In this article, we offer a précis of Appearance & Explanation: Phenomenal Explanationism in Epistemology. We explain the central features of our theory of epistemic justification, Phenomenal Explanationism (PE). Further, we describe how PE applies to justification of various kinds and how it solves problems that plague its closest rival, Phenomenal Conservatism (PC).

According to a widely held view, people's commitments to laws are dependent on the existence in their community of a conventional practice of complying with certain fundamental laws. This conventionalism has significantly hampered our attempts to explain the normative practice of law. Ronald Dworkin has argued against conventionalism by bringing up the phenomenon of persistent fundamental legal controversies, but neither Dworkin nor his legal positivist respondents have correctly understood the real significance of such controversies. This article argues that such controversies (...) pose a deep challenge to any conception of our legal practice as a genuinely normative, rule-mediated, practice. The article also argues that what is needed to deflect this challenge is a new understanding – different from the widely held conventionalist understanding – of how people's commitments to laws are predicated on their fellows’ like commitments. One can be in solidarity with a social movement. For example, one can be in solidarity with the movement for black lives; perhaps this looks like wearing “Black Lives Matter” shirts. Alternatively, one can be in solidarity with feminists by attending a protest by a local feminist group. But what does it mean to be in solidarity with a social movement? Existing theories of solidarity explain what it means to be in solidarity with small, ideologically homogeneous social groups. This model (...) of solidarity cannot be applied to large, complex social movements. The goal of this chapter is to give an account of what it means to be in solidarity with a social movement. On my view, being in solidarity with a social movement consists of being rationally responsive to movement actors while thinking of oneself as a movement actor. (shrink)

As prototypical incentive with biological meaning, food illustrates the distinction between money as tool and money as drug. However, consistent neuroscience results challenge this view of food as intrinsic value and opposite to drugs of abuse. The scarce availability over evolutionary time of both food and money may explain their similar drug-like non-satiability, suggesting an integrated mechanism for generalized reinforcers. By definition, feminism is concerned with the historical, social and political meanings of sexual difference in the human body, and the spectrum of experiences those meanings produce. At the beginning of the twenty-first century, gendered forms of violence persist, abortion remains a political issue, reproductive and cosmetic technologies and their concomitant ethical questions are proliferating, and the presence of women's bodies in public spaces and for public consumption produces a range of anxieties about women's well-being and the common good. In so doing they continue a history of intellectual endeavor that, for centuries, has striven to identify the interplay between corporeal differences and relationships of power. This collection will take the reader on a journey into myriad domains in which a variety of discursive effects come to life in the embodied subject: from the theatres of medical surgery and law to the discussion fora of sex therapy and marriage guidance experts; from Peruvian villages of the late twentieth century to African American plays of the 1920s and 1930s; from explicitly feminist novels and films to the mainstream press and right into feminist scholarship that theorises the female body. The changing world of health care finance has led to a paradigm shift in health care with health care being viewed more and more as a commodity. Many have argued that such a paradigm shift is incompatible with the very nature of medicine and health care. But such arguments raise more questions than they answer. This article critically examines the recent papal allocution on patients in a persistent vegetative state with regard to the appropriate conditions for considering “reformable statements.” In the first part of the article, the purpose and meaning of the allocution are assessed. O'Rourke concludes that given consideration of the individual patient's best interest, prolonging artificial nutrition and hydration is not, in every case, the best option. Although he stresses favorability for preservation of the life of the patient through artificial nutrition and (...) hydration, costs and benefits to the patient should be weighed. Ultimately, he argues in favor of leaving the decision to the patient, his caregivers, and others immediately involved in the case. (shrink)
