This chapter elucidates Schiller’s characterization of Goethe’s scientific method as rational empiricism by considering Goethe’s statement that his philosophical development was influenced by Spinoza, Bacon, and Kant. An examination of Goethe’s color studies in this context shows that he drew key ideas from all three philosophers for developing a three-stage scientific method and, furthermore, that his rational empiricism overcomes a mechanistic conception of inorganic nature by providing an elucidation and a non-mechanical explanation of color phenomena.

ABSTRACTPrevious research suggests that labelling emotions, or describing affective states using emotion words, facilitates emotion regulation. But how much labelling promotes emotion regulation? And which emotion regulation strategies does emotion labelling promote? Drawing on cognitive theories of emotion, we predicted that labelling emotions using fewer words would be less confusing and would facilitate forms of emotion regulation requiring more cognitively demanding processing of context. Participants mentally immersed themselves in an emotional vignette, were randomly assigned to an exhaustive or minimal emotion (...) labelling manipulation, and then completed an emotion regulation strategy planning task. Minimal emotion labelling promoted higher subjective emotional clarity. Furthermore, in terms of specific emotion regulation strategies, minimal emotion labelling prompted more plans for problem solving and marginally more plans for reappraisal, but did not affect plans for behav... Arthur Prior’s argument for the A-theory of time in “Thank Goodness That’s Over” is perhaps his most famous and well-known non-logical work. Still, I think that this paper is one of his most misunderstood works. Because of this, much of its brilliance has yet to be properly appreciated. In this paper, I suggest that the explanation of this is that it has been treated as though it were following the standard model for a piece of Analytic philosophy. That is, it (...) has been assumed that what Prior was doing was deductively demonstrating the truth of a proposition which can be discussed via any sentences with the same semantic content. Here, I argue that this assumption is wrong on two fronts: Most importantly, the strongest reading of the structure of Prior’s argument is as an abduction rather than as a deduction. Many of the most important lessons of the argument are lost by focusing on the bare propositional content of its premise and conclusion statements. In other words, we can learn as much from the manner in which this argument is presented and expressed as we can from that which is expressed. (shrink)

This paper introduces the notion of knowledge structuring by schemata. A schema is a chunk of knowledge which generalizes the idea of functional dependence between pertinent concepts (objects). The rules are closely related to the schemata. Moreover the schemata are organized in a hierarchical network which takes into account the relative importance of the concepts. Examples are given in the financial field and the consequences with regards to knowledge engineering are discussed.

Understanding classroom interactions is a complex process. This article explores what conversation analysis and sociocultural theory of learning can contribute to that process. The exploration is carried out through analyses of interactions between Brian, a five-year-old boy, and Ms Nikora, his teacher, during a nine-hour social studies curriculum unit in a New Zealand classroom. CA and SCT may appear to be strange bedfellows, in that the former concerns itself with language use, while the latter concerns itself with language as mediation, (...) but they turn out to be useful partners. The analyses reveal at least three perspectives from which participants need to be understanding what is going on in classroom interactions in order to participate in them appropriately and learn through them: how people organize conversations, institutional talk, and how teachers and learners jointly construct learning opportunities. Gray's account of a brain mechanism for generating the contents of consciousness is incomplete. Adaptive advantages of conscious functioning need to be sought within the first-person affective sensation motivating flexibly goal-directed actions, as in Humphrey's sensory feedback theory.

Sober and Wilson's enthusiasm for a multi-level perspective in evolutionary biology leads to conceptualizations which appropriate all sources of bio-altruistic traits as products of ‘group’ selection. The key biological issue is whether genes enhancing one sub-population's viability in competition with others can thrive, despite inducing some members to lose fitness in intra-group terms. The case for such selection amongst primates remains unproven. Flexible social loyalties required prior evolution of subjective self-definition and self-identification with others. But normative readiness for truly group-serving (...) sacrifices of ego-interests presupposes entitative conceptions of in-groups as collective social units -- only made possible with the emergence of human symbolic language. Gangestad & Simpson make a convincing case for male and female psychological access to sexual strategies that dispose us towards both faithful long-term mating and promiscuity – according to socio- ecological conditions. However, their model fails to acknowledge how the human self-system's mediation of conduct can permit us to override voluntarily the pseudo-imperatives of optimizing inclusive fitness.

If a trademark becomes a generic term, it may be cancelled under trademark law, a process known as genericide. Typically, in genericide cases, consumer surveys are brought into evidence to establish a mark’s semantic status as generic or distinctive. Some drawbacks of surveys are cost, delay, small sample size, lack of reproducibility, and observer bias. Today, however, much discourse involving marks is online. As a potential complement to consumer surveys, therefore, we explore an artificial intelligence approach based chiefly on word (...) embeddings: mathematical models of meaning based on distributional semantics that can be trained on texts selected for jurisdictional and temporal relevance. After identifying two main factors in mark genericness, we first offer a simple screening metric based on the ngram frequency of uncapitalized variants of a mark. We then add two word embedding metrics: one addressing contextual similarity of uncapitalized variants, and one comparing the neighborhood density of marks and known generic terms in a category. For clarity and validation, we illustrate our metrics with examples of genericized, somewhat generic, and distinctive marks such as, respectively, DUMPSTER, DOBRO, and ROLEX. (shrink)

The new critical edition of the works and correspondence of Jeremy Bentham (1748-1832) is being prepared and published under the supervision of the Bentham Committee of University College London. In spite of his importance as jurist, philosopher, and social scientist, and leader of the Utilitarian reformers, the only previous edition of his works was a poorly edited and incomplete one brought out within a decade or so of his death. Eight volumes of the new Collected Works, five of correspondence, (...) and three of writings on jurisprudence, appeared between 1968 and 1981, published by the Athlone Press. Further volumes in the series since then are published by Oxford University Press. In this reply to Tim Bayne and Yujin Nagasawa, I defend the possibility of a maximal-excellence account of the grounding of the obligation to worship God. I do not offer my own account of the obligation to worship God; rather I argue that the major criticism fails. Thus maximal-excellence can ground an obligation to worship God.

Power in meetings may be enacted in many ways, ranging from democratic and collaborative through to authoritative and didactic, with the exact positioning on this continuum typically under the control of the chair. By contrast with the focus of most previous research on the behaviour of institutionally ratified chairs of intact teams, this paper examines how volunteer chairs of small focus groups in public meetings use the power associated with that role to manage the discussion and to encourage or discourage (...) explicit expression of disagreement. Our analysis identifies ways in which these arbitrarily assigned chairs influence and facilitate the small group discussions through a range of discourse practices. By separating the chair role from its typical co-occurrence with institutional hierarchy we are able to demonstrate the inherent influence and power of the position in the decision making process. The first five volumes of the Correspondence of Jeremy Bentham contain over 1,300 letters written both to and from Bentham over a 50-year period, beginning in 1752 (aged three) with his earliest surviving letter to his grandmother, and ending in 1797 with correspondence concerning his attempts to set up a national scheme for the provision of poor relief. Against the background of the debates on the American Revolution of 1776 and the French Revolution of 1789, to which he made (...) significant contributions, Bentham worked first on producing a complete penal code, which involved him in detailed explorations of fundamental legal ideas, and then on his panopticon prison scheme. Despite developing a host of original and ground-breaking ideas, contained in a mass of manuscripts, he published little during these years, and remained, at the close of this period, a relatively obscure individual. Nevertheless, these volumes reveal how the foundations were laid for the remarkable rise of Benthamite utilitarianism in the early nineteenth century. Bentham’s early life is marked by his extraordinary precociousness, but also family tragedy: by the age of 10 he had lost five infant siblings and his mother. The letters in this volume document his difficult relationship with his father and his increasing attachment to his surviving younger brother Samuel, his education, his interest in chemistry and botany, and his committing himself to a life of philosophy and legal reform. The writings collected in this volume make an important addition to The Collected Works of Jeremy Bentham. They lend credence to Bentham's claim that his ideas were appropriate `for the use of all nations and all governments professing liberal opinions'. The essays, dating mainly from late 1822 and early 1823, are based exclusively on manuscripts, many of which have not been previously published. Turning his attention towards the Mediterranean basin, Bentham here attempts to legislate for one Islamic state, and (...) offers advice to another in the process of throwing off Islamic rule. The Writings for Tripoli include the famous `Securities against Misrule', in which Bentham draws up a constitutional charter with an accompanying explanation of its provisions. He also discusses the social, political, and religious institutions of the country, and proposes a scheme for the introduction of constitutional reform both there and in the other Barbary states. The Writings for Greece include a rare commentary on the first Greek constitution of 1822, and advice and warnings to the Greek legislators against the temptation of `sinister appetites'. The main theme in both groups of writings is the efficacy of representative institutions and the publicity of official actions in preventing the abuse of government power. (shrink)

Political Tactics, composed for the Estates General just before the French Revolution, is one of Bentham's most original works. It contains the earliest and perhaps most important theoretical analysis of parliamentary procedure ever written. It was subsequently translated into many languages and has had a far-reaching influence -- as recently as the early 1990s it was reprinted by the Spanish Cortes.

A critical edition of three of Bentham's works, Deontology and The Article on Utilitarianism previously unpublished. Together with his An Introduction to the Principles of Morals and Legislation, they provide a comprehensive picture of Bentham's psychological and ethical views. This edition, based entirely on manuscripts written by Bentham of by his amanuenses, is equipped with a full introduction linking the three works. Each work is accompanied by detailed critical and explanatory notes.

This article explores the contributions that five different approaches to discourse analysis can make to interpreting and understanding the same piece of data. Conversation analysis, interactional sociolinguistics, politeness theory, critical discourse analysis, and discursive psychology are the approaches chosen for comparison. The data is a nine-minute audio recording of a spontaneous workplace interaction. The analyses are compared, and the theoretical and methodological implications of the different approaches are discussed.

The contractarian theory elaborated by John Rawls in A Theory of Justice exploits the difference principle in a great many ways. Rawls argues that, when used as part of a set of guiding principles for structuring the basic institutions of society, it simplifies the problem of interpersonal comparisons (91-4)1, helps compensate for the arbitrariness of natural endowments (101-3), promotes a harmony of interests between citizens (104-5), reintroduces the principle of fraternity to democratic society (105-6), and, what is critical to his (...) contractarian theory, it is an essential part of the principles of justice which would be chosen by free, equal, and rational persons in the original position.
