Terms of Use
1. General Information
Lemonrock® is produced by, and is a registered trade mark of Hi-Tech Communications Ltd. All rights reserved. With the explicit exception of the exclusions below, no portion of this website may be reproduced in any form, or by any means, without prior written permission from Lemonrock. In this document, the terms "Lemonrock" and "website" refer to any material published on the following domains owned by Lemonrock: lemonrock.com, lemonrock.co.uk and any other future branded domains.
2. Terms
The following rules and regulations ("Terms") apply to all visitors to or Members of this website (collectively, "Users"). By accessing this website, the User acknowledges acceptance of these Terms. Lemonrock reserves the right to change these Terms from time to time at its sole discretion. In the case of any violation of these rules and regulations, Lemonrock reserves the right to seek all remedies available by law and in equity for such violations. These Terms apply to all visits to the Lemonrock website, both now and in the future. The term "User" refers to the person responsible for viewing the content, or initiating its transmission from any of the above named domains.
3. Privacy
Please see our separate Privacy Policy here. Our Privacy Policy forms part of our Terms and Conditions.
4. Our Goals
Lemonrock's primary goal is to provide a reliable gig guide for the public.
Lemonrock strives to:
* support and encourage venues and bands to promote their live music gigs
* verify that all information posted is accurate
* rectify anything on the site that is incorrect
In return, we expect venues and bands to:
* post information that is accurate, including, but not limited to: band line-up (personnel), instruments played, declaration of backing tracks, gig date and time, location of gig, and, for venues, an accurate description of products and services offered.
We will redact any information that we find to be incorrect, at the earliest possible opportunity. In addition, we may limit access to Lemonrock so that posting future gigs is no longer possible.
5. Your email address
When you join Lemonrock you use an email address to identify yourself. We reserve the right to disallow any email address that we perceive to be misleading or that is being used to "pass off" your identity as being affiliated to, or connected with, Lemonrock. We also reserve the right to change our policy at any time, and delete your Lemonrock account without notice to you if we believe that your email address falls into this category.
6. Sending You email
If you have a Band or Venue membership, we will send you email confirmations of all gigs that you add to Lemonrock, the day after you add them to the site. We will also send you email alerts for any gigs added for your band/artist by a venue, or for any gigs added for your venue by a band/artist. You can turn off these confirmations and alerts in your "My Settings" section, or by following the links in our emails.
We may send you email newsletters (usually once a month) to keep you up-to-date with new features on Lemonrock. You may opt-out of these newsletters at any time.
We may also email you a list of gigs in your area every week, if there are any. You may also opt-out of these gig listings.
We may email you daily alerts of newly posted gigs from your "My Faves" section, if there are any. You may opt-out of these gig alerts, delete favourites, and add new favourites by going to your "My Faves" section.
To control your opt-in/opt-out settings, you must either:
  • log in and edit your "My Details" section (or "My Faves" section), or
  • respond to our email messages by clicking the "unsubscribe" button or link
In order for us to send you newsletters or area-based gig listings, you must either confirm your email address to us, or log in to Lemonrock. You can do either of these by following the links in our initial welcome email.
You must actively maintain any email inbox that you use for your Lemonrock account. We may stop sending you emails, without notice, if your inbox is full, or if you have set up email redirection that causes email bounce-backs to our mail server.
7. Mailshot email from Members
Lemonrock has a mailshot enquiry system, designed to save bands and venues from writing several emails in order to get gigs. If you would like to opt-out of this system, you should set 'Receive enquiries?' to 'No' in the edit page for your band or venue. This will prevent email enquiries being sent to you using our mailshot system.
8. Following favourite bands and venues
Any member can add their favourite bands and venues to their 'Favourites' list, which allows them to more easily 'follow' these favourites. Any band or venue in a member's favourites list will have their gigs automatically included in the 'Favourite Gigs' section on the subscribing member's Favourites/Faves page.
Any band or venue can remove/exclude any subscribing member from their list without notifying the member. The excluded members will then cease to get updates about the band's or venue's newly posted gigs, and will no longer see this favourite's gigs in their 'Favourite Gigs' section.
9. Email Tracking System
We track the opening of every email that we send from our automated email sending system. This allows us to identify email delivery problems and gives us important insights into who is not receiving our emails. If you do not wish your emails to be tracked, you may disable the display of images in your email client.
10. Content Created By Members
The views expressed in directly posted information from Members of the Lemonrock site are those of the individual Member and not those of Lemonrock or its ISPs.
(i) Members are asked not to contribute information which is abusive, racist, obscene, defamatory or the content of which is otherwise undesirable, illegal or in breach of any person's rights. Lemonrock reserves the right, at its sole discretion, to remove any such information at any time and without notice to any Member. Bona fide requests to remove defamatory content will be honoured, although we can give no guarantee to the time scale.
(ii) As this is a family-orientated site, Lemonrock will, at its sole discretion, remove any bad language or explicit adult-orientated words or pictures in posted material, and may terminate your account without notice to you. This also applies to MP3 song titles containing explicit words, and MP3 tracks posted that contain explicit lyrics that have not been marked as such.
(iii) Members may not post material that has been designed to distort search engine page rankings. In particular, Members may not employ superlatives (such as "A1", "AAA", "1st", "greatest", "brilliant", "best", etc). Such material may be removed by Lemonrock without notice to the Member. In such cases, membership may be cancelled without notice to any Member, at the sole discretion of Lemonrock.
(iv) Members may not post material that distorts any page, including, but not limited to: width of the page, width of column sections, width of table columns. Such material may be removed by Lemonrock without notice to the Member. In such cases, membership may be cancelled without notice to any Member, at the sole discretion of Lemonrock.
(v) Members may not post any gig that is not confirmed, either in writing, by email or verbally, with the other party (band/artist or venue). If the Lemonrock Editors find any evidence of false postings, the Member's membership will be terminated without notice.
(vi) MP3s posted on this site may be subject to copyright restrictions. If you do not own the copyright to songs posted on this site (e.g. "cover" versions or "covers" of existing songs), you MUST select the correct "Licensing category" for the track when you post it onto this site. Failure to correctly identify such tracks, at any time, means that we cannot correctly identify licensed material to the relevant collecting body (such as PRS for Music). In such cases of deliberate mis-categorisation, your MP3s may be removed from this site, and your membership may be terminated by us without notice to you.
(vii) Pictures and photos posted on this site may be subject to copyright restrictions. If you do not own the copyright, or do not have written permission from the copyright holder to such pictures or photos, you must not post them onto this site. Lemonrock assumes no responsibility for any picture or photo posted without appropriate consent. All responsibility lies solely with the person who uploads the picture or photo. If you do post copyrighted pictures or photos without the copyright holder's permission, we will remove them from this site without notice if we are made aware of any such breach, and your membership may be terminated by us without notice to you. Whether or not you are aware of any copyright restrictions, Lemonrock absolves itself of any responsibility or liability of copyright infringement in every case.
(viii) Pages created by Members on Lemonrock provide information to the public. If Lemonrock determines that any page should be deleted, amended, or re-assigned to a different Member, it may do so without notice to any Member. In cases of contention, where two or more parties claim "responsibility" for the same page, Lemonrock may attempt to resolve ownership by emailing the parties concerned. If no agreement can be reached, or if no response can be obtained from one or more parties, Lemonrock reserves the right to delete, amend or re-assign pages as it sees fit, and without notice to any Members involved. However, Lemonrock gives no guarantee to any Member that they will be consulted before pages are deleted, amended or re-assigned.
(ix) Members are responsible for adding and maintaining correct gig information, including, but not limited to: venue details, band details, gig date, gig time, and entrance fee. If any Member persistently posts inaccurate gig information, or a Member's membership expires, leaving inaccurate information on the site, Lemonrock reserves the right to edit or remove these gigs, and/or to terminate the Member's membership without notice.
(x) Members must have official representation from bands and venues for the pages they create. While it is acceptable to add publicly available general information to any editable page, it is not acceptable to add a Member's own contact details or promotional details to any page that does not belong to them (i.e. band pages created by Venue Members or venue pages created by Band Members). In cases of non-compliance, your membership may be terminated by us without notice to you.
11. Special Conditions for Promoters and Agents
Lemonrock is designed for bands and venues to post their own gigs. It is not designed for promoters/agents, whose operations are often a blurry mix of dealing with both bands and venues.
If you run live music festivals, or promote gigs at a specific venue, and want to add gigs for several different bands, you should join Lemonrock as a Venue Member. Otherwise, promoters/agents may join Lemonrock as Band/Artist Members, on the condition that they add their gigs to Lemonrock using the Support Band feature to list the actual bands playing. When adding gigs as a promoter/agent:
1. You will endeavour to add accurate information, including specific band names, gig descriptions and gig times, to all gigs that you post on Lemonrock.
2. You will not add your contact details (name, address, email, or telephone number) to any band page.
Failure to comply with these conditions may result in your gigs being removed from our site, your access to this site blocked, and your membership being terminated by us without notice to you. We will contact any Member by email where we consider that there is insufficient information about the actual bands/artists who are playing at any posted gig. There may be exceptions to this, for example if a gig is an Open Mic Night or Jam.
12. Membership Expiry
When a Member's membership expires, some of the Member's pages and content can no longer be edited by the Member. The Member's pages may be re-assigned by Lemonrock to another Member, or may be placed in the 'free pool' to make the pages available to a new Member.
On the day following membership expiry, any current gigs that are no longer editable by both the band and venue will be marked as 'TBC' and be excluded from the listings. To be clear, a posted gig will only show in our listings if either the band or the venue can edit the gig. This is done to avoid the problem of unmaintainable, inaccurate, or abandoned gig information.
A grace period is normally applied after a membership expires, during which the Member's pages and content may be protected from deletion or re-assignment. This grace period is currently 21 days, but may be changed, or removed, without notice, at any time by Lemonrock. Lemonrock reserves the right to withdraw the grace period for any Member, for any reason, without notice and without explanation. Following the grace period for bands, any YouTube links and SoundCloud links will be automatically removed. Following the grace period for venues, any YouTube links will be automatically removed.
In addition to a grace period, Lemonrock operates a holding period of 2 months, during which expired band/artist and venue pages will not have any further information removed by Lemonrock (although pages may still be adopted by other Members and details edited or removed by them). The holding period may be changed, or removed, without notice, at any time by Lemonrock.
Following the holding period for bands/artists, the following information will be automatically edited by Lemonrock:
  • the band/artist email address and contact name will be deleted
  • the band/artist gallery photos will be deleted
  • the band/artist MP3s will be deleted
  • the band/artist diaries will be deleted
  • the band/artist blog photos will be deleted
The band/artist page itself will be removed from the Member's account and placed back into the 'free pool', or may be deleted at that point in time, or at any time in the future if not claimed by anyone else.
Following the holding period for venues, the following information will be automatically edited:
  • the venue email address and contact name will be deleted
  • the venue gallery photos will be deleted
  • the venue diaries will be deleted
  • the venue blog photos will be deleted
The venue page itself will be removed from the Member's account and placed back into the 'free pool', or may be deleted at that point in time, or at any time in the future if not claimed by anyone else.
13. Automatic clean-up system
(i) Lemonrock will, on a regular basis, automatically delete unadopted band/artist pages and venue pages that hold little recent gig information. Unadopted pages are removed when:
  • they have no current gigs listed, and:
  • they have no gigs listed within the last 12 months
This means that unadopted pages, disowned pages and pages that a Member has chosen to lapse, will no longer exist on the site.
(ii) Membership clean-up: All new Members must log in within 7 days of joining Lemonrock. We will send regular reminder emails to new Members who have not yet logged in. If a new Member does not log in within 7 days of joining, we will automatically delete their account.
(iii) Gig clean-up: any gig that can no longer be edited by either party (the two parties being the band/artist and the venue) may be deleted by us, without any notice to either party.
(iv) Gig photo clean-up: any gig that is older than one year will be updated to show the default gig photo (i.e. the standard band or venue photo), and the individually specified gig photo, if any, will be deleted from the server.
(v) URL clean-up: we may remove without notice any URL added to a Band or Venue Member's page if we determine that the URL is unreachable, slow to access, or otherwise undesirable.
(vi) Music Lover Member clean-up: we may delete without notice any Music Lover Member account if we detect that their email account is no longer being used or is unable to receive our emails. We may also delete any account that forwards to an email address that rejects our original email.
14. Access to Password Protected/Secure Areas
Access to and use of password protected and/or secure areas of the website is restricted to authorised Members only. Unauthorised individuals attempting to access these areas of the website may be subject to prosecution.
15. Exceptions
Material posted by the Lemonrock Editors and by the registered Members of the Lemonrock site - specifically: sales information, blogs, testimonials and gig reviews - may be quoted and used for non-commercial personal purposes only, without the express permission from Lemonrock, providing that such use is at the sole risk of the person copying and/or distributing such information.
Gig information is available as listings via our gig feed software, and via the share icons on gig pages. Except for these mechanisms, please do not copy gig information from Lemonrock to other sites or publications without Lemonrock's express permission.
All permitted data sourced from Lemonrock must be attributed to "Lemonrock Gig Guide", with a hyperlink or printed reference to our main page at https://www.lemonrock.com.
The Lemonrock logos and Lemonrock icons on the website may be used freely.
16. Membership Cancellation
You may cancel your Lemonrock membership at any time, by going to the Cancel Membership page.
Any subscription fees paid are non-refundable.
Any Member cancelling their membership and then re-joining within 30 days of cancellation in order to obtain another free trial period will be held up to scrutiny. Any Member risks being blocked from using Lemonrock, and their posted gigs being deleted, if we conclude that the Member is taking advantage of our no-obligation free trial system.
17. Subscription Pricing
We will increase our membership prices every year on 1st October by at least current UK inflation. The increase may affect any or all of our annual, monthly and 3-monthly subscription prices, and our Add-on prices. Lemonrock will endeavour to keep such increases to a minimum, to ensure that our members get good value for money.
