Introduction

Welcome to Higher Plane applications. These Terms of Service (“Terms”) govern your use of all applications developed by Higher Plane Software Ltd. By accessing or using any of our applications, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our applications.

Our Applications

These Terms apply to the following applications:

• SpaceWalk: A chord progression generator audio plugin (VST3/AU) for Mac and Windows
• SpaceWalk for iOS: A chord progression generator audio plugin (AUv3) for iPad
• PhraseLab: A melodic phrase generator audio plugin (VST3/AU) for Mac and Windows
• Once Upon a Dream: An AI-powered storytelling app for children
• AltiMETAR: A weather information app for pilots and aviation enthusiasts

General Terms

Eligibility

You must be at least 18 years old to agree to these Terms. For applications involving children's content, you must be a parent, guardian, or caregiver acting on behalf of a child.

Intellectual Property

All trademarks, branding, and app design elements are the property of Higher Plane Software Ltd. Content generated by or accessed through our applications is provided for personal use only.

Acceptable Use

You agree not to:

• Use any application for unlawful or abusive purposes
• Attempt to reverse-engineer, tamper with, or bypass any security features
• Access backend systems or APIs in an unauthorised or automated manner
• Share, distribute, or monetise generated content outside of personal, non-commercial use

Termination

We reserve the right to terminate or suspend access to any application without notice if you violate these Terms or engage in fraudulent or harmful behaviour.

App-Specific Terms

Desktop Plugins (SpaceWalk & PhraseLab)

Description of Service

SpaceWalk and PhraseLab are audio plugins available in VST3 and Audio Unit (AU) formats for use in digital audio workstations (DAWs) and music production software. The following terms apply equally to both plugins (referred to collectively as “the Software”).

License Grant

Upon purchase, Higher Plane grants you a non-exclusive, non-transferable, revocable license to install and use the Software on up to three (3) computers or devices that you own or control for personal or commercial music production purposes.

License Restrictions

You may not:

• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Software
• Redistribute, resell, rent, lease, or sublicense the plugin to third parties
• Remove or modify any copyright notices, trademarks, or other proprietary markings
• Use the plugin in any way that violates applicable laws or regulations
• Share your license key or authorization credentials with others

Ownership and Intellectual Property

The Software and all intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, and patents, are owned by Higher Plane. This license does not grant you any ownership rights to the Software itself, only the right to use it under the terms specified herein.

Generated Audio and MIDI Content

Audio content, MIDI data, musical compositions, and recordings created using the Software belong to you and may be used freely in both personal and commercial projects, including but not limited to:

• Music releases and recordings (streaming, physical media, downloads)
• Film, television, video games, and multimedia productions
• Live performances and broadcasts
• Commercial advertising and promotional content

You may not, however, extract, isolate, or redistribute the raw audio samples, presets, or algorithmic components of the Software as standalone sound libraries, sample packs, or competing software products.

System Requirements and Compatibility

It is your responsibility to ensure that your computer system and DAW software meet the minimum requirements for running the Software. System requirements are provided on the product page and documentation. Higher Plane is not responsible for compatibility issues arising from unsupported systems, outdated software, or third-party conflicts.

Updates and Support

Higher Plane may provide software updates, bug fixes, and feature enhancements at its discretion. Updates may be provided free of charge or may require additional payment for major version upgrades. Technical support is provided on a reasonable-effort basis via email at the contact address provided on our website.

Disclaimer of Warranties

The Software is provided “as is” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Higher Plane does not warrant that the Software will be error-free, uninterrupted, or compatible with all systems and software configurations.

Limitation of Liability

To the maximum extent permitted by law, Higher Plane shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Software, even if advised of the possibility of such damages.

License Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession.

SpaceWalk for iOS

Description of Service

SpaceWalk for iOS is a chord progression generator audio plugin available as an AUv3 instrument and MIDI effect for iPad. It provides the same chord generation capabilities as the desktop version, optimised for touch interaction.

License

SpaceWalk for iOS is licensed through the Apple App Store. Your use of the app is subject to Apple's standard Licensed Application End User License Agreement (EULA) in addition to these Terms.

Generated Audio Content

As with the desktop version, audio content and MIDI data created using SpaceWalk for iOS belongs to you and may be used freely in both personal and commercial projects.

User Data

SpaceWalk for iOS does not collect, store, or transmit any personal data. All settings and presets are stored locally on your device.

Once Upon a Dream

Description of Service

Once Upon a Dream allows users to generate AI-powered children's bedtime stories and optionally access premium AI-generated audio narration. The app includes functionality for creating and selecting child profiles to personalise the story experience.

User Data

The app collects limited information provided by the user, including:

• Child's name, age, and gender (used solely to personalise stories)
• Device identifier (used for security and fraud prevention)

No other personal data is collected or shared.

In-App Purchases and Credits

The app uses a credit system (“Dream Shards”) for story generation and premium narration features. Dream Shards may be purchased through in-app purchases. All sales are final, and Dream Shards are non-refundable and non-transferable.

The app may include free or promotional credits at its discretion.

Content and AI Limitations

Stories and audio generated through the app are created using artificial intelligence. While efforts are made to ensure that stories are appropriate for children, you acknowledge that the content is generated programmatically and may not always be perfect. You agree to review stories and audio as appropriate before sharing with a child.

AltiMETAR

Description of Service

AltiMETAR provides real-time weather information, including METAR and TAF reports, for pilots and aviation enthusiasts. The app accesses weather data from public aviation weather services.

User Data

AltiMETAR does not collect, store, or transmit any personal data. All app preferences and favorite airports are stored locally on your device.

Weather Data Disclaimer

Weather information provided by AltiMETAR is sourced from public aviation weather services and is provided for informational purposes only. You acknowledge that:

• Weather data may not always be current or accurate
• The app should not be used as the sole source of weather information for flight planning
• You are responsible for obtaining official weather briefings and making appropriate flight decisions
• Higher Plane is not liable for any decisions made based on weather information provided by the app

Changes to These Terms

We may update these Terms from time to time. Continued use of any application after such changes constitutes acceptance of the new Terms. Significant changes will be communicated through the applications or our website.
