This article focuses on three questions. First it tries to understand why the difficulty man experiences when he is praying, is an inherent part of prayer. Everyone who prays, will experience that God is intangible. Rahner’s analysis of the human transcendental experience is a help in understanding this experience. Rahner shows that humans, by interacting in the concrete world, are capable of going beyond it. In deeds of for example love, freedom, wisdom one transcends concrete existence, and experiences to be (...) finitum capax infiniti. Yet, this possibility implies a very particular tension: man is naturally inclined to a transcendental reality but will never be able to fully capture it. Limiting oneself to concrete existence will be unsatisfying. Avoiding concrete existence will not work neither, for the transcendental experience only exists if linked to the tangible life we live here and now. Transcendental theology explains that living with this difficult but at the same time necessary tension between transcendental and categorical is the conditio sine qua non for meeting God.This means that, if prayer is such a meeting with God, it will always have an element of difficulty in it. He who prays, knows this. By subject and content this article is at the junction of philosophy, theology and spiritually. The author argues that this is necessary as Rahner’s transcendental theology is based on spirituality, a view shared by others, but which, in the opinion of the writer, is lacking in most of the secondary literature. Finally the author is of the opinion that aforementioned approach should not be limited to Rahner’s work. Should, out of contextual, theological as well as strategic reasons, contemporary theology not pay more attention to spirituality? (shrink)

It is said that the Second Vatican Council rediscovered the role of Holy Spirit in the Church. In this article I want to explore how the Holy Spirit was conceived before the Council, in order to know how that rediscovery can be said to have started before the Council. I will explore the different understandings of the Holy Spirit’s role in the Church in the period 1900 and 1960; explore their historical-theological background; and venture a theological appreciation of those views. (...) We will see that, around 1900, the Holy Spirit was viewed as the guarantee of the truthfulness of magisterial teaching. From the 1930s, He was understood as the soul of the mystical body. His role remained hierarchical, but grew larger, and included the bestowing of grace as well as truth. Thirdly, in the 1950s, the Holy Spirit was considered to work through charisms. As charisms do not exclusively belong to the hierarchy, they implicitly challenged earlier hierarchy focused pneumatology. I will conclude that the Holy Spirit was rediscovered indeed, yet, that his rediscovery made a modest start only. For on the one hand ecclesiology became more theological, and theology more trinitarian, but on the other hand, ecclesiology continued to be rather hierarchy focused, and the dominance of Christocentrism continued to be a serious problem for any appreciation of the Holy Spirit’s role in the Church. The aim of this article is to analyse the relation between the second law of thermodynamics and the so-called arrow of time. For this purpose, a number of different aspects in this arrow of time are distinguished, in particular those of time-reversal (non-)invariance and of (ir)reversibility. Next I review versions of the second law in the work of Carnot, Clausius, Kelvin, Planck, Gibbs, Caratheodory and Lieb and Yngvason, and investigate their connection with these aspects of the arrow of time. It (...) is shown that this connection varies a great deal along with these formulations of the second law. According to the famous formulation by Planck, the second law expresses the irreversibility of natural processes. But in many other formulations irreversibility or even time-reversal non-invariance plays no role. I therefore argue for the view that the second law has nothing to do with the arrow of time. The embedding and promotion of social change is faced with aparadoxical challenge. In order to mainstream an approach to socialchange such as responsible research and innovation and makeit into a practical reality rather than an abstract ideal, we need tohave conceptual clarity and empirical evidence. But, in order to beable to gather empirical evidence, we have to presuppose that theapproach already exists in practice. This paper proposes a social labmethodology that is suited to deal with this circularity. Themethodology combines the (...) defining features of social labs emergingfrom the literature such as agility and real-world focus withestablished theories and approaches such as action research andexperiential learning. Thereby it enables the parallel investigationand propagation of RRI. The framework thus constructed provides atheoretical embedding of sociallabs and overcomes some of theknown limitations of the constitutive approaches. (shrink)

The principle of maximum entropy is a general method to assign values to probability distributions on the basis of partial information. This principle, introduced by Jaynes in 1957, forms an extension of the classical principle of insufficient reason. It has been further generalized, both in mathematical formulation and in intended scope, into the principle of maximum relative entropy or of minimum information. It has been claimed that these principles are singled out as unique methods of statistical inference that agree with (...) certain compelling consistency requirements. This paper reviews these consistency arguments and the surrounding controversy. It is shown that the uniqueness proofs are flawed, or rest on unreasonably strong assumptions. A more general class of inference rules, maximizing the so-called Re[acute ]nyi entropies, is exhibited which also fulfill the reasonable part of the consistency assumptions. (shrink)

The principle of maximum entropy is a method for assigning values to probability distributions on the basis of partial information. In usual formulations of this and related methods of inference one assumes that this partial information takes the form of a constraint on allowed probability distributions. In practical applications, however, the information consists of empirical data. A constraint rule is then employed to construct constraints on probability distributions out of these data. Usually one adopts the rule that equates the expectation (...) values of certain functions with their empirical averages. There are, however, various other ways in which one can construct constraints from empirical data, which makes the maximum entropy principle lead to very different probability assignments. This paper shows that an argument by Jaynes to justify the usual constraint rule is unsatisfactory and investigates several alternative choices. The choice of a constraint rule is also shown to be of crucial importance to the debate on the question whether there is a conflict between the methods of inference based on maximum entropy and Bayesian conditionalization. Helmuth Plessner’s Levels of Organic Life and the Human [Die Stufen des Organischen und der Mensch, 1928] is one of the founding texts of twentieth century philosophical anthropology (understood as philosophical reflection on the fundamental characteristics of the human lifeform). It is argued that Plessner’s work demonstrates the fundamental indispensability of the qualitative humanities vis-à-vis the natural-scientific study of man. Plessner’s non-reductionist, emergentist naturalism allots complementary roles to the causal and functional investigations of the life sciences and the phenomenological and (...) hermeneutic interpretation of the phenomenon of life in its successive levels and stages. Within this context, human agency can be understood as a higher-order property of organic life, which act by the selective activation of lower-level psychophysical powers. Plessner’s three ‘anthropological laws’ are used to situate the notion of practical self-understanding in between two extremes: deterministic views that deny human freedom and responsibility and views that ascribe an unrealistic amount of autonomy to human beings. For a long time, research in communication and argumentation has investigated which kinds of evidence are most effective in changing people’s beliefs in descriptive claims. For each type of evidence, such as statistical or expert evidence, high-quality and low-quality variants exist, depending on the extent to which evidence respects norms for strong argumentation. Studies have shown that participants are sensitive to such quality variations in some, but not in all, cultures. This paper expands such work by comparing the persuasiveness of (...) high- and low-quality statistical and expert evidence for participants from two geographically close cultures, the Dutch and the German. Study 1, in which participants (N=150) judge a number of claims with evidence, underscores earlier findings that high-quality is more persuasive than low-quality evidence for the Dutch, and – surprisingly – also shows that this is less the case for the Germans, in particular for statistical evidence. Study 2 with German participants (N=64) shows that again they are not sensitive to the quality of statistical evidence, and rules out that this finding can be attributed to their understanding of the rules of generalisation. Together, the findings in this paper underline the need to empirically investigate what norms people from different cultures have for high-quality evidence, and to what extent these norms matter for persuasive success. Helmut Plessner was one of the founders of philosophical anthropology, and his book _The Stages of the Organic and Man_, first published in 1928, has inspired generations of philosophers, biologists, social scientists, and humanities scholars. This volume offers the first substantial introduction to Plessner’s philosophical anthropology in English, not only setting it in context with such familiar figures as Bergson, Cassirer, and Merleau-Ponty, but also showing Plessner’s relevance to contemporary discussions in a wide variety of fields in the humanities and (...) sciences. ABSTRACTIn everyday situations, people regularly receive information from large groups of people and from single experts. Although lay opinions and expert opinions have been studied extensively in isolation, the present study examined the relationship between the two by asking how many laypeople are needed to counter an expert opinion. A Bayesian formalisation allowed the prescription of this quantity. Participants were subsequently asked to assess how many laypeople are needed in different situations. The results demonstrate that people are sensitive to the (...) relevant factors identified for determining how many lay opinions are required to counteract a single expert opinion. People's assessments were fairly good in line with Bayesian predictions. (shrink)

Central to the concept of a learning organization is the ability to set up dialogues or conversational inquiries. But the techniques to accomplish this have nowhere in the literature been adequately described. This reduces the concept of a leaming organization to an unattainable ideal. These techniques were for ages, in the form of dialectic, an important instrument for investigation, until they were replaced by the formation of scientific theories. But several fundamental organizational problems cannot be solved by scientific knowledge. The paper deals with the interpretation of Wittgenstein's views on the power of occurrent mental states to sort objects or states of affairs as in accord or in conflict with them, as presented in the rule‐following passages of the Philosophical Investigations. I shall argue first that the readings advanced by Saul Kripke and John McDowell fail to provide a satisfactory construal of Wittgenstein's treatment of a platonist account of this phenomenon, according to which the sorting power of occurrent mental states (...) is to be explained by reference to the mind's ability to grasp universals. I contend that the argument that Kripke extracts from Wittgenstein's discussion doesn’t succeed in undermining the platonist position. Then I argue that McDowell's reading exhibits a more serious shortcoming: the position that he ascribes to Wittgenstein is indistinguishable from the platonist account. Then I put forward a proposal as to how to articulate the relationship between Wittgenstein's views and the platonist position. (shrink)

The method of reflective equilibrium (RE) is well known within the domain of moral philosophy, but hardly discussed as a method in professional ethics education. We argue that an interpersonal version of RE is very promising for professional ethics education. We offer several arguments to support this claim. The first group of arguments focus on a changed practice that is more team-oriented, inter-professional and aims at shared decision-making with patients and clients. The second group of arguments relate to the core (...) aim of professional ethics education, namely to stimulate critical moral reflection. This central aim is a core professional moral competence that entails both a dialogical approach to practice and one’s own moral beliefs as well as a more detached viewpoint on practice, reflection on types of cases and one’s attitude as a professional in practice. Can human rights incorporate future people and their interests, considering all the risks and uncertainties by which these interests are surrounded? Given problems such as climate change, resource depletion and pollution, human rights cannot afford not to be able to do this if they are to remain relevant. On the other hand, taking future people on board may lead to (another) multiplication of human rights claims, and this is hardly good news either. Therefore, an adequate account of how to incorporate (...) the interests of future people into human rights is much needed. It should also tell us about the weight of protecting these interests compared with that of providing other human rights protections. This chapter aims to give the first outlines of such an account. I will call it sufficientarian, because it understands human rights as articulating a ‘threshold of enough’. (shrink)

The treatment of pregnant women addicted to drugs provides an especially important and illustrative example of how political and popular demands can successfully challenge professional ethical norms associated with clinical medicine — norms such as confidentiality, patient autonomy, and the right to consent to and to refuse treatment. One increasingly popular policy approach is to limit patient autonomy by coercing women in an attempt to change their behavior, either by involuntary civil commitment or by imprisoning them for drug abuse or (...) child neglect. Thirty-five states have criminally prosecuted women for substance abuse or alcohol use during pregnancy. Other states aggressively use involuntary civil commitment as a means to protect the yet-to-be-born from harm during pregnancy. Medical professionals have been forced to participate in these programs by mandatory reporting requirements. (shrink)

The relation between the Boltzmannian and the Gibbsian formulations of statistical mechanics is one of the major conceptual issues in the foundations of the discipline. In their celebrated review of statistical mechanics, Paul Ehrenfest and Tatiana Ehrenfest-Afanassjewa discuss this issue and offer an argument for the conclusion that Boltzmannian equilibrium values agree with Gibbsian phase averages. In this paper, we analyse their argument, which is still important today, and point out that its scope is limited to dilute gases.

This book argues that ultimately human rights can be actualized, in two senses. By answering important challenges to them, the real-world relevance of human rights can be brought out; and people worldwide can be motivated as needed for realizing human rights. Taking a perspective from moral and political philosophy, the book focuses on two challenges to human rights that have until now received little attention, but that need to be addressed if human rights are to remain plausible as a global (...) ideal. Firstly, the challenge of global inequality: how, if at all, can one be sincerely committed to human rights in a structurally greatly unequal world that produces widespread inequalities of human rights protection? Secondly, the challenge of future people: how to adequately include future people in human rights, and how to set adequate priorities between the present and the future, especially in times of climate change? The book also asks whether people worldwide can be motivated to do what it takes to realize human rights. Furthermore, it considers the common and prominent challenges of relativism and of the political abuse of human rights. Este documento busca revisar el estado actual del pensamiento católico sobre el respeto al agenciamiento del paciente, a la autonomía y al consentimiento. Sin embargo, no se pretende llegar a una revisión definitiva. De hecho, encontraremos un amplio apoyo de estos conceptos dentro de la bioética católica, a pesar de que persiste un importante disenso sobre aspectos específicos. En primer lugar, el artículo ofrece una descripción resumida de algunas diferencias importantes entre el entendimiento prevaleciente de la autonomía del paciente en (...) la bioética secular y en la bioética católica. En la primera, se suele entender que el respeto a la autonomía del paciente considera las necesidades y deseos subjetivos de éste, incluso cuando, o tal vez precisamente, porque quedan fuera del ámbito de comprensión del profesional de la salud. En la segunda, este respeto se fundamenta en la dignidad delpaciente individual, que abarca los deseos y necesidades subjetivas del paciente, pero que es esencialmente un concepto objetivo y, por lo tanto, intersubjetivamente accesible. Para explicar con más detalle cómo puede respetarse el agenciamiento del paciente dentro de ese marco de referencia objetivo, en el documento se examinan diferentes tipos de agenciamiento del paciente dentro de la relación terapéutica. Para que la atención de la salud sea clínicamente óptima y éticamente sólida –como exigen los principios éticos de beneficencia y no maleficencia–, el paciente debe participar activamente en: 1) la evaluación y el diagnóstico; 2) la planificación del tratamiento, y 3) la terapia propiamente dicha. Además –como exige el principio ético del respeto a la autonomía–el proveedor de atención sanitaria debe: 4) proteger la confidencialidad del paciente; 5) proporcionarle información adecuada, y 6) obtener el consentimiento del paciente para cualquier intervención. A continuación, se examinan diferentes tipos de consentimiento. En una sección final, se revisará la cuestión de si es moralmente permisible que los proveedores de atención de la salud obliguen a los pacientes a rechazar los tratamientos que se consideren inmorales. Gao presents a critical reconsideration of a paper I wrote on the subject of protective measurement. Here, I take the occasion to reply to his objections. In particular, I retract my previous claim to have proven that in a protective measurement, the observable being measured on a system must commute with the system's Hamiltonian. However, I do maintain the viability of the interpretation I offered for protective measurements, as well as my analysis of a thought experiment proposed by Aharonov, Anandan (...) and Vaidman against Gao's objections. The conflict between pregnant women freely using cocaine and the well-being of fetuses presents a difficult social problem. Since 1985, at least 200 women, in thirty states, have been criminally prosecuted for using illicit drugs or alcohol during pregnancy. Such policies enjoy considerable public and political support. Nonetheless, treatment programs that include referral to law enforcement officials raise serious ethical and legal issues for hospitals and health care providers. In this paper, we assess the development of one medical university's controversial (...) treatment program for pregnant women addicted to cocaine.In October 1989, the Medical University of South Carolina instituted a new program, called the Interagency Policy on Management of Substance Abuse During Pregnancy, designed “to ensure appropriate management of patients abusing illegal drugs during pregnancy.” This program required some pregnant women to seek drug counseling and prenatal care under the threat of criminal sanctions. In the face of managed care and market economies infringing on the practice of medicine, reducing its autonomy and determining the moral guidelines for medical practice, many physicians are calling out for a return to what is perceived as a traditional medical ethic. Many religiously motivated critics of certain modern developments in medicine have made similar appeals. These calls are best understood as an attempt to define medicine as a practice that is necessarily ethical in nature, a practice the moral (...) basis of which is internal to that practice. This article examines and assesses this definition of medicine in reference to Aristotle's division of human undertakings into three distinct categories: theory, poieisis (i.e., production), and praxis. It is concluded that medicine can be understood as a praxis (as opposed to a theory or production, both of which are morally neutral), because the practice of medicine, and all of its constitutive acts, can only be explained and assessed in reference to health, which is itself a final good and hence of moral value. Such an understanding would immunize medicine against usurpation by the free market. However, by the same token it would also dissociate medicine from all other moralities external to it, including those grounded in faith and religion. (shrink)

One of the founders of modern hermeneutics, German philosopher Wilhelm Dilthey (1833-1911) confronted the question of how modern, postmetaphysical human beings can cope with the ambivalence, contingency, and finitude that fundamentally characterize their lives. This book offers a reevaluation and fresh analysis of Dilthey’s hermeneutics of life against the background of the development of philosophy during the past two centuries. Jos de Mul relates Dilthey’s work to other philosophers who influenced or were influenced by him, including Kant, Schleiermacher, Hegel, Comte, (...) Mill, Nietzsche, Husserl, Heidegger, Gadamer, and Derrida. Weaving together systematic analysis and historical investigation, de Mul begins the book with an account of the horizon on which Dilthey developed his unfinished masterwork, _Critique of Historical Reason. _The author then elaborates a systematic reconstruction of Dilthey’s ontology of life, relates the ontology to the work of other twentieth-century philosophers, and positions Dilthey’s thought within current philosophical debate. Experimental argumentation research allows researchers to test normative predictions from argumentation theory. In the domain of argument quality, for instance, numerous studies have supported the prediction that high-quality arguments should lead to better claim acceptance than low-quality arguments. These studies also examined factors moderating this effect, such as text length, and cultural background of the receiver. The current experiment adds another factor: incongruity between arguments. By presenting participants with arguments and counterarguments, they were put in a circumstance of incongruity, leading (...) to higher elaboration of arguments and, therefore, to sensitivity to argument quality. Such sensitivity was found to be absent for French participants in an earlier study, but present for Dutch participants. The current study examined whether such sensitivity occurred for both national samples under the circumstance of argument incongruity. Dutch and French students (_N_ = 544) indicated their acceptance of claims followed by statistical evidence and normatively strong or weak expert evidence, each of which served as argument in some cases and as counterargument in others. Analyses showed that normatively strong expert evidence was more persuasive than normatively weak expert evidence for Dutch participants, but that evidence quality did not affect claim acceptance for French participants. Implications for a cultural explanation for the French result are discussed. (shrink)

The Belgian Auditor's Office is not competent to judge good management. Parliamentary initiatives have been taken to extend its competence towards an efficiency, effectiveness and economy control. Up till 1985 the Belgian budget was drawn up according toa classification system with insufficient regard for the application ofmanagement objectives to budgetary allocation. Based on notions originating from the P.P.B.S. system the budget is drawn up now by programmes assigned to organisation divisions. In the future the parliamentary budget procedure could be transformed (...) into a ratification of the General Budget of Expenses and a supervision of the execution of the departmental budgets. The General Budget will contain the programmes. A similar system offers the external controller a better management and control instrument.An efficiency control exists in various farms in Germany, Great-Britain, Ireland, the Netherlands, France, Spain and Canada. Despite the wealth of research showing that psychological contract breach (PCB) has negative outcomes for individuals, knowledge about the influence of the social context in which breaches are experienced is still scarce. This is surprising, as scholars have argued that work climates, such as when unit members are generally highly committed, could buffer an individual’s negative experiences at work. Yet, to date, the unit climate and PCB literatures have largely remained separated and our main goal is to integrate these fields. (...) This is especially timely and relevant, because recent work in the unit climate literature indicates that merely looking at the average climate level might not be enough, because the climate’s strength (i.e., the agreement or homogeneity within the unit) could also provide important social cues. Building on these recent advances, we develop and test a theoretical framework which links both climate concepts to PCB. More specifically, we hypothesized that especially when all unit members are highly and homogeneously committed, an employee would reframe their PCB in such a way that it would less adversely affect work engagement and turnover intentions. Using data from 1,272 employees across 36 healthcare units, multilevel structural path analyses supported this three-way interaction. By answering recent calls for more ‘social PCB research’ and integrating the unit climate and PCB literatures, we aim to provide guidance to scholars and practitioners who want to understand in more depth the social context’s influence on PCB. During the last years the mass media have paid less and less attention to parliamentary activities. That is so because the real decision making, the real power, has shifted from the legislature to the executive. There are also other reasons for the declining interest in parliament: its complicated functioning, the limited interest of parliament in topical subjects, the often lengthy and technical debates. Parliament and mass media could, however, try to bridge the gap between eachother, e.g. by broadcasting special programmes (...) on parliamentary activities. This might give the parliament a chance to reconquer a portion of its lost power. However, it remains to be proved that there is a genuine political willingness to restore the legislature as the dominant political power centre. The mass media cannot and may not be a party to this conflict. They can only be a tool. (shrink)

Against the background of the current European competitive media landscape, the media are more and more compelled to legitimize their activities in their own national context as well as at a European level. Meanwhile, the nature of the media diversity in The Netherlands has changed tremendously; from a society divided along political and religious lines, it has evolved towards a multi-ethnic society. Hence, both the conceptualizing and operationalizing of media diversity from an academic as well as a media practical perspective (...) prove to be hot topics. An expert meeting was held at the Department of Communication at Radboud University Nijmegen in December 2004 in which the contours of media diversity in general and in The Netherlands in particular were explored. Institutional performance as well as program-related aspects linked to the notion of media diversity were discussed. Media diversity was explored from the angle of media economics (How many media actors are there? What about the competition? Is competition deadly or just healthy or somewhere in between?) as well as from the perspective of the program/format level (Is it more of the same? A lot of imports? What about criteria for quality, innovation? Does the public broadcaster make any difference?). In addition, the audience reception perspective (Are these media production and distribution trends followed by media use patterns?) as well as methodologically problematic aspects one encounters when measuring media diversity were assessed. What follows here is a selection of several most pertinent views on this complex topic. We welcome each critical insight from other geographical contexts which might stimulate the debate on measures of open and reflective diversity in the media. (shrink)

The Danish author Søren Aabye Kierkegaard (1813-1855) is one the best-known theologians in the intellectual history of modernity since the nineteenth century. His influence is comprehensive: it is to be detected, amongst others, in theological, philosophical, literary, psychological and aesthetic discourses across the globe in many contexts. As such this publication will provide welcome input in further reflection on Kierkegaard's role in the interpretation of Scripture in modernity. Huls's book is a refreshing addition to Kierkegaardian studies, which will pave the (...) way for further research on one of the great thinkers of our time. It is also a useful contribution to the debate in contemporary hermeneutics about the legacy of the Enlightenment and the nature of biblical interpretation as a hermeneutical enterprise. Scripture aims to bring us back to our being-seen-in-God. By being alone with it, we realize that in it we are looking in the mirror of Him who loves us from our origin. In reading Scripture, we can, consequently, not be allowed to flee in all sorts of human fabrications about Scripture, as if only the knowledge of theologians could expose the true meaning of Scripture. Every person, whether well-schooled or not, whether he has much or little knowledge, knows Scripture, because before all else Scripture lives in us. Scripture merely reminds us of the Word that is spoken in us immediately and that constitutes our subjectivity. As long as the Word has not truly made us fall silent and we ourselves still think we have a say, the Word does not yet have us in its grasp. Only when we truly fall silent, in the realization that our human logic shrinks into insignificance compared to the wisdom of Him who loves us from our origin, can this Word become directive in our existence. Because there is truly only one eternal object of wonder -- that is God -- and only one possible hindrance to wonder -- and that is a person when he himself wants to be something. (shrink)
