Many believe that we have duties to rescue. Many believe, further, that these duties to rescue are in principle enforceable. Some defend a third claim: we are sometimes under a duty not to rescue in sufficiently suboptimal ways, even when we are not under a duty to rescue—even when rescuing is supererogatory. My interest concerns what follows from the combination of these claims. I argue that if there are enforceable duties to rescue, as well as duties not to rescue in (...) sufficiently suboptimal ways, then those duties not to rescue in sufficiently suboptimal ways are also enforceable. And I argue these duties are enforceable only by forcing the rescuer to rescue in the optimal way. This means people lack rights against others forcing them not to rescue in sufficiently suboptimal ways, by forcing them instead to rescue in optimal ways, even when they are permitted not to rescue. This chapter evaluates whether AI systems are or will be rights-holders, explaining the conditions under which people should recognize AI systems as rights-holders. It develops a skeptical stance toward the idea that current forms of artificial intelligence are holders of moral rights, beginning with an articulation of one of the most prominent and most plausible theories of moral rights: the Interest Theory of rights. On the Interest Theory, AI systems will be rights-holders only if they have interests or a well-being. (...) Current AI systems are not bearers of well-being, and so fail to meet the necessary condition for being rights-holders. This argument is robust against a range of different objections. However, the chapter also shows why difficulties in assessing whether future AI systems might have interests or be bearers of well-being—and so be rights-holders—raise difficult ethical challenges for certain developments in AI. According to the Wrong Restriction, we are liable to defensive harm only when we threaten to wrong others. While attractive on a first pass, we argue that plausible philosophical claims make the Wrong Restriction difficult to accept. In its place, we offer the Impermissibility Restriction, according to which one is liable to defensive harm only if one would act impermissibly, all things considered. Accepting the Impermissibility Restriction in place of the Wrong Restriction has significant implications for the ethics of self‐defense.

This paper answers two questions. First, on the assumption that risk of harm is of moral significance, does risk’s moral significance lay in its being harmful? Second, is risk of harm itself harmful? I argue that either risk is not harmful or that risk is harmful only in a small range of cases. If risk is not harmful, and yet risk is of moral significance, risk’s moral significance cannot lie in its being harmful. Businesses promote their environmental awareness through green buildings, eco-labels, sustainability reports, industry pledges and clean technologies. When are these symbols wasteful corporate spin, and when do they signal authentic environmental improvements? This paper considers whether victims can justify what appears to be unnecessary defensive harming by reference to an honour-based justification. I argue that such an account faces serious problems: the honour-based justification cannot permit, first, defensive harming, and second, substantial unnecessary harming. Finally, I suggest that, if the purpose of the honour based justification is expressive, an argument must be given to demonstrate why harming threateners, as opposed to opting for a non-harmful alternative, is the most effective means of affirming (...) one’s honour. Along the way, I also suggest why I think that internalism about the constraints on defensive harming (the view that the satisfaction of the necessity constraint is a necessity condition of a threatener’s liability) is correct. Most importantly, externalism implies that threateners can be liable to suffer gratuitous harm. I take this to be an unattractive consequence of the view. (shrink)

When is industry self-regulation (ISR) a legitimate form of governance? In principle, ISR can serve the interests of participating companies, regulators and other stakeholders. However, in practice, empirical evidence shows that ISR schemes often under-perform, leading to criticism that such schemes are tantamount to firms marking their own homework. In response, this paper explains how current management theory on ISR has failed to separate the pragmatic legitimacy of ISR based on self-interested calculations, from moral legitimacy based on normative approval. The (...) paper traces three families of management theory on ISR and uses these to map the pragmatic and moral legitimacy of ISR schemes. It identifies tensions between the pragmatic and moral legitimacy of ISR schemes, which the current ISR literature does not address, and draws implications for the future theory and practice of ISR. This paper takes up whether the dead are potential right-holders on the Interest Theory of Rights, as well as laying clear how we should approach the question of whether other entities are potential right-holders on the Interest Theory. It argues the dead are potential right-holders on the Interest Theory, but that Matthew Kramer’s argument for this thesis is not very convincing. This is because Kramer’s argument looks in the wrong place by focusing only on the ways in which the dead (...) figure in the lives of the living. Instead, this paper argues we should focus on the nature of the interests of the dead themselves. It suggests that the dead have interests (and that the dead’s interests matter for rights) for much the same reason that the living have interests. Along the way, we work through several choice-points for the Interest Theory, including a taxonomy of different accounts of interests and interests’ relation to the Interest Theory. (shrink)

This chapter examines a range of cases in which it appears one’s rights against harm are violated by another’s behaviour, even though this behaviour has done one no harm. These cases raise a serious problem for most theories of rights, though the problem is most pronounced on the Interest Theory of Rights. According to that theory, rights necessarily protect their holder’s wellbeing. At first glance, one might think that the person’s wellbeing cannot be said to be protected by the right (...) in cases of harmless wronging because they are not harmed in such cases—so, the necessary condition set for the ascription of a right is not satisfied. This paper puts forward a novel solution to this problem, the Safety Condition. The Safety Condition looks beyond what happens in the actual world to close worlds in order that individuals’ wellbeing is robustly protected across circumstances that could just have easily come about. What factors in the organizational culture of an ethically exemplary corporation are responsible for encouraging ethical decision making? This question was analyzed through an exploratory case study of a top pharmaceutical company that is a global leader in ethics. The participating organization is renowned in public opinion polls of ethics, credibility, and trust. This research explored organizational culture, communication in issues management and public relations, management theory, and deontological or utilitarian moral philosophy as factors that might encourage ethical analysis. Our (...) understanding of organiza tional ethics is enhanced by elucidating factors the case revealed as encouraging ethical analysisan organizational culture that emphasizes the importance of ethics, Theory Y management, a symmetrical worldview valuing innovation and dialogue, a counseling role for issues management or public relations in the dominant coalition, rewarding ethical behavior, ethical analysis using moral philosophy, consistency between individual values and organizational philosophy, and ethics training. International collaboration on genetic/genomic studies has expanded dramatically. Informed consent remains a cornerstone for protecting participant autonomy. Over the past few decades, guidelines, recommendations, and theoretical discussions have been published on the informed consent process in cross-cultural contexts, particularly in Africa. These resources suggest best practices—ranging from assessing participant comprehension to engaging local communities. However, it remains unclear how well the current practices address the full range of informed consent challenges encountered by the stakeholders. We performed a systematic literature review (...) of empirical studies that explored stakeholders’ perspectives, primarily research participants and researchers, on informed consent in the context of international genetic/genomic research in countries of Africa. We followed the PRISMA guideline and used thematic analysis for data synthesis and analysis. Twenty-four relevant articles were identified and reviewed for five bioethical issues: (1) comprehension of consent information, (2) voluntary participation, (3) consent elements, (4) consent model, and (5) community engagement. Different levels of understanding and recall over different consent elements, and multiple factors associated with comprehension were observed. Voluntary participation could be influenced by misconception, monetary and healthcare compensation, and previously established trust with the research team. Many participants show less interest in certain consent elements, such as biobanking, data sharing, and future use, but more in the section on benefits. Returning results had potential advantages in building trust between participants and the research team; however, the most appropriate way to return results is under discussion. There was also conversation over consent models (broad, tired, and dynamic) on their balance between autonomy and practicality. Finally, many articles ascertained the value of community engagement and encouraged researchers to consider local cultural beliefs, social stigma, and decision-making habits when designing the consent process. We observed an increased interest in the ethical conduct of the informed consent process under international genetics/genomics studies in recent decades. Awareness and attention to these issues are needed to develop more appropriate consent strategies that could further safeguard the rights and welfare of local participants and support the smooth conduct of research. Does the pursuit of disability justice for people with dementia require that people with dementia personally identify as disabled? On one level, self‐representation has been a critical strategy for combating harmful and inaccurate assumptions that people with disabilities or dementia are inherently incapable of self‐advocacy. At the same time, disability‐rights narratives in which self‐representation is fundamental to liberation cannot fully account for the realities of people with advanced dementia or other conditions that profoundly affect cognitive function. This essay argues that (...) bringing disability and dementia advocacy together requires a shift beyond identity‐based personal narratives and toward structural narratives that illustrate the processes through which dementia is historically constructed and that imagine alternatives to those processes. Such narratives not only reveal the effects of ableism beyond those who identify as disabled but also illuminate possibilities for resisting harmful structural forces through coalitional organizing and solidarity. The Will Theory of Rights says that having control over another’s duties grounds rights. The Will Theory has commonly been objected to on the grounds that it undergenerates right-ascriptions along three fronts. This paper systematically examines a range of positions open to the Will Theory in response to these counterexamples, while being faithful to the Will Theory’s focus on normative control. Background: While the solid organ transplant evaluation process is designed to function equitably, discriminatory practices remain, resulting in disparities in access for persons with disabilities. Physical function and frailty status are often-cited factors in establishing transplant, despite limited consensus on their assessment and impact. Objective: The purpose of this study was to describe how transplant healthcare professionals conceptualize the relationship between physical disability and transplant candidacy. Methods: A convenience sample of multidisciplinary transplant was solicited to respond to an electronic survey (...) between February and March 2024. Results: Of the 126 professionals contacted, 43 participants responded, yielding a response rate of 34 %. The majority of participants (88 %) held contradictory views of physical disability as it relates to transplant candidacy (p = 0.049). Men were more likely to endorse awareness of bias when evaluating transplant candidates (p = 0.008). Professional discipline was significantly associated with perception of transplant process fairness, impact of bias, and interpretation of quality of life. Iterative thematic analysis revealed a propensity to conflate frailty with physical disability. Conclusions: Multidisciplinary transplant professionals rarely endorsed overtly ableist sentiments. However, responses highlighted inconsistent, unclear, and at times contradictory conceptions of physical function and physical disability, which may contribute to disparate access to solid organ transplant for individuals with physical disability. Volume 39 of the Tanner Lectures on Human Values includes lectures initially scheduled during the academic year 2019-2020. Owing to the global coronavirus pandemic, some were delivered at a later date. The Tanner Lectures are published in an annual volume. In addition to permanent lectures at nine universities, the Tanner Lectures on Human Values funds special one-time lectures at selected higher educational institutions in the United States and around the world.

We investigate whether age profiles of ethnobiological knowledge development are consistent with predictions derived from life history theory about the timing of productivity and reproduction. Life history models predict complementary knowledge profiles developing across the lifespan for women and men as they experience changes in embodied capital and the needs of dependent offspring. We evaluate these predictions using an ethnobiological knowledge assessment tool developed for an off-grid pastoralist population known as Choyeros, from Baja California Sur, Mexico. Our results indicate that (...) while individuals acquire knowledge of most dangerous items and edible resources by early adulthood, knowledge of plants and animals relevant to the age and sex divided labor domains and ecologies (e.g., women’s house gardens, men’s herding activities in the wilderness) continues to develop into middle adulthood but to different degrees and at different rates for men and women. As the demands of offspring on parents accumulate with age, reproductive-aged adults continue to develop their knowledge to meet their children’s needs. After controlling for vision, our analysis indicates that many post-reproductive adults show the greatest ethnobiological knowledge. These findings extend our understanding of the evolved human life history by illustrating how changes in embodied capital and the needs of dependent offspring predict the development of men’s and women’s ethnobiological knowledge across the lifespan. Children dependent on life-prolonging medical technology are often subject to a constant background risk of sudden death or catastrophic complications. Such children can be cared for in hospital, in an intensive care environment with highly trained nurses and doctors able to deliver specialised, life-saving care immediately. However, remaining in hospital, when life expectancy is limited, can considered to be a harm in of itself. Discharge home offers the possibility for an improved quality of life for the child and their family (...) but comes with significant medical risks. When making decisions for children, two ethical models predominate, the promotion of the child’s best interests or the avoidance of harm. However, in some circumstances, particularly for children with life-limiting and/or life-threatening illness, all options may be associated with risk. There are no good options, only potentially harmful choices. In this paper, we explore decisions made by one family in such circumstances. We describe a model adopted from risk management programmes beyond medicine, which offers a potential framework for identifying risks to the child that are morally permissible. Some risks and harms to a child, not ordinarily permitted, may be acceptable when undertaken in the pursuit of a specified desired good, so long as they are as low as reasonably practicable. Climate change challenges contemporary management practices and ways of organizing. While aspects of this challenge have been long recognized, many pertinent dimensions are less effectively articulated. Based on contemporary literature and insights from articles submitted to this special issue, the guest editors of this special issue highlight some of the challenges posed by climate change to government and business, and indicate the range of options and approaches being adopted to address these challenges.

Through systematic case analyses of much-discussed social media cases, both negative aspects and best practices of social media use are revealed. Ethical theory is applied to these cases as a means of analysis to reveal the moral principles associated with each case. Four cases are analyzed, ranging from bad to arguably innovative. Based upon comparing the moral principles upheld or violated, descriptive ethics are used to infer normative ethical guidelines to govern the use of social media. This paper compares two theories of the firm used to interpret firms’ corporate social strategies in order to derive new insights and questions in this research area. Researchers from many branches of strategic management agree that firms can strategically allocate resources in order to achieve both long-term social objectives and competitive advantage. However, despite some progress in investigating corporate social strategy, studies rely on fundamentally diverging theoretical approaches. This paper will identify, compare and begin to integrate two competing theories of (...) the firm implicit in corporate social strategy scholarship: the resource-based and behavioural theories of the firm. I discuss the implications of these two theories for both researchers and practitioners on key debates within corporate social strategy, and conclude by suggesting several fruitful avenues for future research based on the emerging integration of these two theories of the firm within the strategy literature. : In earlier work, Bernard R. Goldstein and the present author have introduced a procedural rule for historical inquiry, which requires that one take pains to establish the credibility of any citation of ancient thought by later writers in antiquity through a process of verification. In this paper, I shall apply what I call the Rule of Ancient Citations to Simplicius' interpretation of Aristotle's remarks in Meta L. 8, which is the primary point of departure for the modern understanding of (...) Greek planetary theory. I first sketch several lines of argument that lead me to conclude that Simplicius' interpretation should not be accepted because it assumes a concern with planetary phenomena unknown to the Greeks before the late 2nd and early 1st centuries BC. Then, after showing that there is a fairly well defined range of readings of Aristotle's remarks more in keeping with what we actually know of astronomy in the 5th and 4th centuries BC, I conclude that neither Aristotle's report about the Eudoxan and Callippan accounts of the celestial motions nor Simplicius' interpretation of this report is a good starting point for our understanding of early Greek planetary theory. Student-instructor relationships outside of the classroom have existed for hundreds of years and remain an important topic in the literature. Universities are increasingly concerned with legislating student-instructor relationships. Few empirical investigations of undergraduate student-instructor relationships are reported in the literature, and such relationships are often considered only in the context of sexual harassment or ethics policies. Most of the writings are opinion based or seated in anecdotal evidence, and seldom are students' opinions considered. In this study, 480 undergraduate students attending (...) a medium-sized Western university were surveyed for their opinions about a variety student-instructor relationships. Factor analysis revealed 5 types of student-faculty relationships: sexual, group activities, doing favors, spending time alone with a faculty member, and business relationships. The students' opinions about these relationships varied, with sexual relationships considered inappropriate, whereas group activities were considered very appropriate. These data suggest that university officials who are building policy regarding faculty-student relationships need to consider different types of relationships along with students' developing autonomy. Ensuring access to clean water is one of the most important development and health challenges of the twenty-first century. Given the manifold impacts of business activities on water resources, corporate water actions should be of central concern to business ethics researchers. Yet so far we know too little about whether business activities that impact on water resources are noticed or how corporate water actions are valued by a firm’s stakeholders, including by financial markets. In response, we conduct an event study (...) to investigate the shareholder wealth effect of reports of corporate water actions. We explore stock market reactions to water actions by S&P 500 firms from 2005 to 2017, showing that the market reacts positively to reports of responsible water actions and negatively to irresponsible actions. We further explain that these abnormal returns to water actions are associated with a firm’s past performance on ethical issues, arguing that the reputational effects from prior corporate social responsibility and irresponsibility influence market reactions. Our analysis provides evidence that there are diminishing marginal returns to responsible water actions for firms with records of past responsibility and an offsetting effect for those with past irresponsibility. Similarly, we demonstrate an insurance effect that limits punishment for irresponsible water actions for firms with responsible performance records and diminishing negative marginal returns for those already seen to be irresponsible. This study is the first to show that shareholders recognize market value in corporate water actions and are prepared to award or punish firms in stock markets based on their impacts on water. In Hellenistic Astronomy: The Science in Its Contexts, renowned scholars address questions about what the ancient science of the heavens was and the numerous contexts in which it was pursued.

For many, the case of the Exxon Valdez oil spill has become a symbol of unethical corporate behavior. Had Exxon’s managers not callously pursued their own interests at the expense of the environment and other parties, the accident would not have happened. In this paper, we (1) present a short case study of the Valdez incident; (2) argue that many analyses of the case either ignore or fail to give sufficient weight to the uncertainties managers often face when they make (...) decisions; and (3) propose a framework for moral management grounded in principles of communicative ethics, moral dialogue, and in the non-traditional ideas of many current management and behavioral decision theorists. From this view, the moral manager is not expected to know the “correct” answer to every ethical issue, but rather to participate responsibly in an open dialogue with other interested parties. While James Gibson is often seen as rebelling against the Gestalt psychologists of the Berlin School, he shared their “phenomenological attitude”: the commitment to taking a rigorous description of direct experience as data for psychological theory to explain. This paper argues that while Gibson rejected the Gestalt school’s neurocentric explanatory theory of why things look as they do, he largely accepted their descriptive account of how things look. This suggests a path toward an ecological theory of insight in problem-solving. If (...) Gibson could adopt the Gestalt descriptive account of perception to develop a theory of direct perception, an ecological psychologist can adopt their descriptive account of insight to develop a theory of direct insight. To this end, this paper reconstructs the rich descriptive account of insight from Wolfgang Köhler’s Mentality of Apes, focusing on the gradual, hard-won achievements of insight in problem situations marked by an impasse. From this account, it proposes general concepts—such as experienced structural troubles, gaps, and fittingness—that describe how the immediately experienced structure of a problem situation can guide and drive the process of discovering a solution. Finally, it defends the viability of this approach by arguing that the transformational aspects of insight can be reconciled with Gibsonian realism. (shrink)

“Dementia” is a collective term for a group of common, aging‐associated, progressively debilitating, ultimately terminal conditions that affect a person's thought, memory, speech, and behavior. Dementia challenges ideas about the self, about social relationships, and about how aging societies should respond to the needs of people living with dementia and to the needs of dementia caregivers. This introduction to a collection of original essays and a roundtable explains how cultural narratives shape the experience of living with dementia, for better or (...) worse. Cultural narratives are stories that a society or cultural group shares to make meaning, and these stories may reveal common values and fears. This introduction offers examples of how cultural narratives work and highlights insights from research by bioethics and humanities scholars and by humanities researchers in the social sciences. This introduction also provides an overview of the collection, which includes pieces that highlight innovative community projects that demonstrate how stories affect public understanding about what it means to live with dementia. This paper considers whether rights hold due to the facts, the best available evidence to people, or people's actual beliefs. While there has been much discussion of this question in the context of what we ought to do, there is less discussion from a rights standpoint. This is a shame, since rights are often thought to be relational in a way that is not true of ought, and this relationality causes complications when prospective right-holders' and duty-bearers' epistemic perspectives differ from (...) one another. While the paper begins with a thorny problem for the view on which rights depend on the facts, it ultimately argues we have the most reason to endorse such a view. (shrink)

: The Hellenistic reception of Babylonian horoscopic astrology gave rise to the question of what the planets really do and whether astrology is a science. This question in turn became one of defining the Greco-Latin science of astronomy, a project that took Aristotle's views as a starting-point. Thus, I concentrate on one aspect of the various definitions of astronomy proposed in Hellenistic times, their demarcation of astronomy and physical theory. I explicate the account offered by Geminus and its subordination of (...) astronomy to arguments made in physical theory about what really is the case. I then show how Ptolemy treats the same topic but maintains that this science is sufficient on its own to determine the realia it studies. In this way, I identify two moments in an obvious process of intellectual change that had profound consequences for the history of astronomy and cosmology over the next 1500 years. My hope is that this will advance our understanding of the reception of horoscopic astrology in Hellenistic times and also serve to locate Ptolemy more fully in his intellectual context. (shrink)

The increasing demand for horticultural products for nutritional and economic purposes by lesser developed countries (LDC's) is well-documented. Technological demands of the LDC's producing horticultural products is also increasing. Pesticide use is an integral component of most agricultural production, yet chemicals are often supplied without supplemental information vital for their safe and efficient implementation. Illiteracy rates in developing countries are high, making pesticide education even more challenging. For women, who perform a significant share of agricultural tasks, illiteracy rates are even (...) higher than for men. The dilemma exists of how a developing country can improve its nutritional and economic situation without giving consideration to social and environmental consequences. (shrink)

The goal of our work has been to better understand how Engaged Philosophical Inquiry can be used with young children on topics related to our local forest environment as part our foundation curriculum on sustainability. Theoretically we draw on the work of Matthew Lipman ; Philosophy for Children ; Phillip Cam, ; John Dewey, ; Gunilla Dahlberg and Peter Moss to discuss democratic community building, and ethical pedagogical approaches related to EPI and young children. Working with children of this age (...) holistically on the topic of sustainability has not been systematically researched to date. Our findings therefore contribute to better understandings of EPI and: 1) democratic community building processes; 2) the use of context to focus our discussions; 3) group membership and group size; and 4) turn taking and the role of the moderator. In this essay, we analyze the Black Mirror episode "Arkangel" alongside Nietzsche’s critique of religion. After providing an overview of his critique, we argue that the episode demonstrates how a world enframed by technology itself ends up being just as decadent, or just as pathological, repressive, corrupt, anti-life, and unredemptive as Nietzsche accuses Christianity of being. Nietzsche thought, at one point, that science and technology might provide a non-metaphysical or non-theological solution to what he calls our “metaphysical need.” However, Arkangel (...) shows how technology does not overcome problems of idolatrous forms of religion and can be just another tool for manipulation that produces the same kinds of pathologies.
