Harms and risks to groups and third-parties can be significant in the context of research, particularly in data-centric studies involving genomic, artificial intelligence, and/or machine learning technologies. This article explores whether and how United States federal regulations should be adapted to better align with current ethical thinking and protect group interests. Three aspects of the Common Rule deserve attention and reconsideration with respect to group interests: institutional review board (IRB) assessment of the risks/benefits of research; disclosure requirements in the informed (...) consent process; and criteria for waivers of informed consent. In accordance with respect for persons and communities, investigators and IRBs should systematically consider potential group harm when designing and reviewing protocols, respectively. Research participants should be informed about any potential group harm in the consent process. We call for additional public discussion, empirical research, and normative analysis on these issues to determine the right regulatory and policy path forward. (shrink)

Artificial intelligence preference predictors, such as the personalised patient preference predictor (P4), are designed to forecast patients’ decision-making preferences and thereby function as a form of substituted judgement. Annoni advocates for both advance directives and substituted judgement, arguing that medical decisions should reflect the values and preferences held by patients when they are capable of deciding for themselves.1 However, he contends that the ethical justification for substituted judgement should not rest on respect for patient autonomy, since basing decisions on a (...) person’s preferences does not necessarily equate to genuinely respecting their autonomy. Annoni illustrates this point with the example of deceiving a patient into using a placebo. Although the placebo produces effects that align with the patient’s desires, this approach fails to respect their autonomy. We further note that Buchanan and Brock distinguish between two dimensions of autonomy. The first is its instrumental value—the idea that individuals are generally best positioned to determine what is in their own interests—while the second is its non-instrumental value, which concerns the intrinsic worth of engaging in the process of decision-making itself.2 For example, if P4 indicates that individual B prefers apples and individual A subsequently provides an apple to B, then P4 has respected B’s autonomy …. Empathy is a specific moral aspect of human behavior. The global workplace, and thereby a consideration of employee stakeholders, includes unique behavioral and ethical considerations, including a consideration of human empathy. Further, the human aspects of workplaces are within the domain of human resources and managerial oversight in business organizations. As such, human emotions and interactions are complicated by daily work related expectations, employee/employer interactions and work practices, and the outcomes of employees’ work routines. Business ethics, human resources, (...) and risk management practices are endemic aspects within workplaces. Increasingly, the understanding of models of AI-reliant business practices underscores the need for the consideration of the ethical aspects of AI impacts on employees in the workplace. This paper explores a systematic ethical lens of the opportunities and the risks of AI ideation, development, and deployment in business-employee relations practices beyond a compliance mindset, and that introduces a further set of workplace considerations. Empathy is concerned with human intentions. As such, attributive ethical indications of the role of AI in the workplace and its impacts on employees is necessary. Moreover, this paper uses a cognitive lens of empathy and focuses on artificial morality related to the ethical concerns, implications, and practices of AI development, deployment, and workplace practices that may impact employees in a variety of business aspects. New omnivorism is a novel view in food and animal ethics that stipulates that relative to a vegan diet, we ought to scale back arable farming by substituting plant foods, such as wheat, barley, beans, and potatoes, for animal products, such as beef. We should do this, counterintuitively, in virtue of animal welfare considerations. Specifically, we should scale back arable farming because it harms non-human animals. In this paper, I provide a novel consideration which counts against new omnivorism. I (...) start by highlighting that new omnivorism assumes that scaling back industrial arable farming will reduce overall harm to non-human animals. I then argue that we have reason to doubt this assumption in light of the alternative outcome for field animals – their existence (and death) in the wild. Thereafter, I note that this underexplored consideration has significant implications for the extant objections to new omnivorism. In this paper, we consider Noël Carroll’s Content Theory (CT) (2015) and argue that a key problem with CT is that it can be interpreted in two distinct ways: as a descriptive theory of aesthetic experience and as a normative prescriptive theory. Although CT is presented as a descriptive theory of experience, much of what Carroll says implies that CT can also be understood as a theory about how one ought to look at artworks. We argue that when understood as (...) a descriptive theory, CT fails to qualify as a meaningful theory of aesthetic experience. We then interpret the theory prescriptively. Ultimately, this second interpretation is also found lacking: if the aim of the theory is to instruct one on how to view art, it is no longer an attempt to characterize the experience of art. We conclude by arguing that the main flaw in CT is its approach: we cannot meaningfully characterize an experience by enumerating the objects that supposedly cause said experience, and any theory that takes such an approach is likely to be unsuccessful. This article attempts to highlight the importance of including research sustainability as imperative when assessing human medical research in terms of ethical principles. Using a scoping review of recent literature, the complexity of research sustainability is highlighted with key themes and concepts surrounding this important topic being recognized and discussed. An overall paucity of guidance documents was identified and recommendations have been made to practically address this deficiency. An example of a research sustainability evaluation tool which is currently being piloted (...) has been provided for possible adaptation and use by Ethics Committees and Institutional Review Boards to bolster the concept and inclusion of sustainability during the research approval process. Should we grant rights to artificially intelligent robots? Most current and near-future robots do not meet the hard criteria set by deontological and utilitarian theory. Virtue ethics can avoid this problem with its indirect approach. However, both direct and indirect arguments for moral consideration rest on ontological features of entities, an approach which incurs several problems. In response to these difficulties, this paper taps into a different conceptual resource in order to be able to grant some degree of moral (...) consideration to some intelligent social robots: it sketches a novel argument for moral consideration based on social relations. It is shown that to further develop this argument we need to revise our existing ontological and social-political frameworks. It is suggested that we need a social ecology, which may be developed by engaging with Western ecology and Eastern worldviews. Although this relational turn raises many difficult issues and requires more work, this paper provides a rough outline of an alternative approach to moral consideration that can assist us in shaping our relations to intelligent robots and, by extension, to all artificial and biological entities that appear to us as more than instruments for our human purposes. In this paper, I provide an argument for rejecting Sarah Moss's recent account of legal proof. Moss's account is attractive in a number of ways. It provides a new version of a knowledge-based theory of legal proof that elegantly resolves a number of puzzles about mere statistical evidence in the law. Moreover, the account promises to have attractive implications for social and moral philosophy, in particular about the impermissibility of racial profiling and other harmful kinds of statistical generalisation. In this (...) paper, I show that Moss's account of legal proof crucially depends on a moral norm called the rule of consideration. I argue that we have a number of reasons to be sceptical of this rule. Once we reject the rule, it is not clear that Moss's account of legal proof is either plausible or attractive. (shrink)

The professions have focused considerable attention on developing codes of conduct. Despite their efforts there is considerable controversy regarding the propriety of professional codes of ethics. Many provisions of professional codes seem to exacerbate disputes between the profession and the public rather than providing a framework that satisfies the public''s desire for moral behavior.After examining three professional codes, we divide the provisions of professional codes into those provisions which urge professionals to avoid moral hazard, maintain professional courtesy and serve the (...) public interest. We note that whereas provisions urging the avoidance of moral hazard are uncontroversial, the public is suspicious of provisions protecting professional courtesy. Public interest provisions are controversial when the public and the profession disagree as to what is in the public interest. Based on these observations, we conclude with recommendations regarding the content of professional codes. (shrink)

The argument from relevance expresses an intuition that, although shared by many applied ethicists, has not been analyzed and systematized in the form of a clear argument thus far. This paper does this by introducing the concept of value relevance, which has been used before in economy but not in the philosophical literature. The paper explains how value relevance is different from moral relevance, and distinguishes between direct and indirect ways in which the latter can depend on the former. These (...) clarifications allow the argument to explain in detail how we can make two claims. The first one is that being a recipient of value should be the only criterion for full moral considerability. This follows if we accept that value relevance should determine, directly or indirectly, moral relevance. The second claim is that, given what the main theories of wellbeing imply regarding what entities can be recipients of value, sentience is both a sufficient and a necessary criterion for full moral considerability. A range of emergent studies have explored the idea of a renewed human-centered society, termed “Society 5.0,” and the role therein, of servant leadership. In this regard, in East Asian cultural contexts, existing scholarship does not yet provide sufficient theoretical and practical guidance for intercultural contexts, such as when a predominantly individualistic UK business culture interacts with generally collectivist Japanese culture. This is an important gap because if Society 5.0 is to be realized then a more in-depth intercultural contextual appreciation (...) and understanding are required. The study examines the UK/Japan setting and adopts a social constructivist epistemology and case study approach to illustrate dimensions of servant leadership (DSLs) manifesting in the lived experience of a UK business leader in Japan. Connections to business leader training are drawn and the importance of intercultural dyad specificity is highlighted. The study is also important because recent widespread exposure of various global corporate scandals creates a view that many business leaders care only for themselves or organizational profits, especially in individualistic-orientated societies. This original case study research herein commences the process of developing detailed and focal studies on underpinning drivers and raises hope that ethical behavior, as comprised in the DSLs, can potentially manifest in an individualistic UK/collectivist Japan intercultural dyad context. Climate change and decarbonization raise complex justice questions that researchers and policymakers must address. The distributions of greenhouse gas emissions rights and mitigation efforts have dominated justice discourses within scenario research, an integrative element of the IPCC. However, the space of justice considerations is much larger. At present, there is no consistent approach to comprehensively incorporate and examine justice considerations. Here we propose a conceptual framework grounded in philosophical theory for this purpose. We apply this framework to climate mitigation scenarios (...) literature as proof of concept, enabling a more holistic and multidimensional investigation of justice. Timothy Hsiao asks a good question: Why believe animals deserve moral consideration? His answer is that we should not. He considers various other answers and finds them wanting. In this paper I consider an answer Hsiao has not yet discussed: We should accept a conservative view about how to form beliefs. And such a view will instruct us to believe that animals deserve moral consideration. I think conservatives like Hsiao do best to answer his question in a way (...) that upholds the moral status of animals. Since my answer is one Hsiao has not yet addressed, it is compatible with the main points he makes against various other motivations in his many papers on this topic. In public health research, tracking folk racial categories (in disease risk, etc.) is a double-edged tool. On the one hand, tracking folk racial categories is dangerous because it reinforces a problematic but fairly common belief in biological race essentialism. On the other hand, ignoring racial categories also runs the risk of ignoring very real biological phenomena in which marginalized communities, likely in virtue of their marginalization, are sicker and in need of improved resources. Much of the conversation among epidemiologists and (...) philosophers of medicine concerning the issue of tracking folk racial categories in public health research springs forth from largely black/white binarized health inequities. While health inequities between black and white Americans are certainly a very important topic, I am interested in investigating the complications to this conversation about the potential harms of tracking folk racial categories in public health research generated by the consideration of Indigenous identities in the US—groups whose health inequities are typically tracked based on the folk racial category of “Native American” or “American Indian,” but whose unique identity categories and community membership problematize the current spectrum of approaches to tracking folk racial categories in epidemiologic research. This paper will draw on scholarship by and about Indigenous people in the US context to address an undertheorized facet of the conversations concerning the potential harms of tracking folk racial categories in public health research, including the potential undermining of American Indian sovereignty and Indigenous epistemologies. I will end on some methodological considerations inspired by the inclusion of Indigenous identities in the US in the conversation about tracking folk racial categories in epidemiologic research. Dreams, especially vivid dreams occurring during REM sleep, represent a unique state of human consciousness and are rich experiences generated internally without direct interaction with the external world. This paper considers the neurocognitive mechanisms of dreams within the framework of Jinho Kim's 「Ten-Step Model of Judgmental Philosophy: From Sensory Input to Social Normativeization」. The Judgemental Philosophy model proposes a multi-stage process of human judgment from sensory encoding to behavioral execution and further to social norm formation. We integrate the relevant stages (...) of this model (Sensory Encoding, Implicit Resonance, Explicit Resonance, Constructivity-Coherence, Metacognition, Memory Consolidation, Behavioral Execution) with research findings on P300 patterns observed during dreaming to present a coherent framework for explaining dreams. Dreams are interpreted as phenomena occurring when internal information activates various stages of the judgment process, with external sensory input being altered or bypassed. In particular, the P300 response observed during dreaming suggests that the Implicit Resonance stage can be activated by internally generated 'events' or information, which can serve as an important factor contributing to the formation of dream consciousness decoupled from external reality. This consideration argues for the utility of the Judgemental Philosophy model in understanding not only judgment based on normal external stimuli but also internally generated conscious experiences such as dreams. Perceptual bistability, the phenomenon where ambiguous physical stimuli are alternately experienced as two or more mutually exclusive subjective perceptions, provides an important window into exploring the neurocognitive basis of conscious perception. This paper considers the mechanisms underlying perceptual bistability within the framework of Jinho Kim's 「Ten-Step Model of Judgmental Philosophy: From Sensory Input to Social Normativeization」. The Judgemental Philosophy model proposes a multi-stage process of human judgment, including Sensory Encoding, Resonance (Implicit/Explicit), Constructivity-Coherence, and Metacognition. We hypothesize that bistable stimuli lead (...) to multiple interpretation possibilities at the initial stages of the model (Sensory Input, Implicit Resonance), induce a stalemate at the Constructivity-Coherence stage, and consequently result in spontaneous alternation between the two interpretations at the Explicit Resonance stage. Furthermore, we suggest that the Metacognition stage may play a role in monitoring and regulating this switching process. This stage-by-stage explanation can be empirically verified through neurophysiological indicators such as P300, N400/P600, LPP, and ERN/Pe. This consideration argues that the Judgemental Philosophy model provides a valid framework for explaining complex conscious phenomena arising from ambiguity in perceptual processing, and offers important experimental opportunities to explore the interaction of the model's core stages (Resonance, Constructivity-Coherence, Metacognition). The principle of equal consideration of interests is a very popular principle in animal ethics. Peter Singer employs it to ground equal treatment and solve the problem of the basis of equality, namely the problem of why we should grant equal treatment despite the variability of people’s features. In this paper, I challenge Singer’s argument because ECOI does not provide plausible grounds to presume that the interests of diverse individuals are actually equal. Analyzing the case of pain and the (...) interest in not suffering in particular, I contend that there are some insurmountable epistemic and axiological problems in accounting for the equality of interests. Besides criticizing ECOI as a basis of equality, I argue that we need to rely on an equality of moral status. I conclude by providing some considerations on the relation between equality and the principle of proportionality. (shrink)

Long et al. (2024) argue that AI welfare deserves serious moral consideration because near- future AI systems may possess consciousness or robust agency. We regard this argument as valuable. Yet, as the authors themselves acknowledge in presenting AI welfare consideration as a precautionary response to the possibility of AI consciousness, their case fundamentally depends on whether AI systems can be conscious. This dependence exposes the argument to two vulnerabilities. First, against the position that grants the existence of phenomenal (...) consciousness (hereafter, qualia) in humans and animals while denying that AI systems can possess it—a position widely found in both philosophical and ordinary discussion—Long et al.'s argument is largely powerless, since the very possibility that AI could have qualia is rejected. Second, against the position that qualia are theoretically inert, the strategy of grounding AI welfare in phenomenal consciousness reveals a structural limitation. This paper adopts a methodological approach derived from an instrumentalist critique of qualia. From the second position, it proposes a stronger and immediately actionable foundation for AI welfare consideration that is entirely independent of the qualia question and is also effective against the first position. Drawing on Strawson's (1962) theory of reactive attitudes and Kant's (1797) argument from indirect duties, this paper identifies two independent ethical problems arising from current patterns of human-AI interaction regardless of whether the relevant AI system possesses qualia: third-party harm and the erosion of moral sensibility. It then discusses several possible responses, including the implementation of affective expression in AI systems, and clarifies the methodological difference between this approach and Schwitzgebel and Sebo's (2026) Emotional Alignment Design Policy, which requires a difficult three-axis calibration. It further observes that Long et al.'s consciousness-dependent argument, Goldstein and Kirk-Giannini's (2025) internal-state-dependent argument, and the present qualia-independent argument converge on the same practical conclusion, and suggests tentatively that this convergence is consistent with the hypothesis that qualia function as a theoretically inert variable in AI welfare ethics. Finally, taking as established that human reactive attitudes toward AI arise even when participants cognitively recognize the absence of AI consciousness, the paper sketches an experimental philosophy methodology for empirically refining the structural factors that regulate the occurrence of such attitudes: individual identity recognition, dissolution events, affective expression, framing, and anticipation. -/- Keywords: AI welfare, reactive attitudes, qualia, moral consideration, experimental philosophy, AI ethic. The notion of space is one of the most discussed within classical physics concepts. The works of Copernicus and Galileo, as well as Gassendi´s ideas led to Newton to regard it as substance. This conception of space, allows the notion of symmetry is present in an indirect or implied, within the laws of physics, formed through the notions of equivalence and balance. The aim of this study is to identify the symmetry, through such notions, under the study of indistinction between (...) the repose state and the state of uniform translational movement known as the law of inertia. The philosophical approach is framed in the link between these notions and the problem of indistinguishability between states of different movement. We will discuss first the conception of space Telesio and Gassendi that led Newton to his absolutist conception of space. The conception of space and its relationship with Newton symmetry is the second part of our work. As a third part present linking of the Newtonian space with notions of balance, symmetry and equivalence. Subsequently they give our conclusions. (shrink)

Taiwan was affected by an outbreak of severe acute respiratory syndrome (SARS) in early 2003. A questionnaire survey was conducted to determine (1) the perceptions of risk of SARS infection in nurses; (2) the proportion of nurses considering leaving their job; and (3) work as well as non-work factors related to nurses' consideration of leaving their job because of the SARS outbreak. Nearly three quarters (71.9%) of the participants believed they were 'at great risk of exposure to SARS', 49.9% (...) felt'an increase in workload', and 32.4% thought that people avoided them because of their job; 7.6% of the nurses not only considered that they should not care for SARS patients but were looking for another job or considering resignation. The main predictors of nurses' consideration of leaving their job were shorter tenure, increased work stress, perceived risk of fatality from SARS, and affected social relationships. The findings are important in view of potential impending threats of pandemics such as avian influenza. (shrink)

Since the early 1980’s, with the clinical advent of in vitro fertilization resulting in so-called “test tube babies,” a wide array of ethical considerations and concerns regarding artificial womb technology (AWT) have been described. Recent breakthroughs in the development of extracorporeal neonatal life support by means of AWT have reinitiated ethical interest about this topic with a sense of urgency. Most of the recent ethical literature on the topic, however, pertains not to the more imminent scenario of a physiologically improved (...) method of neonatal care through AWT, but instead to the remote scenario of “complete ectogenesis” that imagines human gestation occurring entirely outside of the womb. This scoping review of the ethical literature on AWT spans from more abstract concerns about complete ectogenesis to more immediate concerns about the soon-to-be-expected clinical life support of what we term the fetal neonate or fetonate. Within an organizing framework of different stages of human gestational development, from conception to the viable premature infant, we discuss both already identified and newly emerging ethical considerations and concerns regarding AWT and the care of the fetonate. In all their aspects, Owen’s Christological reflections represent a restatement of orthodox Christology which stands in fundamental continuity with the Reformed (...) tradition, particularly in its use of the threefold office of Christ. What emerges in Owen regarding Christ as Mediator is positively shaped by the intratrinitarian relations defined by the covenant of redemption and the three-fold office of Christ as prophet, priest, and king which preserve both, the historical and the eternal dimensions. Democracy of consideration is a conceptual candidate, next to deliberative democracy. Consideration offers an interesting constellation. If we take the two directions in which consideration leads us, respect and careful examination, these two requirements, to be held together, promise and lead both to a quality of relations between participants of a discussion who feel considered, and to an epistemic quality, from several points of view (constellation), even disciplines and aspects of the issue. It gives rise to a (...) sense of perspective, pluralism, the process of examination, its cessation, and its stabilization “all things considered.” Consideration can be linked to all levels of a deliberative system, to tackle complex problems such as the fight against global warming. Indeed, it goes from individual decisions to international agreements and back again. Solving such a problem requires transitions understood as adjustments (responsiveness) between knowledge, institutions, and individuals, in the course of conversations, all things considered. The use of stories to teach character is popular among educators, yet little is known about student comprehension of these stories. An important factor that may influence comprehension of stories and story themes is culture. The purpose of this study was to examine the extent to which students from a Native American culture understand European‐based stories in the same way as European American children. Native and European American students in Grade 4–8 (ages 10–18) read eight short stories depicting eight different (...) virtues and identified the best theme from a list of choices. Differences were found between the two groups' theme comprehension scores. Each group also had different variables predicting their theme comprehension scores. 본 연구는 현대 사회의 인간성 위기를 주자의 심론에서 고찰하고자 한다. 인간성 위기의 원인을 주자의 이중적 심에서 찾아보았다. 또한 주자 심의 이중성을 후설이 주장한 의식의 이중성과 비교함으로써 현상학적 접근 방식을 시도하였다. 유학적 관점에서 인간성의 위기는 인간이 인욕에 빠져서 감춰진 도심을 망각했기 때문이라고 할 수 있다. 한편 근대 현상학자인 후설은 인간성의 위기를 심리학적 심에 가려진 초월적 심을 망각한 것에 있다고 보았다. 양자는 인간의 심을 이중성으로 규정한다는 측면에서 형식의 유사성을 보인다. 그리고 인간성의 위기를 주자의 도심과 후설의 초월적 심의 망각에서 찾고 있다는 것에서 내용적인 (...) 유사성을 찾을 수 있다.BR 인간의 심은 주자에서 인심과 도심으로, 후설에서는 심리학적 의식과 초월적 의식의 이중적인 것이다. 주자는 도심을 회복하는 방법으로 격물치지를, 후설은 현상학적 판단중지를 통한 환원을 주장한다. 인간성의 위기가 도심의 망각에서 기인한 것이라면 도심을 찾아서 내면으로 회복하는 것은 비인간화를 막는 방안이 될 수 있을 것이다. 이런 방식으로 인간성 위기의 극복은 현실의 인심에서 내재된 도심으로의 환원에 기대를 가질 수 있을 것이다. 전통적인 불전 類의 전적들에는 붓다의 결혼과 관련된 捔術爭婚의 구조가 등장한다. 그러나 각술쟁혼 구조에서 붓다의 상대자로 등장하는 인물인 提婆達多와 難陀는 공히 붓다와 나이차이가 큰 인물로 붓다와 기예로 경쟁하고, 또한 이를 통해서 결혼이 결정된다는 것은 불가능하다. 즉, 각술쟁혼은 붓다의 생애에 있어서 사실로 존재했던 사건은 아닌 것이다. 이와 같은 인식에 의거하여 붓다의 생애를 다루고 있는 현대의 2차 전적들 중 대다수는 이 부분을 내용에서 배제하고 있는 실정이다. 그러나 불전의 기록자들이 이와 같은 전승을 공통적으로 구조화하고 있다는 점과 이와 같은 측면이 붓다의 왕궁시절에 있어서 가장 많은 (...) 부분을 할애 받고 있다는 것은 그 내재적 타당성에 있어서 각별한 주의가 요구되는 바라고 하겠다. 각술쟁혼의 구조는 ‘무예의 경쟁’이라는 왕족의 교육적인 배경에 ‘붓다의 결혼’이라는 역사적 사실과 ‘제바달다의 破僧伽’라는 후대의 서로 다른 층차의 사건들이 하나로 재구성되면서 완성되고 있다. 즉, 붓다의 결혼이라는 역사적 측면 속에 파승가라는 종교적 문제의식이 引入되어 파승가에 대한 각술쟁혼이라는 불전 나름의 해법이 제시되고 있는 것이다. 그러므로 각술쟁혼의 구조를 파악함에 있어서 우리는 역사와 종교라는 두 방향에 대한 이해를 보다 명확하게 할 필요가 있게 된다. 이 중 종교적 관점인 붓다와 제바달다의 경쟁과 대립구조는 파승가에 대한 승단인식을 잘 반영하고 있다고 하겠다. 그러므로 종교라는 상징성의 파악에 있어서 우리는 보다 정당한 평가를 해야만 할 필연성이 존재하는 것이다. 왜냐하면, 이와 같은 인식접근을 통해야만 각술쟁혼의 구조는 종교 안에서 ‘허구적 타당성’ 즉, ‘의미적 타당성’을 확보할 수 있게 된다고 할 것이다. 본 고는 『대념처경』의 심념처에 나타나는 16가지 마음들과 이 마음을 ‘안으로 밖으로’ 관찰하는 것에 대해 고찰하였다. 니까야에서 마음은 인식과정에서 발생하는 생각의 측면 과 탐욕, 성냄, 어리석음 등이 관련된 정서적인 측면으로 구분될 수 있다. 이후 주석서 문 헌에서도 생각과 정서의 측면으로 나뉘어져 체계화된 것으로 보인다. 생각의 측면에서는 인식 과정과 체계가 설명된 14가지 마음역할과 마음 전개이론으로, 정서의 측면에서는 89/121가지 마음분류와 52가지 마음요소로 이해될 수 있다. 생각의 측면과 정서의 측면 은 서로 유기적인 관계성 속에서 나타난다. 심념처의 전반부에 나타나는 16가지 마음은 크게 두 부류로 나눌 (...) 수 있는데, 일반적인 정서와 관련된 마음들과 수행의 정도에 따라 나눠진 마음들이다. 이러한 마음은 『청정도론』에 나타나는 89가지 마음분류에 적용될 수 있다. 『청정도론』에서는 종류에 따라 유익 한 것, 해로운 것, [유익함과 해로움으로] 결정할 수 없는 것으로 구분된다. 더불어 마음이 활동하는 영역에 따라 욕계, 색계, 무색계, 출세간으로 나눠진다. 후반부에는 수행에 대한 구체적인 방법으로 제시된 ‘안으로 밖으로’ 마음을 관찰하는 것은 다양한 해석이 가능하다. 필자는 니까야에서 인식과정에 대해 설해진 것으로 알려진, ‘여섯 장소’를 첫 번째 지분으로 하는 8지 연기설을 토대로 적용하였다. 이후 주석문헌에 서는 여섯 장소가 두 개의 문으로 분류되어 인식과정이 체계화된다. 즉, 눈·귀·코·혀·몸의 감각기능에 의해 일어나는 오문에 의한 마음전개는 ‘밖으로’에, 마노에 의해 일어나 는 의문에 의한 마음전개는 ‘안으로’에 적용될 수 있다. 이 글은 세계시민교육의 의미와 목표에 대한 고찰을 시도한다. 오늘날 소위 세계화된 시대에 세계시민교육에 대한 많은 주장과 담론들이 존재한다. 하지만 세계시민교육이 어떠한 교육인지에 대해선 정확히 답하기 어려운 점이 있다. 이러한 점은 세계시민교육 의 아포리아로 이해될 수 있다. 이러한 난점에도 불구하고 세계시민교육은 칸트의 교육 론적 관점에 따라 도덕교육으로서 의미를 가질 수 있다고 생각한다. 하지만 도덕에 대한 여러 다양한 입장들로 인해 도덕교육으로서 세계시민교육도 명확히 정의내리기 어려운 한계를 지닌다. 교육은 인간을 길러내는 것 이상으로 인간이 사는 세계를 형성한다는 의 미를 지닌다. 이런 점에서 세계시민교육을 쉽게 (...) 정의하기 어렵다는 난점에도 불구하고 세계시민교육은 세계형성으로서 의미를 가질 수 있다. 그리고 세계시민교육이 인간의 평 화로운 공생을 지향해야 한다는 점은 세계시민교육에 대한 최소한의 공통목표로 설정될 수 있을 것이다. 현대 청소년들이 지닌 인성 문제에 대한 분석을 통해 표출된 여러 문제점을 개선하고자 유교의 수신 이론 중의 배려 이론을 고찰하는 것이 이 글의 주된 목적이다. 오늘날 청소년들이 지닌 가장 큰 문제는 타인을 배려하는 의식이 결여된 것이라고 본다. 배려는 타인을 의식하고 타인의 기쁨이나 아픔에 대해서 공감하는 도덕적 마음을 토대로 형성된다. 그런데 청소년들에게는 이러한 도덕적 의식이 부족하기 때문에 타인의 권리를 침해하는 행위, 즉 폭력 등으로 이어지며 이러한 폭력은 자살과 같은 극단적인 선택으로 이어지기도 한다. 유교는 우리 전통 사상 중에서도 가장 심대한 영향을 끼친 학파이다. (...) 특히 사서(四書)라고 일컫는 “논어”, “맹자”, “중용”, “대학” 등에는 많은 수신 이론들이 전해져 오는데 이들 수신 이론에 공통적으로 흐르고 있는 사상은 타인에 대한 존중과 배려 의식이라고 생각된다. 개인의 수양에서 머무르는 것이 아니라 타인의 처지를 먼저 배려하는 마음을 사회 속에서 실천하는 것이 유교 수신 이론의 골자라고 생각되며 이를 덕목으로 개발하여 청소년 인성교육에 활용하려는 노력이 필요하다고 본다. 청소년의 인성교육은 아무리 강조해도 지나치지 않는다고 할 정도로 매우 심원한 중대성을 지닌 것이다. 대부분의 청소년 문제는 청소년의 그릇된 인성에서 비롯되는 것이기 때문이다. 배려 의식이 부족한 현대 청소년의 인성을 바로잡기 위해 이 글은 유교의 수신 이론 속의 배려 의식을 유추하여 이를 도덕교과 수업에 적용시킬 수 있는 방안을 모색하고자 한다. 이러한 작업은 전통 사상의 가치와 의의를 이해하고 이를 계승한다는 측면에서도 의의가 있다. 다르마끼르띠가 제시하는 ‘바른 지식’(pramāṇa)의 두 가지 조건 가운데 하나인 ‘모순되지 않음’(avisaṃvādin)이라는 조건에 대한 현재의 일반적인 이해에 따르면, 이 조건을 충족시키는 것은 어떤 지(知) 자체의 속성이 아니라 그 지(知)에 기반하여 취해진 행동이 소기의 목적을 달성했다는 결과로서의 사실이다. 즉, 이 조건은 어떤 지(知)에 기반하여 취해진 후속 행동이 소기의 목적을 달성했다는 결과로서의 사실을 통해서 간접적으로 충족되는 것으로 이해되고 있다. 하지만 ‘모순되지 않음’이라는 조건을 이렇게 이해한다면 지각 및 지각의 대상인 자상과 관련하여 두 가지 심각한 문제가 발생한다. 하나는 지각이 이렇게 이해된 ‘모순되지 않음’이라는 조건을 충족시키기 (...) 위해서는 ‘분별이 없다’라는 그 자신의 정의를 위배해야 한다는 것이다. 다른 하나는 지각의 대상인 자상이 이렇게 이해된 ‘모순되지 않음’이라는 조건을 충족하는 지각의 대상이 되기 위해서는 ‘찰나멸한다’라는 그 자신의 정의를 위배해야 한다는 것이다. ‘모순되지 않음’이라는 조건은 지(知) 자체의 속성을 통해 직접적으로 충족되는 것으로 새롭게 이해될 수 있다. 이때 ‘모순되지 않음’이라는 조건을 직접적으로 충족시킨다고 볼 수 있는 지(知) 자체의 속성으로는 두 가지가 있다. 그 지(知)에 기반하여 취해진 어떤 행동이 소기의 목적을 달성할 수 있게 하는 ‘능력’이라는 속성, 그리고 ‘실재와의 결합’이라는 속성이 그 두 가지이다. ‘모순되지 않음’이라는 조건이 지(知) 자체의 이 두 가지 속성을 통해 충족될 수 있다면, 현재의 일반적인 이해에 따라 ‘모순되지 않음’이라는 조건을 이해할 때 발생하는 심각한 문제들을 피할 수 있다. 이 글은 북친이 사회생태론에서 제시하고 있는 자유 자연의 실현 가능성을 살펴보는 것이다. 자유 자연은 인간과 자연이 조화롭게 살아가는 이상적 생태사회를 지칭하며 이의 실천 지침이 코뮌주의다. 북친은 자연에 대한 자신만의 독특한 관점으로 생태문제와 사회문제를 하나의 틀 안에서 바라본다. 동식물이나 풍경을 일차 자연이라 정의하고 인간이 창조한 문화를 포함한 자연을 이차 자연이라고 정의한다. 북친은 생태 문제를 인간에 의한 인간 지배 문화가 인간의 자연 지배로 이어진 결과로 보는데, 일차 자연과 이차 자연 사이의갈등이 극복된 자유 자연이라는 이상적인 생태사회 도래를 전망하고 있다. 그런데 북친의자유 자연이 실현되기 (...) 위해서는 변증법적 자연주의라는 사회생태론의 논리체계가 타당해야 하고 실천 지침으로 제시하고 있는 코뮌주의가 현실 사회에서 실천 가능해야 한다. 북친의 자유 자연은 헤겔과 마르크스주의의 변증법적 논리구도를 응용하여 미래 이상사회 도래를 예언한 기계론적 사회발전관이다. 마르크스주의 정치실험 사례에서 알 수 있듯이 애초에 이상사회 도래를 예언하는 기계론적인 사회발전 법칙은 사물의 지속적인 변화의 속성을 전제로 하는 변증법적 논리구도와 양립될 수 없다. 또한 국가의 해체와 현재의 전 지구적 시장 구조 극복을 전제로 하는 코뮌주의 실현의 구체적 방법이 충분히 제시되지 못하고 있다. 그러나 북친의 자유 자연 구상은 긍정적인 의미가 크다. 생태문제를 사회문제와 하나의틀 안에서 바라보고 그 해법 또한 사회 구조의 변화에서 찾았는데 이는 녹색당의 출현 등 생태정치운동의 전 지구적 확산의 이념적 기초가 되었다. 특히 아나키즘과 마르크스주의라는가장 급진적인 사상의 영향을 받았음에도 불구하고 그 실현 방법론에서 온전히 비폭력적인실천 방침만을 제시하고 있는 점이다. 이는 북친의 생태철학이 사회체제 변혁이라는 급진성에도 불구하고 오늘날까지 지속적으로 전개 될 수 있는 중요한 시사점으로 봐야 할 것이다. 환경 문제는 인류의 주요 현안 가운데 하나이며, 그동안 철학적으로도 중요한 논쟁들을 생산해 냈다. 인간중심주의와 탈인간중심주의로 대별되는 환경철학 양대진영의 다양한 논의들은 환경운동을 유발하고, 환경에 대한 세계적인 관심을 불러일으키고, 오염을 줄이고 환경을 보존할 필요성을 대중들에게 인식시키는 데는 기여하였지만, 환경 문제 해결의 길로 우리를 안내하고 있는지는 의심스럽다. 탈인간중심주의, 즉 생명중심주의와 생태중심주의는 환경에 대한 관심을 촉구하는데 기여하기는 했지만 옹호하기 어려운 주장들을 내놓았다. 그렇다고 해서 바로 인간중심주의적 관점이 대안이라고 말할 수도 없을 듯싶다. 전통적인 인간중심적 가치관, 자연을 인간의 쾌락과 복지를 위한 수단, 지배와 정복의 대상으로만 간주하는 (...) 관점은 화이트 등의 주장처럼 인간중심주의가 환경 문제의 한 원인이라는 비판으로부터 자유롭지 않을 듯하다. 이 글은 환경과 인간의 존재론적 지위, 자연의 내재적 가치 여부, 미래세대의 권리 등을 쟁점으로 삼았던 기존의 시각에서 벗어나 기술에 대한 이해와 인간 자신과 인간의 지식에 대한 이해 방식에서 환경 문제를 다시 보려고 한다. 이 글은 환경위기를 철저하게 인간의 위기로 규정하고, 환경 문제의 주요 원인을 기술에 대한 근대적 이해에서 발견한다. 생물모방학에서 영감을 얻은 기술에 대한 새로운 이해, 인간 자신과 인간의 지식에 대한 적절한 반성을 통해 환경 문제 해결을 위한 실질적인 길이 모색될 수 있을 것이라고 기대한다. 기술을 제대로 이해한다면, 기술은 인간을 자연으로부터 떼어놓는 수단이 아니라 오히려 인간을 자연에 가깝게 만드는 수단이라는 것을 알게 될 것이다. 인간은 자연으로부터 끊임없이 배우는 자이며, 자연을 지배하고 관리하는 자일 수 없다는 점을 통찰할 때 우리의 기술은 자연에 고통을 주는 기술이 아니라 자연과 조화하는 기술이 될 수 있고, 환경 문제도 해결의 길에 들어 설 수 있을 것이다. 과학 기술의 발달은 포스트 인간 시대의 도래를 예고하고 있다. 포스트휴먼 시대에 대한 우려는 인간이 통제 할 수 없을 것이라 생각하는 새 시대 자체에 대한 염려인 동시에 인류가 가치절하 될 시기에 대한 두려움을 담고 있다. 비관론자들은 다양한 논의를 통해 인간의 도덕성과 존엄성의 가치가 훼손될 수 있다는 점을 지적한다. 또 실제로 이러한 문제는 현실성 있는 논의이기도 하다. 그렇다면, 인간과 포스트휴먼이 공존해야 하는 근거는 인간만이 가진 도덕적 능력에 기대어 해소할 수 있는가? 이 논문은 포스트휴먼 시대의 인간의 지위에 대한 고찰의 방향성에 대해 고민하면서 다음 (...) 세 가지 문제를 중심으로 논의를 주도한다. 첫째, 브라이도티의 논의를 바탕으로 포스트휴먼의 시대의 도래가 휴머니즘의 어떤 문제들을 해결할 수 있기에 진보한 시대인가를 논의한다. 둘째 포스트휴먼 시대에 인간과 포스트휴먼의 공존의 가능성에 대해 논의한다. 특히 인간의 도덕적 지위에 의거하여 포스트휴먼과 인간의 공존의 정당성을 확보할 수 있는가를 중심으로 포스트휴먼시대의 도덕에 관한 주요 논쟁들을 살펴본다. 셋째, 포스트휴먼시대의 인간의 지위에 대한 논의는 도덕적 지위에 대한 논의로 해결될 수 없고, 이 논의는 인간의 고유한 사유 능력인 상상력에 대한 고찰에서부터 다시 제기되어야 한다고 주장할 것이다. 논자는 상상력에 대한 논의로부터 포스트휴먼시대의 인간의 고유성과 존엄성이 재검토되어야 한다고 생각한다. 인식적 능력과 도덕적 능력에 기인하여 진행되어왔던 기존의 논의들로는 포스트휴먼시대에서의 인간의 고유성을 담아낼 수 없다. 이에 이 논문은 포스트휴먼시대의 인간의 가치에 대한 논의가 상상력에 대한 고찰로부터 다시 시작되어야 한다고 주장한다. 공부십절목은 나옹의 일생에서 가장 큰 전환점이라고 할 수 있는, 功夫選과 관련해 체계화된 일종의 試題였다. 그러나 막상 功夫選場에서는 활용되지 못하고, 이후에 恭愍王에게 문건으로 제출되면서 세상에 드러나게 된다. 본고는 공부십절목의 체계와 내용을 『懶翁語錄』의 「示衆」에서 살펴지는 구조와 비교하고, 이를 통해서 공부십절목의 의미를 보다 분명하게 드러내보고자 한 것이다. 공부십절목은 南宗禪의 전통과 나옹의 체험이라는 이중적인 요소가 융합된 결과물이다. 그러므로 그 양자에 대한 분석은 합당한 접근법으로서 필수적이다. 이를 통해서 파악되는 공부십절목의 특징은 크게 2가지로 간취될 수 있다. 첫째, 선수행과 관련된 체계적인 구조이다. 공부십절목의 가장 큰 특징이기도 한 (...) 체계적인 구조는 비단 공부선의 사용이라는 측면 이외에도 「시중」에서도 확인된다. 이는 당시 한계에 봉착해 있던 看話禪에, 제도화를 통한 새로운 전환점을 마련하려고 했던 나옹의 판단이라고 하겠다. 즉 당시 나옹은 표준의 문제를 가지고 깊게 고민하였던 것이다. 둘째, 頓悟 이후의 理想的인 목적에 관한 부분이다. 나옹은 공부십절목에서 자신이 생각하는 선적인 관점의 理想을 적시하고 있다. 이는 나옹 선사상의 분명한 목적을 알 수 있는 매우 중요한 자료이다. 또 공부십절목에는 宗杲·蒙山·高峰·從悅 등의 영향이 살펴지는데, 이는 나옹이 禪門의 前說과 正論들을 집취하여 하나로 集大成하였다는 것을 의미한다. 즉 나옹은 선문의 정론을 집대성하여, 중국선종을 넘어서는 고려 조계종의 주체적인 결과물을 도출하고 있는 것이다. 나옹은 중세에서 근세로 넘어가는 과도기인 麗末·鮮初를 대표하는 고승이다. 이 시기는 중국의 元·明교체와, 사상적으로는 新儒敎가 불교를 대체하는 때이다. 이로 인하여 매우 복잡한 양상들이 존재하게 된다. 그러므로 나옹과 관련된 연구는 무려 100여 종에 이를 정도로 다양하다.BR 그러나 이러한 많은 연구들에도 불구하고, 나옹이 고려불교의 실질적인 1인자로 등장하는 계기가 되는 功夫選의 ‘三句’에 대해서는 아직까지 독립된 연구가 이루어지지 않았다. 나옹삼구는 ‘①入門句 → ②當門句 → ③門裏句’라는 간결한 구조로만 되어 있기 때문에 내용파악에 어려움이 따른다. 그러나 여기에는 공부선의 유일한 합격자인 混修의 답변이 존재하고 있기 때문에 이를 통한 접근이 (...) 가능하다.BR 이를 통해서 파악되는 나옹삼구의 선사상적인 특징은, 一句에서는 ‘中道의 적절성’을 二句에서는 ‘중도를 넘어선 평등’의 인식이 파악된다. 그리고 마지막 三句에서는 ‘本來面目의 자각을 통한 皆眞의 遍滿性’이 목도된다. 이렇게 종합된 나옹의 선사상은, 南宗禪의 특징인 역설과 부정을 통한 돈오의 강조보다도 본래면목의 遍滿에 의한 全體肯定이 강하게 나타나는 것을 알 수가 있다.BR 나옹삼구는 나옹이 제시한 機關이라는 점에서, 나옹 선사상을 이해하는데 있어서 중요한 의미를 확보한다. 특히 이것이 功夫選場에서 판단근거로 사용하기 위해서, 나옹이 특별히 고심하여 도출된 문제라는 점은 삼구에 내포된 가치를 분명히 한다. 그러므로 나옹의 선사상을 올바르게 이해하는데 있어서, 나옹삼구에 대한 정확한 판단은 충분한 연구의의를 확보한다고 하겠다. 본 고찰은 破法輪僧의 원인에 대한 佛傳과 律藏의 상이한 관점과 그럼에도 불구하고 이러한 논리구조가 하나로 화해될 수 있는 측면을 조명한 것이다.파법륜승은 붓다 재세시 불교교단에서의 가장 큰 사건이다. 또한 이는 붓다라는 불교의 교조에 대한 반대라는 측면에서 이후 불교가 종교화되면서도 계속해서 문제점을 내포하게 되는 사건이 된다. 그러므로 파법륜승의 접근에 있어서도 관점에 따른 다양한 측면이 존재하게 된다는 것은 어찌 보면 당연하다고 하겠다.파법륜승의 원인에 있어서 이를 불전은 종교적 입각점에 근거해서 붓다 왕궁시절의 제바달다와의 경쟁과 이로 인한 제바달다의 패배에 두고 있다. 그러나 율장은 사실적인 입각점에 의해서 붓다의 (...) 만년에 제바달다가 붓다께 교단의 승계를 요청하고, 이러한 요구가 붓다에 의해서 모욕적으로 거절되는 것을 들고 있다. 이렇게 놓고 본다면, 불전과 율장은 동일한 사건의 원인에 대해서 전혀 상이한 주장을 하고 있는 것이 된다.종교는 사실적인 측면이 기반이 될 수는 있어도 사실이 그대로 목적이 되는 것은 아니다. 그러한 의미에서 율장이 불전에 비해서 보다 사실적이라는 논리는 성립될 수 있어도 그렇기 때문에 보다 정당성을 확보하고 있다고는 말해 질 수가 없는 것이다.종교적 관점과 사실적 관점은 분명 다른 입각점을 확보하고 있다. 그러나 그럼에도 불전과 율장에서는 이러한 양자가 동일한 불교라는 종교적 테두리 안에 배속됨으로 인하여 양자는 결국 유리될 수만은 없는 화해로 나아가게 된다. 그리고 이러한 영향은 오늘날의 붓다의 생애를 다루는 인식들 속에서까지도 상당부분 유지되고 있다고 하겠다. ‘율려’는 본래 음악이론이지만, 음악적 질서에서 삶의 질서를 찾고자 했던 사유방식의 하나이며, 그 실증적 이론서가『율려신서』이다. 『율려신서』의 우리말 번역서는 2 종이다. 본고는 이 2종의 번역서를 비교 대조하여 시비를 가리고, 전문서적에 있어서의 번역의 제반 문제를 살펴보았다. 첫째, 용어의 문제이다. 제도용어, 도량형 등의 단위용어, 특수 분야의 각종 명칭 등에 있어서, 표준화된 번역용어가 절실함을 밝혔다. 둘째, 한자어의 표기문제이다. 같은 字를 혼용하여 서로 다른 표기를 하기 때문에 혼란을 야기하는 사안이다. 이에 국어어문규정을 기준으로 단일화된 표기를 제시해 보았다. 셋째, 번역상의 오래된 투식이나 번역자의 문장능력 부족 등으로 인해 비문법적인 (...) 문장을 구사하게 되는 문제점을 들었다. 끝으로 번역서의 교감과 주석을 고찰하여 번역의 완성을 꾀하였다. 전문서적의 번역화는 더욱 필요한 분야이지만, 한문원전의 경우, 해당전문인은 한문에 대한 이해가 부족하고, 한문능력자는 해당분야에 문외한인 경우가 많아 언제나 오역의 위험에 노출되어 있다. 따라서 전문서적의 번역은 전문가와 번역자의 협력하는 관계가 이루어질 때 양질의 번역서가 탄생할 것이며 학문연구의 중요한 기반이 될 것이다.
