Classifications are useful and efficient. We group things into kinds to facilitate the acquisition and transmission of important, often tacit, information about a particular entity qua member of some kind. Whilst it is universally acknowledged that classifications are useful, some scientific classifications (e.g. chemical elements) are held to higher epistemic standards than folk classifications (e.g. bugs). Scientific classifications in terms of ‘natural kinds’ are considered to be more reliable and successful because they are highly projectible and support law-like and inductive (...) generalisations. What counts as a natural kind is, however, controversial: according to essentialists (e.g. Putnam, Kripke, Ellis) natural kinds are mind-independent and possess essential characteristics; according to promiscuous realists (e.g. Dupre ) there are ‘countless legitimate, objectively grounded ways of classifying objects in the world’; and according to scientific realists (e.g. Boyd, Psillos) natural kinds are grounded in the ‘causal structure of the world’. More specifically, realism about kinds can be understood as a commitment to the existence of natural divisions (kinds) in the world that we come to know as a result of mature scientific investigation into the nature of such kinds. Realism about natural kinds is supported and articulated in terms of three main arguments, metaphysical, semantical, and epistemological. In the first part of my thesis I offer a sustained and systematic investigation of these three main arguments, with their respective promises and prospects for the viability of realism about kinds and I find them wanting, whilst in the second part of the thesis I pursue an unexplored line of inquiry regarding natural kinds and propose a mild realism about natural kinds via the ontology of real patterns. Calls to recognise animal rights and to abandon anthropocentrism are now virtually ubiquitous in pro-animal literature. However, these calls are plagued by conceptual confusion and theoretical misapprehensions. I recommend distinguishing between two meanings of anthropocentrism: epistemic anthropocentrism (the truism that we can only know the world as humans) and normative anthropocentrism (the idea that humans hold a special place in ethics). Anthropocentrism, in both these senses, is unavoidable. But this conclusion is without prejudice to the question of whether animals (...) have (moral) rights. Animals have such rights because their well-being matters independently of our own; and yet we can only affirm animal rights anthropocentrically. The fact that animals have moral rights, however, does not entail that making animals holders of fundamental legal rights is the unmitigated good it has been recently assumed to be. Not only would introducing legally protected fundamental animal rights risk compromising human rights practice and prove divisive; there is also little reason to think it would constitute the solution it is touted to be for the shortcomings of underinclusive and underenforced animal welfare laws. This paper offers a critique of the Bayesian interpretation of quantum mechanics with particular focus on a paper by Caves, Fuchs, and Schack containing a critique of the “objective preparations view” or OPV. It also aims to carry the discussion beyond the hardened positions of Bayesians and proponents of the OPV. Several claims made by Caves et al. are rebutted, including the claim that different pure states may legitimately be assigned to the same system at the same time, and the (...) claim that the quantum nature of a preparation device cannot legitimately be ignored. Both Bayesians and proponents of the OPV regard the time dependence of a quantum state as the continuous dependence on time of an evolving state of some kind. This leads to a false dilemma: quantum states are either objective states of nature or subjective states of belief. In reality they are neither. The present paper views the aforesaid dependence as a dependence on the time of the measurement to whose possible outcomes the quantum state serves to assign probabilities. This makes it possible to recognize the full implications of the only testable feature of the theory, viz., the probabilities it assigns to measurement outcomes. Most important among these are the objective fuzziness of all relative positions and momenta and the consequent incomplete spatiotemporal differentiation of the physical world. The latter makes it possible to draw a clear distinction between the macroscopic and the microscopic. This in turn makes it possible to understand the special status of measurements in all standard formulations of the theory. Whereas Bayesians have written contemptuously about the “folly” of conjoining “objective” to “probability,” there are various reasons why quantum-mechanical probabilities can be considered objective, not least the fact that they are needed to quantify an objective fuzziness. But this cannot be appreciated without giving thought to the makeup of the world, which Bayesians refuse to do. Doing this on the basis of how quantum mechanics assigns probabilities, one finds that what constitutes the macroworld is a single Ultimate Reality, about which we know nothing, except that it manifests the macroworld or manifests itself as the macroworld. The so-called microworld is neither a world nor a part of any world but instead is instrumental in the manifestation of the macroworld. Quantum mechanics affords us a glimpse “behind” the manifested world, at stages in the process of manifestation, but it does not allow us to describe what lies “behind” the manifested world except in terms of the finished product—the manifested world, for without the manifested world there is nothing in whose terms we could describe its manifestation. Kurt Gödel’s Incompleteness theorem is well known in Mathematics/Logic/Philosophy circles. Gödel was able to find a way for any given P (UTM), (read as, “P of UTM” for “Program of Universal Truth Machine”), actually to write down a complicated polynomial that has a solution iff (=if and only if), G is true, where G stands for a Gödel-sentence. So, if G’s truth is a necessary condition for the truth of a given polynomial, then P (UTM) has to answer first that (...) G is true in order to secure the truth of the said polynomial. But, interestingly, P (UTM) could never answer that G was true. This necessarily implies that there is at least one truth a P (UTM), however large it may be, cannot speak out. Daya Krishna and Karl Potter’s controversy regarding the construal of India’s Philosophies dates back to the time of Potter’s publication of “Presuppositions of India’s Philosophies” (1963, Englewood Cliffs Prentice-Hall Inc.) In attacking many of India’s philosophies, Daya Krishna appears to have unwittingly touched a crucial point: how can there be the knowledge of a ‘non-cognitive’ mokṣa? [‘mokṣa’ is the final state of existence of an individual away from Social Contract]—See this author’s Indian Social Contract and its Dissolution (2008) mokṣa does not permit the knowledge of one’s own self in the ordinary way with threefold distinction, i.e., subject–knowledge-object or knower–knowledge–known. But what is important is to demonstrate whether such ‘knowledge’ of non-cognitive mokṣa state can be logically shown, in a language, to be possible to attain, and that there is no contradiction involved in such demonstration, because, no one can possibly express the ‘experience-itself’ in language. Hence, if such ‘knowledge’ can be shown to be logically not impossible in language, then, not only Daya Krishna’s arguments against ‘non-cognitive mokṣa’ get refuted but also it would show the possibility of achieving ‘completeness’ in its truest sense, as opposed to Gödel’s ‘Incompleteness’. In such circumstances, man would himself become a Universal Truth Machine. This is because the final state of mokṣa is construed as the state of complete knowledge in Advaita. This possibility of ‘completeness’ is set in this paper in the backdrop of Śrī Śaṅkarācārya’s Advaitic (Non-dualistic) claim involved in the mahāvākyas (extra-ordinary propositions). (Mahāvākyas that Śaṅkara refers to are basically taken from different Upaniṣads. For example, “Aham Brahmāsmi” is from Bṛhadāraṇyaka Upanisad, and “Tattvamasi” is from Chāndogya Upaniṣad. Śrī Śaṅkarācārya has written extensively. His main works include his Commentary on Brahma-Sūtras, on major Upaniṣads, and on ŚrīmadBhagavadGītā, called Bhāṣyas of them, respectively. Almost all these works are available in English translation published by Advaita Ashrama, 5 Dehi Entally Road, Calcutta, 700014.) On the other hand, the ‘Incompleteness’ of Gödel is due to the intervening G-sentence, which has an adverse self-referential element. Gödel’s incompleteness theorem in its mathematical form with an elaborate introduction by R.W. Braithwaite can be found in Meltzer (Kurt Gödel: on formally undecidable propositions of principia mathematica and related systems. Oliver & Boyd, Edinburgh, 1962). The present author believes first that semantic content cannot be substituted by any amount of arithmoquining, (Arithmoquining or arithmatization means, as Braithwaite says,—“Gödel’s novel metamathematical method is that of attaching numbers to the signs, to the series of signs (formulae) and to the series of series of signs (“proof-schemata”) which occur in his formal system…Gödel invented what might be called co-ordinate metamathematics…”) Meltzer (1962 p. 7). In Antone (2006) it is said “The problem is that he (Gödel) tries to replace an abstract version of the number (which can exist) with the concept of a real number version of that abstract notion. We can state the abstraction of what the number needs to be, [the arithmoquining of a number cannot be a proof-pair and an arithmoquine] but that is a concept that cannot be turned into a specific number, because by definition no such number can exist.”.), especially so where first-hand personal experience is called for. Therefore, what ultimately rules is the semanticity as in a first-hand experience. Similar points are voiced, albeit implicitly, in Antone (Who understands Gödel’s incompleteness theorem, 2006). All humans experience itch in the course of their life. Even a discussion on the topic of itch or seeing people scratch can evoke the desire to scratch. These events are coined ‘contagious itch’ and are very common. We and others have shown that videos showing people scratching and pictures of affected skin or insects can induce itch in healthy persons and chronic itch patients. In our studies, patients with atopic dermatitis were more susceptible to visual itch cues than healthy. (...) Also, personality traits like agreeableness and public self-consciousness were associated with induced scratching in skin patients, while neuroticism correlated with induced itch in healthy subjects. The underlying course of contagious itch is not yet fully understood. It is hypothesized that there are human mirror neurons that are active when we imitate actions and/or negative affect. Until now, there has been only limited data on the mechanisms of brain activation in contagious itch though. We have barely begun to understand the underlying physiological reactions and the triggering factors of this phenomenon. We summarize what we currently know about contagious itch and provide some suggestions what future research should focus on. (shrink)

What do we do when we say ‘We’? This paper pursues a response from analytic pragmatism. The guiding idea of analytic pragmatism is to look to what one must implicitly know how do to be able to use expressions to say something, including how to make that implicit know-how explicit. Accordingly, the question we are tasked to answer is what one must know how to do to say ‘We’ – that is, what practical know-how saying ‘We’ (...) requires and can be employed to make explicit. The concept normative ascent is introduced in developing an answer. On this approach, the know-how in question turns out to be a distinctively normative capacity. This paper is one of the few attempts made by social scientists to measure social capital via psychometric approach, and is the only one of such kind to base its evidence on the AsiaBarometer survey data. After first reviewing the history of social capital, including its conceptual emergence and recent literatures, we expose the issue of difficulty in the measurement of social capital despite its topical popularity. We tackle this measurement issue by applying psychometric procedures to the AsiaBarometer survey data (...) of 2004, 2005, and 2006, focusing on questions pertaining to social capital of ordinary individuals residing in the 29 survey societies. This paper is significant in two aspects. First, using simple statistical procedures, it extracts various dimensions of social capital without first knowing what dimensions to extract. In short, it does not try to measure social capital using some kind of pre-defined concepts such as those outlined in the historical review of our predecessors. Rather, it succeeds in manifesting key factors of social capital by mechanically processing collective responses by individual respondents towards survey questions oriented with social capital. Though the paper does not aim to establish its methodology as a widely held consensus on how to measure social capital, it does give credence and recognition to psychometric approaches as effectives means to measure social capital, which, by its very definition, calls for approaches using collective data to measure notions of individual actions within networks. Second, this paper is the first systematic empirical analysis of social capital in all the subregions of Asia, i.e. East, Southeast, South, and Central. It builds on our earlier works, including the 2006 paper on social capital in Central and South Asia, and gives empirical credence to important concepts on Asian political culture. (shrink)

Evidence-accumulation models (EAMs) are powerful tools for making sense of human and animal decision-making behavior. EAMs have generated significant theoretical advances in psychology, behavioral economics, and cognitive neuroscience and are increasingly used as a measurement tool in clinical research and other applied settings. Obtaining valid and reliable inferences from EAMs depends on knowing how to establish a close match between model assumptions and features of the task/data to which the model is applied. However, this knowledge is rarely articulated in the (...) EAM literature, leaving beginners to rely on the private advice of mentors and colleagues and inefficient trial-and-error learning. In this article, we provide practical guidance for designing tasks appropriate for EAMs, relating experimental manipulations to EAM parameters, planning appropriate sample sizes, and preparing data and conducting an EAM analysis. Our advice is based on prior methodological studies and the our substantial collective experience with EAMs. By encouraging good task-design practices and warning of potential pitfalls, we hope to improve the quality and trustworthiness of future EAM research and applications. The Jesus’ question which was encased in his shadowy identity was both a fascinating and enigmatic phenomenon to people of Jesus time as well as people of today. The synoptic gospels presented the matter of Jesus identity in varying contexts; however, it is approached in this study from the context of Matthew. After receiving a brief answer of ‘who he is’ from Peter, Jesus mandates his disciples to keep the information to themselves. This mandate to secrecy shares certain characteristics with (...) the Messianic secret in Mark, but differs in intentions. From the exegesis of the pericope in Matthew, Jesus’ refusal to let the public know about his personalities with his motive to keep away from ostentation and self-love. Such ostentation and self-love have been referred to in this study as identity crisis. This study argues from empirical evidence that many Nigerian pastors suffer from identity crisis. It therefore, challenges Nigerian contemporary preachers to emulate Jesus’ refusal of self-seeking and to shun hypocrisy and unnecessary publicity. Contribution: To reroute the Christian church in Nigeria, especially the pastors from ostentation and self-seeking publicity to a selfless and modest lifestyle modelled after Jesus’ own personality example according to Matthew 16:13–20. What is health? What is it to be healthy? Our first answer must inevitably be the answer of St. Augustine, when confronted with the theoretical problem of time: “If no one asks me, I know the answer; if I want to explain it to the one who asks me, I do not know it.” In both cases the first sensation of one who aspires to theorizing is that of perplexity. I think, therefore, that this initial perplexity has its (...) source in two principal reasons, capable of reduction to these two assertions: first, the idea of health has a complex structure, and, second, the idea of health has a variable structure. Without a thorough study of this complexity and this variability, the construction of the medical anthropology that our historical level requires would not be possible. Despite numerous published writings on China's regional role, the world still knows very little about Beijing's perception and strategy. This article seeks to make an intellectual contribution in understanding China's foreign policy and its efforts to participate in East Asian integration. This article argues that under the rhetoric of peaceful development and community building, China's foreign policy is pragmatic and changes with the tide of events in international relations. China's participation in regional integration serves as a good case for examining (...) changes in Beijing's strategy. In the past two decades, China has moved from a reluctant participant of regional affairs to an active participant and potential future leader. China's adjusting role is a consequence of Beijing's pragmatism in policy and its growing economic confidence. Pragmatism has led China to and wait for the proper timing to step onto the world stage. According to intellectualists, not much: either knowing how to do something is a matter of knowing that something is the case or, at the very least, know-how requires a prior bit of theoretical knowledge. Anti-intellectualists deny this order of priority: either knowing-how and knowing-that are independent or, at the very least, knowing that something is the case (...) requires a prior bit of know-how. Much of the dispute centers on the relationship between knowing how to do something and having an ability to do it. If having an ability is necessary and sufficient for knowing-how, this is thought to provide comfort for anti-intellectualists. This paper traces the place of ability in the know-how/know-that debate from Ryle's seminal statement of anti-intellectualism through Stanley and Williamson's more recent defense of intellectualism. In most elementary schools in the United States, students get their first systematic introduction to history as a discipline and to chronological treatment of U.S. history as subject matter in fifth-grade U.S. history courses. To develop information about the knowledge and misconceptions concerning U.S. history that fifth-grade teachers can expect to see in their incoming students, we interviewed students who were nearing completion of the fourth grade about U.S. history topics that they would be taught in the fifth grade. The (...) students' responses revealed that they possessedgenerally accurate knowledge about conditions of everyday life inthe “old days,” but only spotty knowledge about historyand the work of historians and about the founding and developmentof the United States as a nation. They had picked up bits andpieces of information in holiday or state history units in earlier grades or through reading, television, or other out-of-school experiences, but these were not yet subsumed within a systematic network of knowledge. Furthermore, accurate information items often were connected in the students' minds with various types of inaccurate beliefs (naive misconceptions, associative errors, conflations, and imaginative elaborations). The students' answers to 23 questions are described and illustrated through excerpts fromtheir interview responses, and these findings are then discussed with emphasis on the need to establish a context for learning U.S. history and to develop certain key ideas so as to promote understanding and clear up misconceptions. Most of the grammarians assume that there is a new sentence style that referred to an old usage in some of the sentence’s structure. According to the grammarians that these old structures are being the reference rules and evidences to explain the structure of the new structure style. Also based on the grammarian approach the old structure is divided into two parts: the first, sentence structure that have been actually used in the language history. The second is an imagination assumption where such kind of structures have not been used before and therefore can be considered as a hypothetical lingual style only, Sebaweeh has conducted a standard approach according to his phrase "This is a an example only, it has not been spoken". It is important to know that the grammarians have followed an analytical approach to make a center point between the original rule and the semi-original rule so as to provide a logical explanation of these structure styles. Bullying is a serious problem in today’s workplace, in that, a large percentage of employees have either been bullied or knows someone who has. There are a variety of ethical concerns dealing with bullying—that is, courses of action to manage the bullying contain serious ethical/legal concerns. The inadequacies of legal protections for bullying in the U.S. workplace also compound the approaches available to deal ethically with bullying. While Schumann (2001, Human Resource Management Review 11, 93–111) does not explicitly examine bullying, (...) the five moral principles that he advocates can be applied to judge the ethics of bullying in the workplace. A possible limitation of this model is that, it is designed to be normative (judgmental), and while it does take into consideration the relationships among the victim, the perpetrator, the groups in the organization, and the organization itself in judging the ethics of bullying, it does not explicitly consider the process by which bullying might develop and persist. In order to gain a deeper understanding of the dynamics of this process, Nijhof and Rietdijk (1999, Journal of Business Ethics 20(1), 39–50)) suggest applying an A–B–C (antecedents, behaviors, and consequences) model to help understand the dynamics of bullying in the workplace. Formal propositions are offered to guide both academics and practitioners to an enriched understanding of the ethics of workplace bullying. (shrink)

The article is an attempt to collect and present the basic outlines of Vanja Sutlić’s philosophy, that is, the “historical thinking”, as he named it, and which is in its intention post-philosophical and trans-philosophical. The starting point of the historical thinking is contained in the attitude that the Being, the essence of the man and the essence of a being are only in the relationship, from the relationship, and by the relationship. The all preceding relationship must not be considered as (...) purely abstract and formal, but as a living, dynamic framework, in the sense of what is understood by one of the leading words of the early Greek thought – harmonia. As the moments of the framework, the Being, the essence of the man and the essence of a being, in their entirety truly never are, but are always becoming, specifically, in the one-time historical-epochal constellation, i.e. in the historical event that is always essentially individuated. Sutlić finds the source of the relationship as such i.e. the historical event, in what was in the philosophical tradition considered and defined s “nothing”. It is in the “nothing” that he, deviating from the traditional definition in the sense of negation and absence, recognizes the positive, powerful and enabling occurrence of the historical individuation of the worlds, which is before all present in the essence of what we know as time and freedom. Promišljanja i prosudbe nove filozofije niču iz LHC-fizike, koja se tumači kao »science universelle« . LHC, kao najveći sudarivač čestica u svijetu do sada, nije motiviran time da uništi Boga niti bilo koju vjeru u svijetu, već za otkrivanje novih čestica s njihovim interakcijama i kozmologijom u Prirodi, baš onoliko koliko pružaju LHC-scenariji na Tera-elektron-volt (...) skali. Polazeći od ponovnog otkrića fizike Standardnog modela i otkrića Higgsovih bozona, nova fizika na LHC-u ide mogućim putovima u skladu s problemom hijerarhije u suvremenoj fizici. K tome još, SM nije konačna teorija i upućuje se prema ne-standardnoj fizici poput supersimetrije , dodanih dimenzija na TeV-skali s kozmološkim posljedicama te ostale scenarije. Ne-standardna fizika, teorija i pokus, predviđa se otvorenom pa je formuliran novi princip agnostičkog eksperimentalizma kao najprikladniji filozofski princip, jer se ne mogu sva opažanja znati/predvidjeti na LHC-u. Čak i ako eksperimentalni program LHC-a krene u krivome smjeru, mnoge će mogućnosti izroniti iz Pandorine kutije fizike. Tada će filozofska promišljanja postati vrlo važna, napose Kuhnovi pogledi kao i naš AE princip te noviji mediteranski razvoj filozofije. Uostalom, standardna paradigma kao i nova fizika na LHC-u ne opisuju svijet u kojemu danas živimo.A paper is aiming towards a new physics paradigm to be brought by the LHC with a critical assessing on that development by the Kuhnian theses and epistemology related to modern physics. Thinking and critical assessments on the new philosophy arise up from the LHC physics, which is interpreted as the ‘science universelle’ . The LHC as the world’s largest particle collider as ever been was not motivated neither to destroy God nor any religion in the World, but to investigate new particles with their interactions and cosmology of the Nature inasmuch as it has proposed by the LHC scenarios on the Tera-electron-Volt scale. Starting from the rediscovery of the Standard Model and discovery of the Higgs bosons, the new physics at the LHC goes by the possible roads according to the Hierarchy Problem in contemporary physics. However, the SM is not a final theory by inquiring a Non-Standard physics, such as Supersymmetry , Extra Dimensions on the TeV scale with cosmological implications, and other scenarios. A Non-Standard physics, both theory and experiment, is foreseen to be open and a novel view of agnostic experimentalism was formulated to be the best philosophical principle, since we can’t know/predict everything to be observed in the LHC. Even if experimental programme of the LHC wouldn’t go in the right way, then many possibilities may emerge from the Pandora’s Box of physics. Then, philosophical considerations would become very important, particularly Kuhn’s views on it including our AE principle and new Mediterranean development of philosophy, respectively. ArgumentThe history of meteorology has focused a great deal on the “scaling up” of knowledge infrastructures through the development of national and global observation networks. This article argues that such efforts to scale up were paralleled by efforts to define a place for local knowledge. By examining efforts of the Blue Hill Meteorological Observatory, near Boston, Massachusetts, to issuelocalweather forecasts that competed with the centralized forecasts of the U.S. Signal Service, this article finds that Blue Hill, as a user of (...) the Signal Service's observation network, developed a new understanding of local knowledge by combining local observations of the weather with the synoptic maps afforded by the nationwide telegraph network of the U.S. Signal Service. Blue Hill used these forecasts not only as a service, but also as evidence of the superiority of its model of local forecasting over the Signal Service's model, and in the process opened up larger questions about the value of a weather forecast and the value of different kinds of knowledge in meteorology. This paper originated in a conference presentation with my colleague Michael Tooley, at which we were both asked to re-evaluate articles about abortion that each of us had written over twenty years earlier. While Tooley and I both contended that abortion should be legally unrestricted, there were striking differences in the style and content of our respective arguments. Contemplating these differences has reinforced my own belief in the importance of emphasizing the centrality of gender when discussing abortion. Since gender as (...) we know it is a system of dominance as well as difference, I take this to mean that contemporary discussions of abortion must address the relationship between abortion access and the social status of women. My early article addressed this relationship to some extent, but the present paper will raise a number of additional gender issues that the early article did not mention. (shrink)

Translated by Theresa Sandok. New York: Peter Lang, 1991. Pp. xix+ 397 (cloth). Zdybicka's volume is the third in Peter Lang's series, "Catholic Thought from Lublin." A convenient way to display the contents of Person and Religion is to elaborate the meaning of " philosophy of religion " and its comprising (...) terms. Philosophy of religion designates the attempt to arrive at an ultimate explanation of the empirically given and existentially apprehended fact of religion (p. 96). In other words, why does religion exist at all and what are its subjective and objective grounds? This endeavor Zdybicka understands to be a recent one. Despite a wealth of reflection on religion over the centuries (See her historical survey, pp. 1-49), only since the 19th century have there been separate disciplines with the phenomenon of religion as their object. Zdybicka also emphasizes that not any kind of philosophy is equal to the task of carrying out the above mentioned attempt. Since the ultimate explanation of religion as truth or fantasy will entail determining whether God exists, only philosophies capable of grasping the real can serve the interests of philosophy of religion. Forms of Kantianism and phenomenology are not equal to the task (p. 97). Only a realistic philosophy connected with a theory of being stands a chance of offering an ultimate explanation of religion. In particular, the metaphysics borne in mind here is that of Krapiec. Peter Lang has recently published an English translation of it under the title, Metaphysics: An Outline of the History of Being (see my review in the January issue of The Thomist.) This work is indispensable background reading for Part III of Zdybicka's volume. Though this metaphysics is existential Thomist, its employment in a philosophy of religion will not resolve the question of which religion is true, though some religions will be ruled out as unsuitable for the human being (p. 97). What is understood as "religion"? In its basic meaning the religious fact is the reference or orientation of the human being toward a transcendent reality (p. 109). Considered more closely, the religious fact is actually multiphasic. First, there is the experience of our own ontic insufficiency and the consciousness of our transcendence and search for a value capable of preserving us in being and giving us complete existential meaning. Second, there is the religious experience in its strict sense. This second phase is itself divided into three phases. First is some kind of revelation from the religious object. Zdybicka stresses that this revelation occurs through signs to which we respond in faith; there is no direct cognitive contact with the religious object. 324 BOOK REVIEWS Second, there is the active response of the one struck by this revelation. The response consists in pursuing union with the deity. This second phase involves purification. Finally, there is the realization of the bond with the sacrum. What is achieved in the human person is holiness. The book concludes (pp. 315-22) with an extended discussion of this value. In sum, the phases of the religious experience properly speaking are: encounter, dialogue, and union. Zdybicka regards religious cults and rites as simply the externalization of religious acts (p. 129). They complete the description of the religious fact. Zdybicka also takes some time to distinguish religious experience from cognitive, moral, and aesthetic experience. Finally, pp. 157-59 contain an interesting inductive argument that the object of religious experience has always been understood as personal. In Part III Zdybicka performs a philosophical assessment of the religious fact. Specifically, the assessment is of the above mentioned introductory phase. Also as mentioned, Zdybicka takes advantage of Krapiec's Gilsonian existential Thomism which has denominated "classical philosophy." This philosophy's analysis of the human person and of reality critically validates both the subjective and objective grounds for the fact of religion properly speaking. The philosophically established subjective grounds include the contingent ontic status of the human person as this is evinced in the presence of the essence/existence composition. Thite serves as an introduction to Vaiśeṣika thought and an introduction to the seventh-century commentary (vṛtti) on the Vaiśeṣikasūtra by Candrānanda. Their book is primarily (...) intended for non-specialists. As Moise notes, "The aim of this edition of Vaiśeṣikasūtra is, therefore, to introduce students of Western philosophy to some of the categories of Indian philosophy, and by way of this to demonstrate the necessity of conceptual correlation between Indian philosophy (particularly Vaiśeṣika) and the perennial and insoluble questions of today's World philosophy" (p. 6). Besides ShashiPrabha Kumar's Classical Vaiśeṣika in Indian Philosophy: On Knowing and What is to Be Known (2013) and the brief summaries included in surveys such as Raffaele Torella's The Philosophical Traditions of India: An Appraisal (2011), there is very little secondary literature in English that offers a general introduction to Vaiśeṣika thought, especially for non-specialists. Moise and Thite's work attempts to help fill this gap, but their work would have benefited from a longer, more descriptive introduction to Vaiśeṣika (à la Kumar and Torella). Primary literature in English on Vaiśeṣika is not much better. For example, as Moise and Thite note, only excerpts of Candrānanda's commentary have been translated into English. Thus, unlike Halbfass (1992), Nozawa (1993), and Thakur (2003) (p. ix), Moise and Thite offer the first complete translation of the earliest extant commentary on the Vaiśeṣikasūtra.The book is divided into three main parts: chapter 1 provides a brief introduction to Vaiśeṣika philosophy and a summary of Candrānanda's commentary, chapter 2 outlines the current state of manuscripts of the Vaiśeṣikasūtra and Vaiśeṣikasūtravṛtti, and chapter 3 contains a transliteration and translation of the Vaiśeṣikasūtravṛtti. The authors also include three appendices, two of which situate Vaiśeṣika philosophy within world philosophy and within its own commentarial tradition, and one of which outlines the extant manuscripts of the Vaiśeṣikasūtra and Vaiśeṣikasūtravṛtti.Moise uses chapter 1 to familiarize his philosophical audience with the tradition of Vaiśeṣika. He does this by drawing attention to the history of Greek and Indian thought, highlighting similarities between these traditions, and emphasizing the importance of naturalism, metaphysics, and ontology in both [End Page 1] traditions. Moise argues that his "preliminary survey on the Pre-Socratic Greek philosophy [sic] is important because of their conspicuous resemblance with the problems raised by the early Vedic and Upaniṣadic seers" (p. 2). The similarity between Greek and Vedic thought is essentially metaphysical, according to Moise. But there are also meaningful differences between the questions Greek and Indian thinkers pose and the answers they provide and attending to these differences can be philosophically fruitful. As Moise argues, "by matching unrelated systems of thought (Indian, Greek, analytic, and so forth), our knowledge rebuilds and reconstructs while the ontic definitions of the world gain more clarity than has ever been possible" (p. 6).According to Moise, Vaiśeṣika philosophy can challenge our metaphysical and ontological notions. Specifically, he argues that Vaiśeṣika ontology provides an alternative to the problematic dualism of matter and form in Aristotelian thought, as well as to the notions of essence and existence in the Medieval Scholastics (p. 4). This article explores some important aspects of U Dhammaloka's Buddhism, drawing in particular on the work of his Rangoon-based Buddhist Tract Society between 1907 and 1910. It explores his work—in the Society and more generally—as in effect a social movement organiser within the Buddhist Revival, looking at his funders, publishers, printers, translators and distributors as well as those who wrote about him, laid down their hair for him to walk on, covered his train or boat fares, put up his friends (...) in monasteries or let them cross borders, and so forth. It also looks at what we know about his organisations and involvement in other people's organisations, asking who he intended to mobilise and who his audience was, how his use of confrontation and polemic fitted into this, and how successful he was. Following this, it goes on to discuss the intellectual sources of the free-thinking (atheist) positions espoused in the Society's publications, and asks more generally how his posture can be located in relation to the politics of plebeian freethought in Ireland, Britain, the USA and Asia. These questions arose out of an attempt to shed some light on the missing half-century before Dhammaloka became a public Buddhist figure; while the article can give no definite answers in terms of organising experience, intellectual inheritance or formative backgrounds, it suggests an alternative perspective that highlights a substantial, internationally connected ‘Workers’ University', grounded in the freethinking cultures of self-taught plebeian radicals, at the roots of western Buddhism. An introduction to the ordinary person, to the rights inherent in the U.S. criminal justice system when encountering it and how to survive such an encounter.

This article reimagines the meanings of U.S. national parks and so-called ‘natural’ places in our environmental histories and histories of science. Environmental historians have created a compelling narrative about the creation and use of U.S. national parks as places for recreation and natural resource conservation. Although these motivations were undoubtedly significant, I argue that some of the early parks were created and used for a third, often overlooked, reason: to preserve a permanent, state-sanctioned space for scientific knowledge production. Deconstructing the (...) concept of the “natural laboratory,” I show how scientists helped justify and then benefited from the creation of national parks. Hawaii National Park serves as my case study. Advocates of the national park aimed to give settler colonial scientists in the Hawaiian archipelago a permanent place for their research, while tying Hawai‘i’s exotic landscape into the sublime nature of the American West. The park was framed as a perfect laboratory for U.S. experts to study “curious” flora, fauna, and geological processes, becoming a major site of knowledge production in volcanology. Reimagining the parks in this way has ramifications for how we think about issues of access and justice. Environmental historians who have explored the ‘dark side’ of the conservation movement have yet to consider the other half of the story: the parks not only barred certain peoples and their ways of life, but also provided access to scientists – a set of actors whose work was deemed more complementary to conservationist goals than the activities of the Native Hawaiians – and marginalized local and indigenous epistemologies. Thus, the question so often asked in environmental history, “Who is nature for?” might be supplemented by the question, “Who has the power to know nature?”. (shrink)

As a patient approaches death, family members often are asked about their loved one’s preferences regarding treatment at the end of life. Advance care directives may provide information for families and surrogate decision makers; however, less than one-third of Americans have completed such documents. As the U.S. population continues to age, many surrogate decision makers likely will rely on other means to discern or interpret a loved one’s preferences. While many surrogates indicate that they have some knowledge of their loved (...) one’s preferences, how surrogates obtain such knowledge is not well understood. Additionally, although research indicates that the emotional burden of end-of-life decision making is diminished when surrogates have knowledge that a loved one’s preferences are honored, it remains unclear how surrogates come to know these preferences were carried out. The current study examined the ways that next of kin knew veterans’ end-of-life preferences, and their ways of knowing whether those preferences were honored in Veteran Affairs Medical Center inpatient settings. Patients and physicians do not know the cost of medical procedures. Opaque medical billing thus contributes to exorbitant, rising medical costs, burdening the healthcare system and individuals. After criticizing two proposed solutions to the problem of opaque medical billing, I argue that the Centers for Medicare and Medicaid Services should pursue a rule requiring that patients be informed by the physician of a reasonable out-of-pocket expense estimate for non-urgent procedures prior to services rendered.

This paper evaluates four recent randomized clinical trials in which the informed consent of participants was either not sought at all, or else was conducted with critical information missing from the consent documents. As these studies have been taking place, various proposals to conduct randomized clinical trials without consent have been appearing in the medical literature. Some of the explanations offered for why it is appropriate to bypass consent or disclosure requirements appear to represent a fundamental misunderstanding of applicable government (...) regulations and even the research enterprise. Others are the result of conceptual disagreements about the importance and application of traditional research ethics norms to ‘comparative effectiveness research’ and modern research environments. Common among these explanations, however, is a failure to appreciate when a research intervention, rather than merely an observation or review of data, is taking place. Review committees and investigators are failing to see, or choosing to ignore, interventions in the lives of research subjects. When these studies have come to light, government agencies with oversight authority have done little or backed down. Prestigious medical journals have published research results knowing that the required consent was not obtained, or they have stood by the published studies even after the inadequacy of consent is discovered. This article critically examines this erosion of consent in theory and practice and calls for restoring the requirement of informed consent to its proper place as a priority in human subjects research. In the history of Islam after the martyrdom of Hz.Uthman, serious problems emerged among the Muslims, and two great wars took place between the Companions. While these events are called strife, this time is called the time of strife. The enemies of Islam who wanted to take advantage of this confused situation of the Islamic ummah, they engaged in various activities that they thought could harm Muslims in order to grow the seeds of strife among Muslims more. Zindīḳs are the (...) leading enemies of Islam. It was necessary for Muslims to recognize the zindīḳs, who were said to have made thousands of narrations on almost every subject. Therefore, Islamic scholars wrote many works about them. In fact the authors of tabaḳāt and ridjāl many of whom were hadith scholars, also mentioned zindīḳs in their works, such that these works were extremely useful in terms of knowing zindīḳs. In this article it was determined for whom the term zindīḳ was used in the works of tabaḳāt and ridjāl and also the situation of hadith transmitters who lived in the first three centuries of the hijri who are alleged to be zindīḳ are discussed. BACKGROUND: Anonymity remains the more common practice in gamete donations, but legislation prohibiting anonymity with a goal of protecting donor-conceived children's right to know their genetic origins is becoming more common. However, given the dearth of research investigating the function of anonymity for donors and recipients, it is unclear whether these policies will accomplish their goals. The aim of this study was to explore experiences with anonymity among oocyte donors and recipients who participated in an anonymous donor oocyte program (...) and to understand the ways in which anonymity functions for them. METHODS: Semistructured interviews were conducted with 50 women: 28 oocyte donors and 22 recipients who were recruited from an academic center for reproductive medicine in the United States. RESULTS: Donors and recipients view anonymity both as a mechanism to protect the interests of all parties (recipients, donors, and donor-conceived children) and as a point of conflict. Specifically, three key areas were identified where both donors and recipients saw anonymity as having an important role: relieving anxieties about family structures and obligations; protecting their interests and those of donor-conceived children (while acknowledging where interests conflict); and managing the future. CONCLUSION: As gamete donation increasingly moves away from the practice of anonymity, examining why anonymity matters to stakeholders will be helpful in devising strategies to successfully implement identity-release options. Transgender legal protections have long been contentious issues, with courts often pathologizing or refusing recognition of transgender identities. Recently, however, courts adjudicating asylum claims have recognized “transgender” as a legitimate category of protection. I take this legal development as an opportunity to ask how courts determine if individuals are transgender. While previous work has shown how courts maintain the gender binary, asylum law offers the first chance to analyze how recognizing a distinct transgender category affects the legal gender order and (...) the classification of trans claimants. Drawing on court decisions, ethnographic observations, and interviews, I argue that the recognition of transgender as a category implicitly acknowledges the malleability of gender. Yet, the adjudication of transgender asylum cases continues to uphold a fixed and binary conception of gender by assuming a “born into the wrong body” narrative and that claimants should always already know their gender identities. Courts thus enforce a cis–trans binary wherein only certain claimants are found “trans enough.”. (shrink)

This work was presented at the Research Center for Philosophy of Science of Ferdowsi University of Mashhad (Iran) – in August 2020. --- -/- Briefly, in the first section of this Persian book, first of all, I (Hereafter: the writer) have presented generalities of Aesthetics and an interpretation of aesthetic universality (Hereafter: φ) and it is argued that each definition of art has to admit φ, and this is a Kantian, minimalist, and subjective view (some others would incline toward an (...) objective interpretation of φ, but it is beyond the purpose of this work). What’s more, this view could be applied to all definitions of art, e.g., Functionalism, Conventionalism, or Hybrid Theories. Additionally, the writer has replied to some objections that would promote definitions of art without φ, but it seems that they could not successfully refute φ, since it appears that φ is a premise in every aesthetic judgment. Next, in another section, the writer has written some primary notes on creativity, which have come from contemporary literature on it, and it is argued that there is a relation between creativity and φ. It is also claimed that the relation is the same φ through the creative processes, creative products, and creative persons, both scientifically and philosophically; and so, the relation represents that φ is true. Besides that, the writer has presented some potential objections to the writer’s view of the relation, and the writer has also replied to those objections. --- -/- In the next section of the book, the writer has applied the φ through creativity to the philosophy of animal-made art, and the writer revolutionarily illustrates that, first of all, the normativity of the philosophy of animal-made art is prior to the descriptive one. Second of all, φ is principally the criterion to know that animal-made art is impossible. The writer’s position recognizes those other works of animal aesthetics, which means aesthetics of all of the non-human creatures on the earth or in the cosmos as a new part of environmental aesthetics, as the marginally second order of animal aesthetics. It is owing to the fact that, first of all, the question, of whether animal-made art is possible or not, is normative. Second of all, if one does not consider the normativity of the question, then one could not get the answer to the nature of it. Next, one could not distinguish between, on the one side, the pleasure of drinking water when one’s thirst may cause death, and on the other side, one’s pleasure of listening to music when there is no urgent necessity for it. The fourth argument is that one needs to identify the normativity of animal-made art because one could generalize aesthetic judgments if one sets φ as the basis of it, and then, one identifies that φ is one of the most fundamental bases in Aesthetics. --- -/- The main section of this book is the writer’s argument—the Animal-Made Art Impossibility Argument—in favor of the impossibility of animal-made art, i.e., Functionalist, Conventionalist, or Hybrid Theories of the definitions of animal-made art, and the writer has replied to some possible ideas and objections to the argument. --- -/- Pouya Lotfi Yazdi --- Iran | June 2022. The conflicts of interest that may arise in relationships between academic researchers and industry continue to prompt controversy. The bulk of attention has focused on financial aspects of these relationships, but conflicts may also arise in the legal obligations that faculty acquire through consulting contracts. However, oversight of faculty members' consulting agreements is far less vigorous than for financial conflicts, creating the potential for faculty to knowingly or unwittingly contract away important rights and freedoms. Increased regulation could prevent this, but (...) it is unclear what forms of oversight universities view as feasible and effective. In this article, we report on a Delphi study to evaluate several approaches for oversight of consulting agreements by medical schools. The panel was comprised of 11 senior administrators with responsibility for oversight of faculty consulting relationships. We found broad agreement among panelists regarding the importance of institutional oversight to protect universities' interests. There was strong support for two specific approaches: providing educational resources to faculty and submitting consulting agreements for institutional review. Notwithstanding the complexities of asserting authority to regulate private consulting agreements between faculty members and companies, medical school administrators reached consensus that several approaches to improving institutional oversight are feasible and useful. Categorical names such as “The English Novel,” “The Modern American Novel,” and “American Literature” often turn up in catalogs as titles of college courses, and we know from them pretty much what to expect. They also have standing in critical discourse, along with allied terms unlikely to serve as course titles: “good writing,” “great literature,” “serious fiction,” “literature” itself. The awareness has grown in recent years that such concepts pose problems, even though we use them with easy enough comprehension (...) when we talk or write to others who share our cultural matrix.Lately, critics like Raymond Williams have been reminding us that the categories change over time and that at any given moment categories embody complex social relations and a continuing historical process. That process deeply invests all terms with value: since not everyone’s values are the same, the negotiating of such concepts is, among other things, a struggle for dominance—whether between adults and the young, professors and their students, one class and another, or men and women. We don’t usually notice the power or the conflict, except when some previously weak or silent group seeks a share of the power: for example, when, in the 1960s, American blacks and their supporters insisted that black literature be included in school and college curricula, or when they openly challenged the candidacy of William Styron’s Confessions of Nat Turner for inclusion in some eventual canon.1 But the gradual firming up of concepts like, say, postwar American fiction is always a contest for cultural hegemony, even if in our society if is often muted—carried on behind the scenes or in the seemingly neutral marketplace. 1.
