Legal relationships can be found across all levels of law and in all fields of law. The present volume takes up this observation by establishing the legal relationship as a key concept, a fundamental category of legal system building, and a doctrinal framework of legal order. However, the approach, based on a legal relationship, encounters deeply rooted reservations in parts of constitutional law scholarship, extending to concerns about an erosion both of the state and state authority. The ongoing debates are (...) the subject of a German-Austrian research project that examines positive law with regard to the existence and significance of legal relationships. Hartmut Rosa advances an account of the temporal structure of society from the perspective of critical theory. He identifies three categories of change in the tempo of modern social life: technological acceleration, evident in transportation, communication, and production; the acceleration of social change, reflected in cultural knowledge, social institutions, and personal relationships; and acceleration in the pace of life, which happens despite the expectation that technological change should increase an individual's free time. According to Rosa, both the structural and (...) cultural aspects of our institutions and practices are marked by the "shrinking of the present," a decreasing time period during which expectations based on past experience reliably match the future. When this phenomenon combines with technological acceleration and the increasing pace of life, time seems to flow ever faster, making our relationships to each other and the world fluid and problematic. It is as if we are standing on "slipping slopes," a steep social terrain that is itself in motion and in turn demands faster lives and technology. As Rosa deftly shows, this self-reinforcing feedback loop fundamentally determines the character of modern life. (shrink)

The problem of names of illnesses is both a problem of words and values that should address not only the classification of disorders, but also a fundamental question both for medical sciences and humanities: can psychiatric nosology and classifications fit with the ontological constitution of human beings? This paper aims to discuss the so-called “psychiatric object” and its language and it intends to provide a hermeneutical-phenomenological account to mental health. In doing so, the paper will firstly examine the “psychiatric object” (...) and its language; secondly, it will show the difference between taxonomy and ontology, both of interest for the psychiatric object; third, it will insist on the critique of the epistemological status of psychiatry conceived from a natural point of view following three main paths: a metaphysical one (Heidegger, Jaspers), a social one (Szasz, Foucault, Basaglia), and an ethical one (Laing). Finally, it will clarify why phenomenology and in particular hermeneutical-phenomenology can illuminate the understanding of the psychiatric object and its implications in a cultural context, in order to achieve a more humanistic psychiatry. The study “Psychoanalysis—its image and its public” intimates that common sense is increasingly informed by science. But common sense asserts its autonomy and, in turn, may affect the trajectory of science. This is a process that leads to many differentiations—in common sense, in scientific innovation and in political and regulatory structures. Bauer and Gaskell's toblerone model of triangles of mediation provided a distillation of their reading of “La Psychanalyse.” Here it was argued that representations are multi-modal phenomena necessitating the (...) use of multiple methodologies.In this paper we briefly summarise these arguments and elaborate ways in which social representation theory can be considered a progressive research programme. “Progressive” because as the theory has developed it has extended the range and depth of its conceptual basis; it provides a new synthesis for the social scientific understanding of the phenomena of common sense and of representation; it acts as an antidote to the reductionism of public opinion and, finally, it is a stimulus to depart from disciplinary silos. The historian and religious scholar Ernst Ludwig Ehrlich (1921-2007) was among the most influential minds in the post-Shoah German-speaking Jewish world. In 1943, with the help of Christian friends, he escaped from Berlin to Switzerland, where as a student, he became a spokesman in Jewish-Christian dialogue. Hartmut Bomhoff narrates how despite the experience of expulsion, life in the underground, and flight, Ehrlich became a bridge-builder.

A German writer's aphoristic, poetic, and difficult reflections on Heidegger's Being and Time. There is a beyond of reason and unreason. It is the human psyche. —Positive Nihilism Like many German intellectuals, Hartmut Lange has long grappled with Heidegger. Positive Nihilism is the result of a lifetime of reading Being and Time and offers a series of reflections that are aphoristic, poetic, and (appropriately, considering his object of study) difficult. Lange begins with an abyss (“There is an abyss of (...) the finite. It is temporality”) and proceeds almost immediately to extremity: “The twentieth century was governed by psychopaths. They collapsed the boundaries of moral reason and refuted Kant's analysis of consciousness.” He reflects further: “But who shall punish whom? One man's virtue is another man's crime. Thus Hitler could feel unwaveringly, as he wiped out entire populations, the starry sky above him and the moral law within him, as stipulated by Kant.” He considers the concept of civilization (“misleading”; “how should one oppose the remedies of civilization to the egomania, the murderous appetites of such outright psychopaths as Stalin or Pol Pot?”), the act of thinking (a fata morgana), the psyche, and Heidegger's Dasein. Positive Nihilism can be considered a pocket companion to Being and Time. “Heidegger's understanding of Being is nihilistic,” Lange writes, and then explains his assertion. He draws on Kant, Nietzsche, Kierkegaard, and Shakespeare's Othello for supporting arguments and illustrations. “Everyone is possessed of the courage to have angst about death. The question is whether this courage necessarily secures those vital advantages Heidegger alleges”–that “self-understanding [is] the mental anticipation of death.” Lange wrestles with Heidegger's position, calling on Tolstoy, Georg Trakl, Herman Bang, and Heinrich von Kleist to argue against it. We should be interested in the future, if only because we will spend the rest of our lives in it. We have always related to the future in particular ways. Moreover, we evaluate imagined futures, and these evaluations affect the present, in which we already live together in anticipation, hope, expectation, or uncertainty - even resignation. Certain future scenarios require a concrete attitude from us, so that we must prepare ourselves and also consider the well-being of coming generations. Some broader (...) orientations of life already contain rather concrete notions of how we should relate to the future. Hartmut von Sass examines these four levels of factual, evaluative, normative, and implicative relations to the future in greater depth, to eventually ask what attitudes toward the future and accompanying emotions the Christian faith already embodies - and this in the face of concrete challenges of a present whose future has become fundamentally uncertain. Yet this undertaking encounters a theological reservation concerning questions of last and penultimate things. Therefore, the general and theologically related question of the future is bound up with a recovery of eschatological interests. The author first rejects the two traditional approaches that either understand Christian images of the future realistically as outstanding facts or that weaken them by declaring everything a pure or impure symbol. The moments of truth in both approaches are preserved, while their pitfalls are avoided by situating eschatology within a practice-theoretical framework. Hartmut von Sass thus asks how the future - as eternal life, God's kingdom, and resurrection into a new life - emerges through and within the practices of faith. In doing so, it becomes clear what strong assumptions faith carries in this regard: despair is suggested as a form of 'sin,' whereas hope appears as one of the virtuous elements of faith itself. Finally, it is to be asked in what sense this promising faith might be linked with corresponding political concerns. Likewise, it is to be considered how God and the future relate to each other if one takes seriously the well-founded assumption that God himself has an open, still possible, and thus not predetermined future. Main description: Untersucht wird das Spannungsverhältnis zwischen einer Theorie der Interpretation, wie sie von den Dialogfiguren vorgetragen wird, und der Praxis der Dichterauslegung, die in den fingierten Gesprächen von Platon inszeniert wird. Methodisch einer historisch reflektierten Hermeneutik des Dialogs verpflichtet, gewinnt die Analyse neue Einsichten zu Platons literarischem und philosophischem Selbstverständnis.

Während der größte Teil der Bevölkerung die kieferorthopädische Therapie, also die Veränderung der Zahn- bzw. Kieferstellung, als eine Behandlung betrachtet, die vor allem auf eine Verbesserung des Erscheinungsbildes zielt, sehen der kieferorthopädische und zahnärztliche Berufsstand sowie auch private und öffentliche Kostenträger in bestimmten Abweichungen von Zahn- oder Kieferstellungen eine Gefährdung der oralen Gesundheit und der Funktionsfähigkeit des Gebisses. Letztere Auffassung bestimmt das ärztliche Handeln in der Kieferorthopädie und begründet auch die Übernahme zumindest bestimmter Leistungen durch die gesetzlichen Krankenkassen. Anhand aktueller (...) wissenschaftlicher Erkenntnisse lassen sich jedoch in vielen Fällen keine (akuten oder potentiellen) gesundheitlichen oder essentiellen funktionellen Beeinträchtigungen und Risiken abweichender Zahnstellungen nachweisen. Ziel dieses Aufsatzes ist es, diesem Widerspruch nachzugehen. Im Folgenden werden wir aufzeigen, welche Faktoren die Anbieter kieferorthopädischer Leistungen beeinflussen, welches die entscheidenden Gründe und Grundlagen für die Behandlung sind und an welchen Kriterien sich die Leistungsübernahme durch die Krankenkassen orientiert. Dabei wird deutlich werden, dass die formalen Kriterien von Behandlung und Kostenübernahme, die tatsächliche Behandlungs- und Kostenerstattungspraxis, die Erwartungen derjenigen, die Behandlungsleistungen in Anspruch nehmen und der aktuelle Stand der Forschung zu erwartbaren Funktionsbeeinträchtigungen durch Zahnstellungsvariationen nicht zwanglos zu vereinbaren sind. Erforderlich erscheint ein interdisziplinärer normativer Diskurs über die Frage, wie die diagnostizierten Spannungen aufzulösen wären. Als Anregung für einen solchen Diskurs werden wir im Ausblick alternative Lösungsstrategien vorstellen. (shrink)

If we are to find the criteria for critical analyses of social arrangements and processes not in some abstract, universalist framework, but from the guiding ‘self-interpretations’ of the societies in question, as contemporary contextualist and ‘communitarian’ approaches to social philosophy suggest, the vexing question arises as to where these self-interpretations can be found and how they are identified. The paper presents a model according to which there are four interdependent as well as partially autonomous spheres or ‘levels’ of socially relevant (...) self-interpretation that have to be taken into account equally in order to provide a sound basis for social and political criticism. Thus, it is from the tensions and incoherences between (A) social ideas and doctrines, (B) social institutions and practices, (C) individual beliefs and convictions, and (D) body-practices and habits that social pathologies can be identified and possible solutions can be envisaged. This chapter is a reprint of a book review of the new translation of _The Second Sex, which_ raises questions about its success in rendering Beauvoir’s thought into English. Siding with critical scholars like Toril Moi, Bauer argues that Borde and Malovany-Chevallier’s translation is disappointing. The translation obscures Beauvoir’s philosophical insights by too often sacrificing readability and clear renditions of Beauvoir’s reasoning to word-by-word translations of Beauvoir’s long sentences and uncommon stylistic choices. This is due to the inexperience of (...) the translators, who, Bauer claims, had never before translated such French theoretical writing and had no experience dealing with the “conceptual and rhetorical challenges” of _Le deuxiéme sexe_. Overall, Bauer’s review echoes the long history of the discounting of and underappreciation of feminist work as reflected in translation practices that assume women’s interests, writing, and scholarship to be tangential to scholarly research. In der Theologie wird Habermas oftmals mit einer gewissen Skepsis begegnet, da seine Einstellungen gegenuber der Religion durchaus kontrovers sind. Sie haben sich bis in die Gegenwart hinein stetig weiterentwickelt, so dass sein Werk insgesamt bedeutende Potentiale hinsichtlich der gesellschaftlichen Rolle von Religion birgt - und daruber hinaus auch hinsichtlich derjenigen von Bildung. Daniel Tobias Bauer rekonstruiert beide Entwicklungslinien bis in die Gegenwart hinein und uberfuhrt sie in den praktisch-theologischen Diskurs. Dies geschieht methodisch anhand Habermas' These, dass bedeutende geistesgeschichtliche (...) Begriffe ursprunglich in der Religion verankert waren und nur aus dieser Verwurzelung heraus gegenwartig angemessen zu verstehen sind.
