Organ donation after the circulatory determination of death requires the permanent cessation of circulation while organ donation after the brain determination of death requires the irreversible cessation of brain functions. The unified brain-based determination of death connects the brain and circulatory death criteria for circulatory death determination in organ donation as follows: permanent cessation of systemic circulation causes permanent cessation of brain circulation which causes permanent cessation of brain perfusion which causes permanent cessation of brain function. (...) The relevant circulation that must cease in circulatory death determination is that to the brain. Eliminating brain circulation from the donor ECMO organ perfusion circuit in thoracoabdominal NRP protocols satisfies the unified brain-based determination of death but only if the complete cessation of brain circulation can be proved. Law being a derivative feature of reality, it exists in virtue of more fundamental things, upon which it depends. This raises the question of what is the relation of dependence that holds between law and its more basic determinants. The primary aim of this paper is to argue that grounding is that relation. We first make a positive case for this claim, and then we defend it from the potential objection that the relevant relation is rather rational determination (Greenberg (...) 2004, 2006). Against this challenge, we argue that the apparent objection is really no objection, for on its best understanding, rational determination turns out to actually be grounding. Finally, we clarify the framework for theories on law-determination that results from embracing our view; by way of illustration, we offer a ground-theoretic interpretation of Hartian positivism, and show how it can defuse an influential challenge to simple positivist accounts of law. Most contemporary bioethicists believe that Western bioethical principles, such as the principle of autonomy, are universally binding wherever bioethics is found. According to these bioethicists, these principles may be subject to culturally‐conditioned further interpretations for their application in different nations or regions, but an ‘abstract content’ of each principle remains unchanged, which provides ‘an objective basis for moral judgment and international law’. This essay intends to demonstrate that this is not the case. Taking the principle of autonomy as an example, (...) this essay argues that there is no such shared ‘abstract content’ between the Western bioethical principle of autonomy and the East Asian bioethical principle of autonomy. Other things being equal, the Western principle of autonomy demands self‐determination, assumes a subjective conception of the good and promotes the value of individual independence, whilst the East Asian principle of autonomy requires family‐determination, presupposes an objective conception of the good and upholds the value of harmonious dependence. This study presents findings from an ontological and contextual determination of the concept of dignity. The study had a caritative and caring science perspective and a hermeneutical design. The aim of this study was to increase caring science knowledge of dignity and to gain a determination of dignity as a concept. Eriksson’s model for conceptual determination is made up of five part-studies. The ontological and contextual determination indicates that dignity can be understood as absolute dignity, the (...) spiritual dimension characterized by responsibility, freedom, duty, and service, and relative dignity, characterized by the bodily, external aesthetic dimension and the psychical, inner ethical dimension. According to a common argument in defense of border control, legitimate states have a right to exclude on grounds of collective self-determination. I argue that the value of self-determination can also serve as a basis for criticizing states’ immigration policies. Specifically, I contend that the externalization policies of states in the Global North often undermine the self-determination of peoples in the Global South. I identify five pathways by which externalization policies undermine self-determination. The self functions as a critical mechanism for an organism to navigate the complex, often unknown, relations between the body and the brain. Organisms that sustain a coherent sense of self utilize it as an adaptive strategy to alter their environment, thereby enabling predictive processing within an incomplete _Umwelt_. While researchers often attempt to model prediction as a Quine-like self-referential loop by studying small neuronal sets, this reductionist approach limits our understanding of the self's holistic predictive nature. Adopting a functionalist (...) perspective, this paper conceptualizes the mind as a system that predicts embodied intrinsic motivations essential for survival and flourishing. (shrink)

This article asks whether states have a right to close their borders because of their right to self-determination, as proposed recently by Christopher Wellman, Michael Walzer, and others. It asks the fundamental question whether self-determination can, in even its most unrestricted form, support the exclusion of immigrants. I argue that the answer is no. To show this, I construct three different ways in which one might use the idea of self-determination to justify immigration restrictions and show that (...) each of these arguments fails. My conclusion is that the nature and value of self-determination have to do with the conditions of genuine self-government, not membership of political society. Although death by neurologic criteria is legally recognized throughout the United States, state laws and clinical practice vary concerning three key issues: the medical standards used to determine death by neurologic criteria, management of family objections before determination of death by neurologic criteria, and management of religious objections to declaration of death by neurologic criteria. The American Academy of Neurology and other medical stakeholder organizations involved in the determination of death by neurologic criteria have undertaken concerted action to (...) address variation in clinical practice in order to ensure the integrity of brain death determination. To complement this effort, state policymakers must revise legislation on the use of neurologic criteria to declare death. We review the legal history and current laws regarding neurologic criteria to declare death and offer proposed revisions to the Uniform Determination of Death Act and the rationale for these recommendations. What limitations on intervention in support of democratic revolutions does proper regard for the collective right of self-determination impose? Some have held that if intervention in support of democratic revolutions is justified, it must cease once the authoritarian regime has been deposed—that any effort by the intervener to use force to shape the new political order would violate the people’s right of self-determination. This essay argues that proper regard for self-determination is compatible with much more extensive interventions.

The determination thesis is the idea that art-ontological facts are determined by the folk ontological conception of artworks embedded in our artistic practices. From this thesis, descriptivism in the metaontology of art has been often characterized as the view that the task of art-ontology is to describe that folk conception. Amie Thomasson and Andrew Kania provide two paradigmatic accounts within this path. In this paper, I argue that this descriptivist approach is ungrounded because the determination thesis suffers from (...) presupposition failure. It presupposes that, whenever there is a practice of producing and appreciating artworks, there is also a folk ontological conception about those artworks. This presupposition, an implicit premise in Thomasson's and Kania's accounts, will be revealed as false, paying attention to the way artistic practices have evolved. I will conclude that descriptivism should abandon this approach and embrace metaontological realism if it aims to be a plausible view. (shrink)

In this article, we develop and defend an account of the normative significance of nonhuman animal agency. In particular, we examine how animals’ agency interests impact upon the moral permissibility of our interactions with them. First, we defend the claim that nonhuman animals sometimes have rights to self-determination. However, unlike typical adult humans, nonhuman animals cannot exercise this right through the giving or withholding of consent. This combination of claims generates a puzzle about the permissibility of our interactions with (...) nonhuman animals. If animals sometimes have rights to self-determination, but lack the capacity to consent, then when, if ever, is it permissible for us to touch them, hold them, bathe them, or confine them? In the second half of the article, we develop a solution to this puzzle. We argue that while we cannot obtain animals’ consent, they can engage in authoritative communications of will through acts of “assent” and “dissent.”. (shrink)

On a plenitudinous ontology, in every filled region of spacetime, there is at least one object that’s ‘exactly then and there’; one per each modal profile that the matter in the region satisfies. One of the strongest arguments for plenitude, the “argument from anthropocentrism”, puts pressure on us to accept that members of different communities correctly self-identify under different subject concepts. I explore this consequence and offer an account of selves on which self-determination is both socially and individually variant; (...) we determine our spatiotemporal boundaries, our de re modal properties, and the kind of being that we are. The values of freedom and equality are at the heart of what it means for liberal states to do justice to their citizens. Yet, when it comes to the question of whether liberal states are capable of realizing the values of freedom and equality while controlling their borders, many philosophers are skeptical that liberalism and existing immigration arrangements can in fact be reconciled. After all, liberal states often deny entrance to prospective immigrants who are fleeing extreme forms of violence. They (...) also often police their borders in ways that are discriminatory and stigmatizing, contributing to a situation where immigrants are treated as morally inferior by society at large. Such practices conflict strongly with any commitment to the values of freedom and equality. -/- Luara Ferracioli here focuses on three key questions regarding the movement of persons across international borders: What gives some residents of a liberal society a right to be considered citizens of that society such that they have a claim to make decisions with regard to its political future? And do citizens of a liberal society have a prima facie right to exclude prospective immigrants despite their commitment to the values of freedom and equality? Finally, if citizens have this prima facie right to exclude prospective immigrants, are there moral requirements regarding how they may exercise it? The book therefore tackles the most pressing philosophical questions that arise from immigration: the questions of who can exercise self-determination, and why they have such a right in the first place. Efforts to revise the Uniform Determination of Death Act in order to align law with medical practice have failed. Medical practice must now align with the law. People who are not dead under the law that defines death should not be declared dead. There is no compelling reason to continue the practice of declaring legally living persons to be dead.

Taking inspiration from Searle’s ‘The Logic of Fictional Discourse’, this essay presents an argument against different versions of the so-called ‘speech act theory of fiction’. In particular, it argues that a Uniformity Argument may be constructed, which is additional to the Determination Argument commonly attributed to Searle, and which does not rely on his presumably controversial Determination Principle. This Uniformity Argument is equally powerful against the ‘Dedicated Speech Act’ theories that Searle originally targeted, and the more recent, Grice-inspired (...) versions of speech-act approaches to fictional discourse. Human freedom is often characterised as a unique power of self-determination. Accordingly, free human action is often thought to be determined by the agent in some distinctive manner. What is more, this determination is widely assumed to be a kind of efficient-causal determination. In reaction to this efficient-causal-deterministic conception of free human action, this paper argues that if one takes up the understanding of determination and causality that is offered by Anscombe in ‘Causality and Determination’, (...) and moreover takes up an understanding of free human action that is constrained by Anscombe’s account of intentional action in Intention, then an account of free human action as distinctively caused or determined by the agent is untenable. However, the notion of necessitation that Anscombe presents in ‘Causality and Determination’, which implies neither causality nor determination, offers an attractive alternative account. This alternative account pushes us to reconsider the sense in which human freedom is a power of self-determination, and to acknowledge the limits of our control in free action. (shrink)

Research and practice about self-determination in the context of disability has centred on teaching skills and providing support to help people with impairments to be independent. However, limited research exists about the impact of Information and Communication Technologies, in particular social media and mobile devices, on the development of self-determination skills among people with disabilities. This paper presents the findings of a qualitative study which collected data from observations, a researcher diary, focus groups, individual interviews and data from (...) social media. The focus of the study was on young people with vision impairments who were transitioning to university life. The study found that the participants developed self-determination skills by using and adapting collaborative and interactive online tools and mobile devices according to their transition needs. This finding expands the understanding of the implications of new technologies for young people with disabilities’ personal development and the enhancement of self-determination. (shrink)

The evaluation of the luminosity scale is performed using several luminometers, and comparisons between these luminosity detectors are made to assess the accuracy, consistency and long-term stability of the results. This article examines a metaphilosophical issue, namely existing disagreements in philosophy of science about the significance of using multiple means of determination in scientific practice. We argue that this disagreement can, in part, be resolved by separating different questions that can be asked about the use of multiple means of determination, including the following: what can be concluded from the convergence of data or the convergence of claims about phenomena? Are the conclusions drawn from the convergence of data (...) and of statements about phenomena of special importance to the debate about realism and antirealism? Do inferences based on multiple means of determination have stronger epistemic force than inferences that are secured in other ways? Is the epistemic goal of deploying multiple means of determination well entrenched within the scientific community? Most of these questions can be discussed both in a formal and in an empirical perspective. If the differences in perspective are taken into account, some disagreements can be easily resolved. In part, however, the disagreements reflect historiographical challenges that are very difficult, if not impossible to meet. (shrink)

This chapter defends the moral right of national communities to self‐determination, but examines the problems involved in institutionalizing such a right, and the problem of perverse consequences in exercising the right.

It is generally thought that objective chances for particular events different from 1 and 0 and determinism are incompatible. However, there are important scientific theories whose laws are deterministic but which also assign non-trivial probabilities to events. The most important of these is statistical mechanics whose probabilities are essential to the explanations of thermodynamic phenomena. These probabilities are often construed as 'ignorance' probabilities representing our lack of knowledge concerning the microstate. I argue that this construal is incompatible with the role (...) of probability in explanation and laws. This is the 'paradox of deterministic probabilities'. After surveying the usual list of accounts of objective chance and finding them inadequate I argue that an account of chance sketched by David Lewis can be modified to solve the paradox of deterministic probabilities and provide an adequate account of the probabilities in deterministic theories like statistical mechanics. This article looks at the relevance of the concept of self-determination to psychiatric patients by studying the existence, importance and manifestations of self-determination. The data were collected by interviewing long-term patients (n = 72) in one mental health care organization, which included a psychiatric hospital and an outpatient department. Self-determination was defined in terms of the right to decision-making, the right to information, the right of consent, the right to refuse treatment, and the right to be heard (...) and taken into account. It was found that, with the exception of the right to refuse and consent, these rights are indeed present in the practice of psychiatric nursing and that they are relevant and important to psychiatric patients. The patients typically gave ethical, practical and legal reasons for a psychiatric patient's right to self-determination. The main reasons why psychiatric patients said they lacked the right to self-determination were illness and staff authority. Recommendations for educational, clinical and methodological implications for the future in nursing are discussed. (shrink)

This paper defends Flatland—the view that there exist neither determination nor dependence relations, and that everything is therefore fundamental—from the objection from explanatory inefficacy. According to that objection, Flatland is unattractive because it is unable to explain either the appearance as of there being determination relations, or the appearance as of there being dependence relations. We show how the Flatlander can meet the first challenge by offering four strategies—reducing, eliminating, untangling and omnizing—which, jointly, explain the appearance as of (...) there being determination relations where no such relations obtain. Since, plausibly, dependence relations just are asymmetric determination relations, we argue that once we come mistakenly to believe that there exist determination relations, the existence of other asymmetries (conceptual and temporal) explains why it appears that there are dependence relations. This work aims to investigate the effects of co-determination in a game-theoretic setting by considering network externalities in consumption. The received theoretical literature, so far focused only on standard (non-network) industries, showed that co-determination might emerge as the sub-game perfect Nash equilibrium (SPNE) of a non-cooperative Cournot duopoly, but this outcome generates a prisoner’s dilemma. The present research shows that (positive) network externalities may solve the prisoner’s dilemma and let co-determination become a Pareto-efficient SPNE with homogeneous or (...) heterogeneous products. In a network industry, co-determination becomes a Pareto-superior institution for society, as firms, consumers and workers are better off than under profit maximisation. These results hold for exogenous (homogeneous and heterogeneous) co-determination and endogenous co-determination. (shrink)

Just as the possibility of bottomless constitution shows that there may be no fundamental layer of reality with respect to objects , the possibility of bottomless determination shows that there may be no fundamental level of reality with respect to properties . Douglas Edwards is arguably the most prominent contemporary advocate of moderate alethic pluralism. Significantly influenced by Crispin Wright and Michael Lynch, his work on the nature of truth has become widely discussed in the topical literature. Edwards labels his version of moderate alethic pluralism determination pluralism. At first blush, determination pluralism appears philosophically promising. The position deserves thoughtful consideration, particularly because of its capacity to accommodate the scope problem. I argue, however, that upon analysis the view is better (...) understood as a form of metaphysical dualism or what I will call meta-dualism. Furthermore, determination pluralists face a dilemma; there appears to be an instability at the core of their dualistic model. On the one horn of the dilemma, they need a clear metaphysical demarcation at the interface of their two necessary domains. On the other horn, they seem to need to a metaphysically vague boundary at the interface of their two necessary domains. Determination pluralism needs substantial revision. (shrink)

How do groups—be they religious or ethnic—achieve sovereignty in a postnationalist world? In Self-Determination without Nationalism, noted philosopher Omar Dahbour insists that the existing ethics of international relations, dominated by the rival notions of liberal nationalism and political cosmopolitanism, no longer suffice. Dahbour notes that political communities are an ethically desirable and historically inevitable feature of collective life. The ethical principles that govern them, however—especially self-determination and sovereignty—require reformulation in light of globalization and the economic and environmental challenges (...) of the twenty-first century. Arguing that nation-states violate the principle of self-determination, Dahbour then develops a detailed new theory of self-determination that he calls "ecosovereignty.” Ecosovereignty defines political community in a way that can protect and further the rights of indigenous peoples as well as the needs of ecological regions for a sustainable form of development and security from environmental destruction. How can mental properties bring about physical effects, as they seem to do, given that the physical realizers of the mental goings-on are already sufficient to cause these effects? This question gives rise to the problem of mental causation (MC) and its associated threats of causal overdetermination, mental causal exclusion, and mental causal irrelevance. Some (e.g., Cynthia and Graham Macdonald, and Stephen Yablo) have suggested that understanding mental-physical realization in terms of the determinable/determinate relation (henceforth, 'determination') provides the key (...) to solving the problem of MC: if mental properties are determinables of their physical realizers, then (since determinables and determinates are distinct, yet don't causally compete) all three threats may be avoided. Not everyone agrees that determination can do this good work, however. Some (e.g., Douglas Ehring, Eric Funkhauser, and Sven Walter) object that mental-physical realization can't be determination, since such realization lacks one or other characteristic feature of determination. I argue that on a proper understanding of the features of determination key to solving the problem of MC these arguments can be resisted. (shrink)

ABSTRACT This paper addresses three basic questions about moral motivation. Concerning the nature of moral motivation, it argues that it involves responsiveness to both reasons of morality and the value of persons and everything else of value. Moral motivation is thus identified as reason-responsive appropriate valuing. Regarding whether it is possible for people to be morally motivated, the paper relies on Self-Determination Theory (SDT) to show how moral motivation is a likely product of education that is need-supportive in modeling (...) appropriate valuing and engaging students in the kinds of reasoning that are essential to moral motivation. Virtuous motivation that inclines people to engage in morally motivated acts is equated with being morally self-determining or achieving the right kind of integrated motivation. SDT shows how people come to be morally motivated, and the paper concludes that an identified aspiration to be virtuous may play a significant role. (shrink)

States’ right to exclude prospective members is the subject of a fierce debate in political theory, but the right to include has received relatively little scholarly attention. To address this lacuna, we examine the puzzle of permissible inclusion: when may states confer citizenship on individuals they have no prior obligation to include? We first clarify why permissible inclusion is a puzzle, then proceed to a normative evaluation of this practice and its limits. We investigate self-determination – a dominant principle (...) in theories of the right to exclude – as a normative ground for limits on the right to include. We argue that states’ duties to respect one another’s self-determination yield limits on permissible inclusion. When inclusive policies for citizenship undermine the permissible scope of self-determination of other states, they are impermissible; they should either be prohibited, or require compensation. Self-authorship has been established as the basis of an influential liberal principle of legislation and public policy. Being the author of one’s own life is a significant component of one’s own well-being, and therefore is better understood from the viewpoint of the person whose life it is. However, most philosophical accounts, including Raz’s conception of self-authorship, rely on general and abstract principles rather than specific, individual psychological properties of the person whose life it is. We elaborate on the principles of (...) self-authorship on the basis of self-determination theory, an empirically based psychological theory that has been at the forefront of the study of autonomy and self-authorship for more than 45 years. Our account transcends distinctions between positive and negative freedom and attempts to pinpoint the exact properties of self-authorship within the psychological processes of intrinsic motivation and internalization. If a primary objective of public policy is to support self-authorship, then it should be devised on the basis of how intrinsic motivation and internalization can be properly supported. Self-determination theory identifies three basic psychological needs: autonomy, competence, and relatedness. The satisfaction of these needs is associated with the support and growth of intrinsic tendencies and the advancement of well-being. Through this analysis, we can properly evaluate the significance of rationality, basic goods, and the availability of options to self-authorship. Implications for law and policy are discussed with an emphasis on legal paternalism and what many theorists call “liberal perfectionism,” that is, the non-coercive support and promotion of the good life. This article examines two distinct ways in which anticolonial thinkers in early twentieth-century Korea reconstructed their nondemocratic tradition in an attempt to justify (rather than take for granted) the claim of self-determination. The exposure to modern education and ideas of democracy prompted these thinkers to critically engage their tradition in the struggle for self-determination. That said, they could not simply abandon the cultural foundation of their nation. Japanese colonial rule drew its legitimacy from not only an assimilation ideology (...) that the Japanese and Koreans shared the same ethnic origin but also a developmentalist conception of the colonized that they were premodern and incapable of self-rule. To reject imperial domination, Korean anticolonial thinkers needed to invent out of their country’s nondemocratic tradition (1) an unassimilable nation/people (2) capable of self-rule. Drawing upon the political writings of two early twentieth-century thinkers in colonial Korea, Yi Kwang-su (1892–1950) and Cho So-ang (1887–1958), I discover from their political thought two nuanced approaches to this project of inventing “the people” in the colonial world. I argue that while Yi succeeded in rebutting the colonial ideology of assimilation, he fell into the trap of developmentalism. I contend that Cho, on the contrary, sidestepped this trap with his revisionist reading of the Confucian past as a history of democratic transformation, thus providing an immediate alternative to imperial sovereignty. This paper argues that Dignāga is ambiguous regarding whether conceptual determination ( niścaya ) constitutes the cognitive result ( pramāṇaphala ). First, I demonstrate that niścaya is conceptual in Dignāga’s context, evidenced by his refutations of Nyāya and Mīmāṃsaka. Second, I argue that his critique of Nyāya implicitly presupposes that determination functions as the result, a premise Jinendrabuddhi makes explicit. While Dignāga categorically identifies non-conceptual self-awareness ( svasaṃvedana ) as the result, I propose that his ambiguity arises because (...) self-awareness’ status as a valid result depends on its accomplishment of determination. This accomplishment serves as the empirical ground for inward self-awareness to be conventionally viewed as outward cognition, thereby resolving the problem of different objects ( viṣayabheda ). Finally, I sketch a mechanism where self-awareness furnishes mental consciousness with the particular that determination conceptualizes, challenging strictly non-conceptualist portraits of Dignāga’s epistemology. A recent surge of research has begun to examine music participation and well-being; however, a particular challenge with this work concerns theorizing around the associated well-being benefits of musical participation. Thus, the current research used Self-Determination Theory to consider the potential associations between basic psychological needs (competence, relatedness, and autonomy), self-determined autonomous motivation, and the perceived benefits to well-being controlling for demographic variables and the musical activity parameters. A sample of 192 Australian residents (17-85, Mage = 36.95), who were (...) currently participating in a musical activity at the time, completed an online questionnaire. Results indicated that females were more likely to perceive benefits to their well-being; and that how important an individual considers music in their life was positively related to perceived well-being. Importantly, the analyses also revealed that the basic needs of competency and relatedness were related to overall perceived well-being as well as specifically social, cognitive, and esteem dimensions of well-being. Autonomous motivation demonstrated significant associations with both an overall well-being score as well as four of five specific well-being subscales measured. Collectively, the findings indicate that Self-Determination Theory offers a useful theoretical framework to understanding the relationship between musical participation and well-being. Further, the pattern of findings reiterates the positive associations between musical participation and one’s psychosocial well-being, with broad implications for people involved in the facilitation of musical activity. The fundamental determinant of death in donation after circulatory determination of death is the cessation of brain circulation and function. We therefore propose the term donation after brain circulation determination of death [DBCDD]. In DBCDD, death is determined when the cessation of circulatory function is permanent but before it is irreversible, consistent with medical standards of death determination outside the context of organ donation. Safeguards to prevent error include that: 1] the possibility of auto-resuscitation has elapsed; 2] (...) no brain circulation may resume after the determination of death; 3] complete circulatory cessation is verified; and 4] the cessation of brain function is permanent and complete. Death should be determined by the confirmation of the cessation of systemic circulation; the use of brain death tests is invalid and unnecessary. Because this concept differs from current standards, consensus should be sought among stakeholders. The patient or surrogate should provide informed consent for organ donation by understanding the basis of the declaration of death. Physicists are increasingly beginning to take seriously the possibility of laws outside the traditional time-evolution paradigm; yet many popular definitions of determinism are still predicated on a time-evolution picture, making them manifestly unsuited to the diverse range of research programmes in modern physics. In this article, we use a constraint-based framework to set out a generalization of determinism which does not presuppose temporal evolution, distinguishing between strong, weak and delocalised holistic determinism. We discuss some interesting consequences of these generalized notions (...) of determinism, and we show that this approach sheds new light on the long-standing debate surrounding the nature of objective chance. Human life is operationally defined by the onset and cessation of organismal function. At postnatal stages of life, organismal integration critically and uniquely requires a functioning brain. In this article, a distinction is drawn between integrated and coordinated biologic activities. While communication between cells can provide a coordinated biologic response to specific signals, it does not support the integrated function that is characteristic of a living human being. Determining the loss of integrated function can be complicated by medical interventions that (...) uncouple elements of the natural biologic hierarchy underlying our intuitive understanding of death. Such medical interventions can allow living human beings who are no longer able to function in an integrated manner to be maintained in a living state. In contrast, medical intervention can also allow the cells and tissues of an individual who has died to be maintained in a living state. To distinguish between a living human being and living human cells, two criteria are proposed: either the persistence of any form of brain function or the persistence of autonomous integration of vital functions. Either of these criteria is sufficient to determine a human being is alive. (shrink)

According to reductionists about agency, an agent’s bringing something about is reducible to states and events involving the agent bringing something about. Many have worried that reductionism cannot accommodate robust forms of agency, such as self-determination. One common reductionist answer to this worry contends that self-determining agents are identified with certain states and events, and so these states and events causing a decision counts as the agent’s self-determining the decision. In this paper I discuss J. David Velleman’s identification reductionist (...) theory, according to which an agent is identified with his desire to make most sense of himself. I develop two constraints that an adequate identification reductionist theory must satisfy and show that Velleman’s theory cannot satisfy both. In particular, I argue that Velleman’s account founders on cases of self-determined self-transformation. (shrink)

This dissertation investigates grounding, the relation of non-causal determination whereby one fact obtains in virtue of some other fact or facts. Although considerations of grounding have been central throughout Western philosophy, the last 15-20 years have seen a renaissance of systematic work on grounding in analytic philosophy. The aim of the dissertation is to contribute to our understanding of the nature of grounding and its relation to other central phenomena in metaphysics. -/- Chapter 1 of the dissertation provides a (...) brief presentation of grounding and introduces some distinctions of relevance to later chapters. Chapter 2 discusses the question of whether grounding can be reduced. Four reductive accounts – in terms of fundamentality and supervenience, essence, reduction, and metaphysical laws respectively – are considered. All of these accounts are found to be subject to objections and are consequently rejected. -/- Chapter 3 considers the relation between grounding and another important phenomenon in metaphysics, namely ontological dependence. The question of the relation between the two is approached through an investigation of their modal connection (or lack thereof). It is argued that on the common assumption that grounding is a factive relation, ontological dependence can be shown to be neither necessary nor sufficient for grounding. Furthermore, to get any form of modal connection between the two relations, one needs to move to a non-factive conception of grounding or consider generic ontological dependence and accept a potentially controversial principle about the modal behaviour of grounding. Even then, the modal connection between grounding and ontological dependence is weak and subject to qualifications. -/- Chapter 4 develops and defends the novel notion of metaphysically opaque grounding. It is commonly assumed that grounding is an especially intimate and powerful connection and enables a form of explanation that is particularly strict and illuminating. An arguably related idea is that grounding is necessarily connected with the core features of things – their essences or natures. Metaphysically opaque grounding constitutes a form of grounding that falsifies both of these ideas. Chapter 4 makes the notion of metaphysically opaque grounding precise, motivates the idea that there are genuine cases of such grounding, explores its consequences for the theory of grounding, and defends the notion from potential objections, concluding that there are currently no strong reasons to rule out opaque grounding. The closure of government-run institutions for people with intellectual disabilities (ID) has led to the advancement of equal rights, status, and community integration. As a result of increased community integration, people with ID now have more access and choice to consume substances such as alcohol. This becomes a significant concern insofar as alcohol use (AU) is on the rise in this population, and people with ID face many barriers to accessing AU/Alcohol Use Disorder (AUD) services. In this chapter, we explore (...) concepts such as “Nothing About Us Without Us”, dignity of risk, choice, autonomy, and self-determination, and highlight their alignment with the principles of harm reduction. We argue that adopting a harm reduction approach is ethically justifiable for people with ID related to AU/AUD. It is crucial to have people with ID lead or be involved in harm reduction strategies to ensure the strategies are meaningful and accessible. (shrink)

Die Annahme, dass der Mensch frei ist, bildet eine wesentliche Grundlage unserer alltäglichen Praxis und zentraler sozialer und rechtlicher Institutionen. Zugleich ist sie hochumstritten: Philosophisch stellt sich die Frage, wie die Freiheit des Menschen vereinbar sein kann mit der naturgesetzlichen Determiniertheit der Welt, religionsphilosophisch, wie sich die Freiheit des Menschen zur Vorstellung eines wirkmächtigen Gottes verhält. Philosophisch wird das problematische Verhältnis der praktischen Intuitionen von Freiheit und Determination auf drei Weisen gedacht: eine inkompatibilistische, die entweder in Form eines Determinismus (...) oder eines Libertarismus auftritt und wonach Willensfreiheit und der Gedanke der kausalen Geschlossenheit der Welt nicht miteinander vereinbar sind, oder eine kompatibilistische, die von der Vereinbarkeit von Freiheit und Determination ausgeht. Die religionsphilosophische Frage nach dem Verhältnis von menschlicher Freiheit und göttlicher Determination wird in deterministischen, monistischen, differenztheoretischen und dialektischen Figuren bedacht. An analysis of our commonsense concept of freedom yields two “minimal criteria”: Autonomy distinguishes freedom from compulsion; Authorship distinguishes freedom from chance. Translating freedom into “self-determination” can account for both criteria. Self-determination is understood as determination by “personal-preferences” which are constitutive for a person. Freedom and determinism are therefore compatible; the crucial question is not whether an action is determined at all but, rather, whether it is determined by personal preferences. This account can do justice to the (...) most important intuitions concerning freedom, including the ability to do otherwise. Waiving determination, by contrast, would violate the minimal criteria rather than providing “more” freedom. It is concluded that self-determination provides everything that we can ask for if we ask for freedom. (shrink)

Discussions about determinables and determinates, on the one hand, and discussions about (formal) theories of location, on the other, have thus far proceeded without any visible interaction, in substantive mutual neglect. This paper aims to remedy this situation of neglect. It explicitly relates (theories of) determinables and (theories of) location. First, I argue that some well known principles of location turn out to be instances of principles relating determinables and determinates. Building on this I then argue that theories of location (...) present formidable counterexamples to those principles about determinables and determinates. One such counterexample in particular is used as an argument against disjunctivism. Finally, I relate the entire discussion to yet another crucial debate in metaphysics, that of metaphysical indeterminacy. (shrink)
