In this paper, I take up the conciliatory-steadfast debate occurring within social epistemology in regards to the phenomenon of peer disagreement. I will argue, because the conciliatory perspective al-lows us to understand argumentation pragmatically—as a method of problem-solving within a community rather than as a method for obtaining the truth—that in most cases, we should not simply agree to disagree.

The paper offers a theoretical investigation into the sources of normativity in practical argumentation. The chief question is: Do we need objectively-minded, unbiased arguers or can we count on “good” argumentative processes in which individual biases cancel each other out? I address this question by analysing a detailed structure of practical argument and its varieties, and by discussing the tenets of a comparative approach to practical reason. I argue that given the comparative structure proposed, reasoned advocacy in argumentative activity (...) upholds reasonableness whenever that activity is adequately designed. In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

The book offers a compact but comprehensive introductory overview of the crucial components of argumentation theory. In presenting this overview, argumentation is consistently approached from a pragma-dialectical perspective by viewing it pragmatically as a goal-directed communicative activity and dialectically as part of a regulated critical exchange aimed at resolving a difference of opinion. As a result, the book also systematically explains how the constitutive parts of the pragma-dialectical theory of argumentation, which are discussed in a number of (...) separate publications, hang together. The detection of hate speech and fake news in political discourse is at the same time a crucial necessity for democratic societies and a challenge for several areas of study. However, most of the studies have focused on what is explicitly stated: false article information, language that expresses hatred, derogatory expressions. This paper argues that the explicit dimension of manipulation is only one – and the least problematic – of the risks of political discourse. The language of the unsaid is (...) much more dangerous and incomparably more difficult to detect, hidden in different types of fallacies and inappropriate uses of emotive language. Through a threefold coding scheme based on the instruments of argumentation theory and pragmatics, a corpus of argumentative tweets published by 4 politicians (Matteo Salvini, Donald Trump, Jair Bolsonaro, and Joseph Biden) within 6 months from their taking office (corresponding to the official end of their election campaign) is analyzed, detecting the types of argument, the fallacies, and the uses and misuses of “emotive words.” This coding results in the argumentation profiles of the speakers, which are compared statistically to show their different implicit strategies and deceptive tactics. Janice Moulton's “The Adversary Method: A Philosophical Paradigm” articulated several criticisms of the popular idea of philosophy as adversarial debate. Moulton criticizes it on epistemic grounds, arguing that philosophy's overreliance on adversarial debate is to the detriment of its goals. Some, notably Trudy Govier, have argued in favor of at least a minimal adversariality, governed by norms of respectful argumentation. This paper suggests that Govier's faith in these norms is misplaced, because it neglects the social circumstances of the arguers. (...) While some authors have argued that politeness and aggression apply differently to those of different genders, this paper extends that analysis to social identities other than gender. In fact, given certain assumptions about the philosophy of language, engagement in polite adversarial debate may not even be possible for people occupying certain social locations. (shrink)

The study presented here examines how interacting with a more capable interlocutor influences use of argumentation strategies in electronic discourse. To address this question, 54 young adolescents participating in an intervention centered on electronic peer dialogs were randomly assigned to either an experimental or control condition. In both conditions, pairs who held the same position on a social issue engaged in a series of electronic dialogs with pairs who held an opposing position. In the experimental condition, in some dialogs, (...) unbeknownst to them (because dialog took place electronically), the opponent was a more capable (“expert”) adult. Dialogs in the control condition were only with peers. Argumentation strategies of the experimental group who argued with the “expert” showed immediate strategy improvements in their subsequent peer dialogs, improvement absent in the control group (Cohen's d = 1.12). In particular, the experimental group showed greater use of counterargument in general and advanced forms of counterargument (undermining) that challenges the deeper premises or reasoning on which an argument is based. Implications with respect to mechanisms of change in the development of argumentation skills are considered. (shrink)

We present a high-level declarative programming language for representing argumentation schemes, where schemes represented in this language can be easily validated by domain experts, including developers of argumentation schemes in informal logic and philosophy, and serve as executable specifications for automatically constructing arguments, when applied to a set of assumptions. This new rule language for representing argumentation schemes is validated by using it to represent twenty representative argumentation schemes.

In their extensive overview of various concepts of presumption Godden and Walton recognise “the heterogeneous picture of presumptions that exists in argumentation theory today”. I argue that this heterogeneity results from an epiphenomenal character of the notion of presumption. To this end, I first distinguish between three main classes of presumptions. Framework presumptions define the basic conditions of linguistic understanding and meaningful conversation. The “presumption of veracity” is their paradigm case. I argue that such presumptions are satisfactorily covered by (...) the Principle of Charity, or else Gricean maxims or satisfaction conditions for speech acts. Formal presumptions are general presumptive rules of argument, theorised as topoi or acceptable inference warrants, including institutional warrants. Material presumptions are acceptable outcomes of nested or outsourced arguments, which entitles arguers to use them as acceptable premises or opinions in further arguments without the typical burden of proof. If this is correct, then the study of presumption always collapses into the study of other, likely more fundamental, concepts. Does it render presumptions, by Occam’s Razor, altogether redundant in argumentation theory? I tentatively answer this question from a consistently conversational perspective on argumentation; I argue that the pragmatic grounds for presumptions are to be found in the conditions for speech act performance in the institutional social world, as developed by Searle. Argumentation underpins and shapes the decision-making, problem-solving, and conflict management which are fundamental to human relationships. This dyadic bias undermines the capacity to engage argumentation in complex communication in contemporary, digital society. Philosophy’s adversarial argumentation style is often noted as a factor contributing to the low numbers of women in philosophy. I argue that there is a level of adversariality peculiar to philosophy that merits specific feminist examination, yet doesn’t assume controversial gender differences claims. The dominance of the argument-as-war metaphor is not warranted, since this metaphor misconstrues the epistemic role of good argument as a tool of rational persuasion. This metaphor is entangled with the persisting narrative of embattled reason, which, (...) in turn, is linked to the sexism-informed narrative of the “man of reason” continually warding off or battling “feminine” unreason. In this paper it is shown how plausible reasoning of the kind illustrated in the ancient Greek example of the weak and strong man can be analyzed and evaluated using a procedure in which the pro evidence is weighed against the con evidence using formal, computational argumentation tools. It is shown by means of this famous example how plausible reasoning is based on an audience’s recognition of situations of a type they are familiar with as normal and comprehensible in (...) their shared common knowledge. The paper extends previous work on this example by using three new multiagent argumentation schemes closely related to the scheme for argument from negative consequences. (shrink)

In this paper, we study conditional preferences in abstract argumentation by introducing a new generalization of Dung-style argumentation frameworks (AFs) called Conditional Preference-based AFs (CPAFs). Each subset of arguments in a CPAF can be associated with its own preference relation. This generalizes existing approaches for preference-handling in abstract argumentation, and allows us to reason about conditional preferences in a general way. We conduct a principle-based analysis of CPAFs and compare them to related generalizations of AFs. Specifically, we (...) highlight similarities and differences to Modgil’s Extended AFs and show that our formalism can capture Value-based AFs. Our intuition is straightforward: yes, argumentation changes minds. It can’t be otherwise! But many cognitive and discursive habits seem to suggest otherwise. As the literature in the psychology of reasoning incessantly emphasizes, we hardly change our minds (and the minds of others) because a predisposed robust confirmation bias (or myside bias) is at work every time we argue, among other persistent cognitive illusions (Pohl, 2012), heuristics and biases (Santibáñez, 2023). To adequately answer the questions of why and how (...) class='Hi'>argumentation changes minds, if at all, this paper frames the problem in an evolutionary perspective. My main thesis is that argumentative competence changes minds because its ultimate goal (Laland et al., 2011; Scott-Phillips, Dickins & West, 2011) is to construct the future to predict more accurately (Suddendorf, Redshaw & Bulley, 2022). This idea converges with some evolutionary analysis of other cognitive skills and cultural inventions. To explain my perspective, I use the distinction between ultimate and proximal goals of a trait, and the cultural background of argumentative competence plays a fundamental role within this distinction. Notre intuition est simple: oui, l’argumentation change les men-talités. Mais de nombreuses habitudes cognitives et discursives suggèrent le contraire. Comme le soulignent sans cesse les écrits sur la psychologie du raisonnement, nous ne changeons guère d’avis parce qu’un biais de con-firmation robuste (ou biais de-mon-côté) prédisposé est à l’oeuvre lorsque nous argumentons. Pour répondre adéquatement aux questions de pour-quoi, comment et si l’argumentation change les mentalités, je pose le prob-lème dans une perspective évolution-niste. Je soutiens que la compétence ar-gumentative change les mentalités parce que son but ultime est de con-struire l’avenir, de prédire avec plus de précision. Cela converge avec les anal-yses évolutionnistes d’autres compé-tences cognitives et inventions cul-turelles. Pour expliquer ma perspec-tive, j’utilise la distinction entre les buts ultimes et proximaux d’un trait. (shrink)

Je soutiens également que contribuer à la coordination de l’action collective est le bénéfice particulier que l’argumentation est capable de produire dans ce contexte et que l’obtention de ce bénéfice constitue sa fonction principale. Normative argumentation theory is a field dedicated to the normative study of argumentation in real-life contexts and to the development of norms meant to guide arguers in the attempt to argue well. Among argumentation theorists, there exist two widespread assumptions. First, the assumption that ideally, arguers ought to explore the reasons relevant to the topic of their interpersonal arguing without constraints. And second, the assumption that the norms of argumentation should be designed to contribute to the (...) realization of this ideal. In this paper, I question those assumptions. I show that argumentative norms meant to realize the ideal of free exploration, freedom-to-explore norms, reliably clash with morally valuable standing norms that protect privacy, autonomy and legitimate authority. When they so clash, they generate epistemic and other morally relevant harms. I argue that normative argumentation theory ought to resolve this problem by acknowledging the potential legitimacy of standing norms even during argumentation. I show how such a change would impact fallacy theory with respect to the ad hominem and poisoning the well fallacies. (shrink)

This paper presents a comprehensive study of argumentation frameworks with necessities (AFNs), a bipolar extension of Dung Abstract argumentation frameworks (AFs) where the support relation captures a positive interaction between arguments having the meaning of necessity: the acceptance of an argument may require the acceptance of other argument(s). The paper discusses new main acceptability semantics for AFNs and their characterization both by a direct approach and a labelling approach. It examines the relationship between AFNs and Dung AFs and (...) shows the gain provided by the former in terms of concision. Finally, the paper shows how to represent an AFN as a normal logic program (LP) and vice versa and in both cases establishes a one-to-one correspondence between extensions under the main acceptability semantics (except for semi-stable semantics where the correspondence is not completely full) of an AFN and particular cases of 3-valued stable models of normal LPs. A leading expert in informal logic, Douglas Walton turns his attention in this new book to how reasoning operates in trials and other legal contexts, with special emphasis on the law of evidence. The new model he develops, drawing on methods of argumentation theory that are gaining wide acceptance in computing fields like artificial intelligence, can be used to identify, analyze, and evaluate specific types of legal argument. In contrast with approaches that rely on deductive and inductive logic and (...) rule out many common types of argument as fallacious, Walton’s aim is to provide a more expansive view of what can be considered "reasonable" in legal argument when it is construed as a dynamic, rule-governed, and goal-directed conversation. This dialogical model gives new meaning to the key notions of relevance and probative weight, with the latter analyzed in terms of pragmatic criteria for what constitutes plausible evidence rather than truth. Parmenides and Melissus employ different deductive styles for their different kinds of argumentation. The former’s poem flows in an interesting sequence of passages: contents foreword, methodological premises, krisis, conclusions and corollaries. The latter, however, organizes an extensive process of deduction to show the characteristics of what is. In both cases, the strength of their argument rests on their deductive form, on the syntactical level of their texts: the formal structure of their reasonings help to identify the features and logical (...) intersections of their thoughts. On the one hand, Parmenides uses modal reasoning, enforcing the employment of the principle of the excluded middle. On the other hand, Melissus radicalizes the use of modal reasoning and employs counterfactual statements in order to develop his doctrine of what is. Despite their differences, both deserve a place in the Stone Age of logic and theory of argumentation due to their common ambition to demonstrate what is. (shrink)
