This study investigates the impact of fraud/lawsuit revelation on U.S. top executive turnover and compensation. It also examines potential explanatory variables affecting the executive turnover and compensation among U.S. fraud/lawsuit firms. Four important findings are documented. First, there was significantly higher executive turnover among U.S. firms with fraud/lawsuit revelation in the Wall Street Journal than matched firms without such revelation. Second, although on average, U.S. top executives received an increase in cash compensation after fraud/lawsuit revelation, this increase is smaller than (...) that of matched non-fraud/lawsuit firms. Third, fraud/lawsuit firms were more likely to change top executive when chief executive officer (CEO) was not the board chairman and CEO had been on the board for a short time. Fourth, fraud/lawsuit firms were more likely to reduce their executive cash compensation when profitability was low, firms were involved in fraud, the compensation committee size was small, and the board met more often. These findings indicate that although, in general, U.S. fraud/lawsuits firms did not reduce their executive cash compensation, those involved in fraud were more likely to reduce their executive cash compensation than to change their top executives. The finding, that ethical standards is not a significant factor for U.S. executive turnover nor compensation reduction, suggests that ethics appears to play no part in the board’s decisions, and that U.S. firms may have ethical standards in writing but they do not implement nor enforce the standards. The aim of this article is to assess the impact of Big Data technologies for insurance ratemaking, with a special focus on motor products.The first part shows how statistics and insurance mechanisms adopted the same aggregate viewpoint. It made visible regularities that were invisible at the individual level, further supporting the classificatory approach of insurance and the assumption that all members of a class are identical risks. The second part focuses on the reversal of perspective currently occurring in data analysis (...) with predictive analytics, and how this conceptually contradicts the collective basis of insurance. The tremendous volume of data and the personalization promise through accurate individual prediction indeed deeply shakes the homogeneity hypothesis behind pooling. The third part attempts to assess the extent of this shift in motor insurance. Onboard devices that collect continuous driving behavioural data could import this new paradigm into these products. An examination of the current state of research on models with telematics data shows however that the epistemological leap, for now, has not happened. (shrink)

Accounts of big data practices often assume that they target individuals. Personalization, with all the risks of discrimination and bias it entails, has been the critical focus in accounts of consumption, government, social media, and health. This paper argues that personalization through models using large-scale data is part of a more expansive change in probabilization that, in principle, is not reducible to individual or ‘personal’ attributes and actions. It describes the ‘personalization’ of an online grocery shopping recommender (...) system to list a small number of grocery items of personal relevance for each of the millions of online grocery shoppers at a major UK supermarket chain. Drawing on a theory of probability proposed by the philosopher of science Karl Popper and anthropological work on shopping, it suggests that the attempt to generate personalized predictions necessarily incorporates impersonal relations to others and things. Using a mixture of discourse analysis and code-based reconstruction of key elements of the recommender system, it suggests that personalization is one facet of an open-ended weave of propensities associated with people and things in contemporary big data configurations. The paper explores how, in the context of recommender systems, the constitutive incompleteness of shopping lists, their propensity to expand or change, might be more important than their capacity to be personalized. This paper focuses on the conception and use of machine-learning algorithms for marketing. In the last years, specialized service providers as well as in-house data scientists have been increasingly using machine learning to predict consumer behavior for large companies. Predictive marketing thus revives the old dream of one-to-one, perfectly adjusted selling techniques, now at an unprecedented scale. How do predictive marketing devices change the way corporations know and model their customers? Drawing from STS and the sociology of quantification, I propose (...) to study the original ambivalence that characterizes the promise of a mass personalization, i.e. algorithmic processes in which the precise adjustment of prediction to unique individuals involves the computation of massive datasets. By studying algorithms in practice, I show how the active embedding of local preexisting consumer knowledge and punctual de-personalization mechanisms are keys to the epistemic and organizational success of predictive marketing. This paper argues for the study of algorithms in their contexts and suggests new perspectives on algorithmic objectivity. (shrink)

This essay explains how, from the theoretical perspective of Basil Bernstein's three “conditions for democracy,” the current pedagogy of artificially intelligent personalized learning seems inadequate. Building on Bernstein's comprehensive work and more recent research concerned with personalized education, Natalia Kucirkova and Sandra Leaton Gray suggest three principles for advancing personalized education and artificial intelligence (AI). They argue that if AI is to reach its full potential in terms of promoting children's identity as democratic citizens, its pedagogy must go beyond monitoring (...) the technological progression of personalized provision of knowledge. It needs to pay more careful attention to the democratic impact of data-driven systems. Kucirkova and Leaton Gray propose a framework to distinguish the value of personalized learning in relation to pluralization and to guide educational researchers and practitioners in its application to socially just classrooms. My only reason for discussing it is to call attention to the strangeness of Jebb's proceeding when seeking to support Hermann's conjecture παλλλοιν which he admits into the text. The objection to Hermann's view is that, as he himself admits, there is no evidence that πáλληλος could be used in the sense of λληλιφóνος. For that, I suppose, is the (...) meaning of ‘mutual hands,’ which both Jebb and Campbell suggest as a translation, although ‘mutual violence’ would be better. But the chief purpose of this note is to protest against the mode of interpretation applied to Philo de Mose 3. 36. II. p. 175 M. διà τàς ν δασι καí πνρì γνιμéνας συνχς καì παλλλονς φθορáς Turnebu s rightl yrenders ‘alternas interneciones,’ and why Jebb supposes him to have meant ‘mutual’ I do not know. Anyhow he admits that Philo used the word in its ordinary sense of successive, and proceeds to paraphrase ‘owing to the continuous and rapid succession of calamities by flood and fire’ . All this is quite beside the mark, for the reference is to the alternate destruction of the world at the κπρωσις by fire and at the ξγρωσιςby water. This study makes an inquiry into algorithmic personalization through the lens of technology as a phenomenon itself. It applies Heidegger’s phenomenological method for the analysis of modern technologies explicated in his seminal essay, The Question Concerning Technology, as well as his overall phenomenological investigation into the question of Being. The study perceives algorithmic personalization not as a novelty but as a manifestation of continuity. The pervasiveness of algorithmic personalization is a result of a preceding ontological disposition that (...) represents human beings as ‘standing-reserve’ (Bestand) or resources, i.e., digital data. The study concludes that extensive datafication of all beings through data-hungry algorithms ultimately culminates in the datafication of the Being itself. The following paragraphs aim to shed light on the concept of personalization by providing a philosophical conceptualization that enables an analysis of its scope and applications within the framework of the digital transformation of higher education. It also describes the five meanings attributable to the concept and details their (...) philosophical underpinnings. This helps clarify the distinction between the extrinsic and intrinsic orientations of personalization, which, in turn, allows to apply this distinction within the framework of the digital transformation of education. In a previous paper (Compléments pour une théorie des distorsions cognitives, Journal de Thérapie Comportementale et Cognitive, 2007), we did present some elements aimed at contributing to a general theory of cognitive distortions. Based on the reference class, the duality and the system of taxa, these elements led to distinguish between the general cognitive distortions (dichotomous reasoning, disqualification of one pole, minimization, maximization) and the specific cognitive distortions (disqualifying the positive, selective abstraction, catastrophism). By also distinguishing between three levels of (...) reasoning – the instantiation stage, the interpretation stage and the generalization stage – we did also define two other cognitive distortions: over-generalization and mislabeling (Théorie des distorsions cognitives : la sur-généralisation et l'étiquetage, Journal de Thérapie Comportementale et Cognitive, 2009). Most of the existing studies on Bourdieu and the digital regards the social and class distinctions in the use of digital technologies, thus presupposing a certain transparency of technologies themselves. Our proposal is to refer to this attitude as “Bourdieu outside the digital.” Yet in this paper, another perspective called “Bourdieu inside the digital” is developed, which moves the focus on the effects of some emerging technologies on social distinctions and discrimination. The main hypothesis is that algorithms of machine learning (...) are producers and reproducers of habitus. Although their results present a greater granularity with respect to the standard techniques of the past, these algorithms still reduce individuals to categories, general trends, classes, and behaviors. Such a reduction has flattening effects on the individuals’ self-understanding, especially in terms of identity and interaction with the social world. This is the phenomenon described in the article as the “personalization without personality,” whose consequences are both existential and social-political. This idea will be illustrated through qualitative and comparative analysis between the correspondence analysis and the multiple correspondence analysis used by Bourdieu in his works and some of those techniques that are performed today in big data analytics. Merchants often use personalized pricing: they charge different consumers different prices for the same product. We assess the ethicality of personalized pricing by generalizing and extending an earlier model by Coker and Izaret (Journal of Business Ethics 173:387–398, 2021) who found that price personalization ethically outperforms unitary pricing. Using a simulation analysis, we show that these results crucially depend on the choice of parameters and do not hold universally. We further incorporate additional sources of marginal cost into the utility (...) function that will likely arise from personalized pricing. These include the expectation that personalized pricing is widely considered unfair by consumers who prefer that all consumers are charged the same price (unitary pricing), and that firms often approximate the consumers’ willingness-to-pay in ways that may raise negative sentiments among consumers who feel that their privacy is breached. By extending our model with disutility from unfairness perception and disutility from surveillance aversion, we demonstrate that personalized pricing is quickly outperformed by unitary pricing under social welfare functions that tend to prioritize total utility (utilitarianism and prioritarianism), whereas personalized pricing can ethically outperform unitary pricing under social welfare functions that tend to prioritize equality (egalitarianism and leximin). Our findings illustrate various intricacies and dynamics regarding the circumstances under which personalized pricing can be considered ethical. (shrink)

Panichas, longtime editor of the conservative quarterly Modern Age, brings to a conclusion a critical trilogy, really a tetralogy, which includes The Reverent Discipline, The Courage of Judgment, and The Critic as Conservator. The unusual title is inspired by Plato’s Phaedrus, with Panichas writing at one point—concerning literary scholar Austin Warren’s “open celebration of great ideas, great writers, great souls”—that, “Literary greatness for him meant spiritual greatness, this is, the kind of greatness that gives (...) us guidance and helps to orient us towards the good, or, as Plato puts it, to make us ‘grow wings to overcome gravity’”.
