Unlike most countries, the United States and Israel have employed the class action procedure for decades. This Article compares the two countries’ class action regimes and examines how the device has evolved in those countries. It examines the current procedures, as well as proposed reforms. It also compares class action statistics in the two countries relating to filings and outcomes. We demonstrate the many common features between the United States and Israeli class (...) class='Hi'>action procedures. As we illustrate, these common features have led to robust class action practices in both countries. At the same time, there are profound differences between the types of class actions filed and their outcomes. Thus, while Israel has many more class actions than the United States on a per capita basis, the cases are much less consequential from a monetary and subject matter perspective. We explore possible explanations for these observations. Furthermore, this study identifies features — utilized by the United States and Israel — that can serve as models for other countries that are adopting or amending their own class action regimes. This Article attempts to clarify a proposition of certain Canadian authors that while class actions represent a significant part of our court activities, they may not truly be compensating our citizens. I argue that leading up to the present study, we did not know for certain whether a class action was an effective mechanism to compensate class members. Through empirical data collected up by the Class Actions Lab from the past twelve years from cases filed (...) in the province of Quebec, District of Montreal, analyzed through the lens of a collective approach to compensation, I demonstrate that Quebec citizens are in fact being compensated by class actions. Hoffman v. Monsanto raises questions about the civil litigation system. Are courts appropriate institutions, and are class actions the appropriate procedure, for resolving disputes about genetically modified organisms (GMOs)? After addressing the institutional question, this article focuses on procedure. Although class actions are designed to empower group litigation, environmental class actions are rarely permitted. This is partly because their claims for private law actions seeking monetary compensation cause courts to focus on individual aspects of the problem, and (...) the collective harm caused by widespread environmental effects is overlooked. Because most environmental lawsuits are prohibitively complex and expensive for individuals to litigate, this results in a denial of justice. It also prevents courts from playing their institutional role in the struggle to craft appropriate legal responses to GMOs. Greater focus on the role of groups and the collective nature of environmental harms would lead to different approaches to interpreting class action procedure. (shrink)

Punitive damages and class actions can be viewed as sharing a common economic function - creating optimal deterrence. This is a function that these remedies can best pursue in different domains. When a tortfeasor causes harm that affects many victims, the preferred remedy is a class action. This is especially so when the amount of compensatory damages are high.There are scenarios, however, in which imposing punitive damages represents the best solution. We identify some of these scenarios to (...) suggest the proper domains of these two remedies. Finally, we identify situations where a combined use of these two remedies is desirable. We suggest that when the amount of losses suffered by victims is so small as to preclude a class action due to transaction costs and inactivity, it may nevertheless be useful to combine punitive damages with a class action. Punitive damages should be awarded within a class action if and only if there are frictions that could prevent the injured party from taking legal action. (shrink)

The “American-style” class action, when combined with private rights, is an important tool of American regulatory policy. And just as American regulation has global reach, the global class action is not unfamiliar to U.S. courts. Yet, global U.S. class actions are facing ever-stronger headwinds. In addition to the recent retrenchment of class actions and international litigation generally, U.S. courts have raised additional barriers to global class actions in particular. This Article’s first goal, therefore, (...) is to document these developments and their consequences for regulation. Against this backdrop, this Article also reviews the options available to foreign lawmakers, foreign courts, foreign litigants and litigation funders, and foreign public enforcers. Foreign lawmakers may provide alternatives to global U.S. class actions; foreign courts and foreign litigants may explicitly or implicitly coordinate to approximate global class resolution; and foreign public enforcers may achieve the goals of global regulatory litigation while avoiding some of its legal impediments. Finally, this Article evaluates these various foreign responses from an institutional perspective, with special attention to the institutional incentives for lawmakers and law enforcers. (shrink)

There is a long-standing debate about whether the costs associated with the potential misuse of securities class action (SCA) litigation outweigh its benefits in strengthening investor protection. We address this debate by examining the market reaction to the ruling in China’s first SCA-style Special Securities Representative Action (SSRA), filed against Kangmei Pharmaceutical. We find that investors react positively to the ruling, suggesting that the adoption of SCA litigation is perceived as value-enhancing. Extending ethical decision-making theory, we show (...) that legal enforcement increases the perceived seriousness of consequences and thereby reshapes both organizational reporting behavior and individual director responses. Specifically, a difference-in-differences analysis reveals that firms with greater ex ante litigation risk improve their financial reporting quality and reduce the incidence of accounting violations and restatements following the ruling. We further show that independent directors are more likely to depart from firms with higher agency conflicts, indicating that individual responses to enforcement depend on the governance environment in which directors serve. Overall, our evidence highlights the effectiveness and value implications of adopting and enforcing SCA litigation in China and provides important conceptual and policy insights for emerging markets with civil law systems and relatively underdeveloped institutions. Class action lawsuits and the justice that they are supposed to enforce have become of great concem to legislators in recent years. The traditional ruIes of tort liability cannot completely support the court decisions that have been reached. The rulings, however, are clearly in the interest of giving victims the justice that they are due. Legal scholars, such as Jules Coleman, claim that the conflicts between tort liability and class action justice cannot be reconciled in our (...) legal system. I propose an avenue of analysis whereby the principles of justice that support tort law are preserved as needed for modem issues, yet at the same time address the genuine public policy concems in these class actions. In an ongoing class action suit against large tobacco companies, including Philip Morris, Inc., and R.J. Reynolds Tobacco Co., Judge Jack B. Weinstein of the U.S. District Court for the Eastern District of New York issued an opinion on October 15, 2002 making statistical proof available to address plaintiffs’ common questions and prove required elements of consumer fraud.The dilemmas inherent in tobacco litigation as a mass tort action include overcoming the collective action problem, mobilizing appropriate and (...) persuasive legal theories for recovery, and meeting the standards of proof, all in a timely and cost-effective manner. China has a civil procedure for collective litigation, which is dubbed Chinese-style class action, as it differs from the U.S.-style class action in some important ways. Using securities class action as a case study, this Article empirically examines both the quantity and quality of reported cases in China. It shows that the number of cases is much lower than expected, but the percentage of recovery is significantly higher than that in the United States. Based (...) on this, the Article casts doubt on the popular belief that China should adopt the U.S.-style class action, and sheds light on the much-debated issue concerning the relationship between public and private enforcement of securities law. The Article also discusses the future prospects of securities class action in China in light of some recent developments which may provide its functional equivalents, including the regulator-brokered compensation fund and public interest group litigation. The business and human rights landscape has shifted significantly in the last two decades (Bilchitz & Deva, Human rights obligations of business: Beyond the corporate responsibility to respect?, pp. 1–26, 2013). Human rights are no longer seen as “add-on” issues to businesses and are progressively becoming the subject of litigation (Hackett et al., Envtl L Rep 50:10849, 2020). This chapter uses the Kabwe class action, which is currently before the Johannesburg High Court, to explore how issues of human (...) rights are increasingly relevant to businesses, and particularly to those who profess to uphold human rights standards in their environmental, social, and governance (ESG) reporting. While ESG reporting has been heavily criticised for downplaying the adverse impacts of corporations (De Silva Lokuwaduge & De Silva, Australas Account Bus Fin J 16(1):146–159, 2022), the rise in ESG-related litigation provides an alternative outlook—a standard for stakeholders to judge business conduct. Similarly, against the backdrop of the negotiations for a binding Business and Human Rights Treaty and the pursuit of environmental justice, claimants have turned to courts to find redress for cross-border corporate harm (Setzer & Vanhala, Wiley Interdiscip Rev Clim Change 10(3):e580, 2019). In the case of Kabwe, a group of Zambian claimants, primarily made up of women and children, seek to hold Anglo American South Africa liable for lead poisoning as a result of decades of environmental pollution caused by the operation of one of its former subsidiaries. This case offers some insight into how claimants are using published statements related to parent company involvement in the operations of their subsidiaries in order to assert legal responsibility. This chapter analyses how the Kabwe class action reflects the view that corporations are social actors and how adverse impacts on people and the environment can lead to ESG litigation risks. It concludes by stating that ESG-related litigation offers claimants who have suffered harm as a result of corporate conduct an avenue for justice as well as ensures that corporations can no longer discard human rights issues in their operations. The world famous Eltroxin saga of 2009–2011, which ignited heated public debates in Europe, Canada, and Australia, reveals the problematic nature of standalone autonomy protection cases. Eltroxin is a life-sustaining thyroid hormone replacement medicine used by millions worldwide; it was reformulated in 2008, and around 10% of patients were badly affected. Poor communication and lack of professional information triggered public hysteria as a global wave of complaints about harmful side effects, including hair loss, weight gain, extreme fatigue, headaches, diarrhoea, and (...) heightened heart rates, flooded the media. Israeli Eltroxin users (around 250 thousand people) were similarly unaware. Following many media reports and ministerial regulations, a high-profile consumer class action was launched against Perrigo, the distributor. Ten years of court proceedings culminated in a compensation settlement of approximately US$ 14 million. This relatively low sum covered the injuries of those patients who were physically affected; compensation for standalone autonomy injuries to all patients (who were denied information about changes to their life-sustaining medicine) was refused. The monetary settlement and court decision were hugely disappointing to the class plaintiffs, and a negative signal was sent to the proponents of consumers' and patients' personal autonomy. However, the class action still marked a positive change in pharmaceutical protocols for relations between health authorities, commercial pharmacy entities, and patients/consumers as seen by the proactive communication around a subsequent Eltroxin reformulation in 2020 in Israel, Europe, and South Africa (Aspen Pharmacare, 2020).1 This paper highlights the vast potential value of consumer class action proceedings, and pharmaceutical consumer (patient) class actions in particular, for public welfare and private autonomy. The paper will explain leading Israeli case law related to consumer autonomy protection in tort law and will argue that this law still holds the unique protection of autonomy as a basic human right and accordingly recognises harm to autonomy as a viable form of damage. Additionally, it illustrates why and how consumer protection class actions are an important tool for protection of human rights in general and of patients' rights in particular. (shrink)

This Article highlights that when procedural rules are legislated and there is substantial coordination between the executive and legislative branches, procedures with potential structural impact are weighted against alternative means of policymaking and implementation. This makes many Continental law countries, parliamentary countries, and countries governed by solid national majorities with substantial control over elected branches, and in general places where power is less fragmented, less likely to encourage American-style class actions. This is manifested in legislative choices of a private (...) enforcement regime for class actions, which, when allowed, is designed to be subordinate to or to piggyback on the enforcement of preexisting bureaucracies. In the United States, there has been tremendous growth in a form of third-party litigation financing where investors buy pieces of lawsuits from plaintiffs. Many scholars believe that this new financing helps to balance the risk tolerance of plaintiffs and defendants and thereby facilitates the resolution of litigation in a way that more closely tracks the goals of the substantive law. In this Article, I ask whether these risk-balancing virtues of claim investing carry over into class action cases. (...) This is a question that has not yet been addressed by scholars because many think it is not possible for financiers to buy pieces of class action lawsuits in the United States. But I show that such investments are neither impractical nor unethical; indeed, it appears that they are already here. It is therefore worth considering whether the investments confer the same social benefits they do in other cases. I argue that although class members do not need a risk transfer device in class action cases because they are almost always risk-neutral in light of their small losses, their lawyers do need such a device. Although this does not necessarily mean that claim investing is socially desirable overall in class actions, the social costs that have thus far been identified with claim investing seem modest compared to the benefits. Writings on epistemic injustice have assessed how people can be harmed in their capacity as knowers when they are a racial minority, a woman, disabled and so on. But what about when they belong to the working class? This paper is an initial attempt to understand why class has so far received limited attention within writings on epistemic injustice and to respond to these reasons. It focuses on how testimonial and hermeneutic injustices specifically harm workers in ways distinctive (...) from the harm one might suffer due to other social identities. It does this by drawing attention to the special case of industrial strike action and the play of conceptual resources and credibility assessments that influence the action’s success. Additionally, it provides a first-time exposition for social epistemologists on what I term the ‘class compositional approach’, derived from 1960-70s Italian labour struggles. This approach, I argue, succeeds in evading the criticism of class reductionism while developing recent philosophical work on class-based injustice. (shrink)

This chapter explores the conceptual connection between collateral estoppel and the preclusion doctrine of virtual representation. It points out the difference between estoppel, which can only benefit nonparties, and virtual representation, which allows nonparties to be adversely bound by judgments. This chapter also offers an account of the jurisprudential debate in American law about the appropriateness of virtual representation and the related Supreme Court precedents to show how this doctrine must not be taken pro tanto as adequate representation, a due (...) process requirement in class actions, to justify preclusion simply by prior litigation of the same issue by someone with the same interest. Finally, it argues that nonparties can assert preclusion in their benefit but cannot be bound aversely by judgments given in cases without their participation or consent, which is the appropriate interpretation of collateral estoppel in light of class actions, virtual and adequate representation and the individual right to a day in court. Action research and reflective thinking can enhance learning since both processes provide students with the opportunities to step back and think about how they actually solve problems. While there is a robust academic inquiry on reflection practices and AR in the educational setting, investigating learners’ reflections through AR practices can shed more light on related research. This study implemented reflective journal writing through AR and aimed to investigate the participants’ views about reflective journal writing, the effects of journal writing (...) on RT development, and the learners’ grammar use in writing. Eighty language learners formed the two experimental and control groups of the study. The possible relationship between the RT level and participants’ final exam was checked. Analyses of the participants’ journals, the semi-structured interview, the questionnaires’ results, and the final exam scores were considered. The findings showed that the participants had positive views about journal writing, and they could enhance their level of RT as well as their grammar use in writing; nevertheless, no relationship between the RT level and final exam scores of the participants was found. The methodology and the results of the study could be conducive to welcoming alternative methods of teaching and assessment that encourage the learners’ reflective practices and active engagements in language classes. The title of this book is perhaps a little misleading, giving the impression that it has a contemporary focus in which the relationship between social class and educational experiences are explored. In reality the focus is strongly historical with in-depth discussions of the contributions of relatively unknown commentators and schools of thought. The book is also very American in focus, both in terms of its philosophical framing and it's policy focus. As a sociologist with an interest in social (...) class='Hi'>class and educational inequalities, I learnt things about the early development of the American class structure that were novel and enlightening, yet found much of the material narrow and even tedious. Recently, a range of educational theorists have explored and extended upon popular currents in political theory through articulating “open” and “unknowing” pedagogies. Such contributions represent a radical turn away from the presumed “universals” found in proclamations of justice and emancipation and, ultimately, the centering of class analysis. At the same time, inspired by and building upon Bourdieuian theory, another cluster of educational research has developed a nuanced understanding of the social, cultural, and educational mechanisms involved in class reproduction. Bringing together theories of reproduction in conversation with theories of pedagogical possibility, Gerrard argues for a renewed understanding of working-class relations to education that incorporates an understanding of working-class action and struggle. The reference class problem arises when we want to assign a probability to a proposition (or sentence, or event) X, which may be classified in various ways, yet its probability can change depending on how it is classified. The problem is usually regarded as one specifically for the frequentist interpretation of probability and is often considered fatal to it. I argue that versions of the classical, logical, propensity and subjectivist interpretations also fall prey to their own variants of the (...) reference class problem. Other versions of these interpretations apparently evade the problem. But I contend that they are all “no-theory” theories of probability - accounts that leave quite obscure why probability should function as a guide to life, a suitable basis for rational inference and action. The reference class problem besets those theories that are genuinely informative and that plausibly constrain our inductive reasonings and decisions. I distinguish a “metaphysical” and an “epistemological” reference class problem. I submit that we can dissolve the former problem by recognizing that probability is fundamentally a two-place notion: conditional probability is the proper primitive of probability theory. However, I concede that the epistemological problem remains. (shrink)

In this chapter I consider some possibilities for responsible research practice geared to reviewing race(d) relations (and their link to classed relations). I discuss in depth an example of research in South Africa which involved initially setting up a cross-racial Focus group, which was then followed up with one-to-one interviews/conversations and group Conversation. The research is set in Margate, and was initiated by me. Because this example concerns issues of “race” and racism in South Africa, I open the chapter with (...) a narration of my learning the meaning of Whiteness as a child in the context of apartheid South Africa, which forms a backdrop to my further Storying in this chapter. Through this example, I wish to show how the banner of research (re-exploring issues not normally discussed in everyday life) allowed discussions to become generated and actions to become pursued that (arguably) otherwise would not have occurred if the research had not been embarked upon. I also show in this case how I tried to “give back” as part of my responsibility to nurture a relationship of Reciprocity, while also being involved with participants in a wider effort to create Theorizingforward-looking stories (for readers to engage with). In ‘Rationality and Revolution’ Nancy Holmstrom addresses an issue that has gained considerable currency among social and political theorists. She asks what insight, if any, Marxists might glean from rational choice accounts of radical working class collective action. The purpose of this comment is to argue that Holmstrom’s unfavorable estimation of rational choice accounts is ill-conceived.Holmstrom raises two basic objections to rational choice explanations of working class collective action. First, she contends that such accounts are limited, (...) inadequate or incomplete and indicates several manifestations of this purported deficiency. Second, Holmstrom alleges that rational choice accounts are ideologically suspect and, as such, fundamentally at odds with Marxist explanations of revolutionary action. Holmstrom appears to believe that this second line of criticism ‘follows’ in some sense upon the first. H so, it would be sufficient to establish the error of her initial line of argument. Because neither of her criticisms can withstand scrutiny, however, independent reasons will be advanced for rejecting each. (shrink)

This dissertation aims to analyze, clarify, and reconstruct the concept of class consciousness by developing a dialectical account of political agency at work in the concept. I defend a dialectical account of agency, that includes both the way in which individuals come together to form groups, but also the capacity of a collective to transform social conditions. I argue that this account of political agency is necessary in order to understand the possibility of social transformation or change. I trace (...) the development of the relationship between consciousness and agency in the early tradition of Western Marxism, focusing primarily on the account of class consciousness given by Georg Lukács in History and Class Consciousness. Against his account of the world historical agency of a unified proletariat, however, I defend Theodor Adorno’s insistence on nonidentity, and the importance of unreconciled groups in capitalist society. In order to understand these groups, such as the vanguard, party, or proletariat, we must understand the way in which individuals form groups, as well as their inherent collectivity. My account of the political agency at work in the concept of class consciousness is broadly speaking pluralist. I argue that a multiplicity of methodologies is needed in order to arrive at a complete picture of the concept. I defend an account of class consciousness that is neither reductive nor deflationary with respect to other dimensions of social domination. This class forward approach seeks to build intersectional political coalitions in order to undertake revolutionary action. Successful revolutionary social transformation is never guaranteed in advance; however, the concept of class consciousness, reconstructed through the lens of political agency, offers conceptual resources to address the problems of today, for the sake of a better tomorrow. Race, Class, Gender, and Sexuality: The Big Questions is a welcome addition to the crop of anthologies on “contemporary issues.” In the past, the tag “contemporary issues” meant abortion, pornography, euthanasia, affirmative action, and the other usual suspects. Anthology after anthology dealt with these same life-and-death issues, often reproducing the same articles. But that has changed in the last couple of years as interest in topics such as sexuality, gender, race, nationalism, and multiculturalism has reanimated the field.

The research study aimed at assessing the various difficulties that speech teachers had in delivering lessons during the distance learning era. The various phenomena and themes that emerged from the survey were determined using a descriptive research design. The survey was conducted to collect information about the various characteristics and behavior of speech teachers. It also explored the factors that influenced their decisions and actions when it came to addressing the pandemic. The repeated themes that emerged, include low motivation, altered (...) activities, unstable internet connection, comprehension, questionable output integrity, delayed submissions, in-person monitoring, and the system of communicating with inactive students in online mode. Using Marcuse's theory of the total mobilization of advanced technology society along the lines of what he calls “the performance principle,” I attempt to describe the complex composition of class oppression in the classroom. Students conceive of themselves as economic units, customers pursuing neutral interests in a morally neutral, socio‐economic system of capitalist competition. The classic, unreflective conception of the classroom responds to this by implicitly endorsing individualism and ideals of humanist citizenship. While racism and cultural diversity have come (...) to count as elements of liberal intelligence in most college curricula, attempts to theorize these aspects of social and individual identity and place them in a broader content of class appear radical and inconsistent with the humanistic notion that we all have control over who we are and what we achieve. But tags such as “radical” and “unrealistic” mark a society based on the performance principle. Marcuse allows us to recognize a single author behind elements of psychology, metaphysics, and capitalism. The fact that bell hooks hits upon a similar notion suggests that we might use Marcuse's theory of the truly liberatory potential of imagination to transform and reconceive our classrooms so that the insidious effects of class, racism, and individualistic apathy might be subverted. Specifically, I outline and place into this theoretical context three concrete pedagogical practices: (a) the use of the physical space of the classroom; (b) the performance of community through group readings and short full‐class ceremonies, and (c) the symbolic modeling represented by interdisciplinary approaches to teaching. All three of these practices engage students in ways that co‐curricularly subvert class (and, incidentally, race divisions) and allow students to imagine, and so engage in, political action for justice as they see it. This article uses a case study of vocational training in Norway to explore the conditions under which employers will cooperate to increase the skill level of their workforce. It generates two sets of insights into the political economy of training in coordinated market economies. First, by demonstrating that cooperation among employers was a recent achievement that required the creation of specific, targeted mechanisms, it suggests that a cooperative outcome is difficult to attain, even amid the generally hospitable institutional environment characteristic (...) of these economies. Second, it demonstrates that the employer collective action problem with respect to the initial training of apprentices differs from that posed by the additional raining of experienced workers. This means that even within a single economy, there are several varieties of training politics, each characterized by different patterns of cooperation and conflict; this further complicates the task of creating a coordinated training regime. This article examines the phenomenon of collective or aggregate civil litigation, manifested in different forms as a class action, representative action, or group action. Different countries have adopted different models of collective civil litigation. This diversity presents a challenge in drawing comparisons, and raises the need to study the different techniques involved. This article summarizes the adoption of a technical perspective. Following this, the article reviews the availability and limitations of the research techniques in relation to (...) what we want. It discusses the questions of goals of collective procedures, levels of need, technical modes of operation, and evaluation. The ultimate goal is to be able to compare different techniques and decide which ones might work best and in what circumstances or types of situation. Its primary ordering axis — atomic number Z, a count of protons — presupposes particle ontology at every level. Several structural anomalies persist within this framework: hydrogen's dual chemical character, helium's ambiguous placement, and the discontinuous displacement of lanthanides and actinides from the main table body. This design study, conducted with 41 undergraduate students enrolled in an introductory college psychology class, describes a practical method for professors and learners to use action science and Gordon Pask’s cybernetics to co-design curricula fit for the Information Age by jointly bringing past experiences, acting, and reflecting as they use AI and other cutting-edge technologies in class, and in their everyday lives. Two cycles of experience, action, and reflection are described. Pask’s cybernetics is used to visualize (...) blueprints of human-computer interaction. Narrative inquiries and network statistics form representable data that draw out insights on implementing new technology-assisted educational activities in real-time and refining them by overcoming social and structural bottlenecks. In Classroom 1, students initially encouraged adding an AI component to storyboarding assignments and shared it helped overcome apprehensions with drawing/artmaking. However, AI sometimes failed to create consistent narratives and add legible texts/captions to images (structural bottlenecks). Classroom 2’s curriculum incorporates feedback from Classroom 1, providing specific instructions to prompt characters consistently in storyboards, and manually add captions. Modifications led to greater efficiency in storyboarding for 19 students next Spring. These learners investigated how to increase interactivity of class discussions in which students often refrained from responding to each other (social bottleneck) using AI chatbots. Network analysis revealed transitivity and eigen centrality were higher in AI group chats. Qualitative reflections highlighted student co-agency in facilitating AI-mediated conversations. Students’ insights fueled future adaptations in the discussion activity, including explicit instructions to review class slides and develop consensus, and a post-chat debrief to allow students to discuss perspectives with other groups. An action is a pair of sets, C and S, and a function \. Rothschild and Yalcin gave a simple axiomatic characterization of those actions arising from set intersection, i.e. for which the elements of C and S can be identified with sets in such a way that elements of S act on elements of C by intersection. We introduce and axiomatically characterize two natural classes of actions which arise from set intersection and union. In the first class, (...) the \-actions, each element of S is identified with a pair of sets \\), which act on a set c by intersection with \ and union with \. In the second class, the \-biactions, each element of S is labeled as an intersection or a union, and acts accordingly on C. We give intuitive examples of these actions, one involving conversations and another a university’s changing student body. The examples give some motivation for considering these actions, and also help give intuitive readings of the axioms. The class of \-actions is closely related to a class of single-sorted algebras, which was previously treated by Margolis et al., albeit in another guise, and we note this connection. Along the way, we make some useful, though very general, observations about axiomatization and representation problems for classes of algebras. (shrink)

This paper explores how gender can operate as a disguise for class in an examination of the self-sacrifice of the Maiden in Euripides' Children of Herakles. In Part I, I discuss the role of human sacrifice in terms of its radical potential to transform society and the role of class struggle in Athens. In Part II, I argue that the representation of women was intimately connected with the social and political life of the polis. In a discussion of (...) iconography, the theater industry and audience I argue that female characters became one of the means by which different groups promoted partisan interests based on class and social status. In Part III, I show how the Maiden solicits the competing interests of the theater audience. After discussing the centrality and marginality of the Maiden's character, I draw upon the funeral oration as a comparative model with which to understand the quite different role of self-sacrifice in tragedy. In addition to representing and mystifying the interests of elite, lower class and marginal groups, the play glorifies a subordinate character whose contradictory social status embodies the social position of other “marginal” members of Athenian society. The play stages a model for taking political action to transform the social system and for commemorating the tragic costs of such undertakings. (shrink)

This study employs Bayesian inference to explore class-based differences in moral judgment. Based on the dual-process perspective in interdisciplinary action theory, we estimate in a first step a process model which differentiates parametrically between emotionally driven deontological, deliberatively driven utilitarian, and residual judgmental inclinations. In a second step, our estimates of these parameters are correlated via beta regressions with indicators of social class and thinking dispositions. We find a considerable association between social class, specifically income, and (...) deontological inclinations, whereas consequentialist inclinations correlate with thinking dispositions but not with social class. This research underscores the utility of Bayesian estimation in closing the gap between theoretical and statistical modelling. Employing this approach enhances our understanding of the nuanced interplay between intuitive and deliberative processes in moral judgment and, more generally, offers a promising direction for advancing sociological action theory. Closed-loop administration of propofol for the control of hypnosis in anesthesia has evidenced an outperformance when comparing it with manual administration in terms of drug consumption and post-operative recovery of patients. Unlike other systems, the success of this strategy lies on the availability of a feedback variable capable of quantifying the current hypnotic state of the patient. However, the appearance of anomalies during the anesthetic process may result in inaccurate actions of the automatic controller. These anomalies may come from the (...) monitors, the syringe pumps, the actions of the surgeon or even from alterations in patients. This could produce adverse side effects that can affect the patient postoperative and reduce the safety of the patient in the operating room. Then, the use of anomaly detection techniques plays a significant role to avoid this undesirable situations. This work assesses different one-class intelligent techniques to detect anomalies in patients undergoing general anesthesia. Due to the difficulty of obtaining real data from anomaly situations, artificial outliers are generated to check the performance of each classifier. The final model presents successful performance. Introduction: It is customary in the dominant English and related schools of philosophy to restrict the terms “action” or “agency.” That is, when the topic is ‘philosophy of action’. This is often done by an appeal to intuition about a few examples. If I fall over, you wouldn’t usually call that an action on my part; it’s not something that I do, it is rather something that happens to me. Donald Davidson has made a more serious attempt (...) than this at explaining a restriction on the term “action,” or what he means by “agency.” “Intentional action” is an insufficient designation for him: it determines no class of events, because an action which is intentional under one description may not be intentional under another. And anyway there are unintentional actions, which he doesn’t want to say are not actions in the restricted sense in which he wants to apply the term. So he suggests that we have an action (in the restricted sense) if what is done (no restriction on the ordinary sense here) is intentional under some description. This allows pouring out coffee when I meant to pour out tea to be an action, being intentional under the description “pouring out liquid from this pot.” I fear, however, that it may allow tripping over the edge of the carpet to be an action too, if every part of an intentional progress across the room is intentional under that description. But Davidson doesn’t want to count tripping as an action. If this is right, then his account is wrong because it lets in what he wants to exclude. Furthermore, I don’t think it comprises omissions, which are often actions. (shrink)

The transition to twenty-first century post-industrial capitalism from the 'welfare' industrial capitalism of the twentieth century, has affected the ways in which class is lived in terms of relational inequality and the factors that structure identity. Class After Industry takes a complex realist approach to the dynamics of individual lives, places, the social structure and analyses their significance in terms of class. A wide range of quantitative and qualitative studies are drawn on to explore how 'life after (...) industry' shapes class, and the consequent potential for social change. The book will be of interest across the social sciences and beyond, to those concerned with how class forms might translate into political action. (shrink)

In this paper, I distinguish three claims, which I label individual intentional autonomy, individual intentional autarky, and intentional individualism. The autonomy claim is that under normal circumstances, each individual's behavior has to be interpreted as his or her own action. The autarky claim is that the intentional interpretation of an individual's behavior has to bottom out in that individual's own volitions, or pro-attitudes. The individualism claim is weaker, arguing that any interpretation of an individual's behavior has to be given (...) in terms of individual intentional states. I argue that individual intentional autonomy implies neither individual intentional autarky, nor intentional individualism, with which it is usually lumped together. I further argue that this insight is the key to an adequate view of an important class of actions, i.e., plural actions. (shrink)

This paper critiques what it sees as a tendency on the part of certain social researchers to engage in moralistic critiques of middle-class parents, especially in relation to the choices and actions of such parents within educational quasi-markets. It proceeds to a linked critique of the influence within education of certain aspects of the work of Pierre Bourdieu, with particular reference to the concepts of symbolic violence and the depiction of cultural meanings as arbitrary. It is argued that both (...) these developments involve unhelpful and unjustified forms of reductionism that could have the effect of alienating middle-class support for a range of broadly progressive political endeavours within and beyond education.
