Numerous ethical theories have been proposed as a foundation of business ethics, and this often brings about appreciable perplexity. This article seeks to identify specific problems for a sound foundation of this discipline. A first problem is this multiplicity of ethical theories, each with its own metaethics, often accepted without a serious discussion of their philosophical grounds. A second problem is the fragmentation of theories; some centred on duties or obligations, others on consequences, virtues, or moral sentiments. In (...) addition, some theories focus on universal principles, while others take the singularity of each situation as their focal point. A third problem is that not every ethical theory covers the personal, organizational and societal dimensions of business ethics, and this introduces reductionism. These problems cannot be satisfactorily addressed through ‘ethical pluralism’, in which all theories are accepted, without falling into ethical relativism. ‘Ethical pragmatism’, which welcomes any ethical theory only on the basis of their practically, is also questioned. Furthermore, there is the problem of integrating ethics into business theory, which is often extrinsic to the economic function. After analysing these problems, the article concludes by exploring some proposals that might serve to build a sound and complete ethical theory which includes human goods (objective values), principles (or norms) and virtues. The necessity of reconsidering the human action for a closer integration of ethics into business theory is also suggested. (shrink)

This chapter presents a new argument for thinking of traditional ethical theories as methods that can be used in first-order ethics - as a kind of deliberation procedures rather than as criteria of right and wrong. It begins from outlining how ethical theories, such as consequentialism and contractualism, are flexible frameworks in which different versions of these theories can be formulated to correspond to different first-order ethical views. The chapter then argues that, as a result, the traditional (...) ethical theories cannot be evaluated in terms of their truth or correctness. Instead, I will suggest that these theories should be understood as providing different kind of ways of thinking about difficult moral problems. I then recommend a certain form of pragmatic pluralism - it may well be that different moral problems are better approached through different ethical theories. (shrink)

We have controversial intuitions about the rightness of retributive punishment, keeping promises for its own sake, and pushing the heavy man off of the bridge in the footbridge trolley case. How do these intuitions relate to ethical theories? Should ethical theories aim to fit with and explain them? Or are only uncontroversial intuitions relevant to explanatory ethical theorising? I argue against several views that we might hold about the relationship between controversial intuitions and ethical theories. Are there good grounds for thinking that the moral values of action are to be derived from those of character? This virtue ethical claim is sometimes thought of as a kind of normative ethical theory; sometimes as form of opposition to any such theory. However, the best case to be made for it supports neither of these claims. Rather, it leads us to a distinctive view in moral epistemology: the view that my warrant for a particular (...) moral judgement derives from my warrant for believing that I am a good moral judge. This view seems to confront a regress-problem. For the belief that I am a good moral judge is itself a particular moral judgement. So it seems that, on this view, I need to derive my warrant for believing that I am a good moral judge from my warrant for believing that I am a good judge of moral judges; and so on. Self-driving vehicles will need to make decisions that carry ethical dimensions and manufacturers have (the responsibility) to pre-determine this underlying, deliberate decision-making process. With the rise of self-driving vehicles, scholars have simultaneously started investigating what ethical theories should guide machine behavior, but have not concluded as to which theory should be preferred and adopted. We aim to address this matter by providing a holistic and analytical review of the autonomous driving ethics literature. Many philosophers in the Anglo-American tradition have held that the predominant modern western theories of ethics like Kant’s deontological theory and Mill’s Utilitarianism have failed to deliver as a “theory” of ethics. In other words, they are not successful as “decision procedures” whereby one can determine which action from a multitude of actions open before the agent would be right and therefore morally obligatory for him to do. In fact, the basic concepts of moral obligation, impartiality, and objectivity (...) of moral standards has been questioned and pitted against the “personal point of view” of the agent. It has been held that the “moral goods” have to be given up for the sake of the “personal goods.” Is this a systemic fault which is linked with the normative nature of ethics? Or, can we understand ethics in a manner where it can be objective and yet not have to give up on the plurality of moral and nonmoral goods? Can ethical theory in this sense function as an “action guide to moral practice”? Where does the impetus towards ethical theory come from? What drives humans to make values explicit, consistent, and discursively justifiable? This paper situates the demand for ethical theory in human life by identifying the practical needs that give rise to it. Such a practical derivation puts the demand in its place: while finding a home for it in the public decision-making of modern societies, it also imposes limitations on the demand by presenting it as scalable and (...) context-sensitive. This differentiates strong forms of the demand calling for theory from weaker forms calling for less, and contexts where it has a place from contexts where it is out of place. This chapter explores ways in which an ethical theory can develop through time and, in particular, variations in Kantian ethical theories. The chapter argues that a Kantian could say that we have duties to particular people as part of ongoing commitments, but an adequate and sufficient account of good and poor decisions in personal relationships cannot be based entirely on the categorical imperative, nor can we do justice to seriously wrong decisions by regarding them as violations of (...) duty. Following John Rawls, writers like Bernard Williams and Christine Korsgaard have suggested that a transparency condition should be put on ethical theories. The exact nature of such a condition and its implications is however not anything on which there is any consensus. It is argued here that the ultimate rationale of transparency conditions is epistemic rather than substantively moral, but also that it clearly connects to substantive concerns about moral psychology. Finally, it is argued that once a satisfactory form (...) of the transparency condition is formulated, then, at least among the main contenders within ethical theory, it speaks in favor of a broadly Aristotelian approach to ethical theorizing. Let the Guidance Constraint be the following norm for evaluating ethical theories: Other things being at least roughly equal, ethical theories are better to the extent that they provide adequate moral guidance. I offer an account of why ethical theories are subject to the Guidance Constraint, if indeed they are. We can explain central facts about adequate moral guidance, and their relevance to ethical theory, by appealing to certain forms of autonomy and fairness. This explanation (...) is better than explanations that feature versions of the principle that ‘ought’ implies ‘can’. In closing, I address the objection that my account is questionable because it makes ethical theories subject not merely to purely theoretical but also to morally substantive norms. Given the tremendous proliferation of student plagiarism involving the Internet, the purpose of this study is to determine which theory of ethical reasoning students invoke when defending their transgressions: deontology, utilitarianism, rational self-interest, Machiavellianism, cultural relativism, or situational ethics. Understanding which theory of ethical reasoning students employ is critical, as preemptive steps can be taken by faculty to counteract this reasoning and prevent plagiarism. Additionally, it has been demonstrated that unethical behavior in school can lead to (...) unethical behavior in business; therefore, correcting unethical behavior in school can have a positive impact on organizational ethics. To meet this objective, a content analysis was conducted on the written records of students formally charged with plagiarizing at a large West Coast university. Each case was classified according to the primary ethical reasoning that the student used to justify plagiarism. Results indicate that students predominately invoke deontology, situational ethics, and Machiavellianism. Based on these findings, specific recommendations are offered to curb plagiarism. (shrink)

Abuses at Abu Ghraib prison in Iraq confront us with the question of how seemingly ordinary soldiers could have perpetrated harms against prisoners. In this essay I argue that a Stoic approach to the virtues can provide a bulwark against the social and personal forces that can lead to abusive behavior. In part one, I discuss Abu Ghraib. In two, I examine social psychological explanations of how ordinary, apparently decent people are able to commit atrocities. In three, I address a (...) series of questions: why should we turn to ethics for help with these problems, and why, in particular, to Stoicism instead of other ethical theories, such as utilitarianism or Kantianism? Given the power of situations in influencing behavior, is a turn to character ethics a viable response to problems such as those at Abu Ghraib? I argue in part four that character formation drawing on Stoic values can provide soldiers with the inner resilience to resist the situational factors that press them to unwarranted aggression. This article examines G. A. Cohen’s endorsement of a hybrid ethical theory and its relationship to his critique of John Rawls’s egalitarian liberalism. Cohen claimed that Rawls’s appeal to special incentives was a distortion of his own difference principle. I argue that Cohen’s acceptance of a personal prerogative (the central element of Samuel Scheffler’s version of a hybrid ethical theory) has several untoward consequences. First, it illuminates how any reasonable challenge to Rawls’s liberalism must recognise Thomas (...) Nagel’s arguments concerning the problems that arise when one attempts to implement a political theory analogous to a hybrid theory of ethics. Second, it undermines Cohen’s critique of Rawls. Third, it undermines the plausibility of Cohen’s ethos-driven social egalitarianism. The article concludes that, despite Nagel’s concerns, the most plausible form of egalitarianism—one that can accommodate the requirements of a hybrid ethical theory—will be Rawlsian, rather than Cohen’s ethos-based system. The last twenty-five years of published literature and curriculum development in bioethics suggest that the field enjoys a successful and stable marriage to philosophical ethical theory. However, the next twenty-five years could be very different. I believe the marriage is troubled. Divorce is conceivable and perhaps likely. The most philosophical parts of bioethics may retreat to philosophy departments, while bioethics continues on its current course toward a more interdisciplinary and practical field.I make no presumption that bioethics is integrally (...) linked to philosophical ethical theory. Indeed, I assume that the connection is contingent and fragile. Many individuals in law, theological ethics, political theory, the social and behavioral sciences, and the health professions carefully address mainstream issues of bioethics without finding ethical theory essential or breathtakingly attractive. The Oxford Handbook of Ethical Theory is a major new reference work in ethical theory consisting of commissioned essays by leading moral philosophers. Ethical theories have always been of central importance to philosophy, and remain so; ethical theory is one of the most active areas of philosophical research and teaching today. Courses in ethics are taught in colleges and universities at all levels, and ethical theory is the organizing principle for all (...) of them. The Handbook is divided into two parts, mirroring the field. The first part treats meta-ethical theory, which deals with theoretical questions about morality and moral judgment, including questions about moral language, the epistemology of moral belief, the truth aptness of moral claims, and so forth. OBJECTIVES: To study empirically whether ethical theory (from the mainstream principles-based, virtue-based, and feminist schools) usefully describes the approaches doctors and nurses take in everyday patient care. DESIGN: Ethnographic methods: participant observation and interviews, the transcripts of which were analysed to identify themes in ethical approaches. SETTING: A British old-age psychiatry ward. PARTICIPANTS: The more than 20 doctors and nurses on the ward. RESULTS: Doctors and nurses on the ward differed in their conceptions of the principles of (...) beneficence and respect for patient autonomy. Nurses shared with doctors a commitment to liberal and utilitarian conceptions of these principles, but also placed much greater weight on relationships and character virtues when expressing the same principles. Nurses also emphasised patient autonomy, while doctors were more likely to advocate beneficence, when the two principles conflicted. CONCLUSION: The study indicates that ethical theory can, contrary to the charges of certain critics, be relevant to everyday health care-if it (a) attends to social context and (b) is flexible enough to draw on various schools of theory. This Editorial outlines recent developments in the Journal’s scope, mission and review policy. It also illustrates the range of topics addressed on the pages of Ethical Theory and Moral Practice, which is now entering its 24th year.

Recent work in ethical theory brings into question the ability of master-principle theories (utilitarianism, deontology, rights and duties, and social contracts) to provide guidance for normative behaviour and ethical reflection. Business ethics education and corporate ethics programmes are still heavily influenced by these theories which have been found to be deficient in adequately dealing with ethical reflection and guiding practice. There appears to be a dissonance between the fields of ethical theory and business ethics (...) education. This paper explores this dissonance by developing a business ethics pedagogical model which compliments master-principle theories with an enhanced or enlightened virtue ethics that incorporates the notions of pluralism, particularism, and intuitionism. This anthology is designed for use as a brief introduction to ethical theory. Included are sections on various forms of ethical theory: Ethical Relativism; Divine Command Theory; Egoism; Consequentialism; Deontology; Justice; Virtue Ethics; Feminist Ethics; and, new to the second edition, Pluralism. Each section includes two or three of the most important and interesting contributions to the field, together with brief introductions by the editors. The second edition contains an improved approach to applied ethics. (...) Whereas in the first edition the authors included a chapter at the end of the book that contained selections that dealt with moral problems, in the second edition they have dropped that chapter in favour of an approach that ties moral issues more closely to the moral theories. Each chapter on moral theories now includes a selection that deals with a moral problem, such as human cloning, abortion, and global warming. The selection illustrates how the relevant theoretical approach is put to use. There is therefore a much tighter integration between theory and practice than before. The new structural approach should make the book significantly more effective in the classroom. The new edition also contains an improved section on feminist ethical theory. (shrink)

This paper focuses on the deontological pluralism of W. D. Ross. First, the structure of this ethical theory is explained and assessed, yielding a slightly qualified endorsement. Then the focus moves on to the content of Ross’s prima facie duties. The paper argues that Ross’s list of duties should be supplemented by agent-relative duties towards family and friends, moral permissions, and other moral rights. Furthermore, whereas Ross held that the duty to promote justice is an agent-neutral duty to (...) bring about a match between virtue and happiness, this paper argues that justice incorporates attention to agent-relative duties, to various rights, and to fairness, which is here explained in terms of sensitivity to relevant differences and insensitivity to irrelevant differences. Normative Ethical theory underwent a period of refinement in some areas and proliferation in others during the 20th century. Theories prominent in the 19th century, such as Utilitarianism, underwent refinement in light of criticisms; other approaches, such as normative intuitionism and virtue ethics, were developed in new directions, ones that reflected the sophistication of analytical techniques developed by philosophers in the 20th century, particularly in ordinary language philosophy. The middle of the 20th century was marked by an interest (...) in conceptual analysis and what could be revealed about our concepts in the analysis of ‘ordinary’ language appeals to those concepts. For example, Gilbert Ryle argued that the hope of clearing up our concepts via formalizing them was futile, and instead the task of philosophy was to clear up confusions present in the ordinary use of concepts, concepts employed by ordinary people as well as specialists in a given area. Normative ethicists in the very early part of the 20th century had not yet adopted a ‘scientizing’ attitude to philosophy. They believed, for example, that one could rely on intuition in formulating ethical theories.1 Theorists in the early part of the century were also optimistic about the prospects of systematizing normative ethics in a way that would be faithful to our common sense normative judgments. How is ethical theory used in contemporary teaching in business ethics? To answer this question, we undertook a survey of twenty-five of the leading business ethics texts. Our purpose was to examine the ways in which normative moral theory is introduced and applied to cases and issues. We focused especially on the authors' views of the conflicts and tensions posed by basic theoretical debates. How can these theories be made useful if fundamental tensions are acknowledged? Our analysis (...) resulted in a typology, presented here, of the ways in which normative theory, and the difficulties within it, are handled in business ethics texts. We conclude that there is a serious lack of clarity about how to apply the theories to cases and a persistent unwillingness to grapple with tensions between theories of ethical reasoning. The recent production of major treatises devoted to elaborating normative ethical theories and the eruption of lively debates concerning the merits of opposed normative systems have been greeted with applause. This reaction is an historical about-face, since for forty or fifty years “ethical” treatises had been attacking the pretensions of traditional moral philosophy, calling for its demise or at the least severely limiting its claims. These skeptical attacks had succeeded in seriously undermining the academic status of moral philosophy (...) and consequently moral philosophy was transformed into “metaethics,” a highly abstract and technical discipline considered much less necessary to the general education of students than what it replaced and with a diminished role in the curriculum. The recent resurgence of interest in normative ethics has generally been lauded as a sign that philosophy has rededicated itself to its proper and time-honored tasks. There is a widespread feeling that the overblown claims of twentieth century skepticism have been whittled down to innocuous proportions and thus that nothing stands in the way of proceeding to construct ethical theories. The study of normative ethical theory now enjoys such respectability and popularity that it is difficult to raise once more the uncomfortable ideas that the ideal of normative ethical theory is a false one, that vanquishing the spectre of noncognitivism is not sufficient for legitimizing it, and that the popular new justifications for the enterprise fail in mischievous ways. In the context of health care system complexity, nurses need responsive leadership and organizational support to maintain intrinsic motivation, moral sensitivity and a caring stance in the delivery of patient care. The current complexity of nurses’ work environment promotes decreases in work motivation and moral satisfaction, thus creating motivational and ethical dissonance in practice. These and other work-related factors increase emotional stress and burnout for nurses, prompting both new and seasoned nurse professionals to leave their current position, or even (...) the profession. This article presents a theoretical conceptual model for professional nurses to review and make sense of the ethical reasoning skills needed to maintain a caring stance in relation to the competing values that must coexist among nurses, health care administrators, patients and families in the context of the complex health care work environments in which nurses are expected to practice. A model, Nurses’ Ethical Reasoning Skills, is presented as a framework for nurses’ thinking through and problem solving ethical issues in clinical practice in the context of complexity in health care. This book consists of a systematic analysis of the basic concepts of Islamic ethics and is based on a vast amount of material in Arabic which is not easily accessible to Western scholars, especially those who have no knowledge of the Arabic language.

There seems to be a prevailing belief among public relations professionals that ethical problems can easily be solved by either reference to a simplified code or citation of a few well-worn platitudes. However, the route to a more complete understanding of questions of ethics is circuitous and often painstaking. By applying a number of ethical theories to a public relations problem, both the skilled public relations technician and the public relations professional may arrive at similar conclusions concerning moral (...) obligations; however, the professional is in the most favorable position to effect change. When clinical ethics committee members discuss a complex ethical dilemma, what use do they have for normative ethical theories? Members without training in ethical theory may still contribute to a pointed and nuanced analysis. Nonetheless, the knowledge and use of ethical theories can play four important roles: aiding in the initial awareness and identification of the moral challenges, assisting in the analysis and argumentation, contributing to a sound process and dialogue, and inspiring an attitude of (...) reflexivity. These four roles of ethical theory in clinical ethics consultation are described and their significance highlighted, while an example case is used as an illustration throughout. (shrink)

This article’s thesis is that teachers of practical and professional ethics should adopt what Nick Fotion calls a “weak” approach to ethics theory and reasoning, one that is situated within a practice-driven attitude toward ethics engagement. This approach insists that ethics reasoning should strive to find real solutions to real world problems, while also embracing that such solutions are more often than not only tentative. That is, the approach does not demand that one’s reasoning model will always provide the (...) complete and final answer to every ethics question, but instead strives for the best answer within acknowledged epistemological deficits. This humbler attitude recognizes that one’s proposed solutions could very well be upended by facts not currently available or by more skilled reasoning. Adopting such an approach can also do much to alleviate what I call the “roller-coaster” effect: namely, the all-too-common experience of reading the traditional theorists, quite rightly finding that they provide powerful and compelling—even convincing—arguments, only to then have that conviction undercut by the often devastating critique presented by the text or professor. On this model, one instead embraces key insights from those theorists and works to merge them into a practical method of ethics reasoning. I close with a proposal for one such method. (shrink)

This article starts with a brief historical account of the ongoing debate about the status of clinical ethics: theory of practice. The author goes on to argue that clinical ethics is best understood as a practice. However, its practicality should not be measured by the extent to which clinical-ethical consultants manage to mediate or negotiate resolutions to ethical conflicts. Rather, clinical ethics is practical because it is characterized by a profound concern for the well-being of individual patients (...) as well as the moral parameters of swift and urgent medical action in the face of limited supportive information. This article will explore and summarise the four main ethical theories that have relevance for healthcare assistants. These are utilitarianism, deontology, virtue ethics, and principlism. Understanding different ethical theories can have a number of significant benefits, which have the potential to shape and inform the care of patients, challenge bad practice and lead staff to become better informed about areas of moral disagreement.

Ethical theories are explanatory. But do ethical theories themselves include explanatory content? The direct model holds that they do. The indirect model denies this, maintaining instead that, if true, ethical theories can be employed to provide explanations of the phenomena they concern. The distinction between these models is left implicit in much of ethics. The choice between them, however, has significant methodological and other consequences. I provide two arguments for the direct model and suggest that ethical (...) theories do contain explanatory content. I then respond to three objections, connecting this neglected issue to others concerning property-identity and the nature of explanation and theory confirmation in ethics. (shrink)

Many environmental problems are longitudinal collective action problems. They arise from the cumulative unintended effects of a vast amount of seemingly insignificant decisions and actions by individuals who are unknown to each other and distant from each other. Such problems are likely to be effectively addressed only by an enormous number of individuals each making a nearly insignificant contribution to resolving them. However, when a person’s making such a contribution appears to require sacrifice or costs, the problem of inconsequentialism arises: (...) given that a person’s contribution, although needed (albeit not necessary), is nearly inconsequential to addressing the problem and may require some cost from the standpoint of the person’s own life, why should the person make the effort, particularly when it is uncertain (or even unlikely) whether others will do so? In this article I argue that justifications for making the effort to respond to longitudinal collective action environmental problems are, on the whole, particularly well supported by virtue-oriented normative theories, on which character traits are evaluated as virtues and vices consequentially or teleologically and actions are evaluated in terms of virtues and vices. If ethical theories are to be assessed on their theoretical and practical adequacy, and if providing a compelling response to the problem of inconsequentialism is an instance of such adequacy, then this is a reason for preferring virtue-oriented ethical theory over non-virtue-oriented ethical theories, such as Kantian, act utilitarian, and global utilitarian theories. The analysis is being done using the current situation of the migrants who are trying to find refuge in Europe. The massive number of migrants from countries at war who are arriving in European countries poses an unprecedented burdensome problem that is creating some ethical and moral dilemmas for European policy makers.
