‘The day of the Lord is already here’ (2 Thess 2:2b) – A key problem to the understanding of the second letter to the Thessalonians. 2 Thessalonians 2:2b, that is, the words ἐνέστηκεν ἡ ἡμέρα τοῦ κυρίου are a crux interpretum. At the same time their interpretation is crucial for the overall understanding of 2 Thessalonians. Does this text offer a view of early Christian eschatology totally different from Paul’s or is it compatible to what we read for example in (...) 1 Thessalonians? The article deals critically with two recent monographs by Norbert Baumert and Maria-Irma Seewann who offered a new interpretation of the passage according to which 2 Thessalonians 2:2 is not concerned with matters of Parousia, but with Christ’s presence in the community. It offers an overview of the development of the ‘Day of the Lord’ traditions in the Old Testament and Early Judaism and shows that Baumert and Seewann’s interpretation is untenable. After an analysis of the context of 2 Thessalonians 2:1–2 the article develops an own interpretation of 2 Thessalonians’ 2:2 in light of a parallel in Hippolyt’s Commentary on Daniel. The eschatology of 2 Thessalonians 2 finally, provides an argument for the text’s pseudepigraphy. (shrink)

In Kimber v. Thiokol Corp., 196 F.3d 1092, the U.S. Court of Appeals for the Tenth Circuit upheld a U.S. District Court's grant of summary judgment against an employee's claim that an employeroperated disability insurance plan, which offered different levels of compensation for disabilities due to mental and physical conditions, violated Title I of the Americans with Disabilities Act. The Court of Appeals found that the Thiokol plan administrator's interpretations of the plan were not arbitrary and capricious, and that the (...) plan's different treatment of disabilities caused by physical and mental conditions did not violate the ADA. The performance and the success of a group working as a team on a common goal depends on the individuals’ skills and the collective coordination of their abilities. On a perceptual level, individual gaze behavior is reasonably well investigated. However, the coordination of visual skills in a team has been investigated only in laboratory studies and the practical examination and knowledge transfer to field studies or the applicability in real-life situations have so far been neglected. This is mainly due to (...) the fact that a methodological approach along with a suitable evaluation procedure to analyze the gaze coordination within a team in highly dynamic events outside the lab, is still missing. Thus, this study was conducted to develop a tool to investigate the coordinated gaze behavior within a team of three human beings acting with a common goal in a dynamic real-world scenario. This team was a basketball referee team adjudicating a game. Using mobile eye-tracking devices and an indigenously designed software tool for the simultaneous analysis of the gaze data of three participants, allowed, for the first time, the simultaneous investigation of the coordinated gaze behavior of three people in a highly dynamic setting. Overall, the study provides a new and innovative method to investigate the coordinated gaze behavior of a three-person team in specific tasks. This method is also applicable to investigate research questions about teams in dynamic real-world scenarios and get a deeper look at interactions and behavior patterns of human beings in group settings. A theory of intergenerational justice consists in the study of the moral and political status of the relations between present and past or future people, more specifically, of the obligations and entitlements they can potentially generate. The challenges that justify talking about responsibilities between generations are myriad. And the disputes they prompt can focus on the past just as much as on the present, even though the fact that the human species has reached a state of technological progress that enables (...) it to have an irredeemable impact on the planet and perhaps even endanger future human existence tends to make concerns about the future more pressing. Debates on intergenerational justice are twofold. The first revolves around the issue of whether claims of justice across generations whose members' lifetimes do not necessarily overlap could be justified. And the second revolves around the specific conception of justice in play, that is, around the nature of the standard that must be applied as well as around the identification of the contents of the duties that present generations supposedly have vis-à-vis past or future generations. This survey article depicts the conceptual and argumentative framework in which these debates are set. It aims to outline certain of the main features shared by the most influential contemporary theories of intergenerational justice, and the problems inherent in them. It concludes by suggesting that, even though the idea of succeeding generations is merely an abstraction, there are specific empirical states of affairs that require different theoretical responses to intergenerational justice. This paper aims at answering some of the objections to the NIP’s criticism of the idea of rights of future persons. Those objections usually adopt different perspectives depending on how they understand differently the nature of the correlativity between rights and duties – some adopt a present-rights-of-future-persons view, others a future-rights-of-future-persons view, others a transitive present-rights-of-present-persons view, and others still an eternalist view of rights and persons. The paper will try to show that only a non-transitive present-rights-of-present-persons view can survive (...) the challenges posed by the notion of correlativity inherent in the NIP, and thus preserve rights language when discussing the future. This view is proved also more suitable for the legal and political realms, where policies and law-making are usually more concerned with present addressees and short term effects. (shrink)

This paper addresses several issues in argumentation theory. The over-arching goal is to discuss how a theory of analogical argument schemes fits the pragma-dialectical theory of argument schemes and argument structures, and how one should properly reconstruct both single and complex argumentation by analogy. I also propose a unified model that explains how formal valid deductive argumentation relates to argument schemes in general and to analogical argument schemes in particular. The model suggests “scheme-specific-validity” i.e. that there are contrasting species of (...) validity for each type of argument scheme that derive from one generic conception of validity. (shrink)

Hope as a virtue is an acquired disposition, shaped by reflection; as a civic virtue it must serve the good of the community. Ernst Bloch and Lord Buddha offer help in constructing such a virtue. Using a taxonomy developed by Darren Webb I distinguish open hope from goal-oriented hope, and use each thinker to develop the former. Bloch and Buddha are very different (and notoriously obscure; I do not attempt an exegesis). But they share a metaphysics of change, foundational for (...) making any sense of hope.Buddhism would seem to repudiate hope; it is a source of suffering (i.e., pain in living with reality). Seen more deeply, however, Buddhism offers material for a carefully limited virtue of hope: the habits of noticing good and acknowledging transience. This disposition, acquired through Buddhist practice among other ways, shields one against despair. The habit also frees up energy that would otherwise be wasted. Ernst Bloch gives us insight into how to use that energy, teaching us to value the yearning implicit throughout culture. Open hope becomes a civic virtue when it concerns civic matters; it can be threatened by hyperbolic discourse in political life. (shrink)

This paper shows Socratic elenchus as an efficient and effective way of modeling rational knowledge seeking. Like ordinary conversations, the elenctic exchanges in the dialogues presuppose a degree of autonomy on the part of its participants. Socrates’ line of questioning often seems pertinent to a particular interlocutor because he is well aware of the fact that the interlocutor has goals and ambitions or is reputed to be an expert at something. In turn, Socrates’ line ofquestioning reflects his own goals and (...) ambitions. In Alcibiades Major Socrates is trying to turn Alcibiades towards a greater awareness of his limitations. Plato’s dialogues also force readers to consider their own solutions to the topics introduced in them. Consequently, the autonomy of a dialogue’s participants requires that interpreters not exaggerate one aspect of a dialogue’s structural features at the expense of other aspects. (shrink)

The “paradox of deontology” depends partly upon ignoring the special responsibility each person has for her own actions, and partly upon ignoring the essential differences between refraining from X and persuading another to refrain. But only in part; the paradoxical situations schematized by Shaw can occasionally occur. When they do, his pragmatic defense of deontology is sound.

Why does Descartes give some propositions, most notably cogito, a privileged epistemic status? In the first part of the paper I consider, and reject, the standard account of the indubitability of cogito championed by, among others, Hintikka, Ayer, Slezak, and Frankfurt. After examining what I call the Cartesian regress, I invoke the fiction of a self-blind individual, close to the one originally introduced by Shoemaker, to give an alternative account of the indubitability of cogito. I argue that Descartes initially needs (...) to exempt the self-attribution of thought from the scope of Cartesian doubt, because an individual who is self-blind, and, so, cannot self-attribute thoughts, cannot treat propositions about the external world as dubitable. Self-regarding acts are frequently classified as non-moral; even more frequently, they are assumed to have less moral weight than parallel other-regarding acts. I argue briefly against the first claim, and at greater length against the second. Our intuitions about the lesser moral weight of self-regarding acts arise from imperfectly recognized, and morally relevant, differences between acts which are ordinarily described in misleadingly parallel phrases. ‘Love of self,’ for instance, and ‘love of another’ are not symmetrical attitudes, in spite of the (...) symmetrical grammar. More obviously, one cannot steal from, lie to, nor force oneself in the same way one can do these things to others. I conclude, therefore, that difference in moral weight never stems merely from a difference in the person concerned, but rather from differences between the actions themselves; furthermore, that whatever it is wrong to do to a willing other, it is wrong to do to oneself. Spinoza studies have paid little attention to the concept of justice for centuries. However, he refers to it quite often in different contexts, especially in his mature texts. More specifically, he defines it as synonymous with suum cuique tribuere, even though he fails to provide a reasonable account of how this traditional legal expression fits into his philosophical system. This article shows that there is a relevant philosophical dimension in Spinoza’s treatment of the suum cuique that emerges out of his (...) notion of equality. The main section identifies the connection between Spinoza’s references on justice as suum cuique and the different conceptions of equality that are inherent in his system (an ontological, a metaphysical, a productive (ethical), a legal, and a political equality). The conclusion tries to answer the question of whether such an understanding of the suum cuique as equality constitutes a theory of justice or not. (shrink)

The point of departure for this article is that the current white backlash over the use of the framing device “Black Lives Matter” is a correlate of the diminished capacity to make race-based claims fostered by neoliberal conceptions of race. The article attends to how President Obama, paradoxically, has deepened color-blind forms of racism and thus weakened the ability for grass-roots Black challenges to the discursive and political status quo. His implicit conception of whiteness as invisible, singular and of transcendent (...) power, is discussed as a theo-politics and assessed via two examples: the rhetoric he uses with Black audiences, and his foreign policy choices in Africa. This article hopes both to show that Obama's management of the complex conditions he inherited have not been fruitful for African Americans, the group that offered such unmitigated supported for his campaigns; and to inspire momentum against neoliberal ways of thinking about race and its concomitant color-blind whiteness. This essay argues that legal efficacy understood as existent binding force and as dominance of a system of coercion vis-à-vis competing systems is not strictly a matter of fact, but involves what can be termed justified normativity in a factual context. The argument is divided into four sections. The first three sections describe different dimensions of a normative concept of legal efficacy applied to legal systems: efficacy as persuasiveness, as indirect communication, and as constitutive obedience. The final section focuses on (...) the efficacy of individual norms and adds a new criterion – membership – which establishes a multi-layered test of efficacy. (shrink)

This book provides the missing theoretical link between Sraffa's Production of Commodities by Means of Commodities and Debreu's Theory of Value. Its thesis is that both classical and neoclassical value theory operate through arbitrage and speculation in the financial markets. Key among those markets is the bourse or stock market. Once a stock market is incorporated into general-equilibrium theory, the classical analysis of value and the neoclassical theory of price can be seen to possess the same mathematical structure. Thus the (...) theory of arbitrage pricing in financial markets is capable of bringing together the two great rival schools of economic thought. (shrink)
