A digital revolution is underway in which individuals on their computers, some working independently or in ad hoc collectives, and others as part of established organizations, are gathering and verifying information from online spaces that they believe contain evidence of human rights violations or international crimes such as war crimes, crimes against humanity, or genocide. Known commonly as digital investigators, citizen sleuths, or open source intelligence (OSI) researchers, this community of practice has expanded across major newspaper agencies (such as the (...) New York Times, the BBC and the Washington Post), human rights organizations (such as Amnesty International, Human Rights Watch and others), and national and international court systems (including United Nations Commissions of Inquiry and Fact-Finding Missions, and the International Criminal Court). In this article, we draw from our legal and sociological training to explore the role of power and humility in this quickly-emerging field of practice. Fundamentally, power and humility intersect with conceptions of ethics and responsibility but have too often been an afterthought to the intrigue of methodological possibilities and investigative outcomes. From who has access to digital open source investigative training to how investigations are designed to who are considered experts, this article posits that a failure to interrogate power asymmetries and an unwillingness to approach such research with appropriate humility can undermine the integrity and legitimacy of these investigations. Obtaining informed consent, an ethical obligation of nurses and other health care providers, occurs routinely when patients make health care decisions. The values underlying informed consent (promotion of patients’ well-being and respect for their self-determination) are embedded in the dominant American culture. Nurses who apply the USA’s cultural values of informed consent when caring for patients who come from other cultures encounter some ethical dilemmas. This descriptive study, conducted with Latino, Chinese and Anglo-American cancer patients in a large, public, west-coast (...) clinic, describes constraints on the informed consent process in a multicultural setting, including language barriers, the clinical environment, control in decision making, and conflicting desired health outcomes for health care providers and patients, and suggests some implications for nursing practice. The psychological and neurobiological processes underlying moral judgement have been the focus of many recent empirical studies1–11. Of central interest is whether emotions play a causal role in moral judgement, and, in parallel, how emotion-related areas of the brain contribute to moral judgement. Here we show that six patients with focal bilateral damage to the ventromedial prefrontal cortex (VMPC), a brain region necessary for the normal generation of emotions and, in particular, social emotions12–14, produce an abnor- mally ‘utilitarian’ pattern of (...) judgements on moral dilemmas that pit compelling considerations of aggregate welfare against highly emotionally aversive behaviours (for example, having to sacrifice one person’s life to save a number of other lives)7,8. In contrast, the VMPC patients’ judgements were normal in other classes of moral dilemmas. These findings indicate that, for a selective set of moral dilemmas, the VMPC is critical for normal judgements of right and wrong. Paul Appelbaum and colleagues propose four models of informed consent to research that deploys whole genome sequencing and may generate incidental findings. They base their analysis on empirical data that suggests that research participants want to be offered incidental findings and on a normative consensus that researchers incur a duty to offer them. Their models will contribute to the heated policy debate about return of incidental findings. Evidence on AI acceptance comes from a diverse field comprising public opinion research and largely experimental studies from various disciplines. Differing theoretical approaches in this research, however, imply heterogeneous ways of studying AI acceptance. The present paper provides a framework for systematizing different uses. It identifies three families of theoretical perspectives informing research on AI acceptance—user acceptance, delegation acceptance, and societal adoption acceptance. These models differ in scope, each has elements specific to them, and the connotation of technology acceptance thus (...) changes when shifting perspective. The discussion points to a need for combining the three perspectives as they have all become relevant for AI. A combined approach serves to systematically relate findings from different studies. And as AI systems affect people in different constellations and no single perspective can accommodate them all, building blocks from several perspectives are needed to comprehensively study how AI is perceived in society. This article defends the idea of applying principles of corrective justice to the matter of climate change. In particular, it argues against the excusable ignorance objection, which holds that historical emissions produced at a time when our knowledge of climate change was insufficient ought to be removed from the equation when applying rectificatory principles to this context. In constructing my argument, I rely on a particular interpretation of rectificatory justice and outcome responsibility. I also address the individualism objection by showing (...) why we should view states as relevant agents of climate change. This argument is built on the assumption that states are institutions set up to coordinate and regulate human interaction, so as to protect their citizens from the unwanted consequences of such interaction. Natural languages contain many layers of sequential structure, from the distribution of phonemes within words to the distribution of phrases within utterances. However, most research modeling language acquisition using artificial languages has focused on only one type of distributional structure at a time. In two experiments, we investigated adult learning of an artificial language that contains dependencies between both adjacent and non-adjacent words. We found that learners rapidly acquired both types of regularities and that the strength of the adjacent statistics (...) influenced learning of both adjacent and non-adjacent dependencies. Additionally, though accuracy was similar for both types of structure, participants’ knowledge of the deterministic non-adjacent dependencies was more explicit than their knowledge of the probabilistic adjacent dependencies. Within the growing developmental literature on children's testimonial learning, the emphasis placed on children's evaluations of testimonial evidence has shielded from view some of the more collaborative dimensions of testimonial learning. Drawing on recent philosophical work on testimony and interpersonal trust, we argue for an alternative way of conceptualizing the social nature of testimonial learning. On this alternative, some testimonial learning is the result of a jointly collaborative epistemic activity, an activity that aims at the epistemic goal of true belief, (...) but that does so by means of an irreducibly social process. The article explores the challenges of ensuring voluntary and informed consent which is obtained from potential research subjects in the north‐eastern part of Romania. This study is one of the first empirical papers of this nature in Romania. The study used a quantitative survey design using the adapted Quality of Informed Consent (QuIC) questionnaire. The target population consisted of 100 adult persons who voluntarily enrolled in clinical trials. The informed consent form must contain details regarding the potential risks and benefits, (...) the aim of the clinical trial, study design, confidentiality, insurance and contact details in case of additional questions. Our study confirmed that although all required information was included in the ICF, few clinical trial participants truly understood it. We also found that the most important predictive factor for a good subjective and objective understanding of the clinical trial was the level of education. Our study suggests that researchers should consider putting more effort in order to help clinical trials participants achieve a better understanding of the informed consent. In this way they will ensure that participants’ decision‐making is meaningful and that their interests are protected. (shrink)

Background Little is known about how financial influences affect medical decision-making and may challenge the primacy principle of patient welfare. First qualitative results in cancer medicine identified specific decision-making situations that can be influenced by financial considerations and characterized by the type of their financial influence. These qualitative findings provide evidence that these influences are largely shaped by reimbursement strategies. Nevertheless, questions on how reimbursement strategies affect medical decision-making, and what their normative dimension is regarding the primacy principle, remain unclear. (...) Methods To address the research questions, we conducted an empirical qualitative content analysis according to Kuckartz and an ethical analysis using Ives’ framework of reflexive balancing following the “standards of practice in empirical bioethics research” and the “framework for empirical bioethics research projects”. Results The empirical analysis identified six financially incentivized actions: to refrain, to reduce, to deflect, to privilege, to prioritize, and to withhold. These were linked to pre-existing definitions from the normative context: rationing, prioritization, deprioritization, and selection. The ethical analysis showed that a lack of transparency about whether reimbursement strategies implement normative priorities or merely regulate costs makes it difficult to assess their compatibility with the primacy of patient welfare. Conclusions The empirical and ethical analyses demonstrate that financial influences, as embedded in reimbursement strategies, can challenge the primacy principle by shaping which options appear feasible or appropriate in practice. Greater transparency and clearer justification of the goals embedded in reimbursement systems are required to determine when such influences are ethically acceptable and how they should be governed. While the low conviction rate for cases of sexual violence is often justified by the so-called ‘he-said-she-said’ nature of these cases, the increasing presence of digital evidence has begun to challenge this justification. This digital evidence can provide new opportunities for intervening in and prosecuting sexual violence. However, it may also be used against complainants or deemed still insufficient for proving guilt. Thus, while digital evidence may be challenging typical criminal justice responses to sexual violence, it may equally be utilised (...) to buttress entrenched stereotypes and criminal justice practices that lead to complainant dissatisfaction and serve to support low conviction rates. I draw on critical feminist legal theory, feminist engagements with digital technology and sexual violence, and visual criminology to theorise the burgeoning role of the digital witness in sexual violence cases. This paper argues that climate migration-in case of climate refugees in a strict sense-differs from other forms of migration not only by its finality but also by the fact that entire communities are forced to resettle elsewhere. For such communities to migrate with dignity-that is in a way that protects the social bases of their self-respect-their host countries are required to ensure the necessary institutional arrangements enabling these people to become full and equal members within a reasonably short time. Ensuring (...) that their equal participation rights are not merely formal but have ‘fair value’ requires taking cultural differences into account to ensure that they do not pose substantial disadvantages for participation in the political and social sphere. Work on advice has concentrated on institutional settings where there are restrictions on roles, actions and their organisation. This article focuses on advice giving in mundane settings: interactions between mothers and their young-adult daughters in a corpus of 51 telephone calls. Analysis reveals a range of designs that can be ‘advice implicative’ including advice-implicative interrogatives and advice-implicative assessments. Recipients orient to the characteristic features these implicit forms share with more explicit advice: normative pressure on the recipient’s conduct and epistemic asymmetry (...) between advisor and advisee. Advice-implicative actions orient to contingencies on the recipient’s ability or willingness to perform the target action. They also display varying degrees of entitlement over the recipient’s performance of the target action. Manipulating contingency and entitlement can soften or heighten both the normative thrust and the knowledge asymmetry of the advice giving. This analysis further discusses the distinction between the practices of advising, directing and requesting, and allows consideration of how action design connects to relationality between parties. Disabled women's issues, experiences, and embodiments have been misunderstood, if not largely ignored, by feminist as well as mainstream disability theorists. The reason for this, I argue, is embedded in the use of materialist and constructivist approaches to bodies that do not recognize the interaction between “sex” and “gender” and “impairment” and “disability” as material-semiotic. Until an interactionist paradigm is taken up, we will not be able to uncover fully the intersection between sexist and ableist biases that form disabled women's (...) oppressions. Relying on the understanding that sexuality is one such material-semiotic phenomenon, I examine the operation of interwoven biases in two disabled women's narratives. (shrink)

Context: This article examines the integration of automated and (manual) hermeneutic methods in literary studies, in relation to the distinctiveness of naturalism and modernism. Semantics in literary texts cannot be automatically detected, but can be heuristically derived through specific linguistic patterns.Objectives: Our objectives are to analyze semantic structures in literary texts – specifically, indicators of semantic meaning based on linguistic occurrences – and to adapt existing technical solutions while developing new requirements for literary analysis.Method: We use a mixed methods approach (...) to analyze and interpret semantic processes, combining typical NLP-based techniques with hermeneutic methods. For this purpose, we transfer the concept of the so-called Quality Defect Detection, which is used in Requirements Engineering. We distinguish semantic categories for classifying linguistic occurrences as ‘findings’ to empirically test whether it is indeed possible to derive unambiguous epochal affiliations on the basis of their frequencies. These findings are manually evaluated by the reviewer in terms of accuracy and recall.Result: The results indicate an increase in negative words, vague pronouns, universal quantifiers (such as adverbs like “always” and “never”) and long sentences in modern texts. These results are preliminary, as they were generated based on a test corpus and need to be validated on larger corpora.Conclusion: Although the findings reflect aesthetic programs such as ‘unambiguity’ in naturalism, they interfered with the unambiguity filters used in Requirements Analysis, indicating that the historical category requires further specification and that the filter categories and rules should be adapted. This study was concerned with Wason's THOG task, a hypothetico-deductive reasoning problem for which performance is typically very poor ( < 20% correct). Recently, however, Needham and Amado (1995) and Koenig and Griggs (2004) have observed both facilitation and spontaneous analogical transfer effects for the Pythagoras version of this task. Based on their findings, Koenig and Griggs concluded that in addition to the separation of the data (the properties of the designated THOG) from the hypotheses that need to (...) be generated (the possible combinations of properties written down), an explicit request to generate these hypotheses is necessary to obtain significant analogical transfer. In the present study we extended the generalisability of this conclusion in three experiments with 214 undergraduate participants using O'Brien et al.'s (1990) Blackboard version of the task. We discuss the relationship of the results to dual process theories of reasoning and propose that analogical transfer may be a better criterion than task facilitation for judging participants' task understanding. Natural Law, Science, and the Social Construction of Reality looks at changes in knowledge and the relationship to values from the modern era to today. Author Bernie Koenig examines Newton's influence on Locke and Kant, how Kant influenced Darwin and Freud, and the implications of their work for both anthropology and moral theory.

Through a multiphase coding process, the researchers examined the selection, characteristics, and planned use of 111 written, visual, oral, and material sources that preservice teachers incorporated into plans for inquiry-based elementary social studies instruction. Preservice teachers identified Google as their main tool for locating potential sources, selected far more secondary than primary sources, and varied widely in how they prepared sources for elementary students. Planned use of sources focused almost entirely on identifying key details, with limited opportunities designed for students (...) to contextualize sources, examine bias, or corroborate evidence. Teeth are one of the most fascinating innovations of vertebrates. Their diversity of shape, size, location, and number in vertebrates is astonishing. If the molecular mechanisms underlying the morphogenesis of individual teeth are now relatively well understood, thanks to the detailed experimental work that has been performed in model organisms (mainly mouse and zebrafish), the mechanisms that control the organization of the dentition are still a mystery. Mammals display simplified dentitions when compared to other vertebrates with only a single tooth (...) row positioned in the anterior part of the mouth, whereas other vertebrates exhibit tooth rows in many locations. As proposed 60 years ago, tooth rows can be formed sequentially from an initiator tooth. Recent results in zebrafish have now largely confirmed this hypothesis. Here this observation is generalized upon and it is suggested that in most vertebrates tooth rows could form sequentially from a single initiator tooth. (shrink)

This paper discusses the Swiss minaret ban as a threat to equal citizenship rather than a threat to freedom of religion. The main argument of the paper is that cultural differences can threaten the fair value of equal political participation rights as well as socio-economic ones. These differences are morally troubling despite legitimate emphasis on the need for a shared (political) culture. To ensure that the state treats its citizens as equals with regard to cultural differences requires a form of (...) liberal neutrality which consists of two elements. Equal citizenship requires, first, justificatory neutrality in deciding which matters are legitimate concerns for legislation. It requires also—as a second safeguard—institutional arrangements which ensure that in the process of implementing justificatory neutral decisions the interests of all affected citizens receive a fair hearing. This means that the factors which tend to undermine the equal standing of citizens in society should be counteracted. (shrink)

Exploring the little-known medium of the English crime scene miniature, this chapter removes the roof of the ‘bungalow of death’ and invites us to peer inside. Tiny scale models of murder scenes, like that of the Crumbles bungalow where Patrick Mahon killed Emily Kaye in 1924, appeared in nineteenth- and twentieth-century courtrooms more frequently than the historical record suggests. The result is that these little likenesses have been overlooked in the literature on crime and forensics in the past, underestimating the (...) significance of spatialized understandings of evidence and visual representations of crime scenes in court. This chapter explores the larger methodological implications of murder miniatures for sources about crime and trials in the past, illustrating the effects of investigating crime scenes at scale. This article considers a 2010 government report on the South African visual arts industry. Using a Foucauldian lens, I show how it produces a discourse on ‘gender’ and ‘race’ where these terms function only as quantitative and statistical categories in an administrative and economic art world model. The report presents its findings according to four figures, namely, the ‘white male’, ‘white female’, ‘black male’ and ‘black female’, which I conceptualize as knowledge ‘avatars’ acting as placeholders that obscure the field’s complexity. Despite the use of ‘gender’ and ‘race’ terms identifying various issues in the field, the report’s recommendations to the government virtually ignores the race/gender imbalance so clearly revealed – it is simply folded out of sight or performed away discursively. This phenomenon is explained via Jennifer Tennant Jackson’s concept ‘the efficacity of meta-conceptual performativity’ – how discourses can push things away from the regular knowledge surface (the dispositif) into the ‘fold’. Media, police, and educational responses to nonconsensual pornography (i.e. ‘revenge porn’) have been critiqued for relying on sex negative beliefs that result in victims of this act being blamed and shamed for their own victimisation. In this article I analyse judicial discourse in nonconsensual pornography case law to assess the extent to which sex negativity is embedded in legal responses. I find that, while overt victim blaming and shaming is not present in the judicial discourse, subtle forms of sex negativity (...) are expressed in a minority of cases through references to consensual youth image sharing as inappropriate and through the framing of reputational harms. I argue that it is essential for legal responses to not only avoid sex negative narratives (as most currently do) but to actively reveal and counter the sex negative beliefs that underlie many of the harms associated with nonconsensual pornography. Patterns of memory sharing begin early in one’s life, informing relationships, one’s history, and one’s sense of cultural belonging. Memory sharing among families has been the focus of research investigating the relationship between mental health and intergenerational memory. A burgeoning body of research is showing that intergenerational knowledge of one’s family history is associated with positive mental health and wellbeing. However, research on the specific mechanisms and potential applications of such findings are just beginning to emerge. In particular, studies examining (...) intergenerational storytelling point to the importance of culture and gender as critical factors underlying how stories are told and the extent to which these stories are associated with wellbeing. Such findings hold important promise for the pentation and treatment of mental health issues. As research in this area continues to evolve, the identification and characterization of factors and mechanisms underlying intergenerational family stories and wellbeing may help to guide the integration of family stories into mental health interventions. This paper argues for a largely unnoted distinction between relational and modal components in the lexical semantics of verbs. Wehypothesize that many verbs encode two kinds of semantic information:a relationship among participants in a situation and a subset ofcircumstances or time indices at which this relationship isevaluated. The latter we term sublexical modality.We show that linking regularities between semantic arguments andsyntactic functions provide corroborating evidence in favor of thissemantic distinction, noting cases in which the semantic groundingof linking through participant-role properties (...) apparently fails. Thissemantic grounding can be preserved, however, once we abstractaway from sublexical modality in lexical semantic representations.Semantically-based linking constraints are insensitive to the sublexicalmodality component of lexical entries and depend only on informationin a predicator's situational core. Understanding the association between autonomic nervous system [ANS] function and brain morphology across the lifespan provides important insights into neurovisceral mechanisms underlying health and disease. Resting-state ANS activity, indexed by measures of heart rate [HR] and its variability [HRV] has been associated with brain morphology, particularly cortical thickness [CT]. While findings have been mixed regarding the anatomical distribution and direction of the associations, these inconsistencies may be due to sex and age differences in HR/HRV and CT. Previous studies have been (...) limited by small sample sizes, which impede the assessment of sex differences and aging effects on the association between ANS function and CT. To overcome these limitations, 20 groups worldwide contributed data collected under similar protocols of CT assessment and HR/HRV recording to be pooled in a mega-analysis (N = 1,218 (50.5% female), mean age 36.7 years (range: 12-87)). Findings suggest a decline in HRV as well as CT with increasing age. CT, particularly in the orbitofrontal cortex, explained additional variance in HRV, beyond the effects of aging. This pattern of results may suggest that the decline in HRV with increasing age is related to a decline in orbitofrontal CT. These effects were independent of sex and specific to HRV; with no significant association between CT and HR. Greater CT across the adult lifespan may be vital for the maintenance of healthy cardiac regulation via the ANS-or greater cardiac vagal activity as indirectly reflected in HRV may slow brain atrophy. Findings reveal an important association between CT and cardiac parasympathetic activity with implications for healthy aging and longevity that should be studied further in longitudinal research. This paper establishes a critical relationship between the concepts of memory and experience in the writings of Walter Benjamin, as a preliminary step to expose the negative philosophy of the same author –conceived in terms of remembrance and redemption. This conceptual framework is necessary to propose a Benjaminian negative anthropology that rejects formal anthropological universality and the effort to impose a human ideal that must be achieved by all human beings.

The public sphere has been seen by conservatives as an arena for safeguarding private relations. Private power relations could be threatened by newly recognized social groups that make claims on the state for justice and equality. Therefore, conservatives have been concerned about who can speak and exist in public and who can thereby make demands on the state. In the debates over transgender rights in Canada, social conservatives and neoliberal forces have merged in complex and impactful ways. Analyzing House of (...) Commons and Senate debates and committee proceedings for Bill C-279 and Bill C-16, I examine three conservative arguments that illustrate attempts to maintain private power relations and hierarchal gendered divisions by ensuring that transgender and gender nonconforming people are not allowed to exist, speak or make claims in public: first, the assertion that gender identity and gender expression are not definable identity categories for claims-making because transgender people are deceptive and can change their gender based on their feelings; second, the targeting of public facilities, and particularly public bathrooms, as sites of contention, danger and necessary gender segregation; and third, the attempt to delegitimize rights claims by criminalizing transgender people in relation to cisgender women and children. On November 4, 2008 California voters passed Proposition 8, and accordingly same-sex marriage was banned under the state constitution. Proposition 8 is now being considered by the Supreme Court. The proposition has sparked national debate about the nature of the relationship between the state and citizens’ sexuality and corresponding rights; calling into question the practice of allocating rights and privileges on the basis of sexuality and family form. Proponents of the proposition, who can be classified as predominantly socially conservative, want (...) to maintain the status and privileges of marriage for heterosexuals; arguing that allowing same-sex marriage threatens the legitimacy, sanctity and strength of traditional heterosexual marriage. This article examines the extent to which three Californian pro-same-sex marriage organizations (Equality California, Join the Impact, and the Courage Campaign) have challenged and/or appropriated social conservative and neoliberal discourses in their effort to gain access to the rights and privileges that are currently administered through marriage. Open-ended interviews remain the default data generation technique for qualitative psychology and sociology. This commentary raises questions with Griffin's understanding of naturalistic materials and the emic/ etic distinction. It reiterates problems in the use of open-ended interviews, and repeats the case for more considered support for their use.
