Which I pointed out.
(Funny side note: after I called her on it, she added her name to the top, where my name had been. It was blank when I first saw it. But I have screencaps of how it looked originally. *g*)
Her response?
"Wolverine belongs to Marvel."
My response: "I'll let people know that the graphics on loganandmarie.com are up for grabs for whoever wants to use them, since you don't believe in propietary rights in regards to fanart, manips, etc."

And I'll be sure to haul out that "Wolverine belongs to Marvel" line the next time some nutjob starts crying plagiarism around here.

Yes, the fandom community doesn't have a "real" way to enforce its rules, which is why people who break them are subjected to the only recourse we have: pointing out what they did, in public.

Yes, the orignal image does belong to the movie studio, the comic company, whatever.
But if you look at it that way, you're coming at it from a different angle than I am. The image thief isn't stealing the image--they are stealing the time and effort the person put into making the image into something new and different and unique. The stolen image is the physical representation of intangibles that are of value to the person who used them to create something, and taking it is wrong.
Let's say I go to the store and buy a Betty Crocker cake mix. I make the cake, and then put it on my windowsill to cool (because I live in Mayberry), and you come along and steal it.
Have you stolen my cake? Or Betty Crocker's cake?
Do I have no right to protest that you took my cake, because I made it from ingredients I got from a box?

But that's what fandom is based on, rights over things that are created from things that don't belong to you.
And the suggestion that it's okay to take fanart because it's made from images that belong to the owners of the source material...well, that's just scary. Because what does that mean for fan fiction, then?
As far as LJ icons specifically, some people put a lot of effort into them, and they are their own creations. Little 100x100 fanarts, if you will. So they should be included in the "do not steal" rule.
Because if they aren't, sooner or later someone will start nipping fanart and saying that it's not that different from an LJ icon and it's okay to take those. so why is taking fanart wrong? And then people will start taking stories and putting their own names on them, and saying that's okay because a story isn't that much different from fanart.
And if it got to that point, I honestly think I'd be out of here. Once it becomes okay to just take what you want, then there's no point in putting any effort into stuff other people are just going to steal.
