressed and unexpressed racism. I point out advantages that my view has over Thomas Schmid's somewhat similar suggestion, and use the account to examine a number of claims made about racism by H. L. Gates, Jr, Elizabeth Young-Bruehl, Gertrude Ezorsky, and others. Finally, I defend this approach from the general criticism that Benjamin DeMott has levelled against any effort so to understand racism. In the 10 years after the launch of the United Nations Global Compact (GC), there have been very few empirical assessments of the initiative in the academic literature. In this study, drawing from institutional theory and the resource-based view of the firm, we examine motivations of business participants to adopt the GC principles in the Spanish context. Using survey data from Spain – the country reporting the highest volume of business participants in the GC – we find that external institutional (...) forces as well as internal organisational resources shape motivations for adopting GC principles. In particular, we find that early and late adopters are motivated similarly by the perceived opportunity of achieving image gains, while late adopters are motivated more by economic gains than early adopters. We further find that regardless of the extent of internal intangible resources possessed, firms are similarly motivated by economic gains. The results also show that companies with more intangible resources are motivated more by image gains than those with fewer resources. Our findings indicate that contrary to its earlier days, economic gains have emerged as an important motivator for the adopters of the GC principles with image gains still being an important motivator. The latter, including being itself, were known as the transcendentals in the Middle Ages and gave rise to the much disputed doctrine of the transcendentals. This article explores the main tenets of the doctrine and the difficulties that they face, the reasons why scholastic authors were interested in these issues, and the origins of the doctrine.

In his contribution, Jorge L. Rodríguez criticizes the position that Marmor has defended in previous works. Basically the criticism is that, according to Rodríguez, it cannot be the case that a convention is constitutive, and therefore the rule of recognition cannot be of this type. According to this author, the concept of convention employed by Marmor is too weak: it leads to consider a rule as conventional even though all the members of a community follow it because they consider (...) that it is correct, and a rule may not be considered as conventional even though everyone is following it just because others follow it. Moreover, it seems to be pointless to speak of constitutional conventions inasmuch as, according to Rodríguez, the arbitrary character of conventions is incompatible with the constitutive character of a rule. As a consequence, Marmor’s view would be affected by an internal inconsistency because, following his own definitions, the constitutive character of the rule of recognition is incompatible with its conventional character. Este artículo trata sobre dos temas: cómo se establece el canon filosófico y las razones por las cuales la filosofía latinoamericana es generalmente excluida tanto del canon de la filosofía occidental como del canon de la filosofía a nivel mundial. El segundo tema permite ilustrar los problemas que surgen en el contexto del primero y proporciona una respuesta a ellos. El artículo sostiene que varias teorías que se proponen explicar la formación del canon y la exclusión de ciertos filósofos del (...) canon occidental en particular, no hacen justicia a la situación porque ignoran el papel de la tradición en el proceso. Más específicamente, se ilustra cómo la tradición explica por qué la filosofía latinoamericana tiende a estar ausente tanto del canon filosófico occidental como del mundial. This article discusses two topics: how the philosophical canon is established and the reasons why Latin American philosophy is generally excluded both from the canon of western philosophy and the canon of world philosophy. The second topic illustrates the problems that come up in the context of the first and provides answers to them. The article argues that several theories that purport to explain the formation of the canon and the exclusion of certain philosophers from the western philosophical canon in particular, do not do justice to the situation because they ignore the role of tradition in the process. More specifically, the article shows how tradition explains why Latin American philosophy tends to be absent both from the canon of western philosophy and the world canon of philosophy. (shrink)
