The European Court of Human Rights (ECtHR) plays an increasingly influential role in shaping health-related human rights in Europe, despite the absence of an explicit right to health in the European Convention on Human Rights (ECHR). This article examines how the Court adjudicates morally and legally contested health issues across six domains: physician-assisted dying, abortion, vaccination, place of birth, posthumous reproduction, and climate-related health risks. Drawing on comparative doctrinal analysis, the article identifies recurring patterns in health-related cases. These include an (...) emphasis on procedural fairness, a tendency to frame harm in individualised terms, and deference to national scientific authorities. By tracing these patterns, the article clarifies how the Court navigates competing rights and interests in contested health cases. It also considers emerging challenges, such as litigation over artificial intelligence in healthcare, highlighting the ECtHR’s growing influence on the development of health law and policy through its interpretation of the ECHR. The statue and the lump of clay that constitutes it fail to share all of their kind and modal properties. Therefore, by Leibniz’s Law, the statue is not the lump. Question: What grounds the kind and modal differences between the statue and the lump? In virtue of what is it that the lump of clay, but not the statue, can survive being smashed? This is the grounding problem. Now a number of solutions to the grounding problem require that we substantially (...) revise our view of reality. In this paper, I provide a solution to this problem that does not require such a revision. I then show how my solution to the grounding problem can solve a related problem and answer a related question. The upshot is that the solution I offer is not only non-revisionary, but also fruitful. According to many, necessary existence either is or follows from a perfection. There is something to this. Part of what makes or follows from something’s being impressive is its ontological durability: it has a strong grip on existence. But a necessarily existent being does not just have a strong grip on existence, but a grip that cannot be loosened! So it looks like necessary existence either is, or follows from, a perfection. In this paper, I argue otherwise and so argue (...) that necessary existence neither is, nor follows from, a perfection. And if this is so, then not only is the relationship between necessary existence and perfection not what many take it to be, but work on God (or a good deal of it) needs to be reconceived. (shrink)

In this paper, I both propose and discuss a novel account of truthmaking. I begin by showing what truthmaking is not: it is not grounding and it is not correspondence. I then show what truthmaking is by offering an account that appeals both to grounding and what I call ‘deep correspondence’. After I present the account and show that it is an account that unifies, I put it to work by showing how it can overcome an objection to truthmaking, how (...) we can get truthmaking from correspondence, what it says about truthmaker necessitation, and how it can explain a connection between truthmaker maximalism and pluralism about truth. Truthmaker says that things, broadly construed, are the ontological grounds of truth and, therefore, that things make truths true. Recently, there have been a number of arguments purporting to show that if one embraces Truthmaker, then one ought to embrace Truthmaker Maximalism—the view that all non-analytic propositions have truthmakers. But then if one embraces Truthmaker, one ought to think that negative existentials have truthmakers. I argue that this is false. I begin by arguing that recent attempts by Ross Cameron and (...) Jonathan Schaffer to provide negative existentials with truthmakers fail. I then argue that the conditional—if one embraces Truthmaker, the one ought to embrace Truthmaker Maximalism—is false by considering worlds where very little, if anything at all, exists. The conclusion is that thinking that negative existentials do not have truthmakers, and therefore rejecting Truthmaker Maximalism, need not worry Truthmaker embracers. (shrink)

In Necessary Existence, Pruss and Rasmussen give an argument for a necessary being employing a modest causal principle. Here I note that, when applied to highly general and fundamental matters, the principle may well be false (or at least not so obvious).

Divine Simplicity has it that God is absolutely simple. God exhibits no metaphysical complexity; he has neither proper parts nor distinct intrinsic properties. Recently, Jeffrey Brower has put forward an account of divine simplicity that has it that God is the truthmaker for all intrinsic essential predications about him. This allows Brower to preserve the intuitive thought that God is not a property but a concrete being. In this paper, I provide two objections to Brower’s account that are meant to (...) show that whatever merits this account of divine simplicity has, plausibility is not one of them. (shrink)

As it is presently employed, grounding permits grounding many things from one ground. In this paper, I show why this is a mistake by pushing for a uniqueness principle on grounding. After arguing in favor of this principle, I say something about it and kinds of grounding, discuss a similar principle, and consider its import on a formal feature of grounding, ontology, and ontological simplicity.

This paper argues that fundamental deterministic dynamical laws cannot be used to select from among the events falling within the backwards light cone of an event any narrower class that might be regarded as causes of the event. It applies this in a critique of Donald Davidson’s Principle of the Nomological Character of Causality and the use he makes of it in his argument for anomalous monism. In this paper I do not assume that dynamical laws incorporate a primitive notion (...) of causality that entails an intrinsic direction of time—as Davidson does in his formulation of dynamical laws as causal laws. Disgust has been a perennial feature of art from medieval visions of hell to postmodern travesties. The purpose of this chapter is to chart various ways in which disgust functions in artworks both in terms of content and style, canvassing cases in which the content and/or style is literally disgusting in contrast to cases where the disgust serves to characterize the content, often for moral or political or broader cultural purposes.

Standard approaches to ontological simplicity focus either on the number of things or types a theory posits or on the number of fundamental things or types a theory posits. In this paper, I suggest a ground-theoretic approach that focuses on the number of something else. After getting clear on what this approach amounts to, I motivate it, defend it, and complete it.

As I will use the term, an object is a mereological sum of some things just in case those things compose it simply in virtue of existing. In the first half of this paper, I argue that there are no sums. The key premise for this conclusion relies on a constraint on what, in certain cases, it takes for something to ground, or metaphysically explain, something else. In the second half, I argue that in light of my argument against sums, (...) Universalism, which is perhaps the most widely accepted answer to the Special Composition Question, is false. (shrink)

This chapter focuses on the dispute between necessitarians and contingentists, mainly addressing the issue as to whether laws of nature are metaphysically necessary or metaphysically contingent with a weaker kind of necessity, commonly referred to as natural, nomological, or nomic necessity. It is assumed here that all fundamental properties are dispositional or role properties, making the dispute a strictly verbal one. The existence of categorical intrinsic properties as well as dispositional properties is also assumed and the relationship between them examined. (...) Finally, the chapter concludes by returning to the debate between necessitarians and contingentists under the assumption that both dispositional and categorical fundamental properties exist. It is argued here that necessitarian positions can be recast as contingentist, but that there are unequivocally contingentist positions preferred because they are less mysterious despite being ontologically more complex. What values, if any, would be undermined by determinism?[i] Traditionally this question has been tackled by asking whether determinism is compatible with free will or whether it is compatible with moral responsibility. Compatibilists say that determinism would not threaten free will or moral responsibility, and hence that people’s values should not be influenced by whether or not they believe in determinism. Incompatibilists say that determinism would undermine free will or moral responsibility, and hence that a belief in determinism should have (...) a considerable impact on one’s values, precluding many popular evaluative beliefs. In this paper I arrive at a view of what it is for all substances to be physical by first arguing for an account of substance dualism as the view that the world is subject to psychophysical laws (or principles in the case of a Principle of Libertarian Choice) of succession PiMj --> PijMij in which some Mj are nonredundant and nonphysical and some Pi are nonredundant and nonmental. This leads to a classification of versions of substance dualism that differs (...) from the traditional classification into epiphenomenalism, interactionism, and parallelism. I reclassify epiphenomenalism as a form of substance physicalism and reject parallelism as incoherent. The position in which there is fundamental mental to mental causation but no fundamental mental to physical causation comes into view as a version of substance dualism that falls outside the traditional classification. Substance physicalism is accordingly analysed as the view that the world is subject to laws of succession whose antecedents are purely physical properties. (shrink)

In a 2014 paper in this journal, I put forward two objections to a version of divine simplicity I call ‘Divine Truthmaker Simplicity’. James Beebe and Timothy Pawl have come to Divine Truthmaker Simplicity’s defense. In this paper, I respond to Beebe and Pawl, consider an overlooked way of defending Divine Truthmaker Simplicity, and conclude by outlining an alternative account of God’s simplicity.

This paper was written for introductory students. It sketches the notion of libertarian freedom and argues that it is most obviously threatened by a combination of two theses, materialism and the determinacy of physics. It might be saved by denying just materialism, but materialism is highly plausible if physics is deterministic. It cannot be saved by denying just the determinacy of physics. It might be saved by denying both materialism and the determinacy of physics, but materialism is not made much (...) less plausible if physics is indeterministic. Then I consider the implications of accepting that libertarian freedom is an illusion. I argue that it would be a mistake to think that it entails fatalism, and that it would be a mistake to think that it undermines all forms of moral responsibility. But it plays an important role in undermining the view that punishments and rewards can be given purely backwards-looking justifications in terms of retribution and desert. I close by mentioning that there are compatibilist notions of freedom that have other uses. (shrink)

When performing an action of a certain kind, an agent typically has se- veral reasons for doing so. I shall borrow Davidson’s term and call these rationalising reasons (Davidson 1963, 3). These are reasons that allow us to understand what the agent regarded as favourable features of such an action. (There will also be reasons against acting, expressing unfavour- able features of such an action, from the agent’s point of view.) I shall say that R is a rationalising reason of (...) agent X’s for K-ing iff R consists of (i) a desire of X’s to L and (ii) a belief of X’s that K-ing promotes L-ing (to be discussed shortly). It is frequently said that when an agent X is K-ing and has several rationalising reasons for K-ing, not all of those reasons are reasons for which X is K-ing, that motivate X’s K-ing, or that explain X’s K-ing. This article considers the ways in which Julia Kristeva's work aligns with process philosophy, resisting the essentialism of substance philosophy.

The aim of this paper is to offer a classification of particulars in terms of their relations to spatiotemporal and spatial regions. It begins with an examination of spatiotemporal particulars, and then explores the extent to which a parallel account can be offered of continuants, or spatial particulars that can endure and change over time, assuming such particulars exist. For every spatial particular there are spatiotemporal particulars that can be described as its life and parts thereof. But not every time-slice (...) of a spatiotemporal particular yields a spatial region suitable for hosting a corresponding spatial particular. Events are spatiotemporal particulars though not all spatiotemporal particulars are events. Objects and states are spatial particulars though not all spatial particulars are objects or states. Spatial and spatiotemporal particulars can be either bare regions, or the contents or material contents of such regions, or property instantiations. It is left open whether events are contents of regions, property instantiations, or both. But it is argued that objects are material contents of spatial regions while states of objects are property instantiations. Spatiotemporal particulars can be changes or nonchanges. Events and states can be instantaneous while objects cannot. (shrink)

This thesis focuses on Abelard’s solution to the problem of understanding universals as presented in the Tractatus de Intellectibus. He examines this issue by asking what is understood when we consider the term ‘man’, a problem I call the ‘homo intelligitur [man is understood]’ problem. This is an important question, since earlier in the Treatise, Abelard states that understandings paying attention [attendens] to things otherwise than they are are empty, and thus, cannot be true. The challenge is therefore to explain (...) how understandings about universals, such as genera and species, can be sound, given that Abelard is a nominalist and, as such, does not believe in the existence of universal entities. His own answer to the problem is that such understandings attend to natures. However, since natures are, on his view, nothing more than the individuals they belong to, it is unclear how his solution is intended to work. I propose two ways to understand Abelard’s solution to the ‘homo intelligitur’ problem, identifying their respective merits and drawbacks. The first one is to treat ‘nature’ as meaning ‘status’. I explore this solution in Chapters 2 and 3, and conclude that while it has the advantage of establishing links between De Intellectibus and previous logical works by Abelard, it has some significant drawbacks, most notably that it is unclear how we can have epistemic access to status given that status are not things, which renders unclear how the criteria for the soundness of understandings can be met. The second one involves treating natures as referring to behaviors typical of members of a given genus or species. These behaviors come from the particular essential forms possessed by individuals, i.e. their differentiae understood as analogous to nuclear tropes in Peter Simons’ trope theory. I conclude that this solution is more intuitive than the first one and has the advantage of not depending on a specific interpretation of the evolution of Abelard’s thought. However, it is unclear how to treat behaviors and regularities in his ontology. (shrink)

In their recent Opinion in TiCS, Yildirim and Paul propose that large language models (LLMs) have ‘instrumental knowledge’ and possibly the kind of ‘worldly’ knowledge that humans do. They suggest that the production of appropriate outputs by LLMs is evidence that LLMs infer ‘task structure’ that may reflect ‘causal abstractions of... entities and processes in the real world.' While we agree that LLMs are impressive and potentially interesting for cognitive science, we resist this project on two grounds. First, it casts (...) LLMs as agents rather than as models. Second, it suggests that causal understanding could be acquired from the capacity for mere prediction. (shrink)

Este documento introduce el Criterio Ontológico Mínimo (COM) como un marco heurístico transdisciplinario que integra la lógica de Gödel, la termodinámica y la ingeniería de tensegridad para analizar la estabilidad en sistemas complejos. Se postula que la resiliencia de un sistema de poder no depende de su homogeneidad, sino de su capacidad para integrar y mantener la tensión con su polo opuesto.

Este trabajo presenta la Nomofísica como una nueva disciplina que estudia los isomorfismos estructurales de estabilidad en sistemas complejos. Se introduce el Criterio Ontológico Mínimo (COM) y el Teorema de la Inconsistencia del Poder Absoluto (TIPA), los cuales postulan que cualquier sistema monádico (centralizado y sin alteridad) está condenado a la saturación cognitiva y al colapso ante el aumento de la entropía. -/- Frente a la fragilidad de la Mónada, proponemos el Modelo Dioscúrico, una arquitectura basada en la Tensegridad Funcional (...) que utiliza la divergencia informativa (medida mediante la Divergencia KL) como un cable de tensión estructural. A través de un Benchmark de Resiliencia Estructural e implementaciones en modelos de lenguaje (LLM), demostramos que la dualidad asimétrica y el Veto Estructural permiten una estabilidad operativa superior en entornos de alta incertidumbre (OOD). Este enfoque desplaza el problema de la "Alineación de la IA" desde la ética normativa hacia la integridad arquitectónica, proponiendo que la prudencia sistémica es una propiedad emergente de la tensión entre opuestos. La presente obra introduce los fundamentos de la Nomofísica, una propuesta teórica que plantea un isomorfismo estructural entre las leyes que rigen los sistemas materiales y las dinámicas de gobernanza social. Basándose en principios de la termodinámica, la mecánica cuántica y la ingeniería de tensegridad de R. Buckminster Fuller, desarrolla un modelo de análisis articulado en torno a tres pilares: el Criterio Ontológico Mínimo (COM), concebido como una metodología para identificar únicamente los elementos y variables con efectos operativos verificables dentro (...) de un sistema; la Visión Dioscúrica y la Zona Gris (ZG), que explica la estabilidad sistémica a partir de la interacción coordinada entre polos en tensión; y la Tensegridad social, que traslada los principios de la mecánica estructural al ámbito institucional para comprender el disenso y los contrapesos como tensiones indispensables para conservar el equilibrio, la adaptabilidad y la resiliencia de las sociedades. Este trabajo presenta el Algoritmo de Tensegridad Lógica (ATL), una metodología inspirada en la física de materiales y la geometría diferencial para mitigar la degradación catastrófica en modelos de lenguaje masivos (LLMs). Mediante la implementación de una Arquitectura Dioscúrica (Sistemas Cástor y Pólux), el modelo abandona la seguridad basada en filtros reactivos en favor de una invariancia estructural. Demostramos mediante simulaciones tensoriales que el mantenimiento de un Factor de Tensegridad (T > 0) permite la absorción de ataques adversarios y la (...) gestión de fuentes contradictorias sin pérdida de coherencia sistémica. Este trabajo presenta una propuesta técnica para la medición de la estabilidad en sistemas de Inteligencia Artificial mediante la aplicación del Criterio Ontológico Mínimo (COM). Se explora la posibilidad de una Seguridad de Capa Cero, donde la integridad estructural se evalúa a través de un Coeficiente de Invariancia \left(\Phi_{\mathbit{com}}\right) fundamentado en la Curvatura de Ricci. A través de una arquitectura Dioscúrica, se propone un Sensor de Tensión Virtual como herramienta analítica para detectar desviaciones lógicas (paradojas o inconsistencias) en procesos de (...) razonamiento automatizado. Este trabajo propone el Algoritmo de Tensegridad Lógica (ATL) basado en la Nomofísica y el Criterio Ontológico Mínimo (COM). El ATL introduce una estructura dual (Cástor/Pólux) formalizada mediante la divergencia de Kullback-Leibler y el Factor de Tensegridad (T). Proporcionamos evidencia preliminar mediante simulaciones de que T > 0 es una condición necesaria para la resiliencia estructural ante perturbaciones fuera de distribución (OOD).

Basándose en la narrativa bíblica del Arca de Noé, Herrera desarrolla una metáfora sobre la paz, la reconciliación y la restauración de la armonía entre la humanidad y el mundo natural. La obra interpreta la rama de olivo no solo como un signo del fin del diluvio, sino como un emblema más (...) profundo de renacimiento ético, que simboliza la oportunidad para que la humanidad reconstruya un mundo más justo y compasivo tras la calamidad. -/- A través de un lente filosófico, Herrera examina la dualidad entre destrucción y creación, planteando que el potencial de crecimiento moral y espiritual surge tras grandes pruebas. El texto cuestiona la naturaleza de la justicia divina y la responsabilidad humana, sugiriendo un llamado a una vigilancia ética constante en un mundo perpetuamente al borde de la autodestrucción. Es una parábola sobre la búsqueda del hombre por la conexión y la reconciliación con lo divino, en un mundo violento lleno de caos, anarquía y la búsqueda antinómica de ideales hedonistas. -/- La obra de Herrera resuena con las preocupaciones contemporáneas sobre la degradación cultural y la fragmentación social, instando a una re-evaluación de nuestra relación con Dios y entre nosotros. This PhD thesis is a careful discussion of Aristotle's Metaphysics VII (Zeta) almost line by line (or at least argument by argument). It might be interesting to know that a revised and shortened version of it was published as a book in Portuguese, "As Noções Aristotélicas de Substância e Essência", Campinas: Editora da Unicamp, 2008. Actually, I believe the original version of the PhD thesis has been superseded by the book.

Noa Naaman-Zauderer’s book aims to bring to light the ethical underpinnings of Descartes’ system: on her view, in both the practical and the theoretical spheres Descartes takes our foremost duty to lie in the good use of the will.The marked ethical import of Cartesian epistemology takes the form of a deontological, non-consequentialist view of error: epistemic agents are praised/blamed when they fulfill/flout the duty to not assent to ideas that are less than clear and distinct.Extra-theoretical realms admitting of no clear (...) and distinct perceptions are subject to ‘softer’ duties of acting on the basis of the best available reasons. Since Cartesian epistemology involves ethical considerations,and since the late Cartesian ethics of virtue crucially depends on metaphysical knowledge about the nature and function of the will, Descartes’ ethics is not just a fruit of his tree of knowledge but it also nourishes its own roots. This book discusses Aristotle’s notions of essence and substance as they are developed in Metaphysics ZH. I examine Aristotle's argument at length and defends an unorthodox interpretation according to which his motivation is to provide an answer against a conflation between criteria for existential priority (delivering substances as primary beings) and criteria for explanatory priority (delivering essences as primary principles).

This article reviews the notion of 'noûs' and the verb 'noein' in pre-Socratic philosophy: it brings together research carried out since Kurt von Fritz's famous articles of 1945-1946, taking into account 20th and 21th centuries studies, in particular the ones of James H. Lesher, Shirley D. Sullivan, Rossana Stefanelli and Favio Stella. This paper also focuses on the conception of 'noûs' in the thought of Xenophanes, who links it with divinity and thus anticipates the important contribution of Anaxagoras. Finally, it (...) examines the conception of 'noûs' and 'noein' in Parmenides, in whose Poem it is closely linked to his conception of Being. (shrink)

I argue that a certain type of naturalist should not accept a prominent version of the no-miracles argument (NMA). First, scientists (usually) do not accept explanations whose explanans-statements neither generate novel predictions nor unify apparently disparate established claims. Second, scientific realism (as it appears in the NMA) is an explanans that makes no new predictions and fails to unify disparate established claims. Third, many proponents of the NMA explicitly adopt a naturalism that forbids philosophy of science from using any methods (...) not employed by science itself. Therefore, such naturalistic philosophers of science should not accept the version of scientific realism that appears in the NMA. (shrink)

Este artigo empreende uma discussão acerca da noção de fórmula discursiva nos trabalhos de Krieg-Planque e de um possível diálogo com o trabalho desenvolvido por Foucault, sobretudo, a partir do modo como o filósofo percebe o discurso, uma vez que ambos pertencem a uma tradição epistemológica francesa. Dessa forma, vamos adentrar pelo percurso de lapidação da noção de fórmula, tomando, para isso, a entrevista que Krieg-Planque concedeu a Philippe Schepens do Laboratoire de Sémio-linguistique, didatique e informatique (LASELDI) e do livro (...) A noção de fórmula em análise do discurso: quadro teórico e metodológico, trabalhos que representam para nós brasileiros uma espécie de introdução à discussão sobre a noção de fórmula proposta por Krieg-Planque no campo da Escola Francesa de Análise do Discurso (AD). Nessa discussão, vamos perceber que toda fórmula discursiva traz consigo uma densidade histórica apoiada em pré-construídos que estão voltados para as novas construções, tal qual propunha Foucault acerca das práticas e das materialidades discursivas em sua arqueologia do saber e em sua genealogia do poder. O objetivo desta pesquisa é compreender a noção aristotélica de nous, palavra grega que escolhemos traduzir, via de regra, por “inteligência” ou “intelecto”, nos seus diferentes sentidos e contextos de aplicação na obra de Aristóteles. Por se tratar de uma palavra deveras polissêmica e, não raras vezes, até mesmo confusa e enigmática, boa parte deste trabalho consiste em distinguir os seus diferentes usos e sentidos nos escritos de Aristóteles, no intuito de afastar o risco de confundi-los, o que costuma acontecer (...) com considerável frequência. Em suma, da perspectiva de Aristóteles e seus interlocutores antigos, nous se diz em pelo menos três sentidos principais: (1) nous como inteligência universal e divina inerente à natureza, princípio do ordenamento cósmico, das leis e de toda regularidade constatada no mundo natural; (2) nous como intelecto humano, enquanto topo da hierarquia cognitiva, isto é, enquanto parte racional, separada e mais elevada da alma, precisamente aquilo que distingue o ser humano dos outros animais e, como tal, está presente em todos os indivíduos do gênero humano; ou (3) nous como inteligência científica, uma virtude intelectual caracterizada por certa competência, habilidade, capacidade ou disposição cognitiva – distinta, porém paralela à episteme (“conhecimento científico”) – responsável pelo reconhecimento e compreensão contextual dos assim chamados “primeiros princípios imediatos” das ciências no âmbito da teoria aristotélica da demonstração científica. Assim, além de uma teologia, uma cosmologia e uma teleologia natural baseadas na noção de nous como inteligência divina, como veremos, é possível sistematizar ainda uma teoria do intelecto no Sobre a Alma e uma teoria da inteligência nos Segundos Analíticos – e Ética a Nicômaco – que sejam mutuamente independentes, de modo que uma seja de interesse primário da filosofia da mente e da psicologia aristotélica e a outra de sua filosofia da ciência. I discuss some of Aristotle’s scattered remarks from which one can construct his conception of matter. Aristotle seems to oscillate between two conceptions: one in which matter is the principle of becoming, another in which matter is a constituent element with no contribution for processes of becoming. Sometimes Aristotle takes matter as a thing independent in itself, and the correlated form is a feature that does not contribute to the matter’s essence, nor is a necessary condition for its existence. But (...) sometimes Aristotle takes matter as a constituent element the existence of which depends on the whole thing it is the matter of. These different approaches to matter seem to suggest an inconsistent theory of matter. However, I argue that, quite to the contrary, Aristotle has a consistent theory about matter. One of my main points is to distinguish contexts in which Aristotle is indeed talking about matter in general from contexts in which he uses the term “matter” to refer to a given thing that was previously taken as matter and to talk about that thing not qua matter, but qua the thing it is. La division entre "Intellect Agent" (intellectus agens) et "intellect Patient" (noûs pathêtikos) est-elle historique et donc culturelle ? Si oui , y a-t-il un intellect Uni-versel entre les deux ?

Uma pesquisa revisando o pensamento gestáltico se justifica pelo intenso debate em torno da tese emergentista da mente. Sem a pretensão de uma exposição extensiva dos usos de noções emergentistas na análise do conceito de mente, realiza-se uma exposição do conceito com foco nas perspectivas de John R. Searle e de Evan Thompson. Ambos realizam uma defesa da emergência como conceito central na compreensão e explicação da relação mente corpo, mas o primeiro centrado no conceito de propriedades emergentes e o (...) segundo centrado no conceito de processos emergentes. Neste debate entendemos que contribuições da teoria da Gestalt podem se fazer interessantes. Apresenta-se neste contexto o pensamento gestáltico enfatizando o texto “Über ‘Gestaltqualitäten’ ” de 1932, ditado à sua esposa por Chistian von Ehrenfels (1859-1932) no ano de sua morte como um comentário a partir da repercussão de seu artigo “Über ‘Gestaltqualitäten’ ”, publicado em 1890 e comentado pelos três autores de maior repercussão da psicologia da Gestalt; Max Wertheimer (1880-1943), Kurt Koffka (1886-1941) e Wolfgang Köhler (1887-1967). Ethical analyses of the effects of neural interventions commonly focus on changes to personality and behavior, interpreting these changes in terms of authenticity and identity. These phenomena have led to debate among ethicists about the meaning of these terms for ethical analysis of such interventions. While these theoretical approaches have different criteria for ethical significance, they agree that patients’ reports are concerning because a sense of self is valuable. In this paper, I question this assumption. I propose that the Buddhist (...) theory of no‐self offers a novel approach to making ethical sense of patients’ claims following deep brain stimulation. This alternative approach is based on the value of insight into patterns of cause and effect among mental states and actions. (shrink)

The aim of this paper is to analyze methodological problems of cross-cultural research in experimental philosophy. By studying five research projects, representing two distinct approaches to the examination of cross-cultural differences in philosophical intuitions, I point out the difficulties related to the content validity that appear in the choice of some cultural affiliation indicators. I criticize various indicators of cultural affiliation that are used in experimental philosophy (selfidentification, language) and suggest which indicators, and how, should be chosen in that kind (...) of research. I also argue that some problems related to bilingualism, translation, and the possible influence of language on the owned or reported philosophical intuitions may be impossible to transcend in cross-cultural research in experimental philosophy. This paper discusses the philosophical and logical motivations for rejectivism, primarily by considering a dialogical approach to logic, which is formalized in a Question–Answer Semantics. We develop a generalized account of rejectivism through close consideration of Mark Textor's arguments against rejectivism that the negative expression ‘No’ is never used as an act of rejection and is equivalent with a negative sentence. In doing so, we also shed light upon well-known issues regarding the supposed non-embeddability and non-iterability of force indicators.

Ita La recensione presenta la prospettiva enattivista difesa da Alva Noë, e ne discute alcuni aspetti specifici. Il pensiero, la coscienza e la cognizione non sono pienamente comprensibili, secondo l’enattivismo di Noë, senza un’adeguata considerazione del ruolo ricoperto dal corpo e dall’ambiente. Sarebbe quindi sbagliato continuare a pensare che il cervello da solo sia responsabile dei processi cognitivi umani: il programma che ricerca i correlati neurali della coscienza sarebbe quindi destinato al fallimento dal principio, perché tralascia in partenza corpo e (...) ambiente; i programmi di ricerca nel campo dell’intelligenza artificiale sarebbero ugualmente compromessi, non solo con una concezione computazionalista della cognizione, ma anche con la vecchia idea che un cervello artificiale sia sufficiente alla cognizione quanto un cervello naturale. Di seguito si prendono in esame due prospettive sperimentali su cui Noë fa grande affidamento: gli studi sulla plasticità neurale dei furetti svolti da Mriganka Sur e altri, e la realizzazione di un sistema di sostituzione visuo-tattile da parte di Paul Bach-Y-Rita. Per Noë si tratta di elementi cruciali in supporto alla propria prospettiva: in realtà, come emerge dalla breve analisi, l’attribuire loro un significato così chiaro e univoco pro-enattivismo è qualcosa di molto meno scontato. Infine, segue un breve bilancio del libro di Noë, dove gli elementi d’interesse del volume sono presentati insieme all’individuazione di alcuni punti deboli, che il testo condivide con la gran parte degli studi che in vario modo fanno leva sull’intuizione legata all’embodiement: da un lato una difficoltà strutturale riguarda la possibilità di identificare con chiarezza gli elementi costitutivi del mentale; dall’altro lato, il riferimento a forme di esternalismo radicale sembra ugualmente comportare diversi problemi. -/- Abstract Eng The review presents Alva Noë’s enactivist view, and aims at discussing some of its ideas. Thought, consciousness, and cognition are not understandable, Noë claims, without taking into proper consideration the role played by the body and the environment. It would be wrong indeed to go on thinking that our brain alone is responsible for human cognitive processes: the program searching for the neural correlates of consciousness is hopeless in principle, because it neglects from the beginning the body and the environment; research programs in artificial intelligence are as well compromised, not only with a computationalist view of cognition, but also with the old idea that an artificial brain will suffice for cognition just like a natural one. Thereafter, two experimental perspectives, that Noë uses to support his view, are examined: Mriganka Sur’s studies on neural plasticity of ferrets, and Paul Bach-Y-Rita’s tactile-visual substitution system. Noë argues that these results are crucial in supporting his view, but, as the discussion highlights, their pro-enactivism meaning is not so clear and unambiguous. Finally, a balance of the book follows, where the many elements of interest are presented together with the acknowledgment of some weak points, that the book shares with the majority of the proposals that deal with the embodiment’s insight: on the one hand, a structural difficulty concerns the possibility to identify clearly the constitutive elements of the mental; on the other hand, the reference to radical versions of externalism seems to entail many difficulties as well. O presente artigo pretende mostrar como o emprego feito por Schopenhauer das noções de caráter inteligível e de caráter empírico em Sobre a quádrupla raiz do princípio de razão suiciente pode ilustrar a natureza de suas primeiras recepções de Kant e de Schelling.

A obra Eletric Waves foi o ponto de partida para a análise filosófico-metodológica das teorias científicas por parte de H. Hertz e a culminância dessa prática deu-se com a sua obra póstuma The Principles of Mechanics. Nas introduções a essas duas obras um tema metacientífico se apresenta como núcleo central. Nelas Hertz trata das diferentes representações, imagens ou modelos dos fenômenos físicos: no caso da primeira obra, dos fenômenos eletromagnéticos; no caso da segunda, dos fenômenos mecânicos. E a questão que (...) tenta resolver é a seguinte: qual é a origem da pluralidade de imagens nas teorias científicas? Seria ela inevitável? É sobre esse tipo de questões que se fixa o presente trabalho na intenção de apresentar o papel da noção de representação na concepção de ciência de Heinrich Hertz. (shrink)

Many North American and British universities have recently prohibited all sexual and romantic relationships between students and teachers, even when they are consensual. This paper shows that such strict prohibitions are difficult to justify. While some aspects of the relationships they target may be troubling, they are usually sufficiently mitigated by standard anti-harassment policies. Common objections to such relationships, based on anti-discrimination or fiduciary law also fail to show that they are impermissible, as they rely on unwarranted empirical assumptions or (...) on an unjustified petition of principle regarding the students’ interests.
