En los últimos años el problema de la traducción ha pasado de ocupar un lugar marginal o marginado a recibir una atención creciente por parte de distintas prácticas discursivas —entre ellas la filosofía, la literatura, el psicoanálisis y la traductología—, así como de gremios, audiencias e instituciones varias. La traducción se encuentra en el centro de un fecundo y animado debate interdisciplinar cuya polifonía pareciera tributar a la irreductible pluralidad de las lenguas.

Werner Hamacher's thought, despite its relevance and scope in other languages, has had a rather tenuous reception in the Spanish-speaking world to date. It is even possible to speak of the obstruction, in some of its points, of the circulation of his thought, as a product of the complexity of its translation. These difficulties, far from being reducible to a merely technical problem, are discussed hand in hand with the comparative reading of some of his texts in Spanish. His thought (...) from and in the language, sometimes despite it, illustrates the relevance of considering translation as a key operation for the philosophical debate in general and in Spanish-speaking countries in particular. Uber die verschiedenen Methoden des Ubersetzens se ha convertido en una referencia canónica del debate contemporáneo en torno a la traducción. Con el paso del tiempo, se ha establecido una lectura hegemónica que resalta el par extranjerización-domesticación como su hipótesis central, y, al mismo tiempo, denuncia el nacionalismo de Schleiermacher. A través de un close reading del texto se demuestra que esta no es la única lectura posible ni necesariamente la más correcta, ya que no consideraría ni el resto de (...) su pensamiento ni su propia relación con las lenguas. En lugar de esta lectura, se resaltan ciertas figuras del pensar de Schleiermacher, entre ellas, la figura del Entsetzen. (shrink)

Les relations entre l’avocat et le droit fiscal ont beau ne dater que d’une trentaine d’années, elles sont loin d’être paisibles et harmonieuses. En effet, la fiscalité étant au cœur du financement de l’État, l’explosion de la dette publique a placé la lutte contre la fraude fiscale au centre des politiques publiques. L’avocat fiscaliste a été présenté à l’opinion publique comme le facilitateur de cette fraude à combattre, voire comme le complice des fraudeurs, celui qui, grâce à sa connaissance de (...) la matière, permet une optimisation fiscale qualifiée d’agressive. Depuis près d’une quinzaine d’années, l’avocat fiscaliste fait l’objet de nombreuses mesures visant à le dissuader d’exercer son art dans le domaine du conseil : obligations de déclaration des schémas d’optimisation transfrontières, réduction du champ de son secret professionnel, etc., la liste des atteintes à sa pratique est hélas longue… Fort heureusement, avec au même moment l’introduction de la Question prioritaire de constitutionnalité, un champ nouveau de contentieux d’attaque de la norme s’est ouvert à lui. Ce contentieux particulier l’a conduit à se familiariser avec les concepts nouveaux de droits fondamentaux, qu’il a à son tour su utiliser contre les pouvoirs publics pour défendre son droit à conseiller ses clients afin de les aider à trouver la voie la moins imposée. Car l’avocat fiscaliste est un rouage indispensable du consentement à l’impôt, qui est le pilier de notre démocratie. Puissent nos gouvernants le comprendre sans que les juges ne soient obligés de le leur rappeler. (shrink)

El artículo analiza el problema del comprender a partir de las nociones de des-alejamiento, partida y trauma. Mientras que la comprensión tradicionalmente ha sido abordada desde una noción clásica de representación, asociada a la presencia y la disponibilidad, aquí se explora una vía del comprender que recoge ciertos aportes del pensamiento de Werner Hamacher y Sigmund Freud, que arrancan de una reformulación de la noción predominante de representación. La lectura minuciosa, apegada al texto, de un poema de Rilke, que implica (...) además su traducción, permite poner a prueba dichos aportes y desarrollar las ideas de sustracción, partida y des-alejamiento sobre el trasfondo del célebre juego freudiano del Fort/Da. Todo esto, con el fin de esbozar las consecuencias de tal ejercicio para una comprensión detraída del comprender a partir del antecedente de los autores mencionados. (shrink)

A partir de su papel económico-político, del lugar que el racismo y el nacionalismo ocupan en él, así como del carácter conservador y de clausura social que propone, se pretende lograr una caracterización de este fenómeno político. Sin pretensiones de elaborar una defin- ición enciclopédica, se establecen unas coordenadas analíticas que permitan situar este problema en la (...) articulación teórica de elementos que se encontraban dispersos. La noción de sujeto es un concepto polivalente, múltiple, sobredeterminado, en suma, problemático. Con tal de contribuir a su esclarecimiento, se discute el lugar y estatuto del sujeto a partir de sus respectivos procesos de constitución, tanto en Jürgen Habermas como en Michel Foucault. Se examina, fundamentalmente, la relación del sujeto con el lenguaje y con la historia. A propósito de la constitución subjetiva se distinguen modalidades productivas altamente diferentes, que, a su vez, ponen en juego conceptos teóricos divergentes, dando (...) origen a modalidades subjetivas contrastadas, con posibilidades y vías de acción sumamente discordantes. Recuperando ciertos conceptos de la Teoría Crítica, se propone pensar en un tipo de subjetividad dialógica que recoja estas diferencias sin anularlas o ignorarlas. The notion of subject is a multiple, polyvalent, overdetermined concept, in short, a problematic concept. Aiming at its clarification the place statute of the subject is discussed starting with the consideration of its respective processes of constitution in so much in Jürgen Habermas as in Michel Foucault. It is examined, fundamentally, the relation of the subject toward language and history. By the way of the subjective constitution highly different productive modalities are distinguished, that, at the same time, imply divergent theoretical concepts, causing contrasted subjective modalities, with extremely discordant possibilities and ways of action. Recovering certain concepts of the Critical Theory there is proposed a type of dialogical subjectivity, that collects these differences without annulling them or to ignore them. (shrink)

La pregunta por el alcance y la relevancia de la angustia en la obra escrita de Martin Heidegger es uno de los problemas fundamentales del debate contemporáneo, y no solamente en cuanto a sus declinaciones filosofizantes. En este trabajo se delimita el lugar de ¡a angustia en Ser y Tiempo, centrándose, en un primer momento, en contextualizar la temática al interior del proyecto inconcluso de Ser y Tiempo, para luego introducir la noción de la angustia en tanto apertura distinguida o (...) destacada del Dasein. The question about the extent and relevance of the concept of anxiety inside the written work of Martin Heidegger is one of the fundamental problems not only the p h i l o s o p h i c al declinations of the contemporary debate turn around. In the present article the place of anxiety in Being and Time is delimitated, focusing the discussion, in first place, on locating the thematic in the context of the unconcluded project of Being and Time, followed by the introduction of the notion of anxiety as distinguished or outstanding aperture of the Dasein. El concepto de la vida en Nietzsche es una idea central, tanto de su propio pensamiento como en relación a sus repercusiones en el debate contemporáneo. Sus múltiples significaciones superan el campo en el cual inicialmente había sido planteado, invitando a la discusión en las fronteras disciplinares y al debate interdisciplinario. Se plantea examinar la concepción nietzscheana del eterno retorno desde la noción lacaniana de repetición con tal de esclarecer la idea de la vida como mujer.

Nowadays psychology as a scientific discourse and a positive practice finds itself in an epistemologically critical situation. The analysis of the actual state of the academic discussion in cognitive-behavioural psychology, the most representative and widespread theoretical-practical trend in European nations, reveals that it frequently is misunderstood as a exclusively technical proceeding, an amount of deficiently articulated operatory interventions, alienated from its underlying anthropological assumptions. This paper proposes to exam how far the gap between theoretical reflection and effective practice, a cleavage (...) frequently confirmed, may be reduced discussing the concept of Menschenbildannahmen, an idea firmly rooted in anthropological thinking. Actualmente, la psicología en tanto discurso científico y práctica positiva se encuentra en un estado epistemológicamente crítico. El análisis del estado actual de la discusión académica en la psicología cognitivo-conductual, la corriente teórico-práctica más representativa y más difundida en los estados europeos, devela que ésta frecuentemente es malentendida como un mero procedimiento técnico, un conjunto precariamente articulado de intervenciones operatorias, desentendidas de sus supuestos antropológicos subyacentes. Se propone examinar en qué medida la brecha entre reflexión teórica y práctica efectiva, una escisión ampliamente constatada, puede ser aminorada sometiendo a discusión el concepto de las Menschenbildannahmen, de extensa raigambre en el pensamiento antropológico. La acción de los medios de prensa de construir y representar realidades socioculturales genera --en reiteradas ocasiones-- relaciones desiguales, promoviendo e institucionalizando unas identidades en desmedro de otras. La situación se complejiza cuando se trata de países vecinos, con sus respectivas tradiciones socio-histórico-culturales, pasados comunes y límites bisagra. Bajo este escenario se analizaron las producciones noticiosas de cobertura nacional publicadas en los periódicos de mayor tirada de dos países limítrofes: “El Mercurio” de Chile y “El Comercio” de Perú. De este (...) modo, y por medio de una herramienta metodológica ligada al Análisis Crítico y Complejo del Discurso, esta investigación busca comprender los procesos de construcciones noticiosas y representaciones que los medios de prensa chilenos y peruanos hacen en torno a los “discursos de la diferencia” que se institucionalizan en la relación entre ambas naciones. The action of the press media of constructing and representing socio-cultural realities generates --on numerous occasions-- unequal relationships, which promote and institutionalize certain identities in detriment of others. The situation becomes more complex when it deals with neighboring countries and their corresponding socio-historical-cultural traditions, shared pasts, and “hinge-like” borders. Under this scenario, the production of national news by two nationwide press media of the neighboring countries will be analyzed: “El Mercurio” of Chile and “El Comercio” of Perú. In this manner, and using a methodological tool based on the Critical and Complex Analysis of the Discourse, the main objective of this research is to understand processes of construction of news and representations that the Chilean and Peruvian press make linked to the “discourse of the differences” which have been institutionalized in the relationship between them both. El presente artículo se interroga por la noción de sujeto implícita en el proceder empleado por Tribunales de Familia para casos de violencia hacia la mujer en Chile. Considera las implicancias que tienen las leyes en el contexto del proceder de los casos de violencia, para terminar revisando ciertas nociones desprendidas del operar jurídico, a partir de una lectura que incluye aspectos de las ciencias humanas y del psicoanálisis. Se expone, finalmente, cómo estas nociones están enraizadas en y, a su (...) vez, sostienen ciertos discursos respecto a la violencia hacia la mujer, que permiten determinadas modalidades de subjetivación.The present article discusses the notion of subject implicit in the procedures of Family Courts in case of women violence in Chile. The article takes in to account the influence of laws in the context of violence cases and it finishes reviewing certain notion taken from the juridical work. This is done beginning with a reading based on human sciences and psychoanalysis. Finally, the article point out the roots of these notions and, at the same time, discusses certain discourses related to woman violence that allow certain subjectivation modes. (shrink)

Resumen: El llamado “caso Schreber” es uno de los textos más visitados, tanto por la tradición psicoanalítica como por los distintos debates interdisciplinares que se entretejen alrededor de él. En el interior de la abundante riqueza de lecturas filosóficas, literarias, clínicas y otras, hay un aspecto al que, sorprendentemente, se le ha prestado poca atención, a saber, la relación entre el delirio de Daniel Paul Schreber y el forjamiento, del lado de Sigmund Freud, de una teoría no solo de la (...) psicosis como estructura clínica, sino también de las fuerzas y dinamismos que rigen el funcionamiento del aparato anímico, la llamada teoría pulsional [Trieblehre]. En este artículo se discute esta relación de la mano del análisis comparativo de la noción de “mito endopsíquico”, que atravesará los campos del delirio schreberiano y de la metapsicología freudiana, para evidenciar en ambos dominios, mediante una serie de relaciones de analogía e isomorfismo, los elementos cruciales de una representación de la vida como de-vivir, es decir, como desgaste o degradación de las poderes de lo viviente.: The so-called “Schreber case” is one of the most visited texts, both by the psychoanalytic tradition and by the interdisciplinary debates intertwined around it. Within the abundant richness of philosophical, literary, clinical, and other readings, one aspect has surprisingly been given little attention, namely, the relationship between the Daniel Paul Schreber delirium and the forging, by Sigmund Freud, of a theory of psychosis as a clinical structure and also of the forces and dynamisms that rule the functioning of the psychic apparatus, the so-called drive theory {Trieblehre}. In this article, this relationship is discussed through a comparative analysis of the notion of “endopsychic myth” in the fields of Schreberian delirium and of Freudian metapsychology, in order to show in both domains, using a series of relations of analogy and isomorphism, the crucial elements of a representation of life as a “dis-living”, that is, as a wear or degradation of the powers of all living matter. This volume provides the first English translation of Hans Kelsen's and Carl Schmitt's influential Weimar-era debate on constitutional guardianship and the legitimacy of constitutional review. It includes Kelsen's seminal piece, 'The Nature and Development of Constitutional Adjudication', as well as key extracts from the 'Guardian of the Constitution' which present Schmitt's argument against constitutional review. Also included are Kelsen's review of Schmitt's 'Guardian of the Constitution', as well as some further material by Kelsen and Schmitt on presidential dictatorship under (...) The Hans Reichenbach Papers comprise published and unpublished manuscripts, lectures, correspondence, photographs, drawings, and related materials from his early student days until his death. The correspondence contains about 9000 pages to and from Reichenbach; it ranges over his entire career. Those with whom Reichenbach maintained lifelong contact include Rudolf Carnap, Ernst Cassirer, Herbert Feigl, Philip Frank, Carl Hempel, Sidney Hook, Paul Oppenheim and Wolfgang Pauli. In addition, there is significant correspondence with von Astor, Bergmann, Bertalanffy, Dingler, Dubislav, Einstein, Fraenkel, (...) Frank, Freundlich, Grelling, Grünbaum, Paul Hertz, Hutten, Jordan, Landé, von Laue, Lewin, C.I. Lewis, Charles Morris, Nagel, Neurath, Northrop, Planck, Quine, Regener, Rougier, Salmon, Schillp, Schlick, Scholz, Schrödinger, Martin Strauss, Tarski, Vaihinger, Weiss, Williams, Zawarski, and Zilsel. The correspondence provides a valuable source of information about Reichenbach’s personal and philosophical development. It also provides primary source material for research into one of the 20th century most influential philosophical movements. Reichenbach’s manuscripts include many of his own notes as a student. Some go as far back as his university days in science and mathematics. Some of the most significant of these notes are those taken by him as a student of Albert Einstein on the special and general theories of relativity. There are four such notebooks dating from 1918. In addition there are his student notes on astronomy, Planck and electricity, Hilbert’s “Statistical Mechanics” and “Problems and Principles.” He also kept many of his lecture notes from Germany, Turkey, and the United States. The number of lectures runs to over 100 and provides a glimpse into the problems of philosophy and how he presented them to his students. Many of his lectures discussed principles of radio and issues in philosophy and modern science, often in form of popularizations of questions in relativity and quantum theory delivered on radio programs for a wider audiences. We publish here the letters between Gadamer and Ricoeur, as they are found in the Archives of the two philosophers (Gadamer-Archiv in Marbach and Fonds Ricoeur in Paris). Starting from February 1964 and ending on October 2000, the thirty-five letters reproduced here cannot give a complete picture of their much richer correspondence and relations, because it seems that neither Ricoeur, nor Gadamer kept all the letters they received from one another. But altogether, they document their common concerns, their mutual respect, (...) even their intellectual solidarity and finally the particular context that brought them to write to one another, i.e. Ricoeur’s intention to publish a translation of Gadamer’s book, Truth and Method, in a new series he edited for the Seuil Publisher. Als Referenten sind ein katholischer und ein evangelischer Theologe und zwei Philosophen vorgesehen. Das Präsidium des »Österreichischen College« hat mich beauftragt, Sie zu bitten, eines der Referate zu übernehmen.

Hans Albert ist der Hauptvertreter des Kritischen Rationalismus und einer der einflussreichsten Wissenschaftslehrer im deutschen Sprachraum. Seine interdisziplinar angelegten Arbeiten beschaftigen sich mit den Grundlagen der Sozialwissenschaften und der Bedeutung kritisch-rationalen Denkens fur die sozialwissenschaftliche Theorie und Praxis. Der vorliegende Band enthalt Texte fuhrender Vertreter aus Philosophie, Soziologie, Religionswissenschaft und Jurisprudenz, die sich mit den Positionen Alberts im Kontext ihres eigenen Fachgebiets beschaftigen.

Hans Reichenbach (1891–1953) was a formidable figure in early-twentieth-century philosophy of science. Educated in Germany, he was influential in establishing the so-called Berlin Circle, a companion group to the Vienna Circle founded by his colleague Rudolph Carnap. The movement they founded—usually known as "logical positivism," although it is more precisely known as "scientific philosophy" or "logical empiricism"—was a form of epistemology that privileged scientific over metaphysical truths. Reichenbach, like other young philosophers of the exact sciences of his generation, was (...) deeply impressed by the far-reaching changes in physics brought about by Einstein's special and general theories of relativity. Reichenbach responded to scientific advances by doing fundamental work in space-time theories, in quantum mechanics, in statistical mechanics, and in the development of probability theory—making him the most important philosopher of physics in the first generation of logical empiricism. Forced from his academic position by the Nazi race laws in 1933, Reichenbach wrote _Experience and Prediction_ at the University of Istanbul, where had had fled, expressly to introduce logical positivism to English speakers. In the two decades following World War II, during the explosion of scientific advances in North America, logical positivism was the reigning theory of the philosophy of science and Reichenbach was at the peak of his career. But, inevitably, support for logical positivism began to wane as it became obvious that the justification of scientific theories could not be entirely resolved by relying on strictly formal, technical processes. The growth of the discipline of the history of philosophy of science, which has created an audience of scholars eager for seminal classics in scientific philosophy, and the evidence supporting a historicist paradigm within logical positivism are two important reasons to make _Experience and Prediction_ available once again. "Hans Reichenbach's_ Experience and Prediction_ is one of the most important books in twentieth-century philosophy of science. Its author was, along with Rudolf Carnap, one of the two principal ambassadors to North America of the exciting new European philosophical movement known here under the names 'Logical Positivism' and 'Scientific Philosophy.'
