Textualism and Pragmatism are often analyzed within discourse in the setting of the United States Supreme Court. Both philosophies seek to find legal truth to advance legal knowledge. A similar dichotomy is currently surfacing within nursing philosophy and theory as disciplinary knowledge and meaning‐making are advanced. While Textualism and Pragmatism cannot be used universally given their philosophical limitations, they do enhance disciplinary discourse when used as methods. The current debate in both legal and nursing contexts using Breyer's (2024) (...) arguments in favor of Pragmatism over Textualism are critiqued and the serious limitations of these philosophies clarified. An alternate philosophy, Process philosophy, is presented and applied. Process philosophy's application to the analysis organizes abstractions of legal arguments and clarifies Textualism and Pragmatism's ontological context‐related implications. Finally, an exploration of ethical codes, a potential sign of dominant disciplinary Pragmatism, is provided with rationale for the need to consider process when evaluating ethics of care. (shrink)

A cross-cultural survey experiment revealed a dominant tendency to rely on a rule’s letter over its spirit when deciding which behaviors violate the rule. This tendency varied markedly across (k = 15) countries, owing to variation in the impact of moral appraisals on judgments of rule violation. Compared with laypeople, legal experts were more inclined to disregard their moral evaluations of the acts altogether and consequently exhibited stronger textualist tendencies. Finally, we evaluated a plausible mechanism for the emergence of (...) class='Hi'>textualism: in a two-player coordination game, incentives to coordinate in the absence of communication reinforced participants’ adherence to rules’ literal meaning. Together, these studies (total n = 5,794) help clarify the origins and allure of textualism, especially in the law. Within heterogeneous communities in which members diverge in their moral appraisals involving a rule’s purpose, the rule’s literal meaning provides a clear focal point—an identifiable point of agreement enabling coordinated interpretation among citizens, lawmakers, and judges. My article concerns constitutional interpretation and substantive due process, issues that played a central role in Obergefell v. Hodges (2015), one of the two same-sex marriage cases. (The other same-sex marriage case was United States v. Windsor (2013).) -/- The late Justice Scalia consistently maintained that the Court “invented” substantive due process and continues to apply this legal “fiction” not because the Constitution supports it but simply because the justices like it. Two theories underlay his cynical conclusion. First is the (...) theory of “Constitutional Textualism”—or just plain “Textualism”—which says that the meaning of the Constitution lies entirely within the “four corners” of the document. Second is the theory of “Originalism,” which says that this meaning was fixed at the time of ratification. (Likewise, the meanings of the amendments were fixed at the time of their ratification.) -/- While Justice Scalia helped to inspire a Textualist/Originalist (and anti-substantive-due-process) movement, his Originalism has received far more attention than his Textualism. Since Judge Robert Bork first introduced Originalism to the general public during his Supreme Court nomination hearings in 1987, this theory has ignited passions on all sides and effectively re-framed the entire debate about how to interpret the Constitution. Constitutional scholars, left and right, now define themselves as either for or against Originalism. Meanwhile, Textualism has merely retreated into the background. -/- Part of the reason for this disparate treatment is that many who reject Originalism still consider themselves to be Textualists. They agree with Justice Scalia (and Judge Bork) that the text is all-important. They disagree, however, that its meaning was fixed for eternity at ratification. Instead, they maintain that either the meaning of the text or applications of this meaning to new cases can change as society changes. -/- In this Article, I bring Textualism out of Originalism’s shadow and into broad daylight. I argue that once we dig just a little deeper into the proposition that all of the meaning in the Constitution inheres in its words, we find that this theory simply cannot work. In order to interpret the nation’s foundational document, we must resort to assumptions that it does not explicitly state. (Indeed, even Textualism itself is a theory that the Constitution does not explicitly endorse.) And the notion that “extra-textual” assumptions necessarily inform our interpretations of the Constitution poses a direct and insurmountable threat to Textualism. -/- The Constitution actually requires each judge, when faced with a case concerning the right to privacy, not merely to consider the text but also to anticipate and evaluate the moral, social, and political consequences of both possible decisions before choosing between them. While this position may initially sound counterintuitive, it turns out to be a much more realistic theory of constitutional interpretation than Textualism (and Originalism). -/- I ultimately conclude that, contrary to Justice Scalia, the Constitution most certainly does protect a right to privacy. Frederick Douglass’s constitutional textualism can be interpreted from within the Black Natural Law Tradition (BNLT) in two ways. First, the BNLT has a more complex anthropology than the Classical Natural Law Tradition (CNLT), and it is in and through this anthropology that the work of Douglass political theorists Vincent Lloyd and Bill E. Lawson enables a new interpretation of Douglass’s constitutional textualism informed by imagination, time, and aesthetics. Second, the BNLT’s corollary of political activism in pursuit of racial (...) justice enables an interpretation of Douglass constructively using abstraction, as he does with his trope of “any man outside of America.” It is this trope that provides Douglass a point of departure for his race-conscious constitutional textualism. I contrast Douglass’s constructive use of abstraction with a more destructive use of abstraction for theoretical purposes, which can be politically and morally harmful, despite the best intentions, as in John Rawls’ A Theory of Justice. Textualist and originalist legal reasoning usually involves something like the following thesis, whether implicitly or explicitly: the legal content of a statute or constitutional clause is the linguistic content that a reasonable member of the relevant audience would, knowing the context and conversational background, associate with the enactment. In this paper, I elucidate some important aspects of this thesis, emphasizing the important role that contextual enrichment plays in textualist and originalist legal reasoning. The aim is to show how the linguistic (...) framework underlying sophisticated versions of new textualism and public-meaning originalism can help to shed important light on the plausibility of what John Perry calls conception textualism. Contra Perry, I do not think that conception textualism—arguably best classified as a version of expected-applications originalism—is “confused, implausible, and unworkable.” I also briefly compare my linguistic case for conception textualism with Justice Scalia's nonlinguistic argument for it, the main premise of which concerns the constitutive function of constitutions. In the last century there were philosophers who argued that nothing exists but ideas. In our century there are people who write as if there were nothing but texts. These people, whom I shall call “textualists,” include for example, the so-called Yale school of literary criticism centering around Harold Bloom, Geoffrey Hartmann, and Paul De Man, “post-structuralist” French thinkers like Jacques Derrida and Michel Foucault, historians like Hayden White, and social scientists like Paul Rabinow. Some of these people take their (...) point of departure from Heidegger, but usually the influence of philosophers is relatively remote. The center of gravity of the intellectual movement in which these people figure is not philosophy, but literary criticism. In this paper I want to discuss some similarities and differences between this movement and nineteenth-century idealism. (shrink)

The application of legal hermeneutics could be a constructive tool for interpreting the U.S. Constitution. Yet hermeneutics is virtually never used or mentioned by Supreme Court Justices. The two worlds, hermeneutics and constitutional law, seem to inhabit different silos. Still, the Justices and other judges could profit from the application of the discipline. This article examines the views of two leading theoreticians of hermeneutics, Hans-Georg Gadamer and Paul Ricoeur, which undermine the textualist and originalist approach to the Constitution, and highlights (...) hermeneutic tools for constitutional interpreters. Positivist theory, to state the obvious, is not held in high regard, at least among some members of U.S. legal academia. This position, it seems, is partly owed to alleged methodological deficiencies of the positivist approach: A formalist, or even “hyperformalist” theory, positivism, it is sometimes suggested, is destined to entail a “hypertextualist” and thus in any case inadequate view on interpretation. Focusing on the Kelsenian variety of legal positivism one may wonder whether this presumption actually proves to be correct. (...) Arguably Kelsen’s theory is to be understood as a formal approach to law. Still: Whether the appreciation of positivist thought as “formalist” or even “hyperformalist” actually does apply obviously depends on the definition of formalism. But, even if Kelsen’s theory of legal positivism is to be considered a formal approach to law, are the methodological consequences thus implied valid? Does the pure theory of law call for a purely formalist theory of interpretation? This essay argues it does not. (shrink)

This book addresses the question of deconstruction by asking what it is and discussing its alternatives. To what extent does deconstruction derive from a philosophical stance, and to what extent does it depend upon a set of strategies, moves, and rhetorical practices that result in criticism? Special attention is given to the formulations offered by Jacques Derrida and by Paul de Man . And what, in deconstructive terms, does it mean to translate from one textual corpus into another? Is it (...) a matter of different theories of translation or of different practices? And what of difference itself? Does not difference already invoke the possibility of deconstruction’s “others”? Althusser, Adorno, and Deleuze are offered as exemplary cases. The essays in this volume examine in detail these differences and alternatives. The Textual Sublime is particularly concerned with how a text sets its own limits, borders, and margins, how it delimits what constitutes the text per se and how it invokes at the same time what is not determinately in the text. The textual sublime is that aspect of a text that deconstruction shows to be both an element of the text and what surpasses the text, what takes it outside itself and what ties it to differing philosophical, rhetorical, historical, and critical practices. In the thesis literature review, an engineering graduate student is expected to place original research in the context of previous work by other researchers. However, for some students, particularly those for whom English is a second language, the literature review may be a mixture of original writing and verbatim source text appropriated without quotations. Such problematic use of source material leaves students vulnerable to an accusation of plagiarism, which carries severe consequences. Is such textual appropriation common in engineering master’s writing? (...) Furthermore, what, if anything, can be concluded when two texts have been found to have textual material in common? Do existing definitions of plagiarism provide a sufficient framework for determining if an instance of copying is transgressive or not? In a preliminary attempt to answer these questions, text strings from a random sample of 100 engineering master’s theses from the ProQuest Dissertations and Theses database were searched for appropriated verbatim source text using the Google search engine. The results suggest that textual borrowing may indeed be a common feature of the master’s engineering literature review, raising questions about the ability of graduate students to synthesize the literature. The study also illustrates the difficulties of making a determination of plagiarism based on simple textual similarity. A context-specific approach is recommended when dealing with any instance of apparent copying. (shrink)

The interest in textuality from a hermeneutic perspective has its historical origins in Martin Luther's doctrine of Sola Scriptura, “Only Scripture”. Schleiermacher, who to liberated hermeneutics from the Bible, presented a scientific account of textuality that consists in establishing a dialectic between the grammatical and the psychological. The modern hermeneutic theory of textuality was first developed by Hans‐Georg Gadamer. To be a work, says Ricoeur, textual discourse must satisfy three criteria: it must be a sequence longer than a sentence; it (...) must be codified into a genre (a story, poem, essay, etc.); and it must be uniquely configured into a style. Ricoeur's analysis of work in this sense is an attempt to synthesize the romantic hermeneutics of Schleiermacher with what he sees as being its antithesis. The hermeneutics of both Ricoeur and Gadamer are returned to their Lutheran origins through this faith in textuality, or textual goodwill. (shrink)

At first blush, it might seem as though digital approaches could provide us with precisely the kind of input we need to perform something like conceptual analysis in the philosophy of science: querying the expressed intuitions of the “folk” (here, practicing scientists publishing in the journal literature) to see how they put various concepts to use, to which cases they believe they can be applied, etc. In this chapter, I want to nuance this argument, both by clarifying what we might (...) mean by “conceptual analysis” in this case and by tempering expectations about what digital approaches could be reasonably expected to give us. I claim that such a more moderate goal, which I’ll call here “conceptual cartography,” can still provide the philosophy of science with a number of advantages (which are otherwise difficult to attain), while avoiding the possibility of making promises that we can’t fulfill. Utilizing the metaphor of the palimpsest, this paper looks at layering processes at work in the natural world and human perceptions of it, paying particular attention to the manifestations of the past visible in constructions in and of the landscape. History is made of constant reformations, in which pieces of the past make up the present. The palimpsest offers a useful tool for discussing a trans-temporal landscape. The layers of landscape construction go beyond the literal geological construction, encompassing human pasts (...) and presents as well. Engaging the palimpsestuous layers at work in physical and textual landscape construction allows us to place human endeavours into more expansive notions of temporality. (shrink)

In order to establish patterns of materialization of the beliefs we are going to consider that these have defined mathematical structures. It will allow us to understand better processes of the textual, architectonic, normative, educative, etc., materialization of an ideology. The materialization is the conversion by means of certain mathematical correspondences, of an abstract set whose elements are beliefs or ideas, in an impure set whose elements are material or energetic. Text is a materialization of ideology and it is any (...) representation of the Reality represented by symbolic means. Textual entailment is a relationship that obtains between fragments of text when one fragment in some sense implies the other fragment. The automation of textual entailment recognition supports a wide variety of text-based tasks, including information retrieval, information extraction, question answering, text summarization, and machine translation. Much ingenuity has been devoted to developing algorithms for identifying textual entailments, but relatively little to saying what textual entailment actually is. This article is a review of the logical and philosophical issues involved in (...) providing an adequate definition of textual entailment. We show that many natural definitions of textual entailment are refuted by counterexamples, including the most widely cited definition of Dagan et al. We then articulate and defend the following revised definition: T textually entails H = df typically, a human reading T would be justified in inferring the proposition expressed by H from the proposition expressed by T. We also show that textual entailment is context-sensitive, nontransitive, and nonmonotonic. (shrink)

This research paper focuses on the comprehensive description and analysis of the structure of judgments from the Court of Justice of the European Union (CJEU). Despite the growing interest in examining the rhetorical and linguistic aspects of legal texts, the genre structure of judgments has remained a little-explored area. While headings and paragraph enumeration provide a systematic reference system for citation and cross-referencing they do not reveal the dynamic relations between individual text chunks in judgments. The current analysis combines Swales (...) and Bhatia's genre theory with Hoey's approach to patterning in discourse and corpus linguistics analyses. The findings show that the complexity of CJEU judgments extends beyond surface-level information with linguistic expressions playing a crucial role in highlighting dynamic relations and discourse patterning. The results reveal how the structure of CJEU judgments has changed over time and point to the intratextual relations between different sections. Additionally, the study provides a detailed description of the textual organisation of CJEU judgments in terms of move structures and conventionalised discourse patterns. (shrink)

In this paper, we wish to explore the role that textual representations play in the creation of new mathematical objects. We do so by analyzing texts by Joseph-Louis Lagrange (1736–1813) and Évariste Galois (1811–1832), which are seen as central to the historical development of the mathematical concept of groups. In our analysis, we consider how the material features of representations relate to the changes in conceptualization that we see in the texts.Against this backdrop, we discuss the idea that new mathematical (...) concepts, in general, are increasingly abstract in the sense of being detached from material configurations. Our analysis supports the opposite view. We suggest that changes in the material aspects of textual representations (i.e., the actual graphic inscriptions) play an active and crucial role in conceptual change.We employ an analytical framework adapted from Bruno Latour’s 1999 account of intertwined material and representational practices in the empirical sciences. This approach facilitates a foregrounding of the interconnection between the conceptual development of mathematics, and the construction, (re-)configuration, and manipulation of the materiality of representations. Our analysis suggests that, in mathematical practice, distinctions between the material and structural features of representations are not permanent and absolute. This problematizes the appropriateness of the distinction between concrete inscriptions and abstract relations in understanding the development of mathematical concepts. (shrink)

In February 2010, the American Psychiatric Association (APA) launched their DSM-5 website with details about the development of the fifth edition of the Diagnostic and Statistical Manual of Mental Disorders (DSM-5). The APA invited “the general public” to review the draft diagnostic criteria and provide written comments and suggestions. This revision marks the first time the APA has solicited public review of their diagnostic manual. This article analyzes reported speech on the DSM-5 draft diagnostic criteria for the classification Posttraumatic Stress (...) Disorder. It demonstrates how textual standardization facilitates the cultural portability of the DSM-5 diagnostic criteria such that a community of speakers beyond the borders of the APA come to be seen as exemplary speakers, writers, and revisers of the professional style. Furthermore, analysis shows how co-authoring practices recontextualize the “voice” and persona of putative patient reported speech on Criterion D2. As a consequence of textual standardization, spoken discourse becomes recontextualized as the product of scientific inquiry and the organization of psychiatric knowledge. (shrink)

This article discusses how Liang Shuming’s Eastern and Western Cultures and Their Philosophies adopted a genealogical mode of textual authorization which took shape in its depiction of Chinese history as a failure to live up to an ideal way of life imagined by Confucius. Implied in this discourse was the idea that Liang himself had been the first Confucian to understand what Confucius had truly meant. This genealogical discourse authorizing Liang and his text by linking them directly to Confucius was (...) further strengthened by a rhetoric which naturalized the discourse passed down from Confucius to Liang, distinguishing it from other forms of discourse seen as artificial. Finally, the text’s genealogical discourse also managed to incorporate the May Fourth critique of Confucianism by rejecting the historical manifestations of Confucianism before salvaging an ideal imagined by Confucius which was presented as uncontaminated by history and Confucianism’s enmeshment with state power. Via a hermeneutics focused on Chinese numerology and concentric arrangements, the book offers a novel construal of the textual universe proper to early China writings. The author lays bare distinguishable patterns of textual composition while relating them to corresponding patterns of thinking. He differentiates rhetorical variants through detailed studies of the Zhuangzi's Inner chapters, the Laozi, the Analects, and the Huainanzi. The philosophical depth and relevance of the Chinese ancient worldview appear in a fresh light when one unearths the patterns (...) into which its content is embedded. The focus on textual patterns and rhetorical arrangements also facilitates the reading of Chinese classics alongside other traditions. This paper considers the use of textual analysis of oral histories as a method for historians of nursing. Fifty‐three oral histories of retired nurses in midwestern USA were analyzed for the purpose of historical reconstruction of past education experiences in nursing. Textual analysis was used to determine how nurses made sense of their educational experiences, and it involved gathering data, analyzing the information, and using a different method of interpreting the data. Although the participants responded to specific questions, the oral (...) histories in this study are more than mere answers to the researchers’ queries. The participants’ memories are narratives that are the joint product of both the historian and the participant. As such, the oral history becomes a text to be stored along with other primary sources for future historians’ use. The research also suggests decentering oral histories from an exclusively academic agenda and focusing more on what the participants choose to remember and why they make those choices. (shrink)

This study proposes the formalization of a structural model entitled Narrative Architecture of Textual Invariance (ANIT), characterized by the complete reorganization of a literary work without any alteration to its textual materiality. The study demonstrates that modifying the structural order of narrative segments may generate distinct interpretive experiences while fully preserving each original textual unit. The central hypothesis maintains that textual invariance is independent of the formal sequence applied, making it possible to alter structural architecture without compromising the lexical, syntactic, (...) or punctuation integrity of the work. For empirical verification, two complete versions of the same previously published short story are presented, organized in distinct sequences yet composed of exactly the same textual units. The formal analysis includes descriptive logical modeling, objective criteria of verifiability, and full demonstration in the annexes. It is concluded that ANIT constitutes a verifiable structural model in which order functions as an ontological operator capable of producing distinct narrative realities without any rewriting, suppression, insertion, or modification of content. We can easily misread historical texts if we take ideas and passages out of their textual contexts. The resulting errors are widespread, possibly even more so than errors through reading ideas and passages out of their historical contexts. Yet the methodological literature stresses the latter and says little about the former. This paper thus theorises the idea of textual context, distinguishes three types of textual context, and asks how we uncover the right textual contexts. I distinguish four kinds of textual-context (...) error, and offer practical tips for avoiding these errors. However, the beating heart of this paper is the history–philosophy debate: in contrast to the prevailing assumption that historical and philosophical analysis are fundamentally different, I show that a commitment to textual context, which should be entirely uncontroversial, also commits one to think philosophically. Textualism is now the Court’s lingua franca. In response, some have proposed a “progressive textualism,” defined by the use of traditional textualist methods to reach politically progressive results. This Article explores a different kind of “progressive textualism.” Rather than starting with the desired policy outcome—politically progressive or conservative—we begin from one of modern textualism’s central values: A commitment to “democratic” interpretation. As Justice Barrett argues, this commitment views textualists as “agents of the people” who “approach language (...) from the perspective of an ordinary English speaker.” Textualists thereby claim to promote democracy by interpreting law consistently with what it communicates to the ordinary public. However, recent empirical studies reveal discrepancies between textualist interpretive commitments and how ordinary people understand legal texts. These discrepancies undermine claims that textualists’ methodology is committed to democratic interpretation. -/- A textualism centered on democratic interpretation would be methodologically more progressive if it centered facts rather than fictions about how ordinary people interpret language. It would recognize that people understand legal language in light of linguistic “(co)text” and “(con)text,” and sometimes nonliterally; they often understand ambiguous terms in law to have legal, not ordinary, meanings; and their understanding of law is informed by its apparent purpose and sometimes by interpretive rules that are conventionally justified on normative grounds. In contrast, current textualism is often methodologically regressive, crafting a fictional “ordinary person” more closely connected to ideological policy goals than facts about ordinary language comprehension. Textual representation of graphene in Sweden’s most circulated newspapers is analyzed in 229 articles from 2004 to 2018. What is and is not said about graphene is explored through systematically identifying the lexical and grammatical patterns of sentences using the word “graphene.” Graphene is said to be a super material with certain properties, to be an object of research, commercialization, and application, and to have societal significance. Given frequent classifications of graphene as a nanomaterial in scientific discourse, there is notably (...) limited reference to graphene as “nano” in the newspapers and only marginal reference to risk. This paper discusses the findings regarding this Swedish newspaper discourse on graphene in relation to its intertextuality, i.e., how texts draw upon and recontextualize other texts: the Swedish newspaper discourse on graphene echoes discourses of promise formulated elsewhere in society; it is not very diversified in terms of themes; it is dominated by positive and neutral representations rather than by risk; and it makes limited reference to the nano-discourse, even though, according to most definitions, graphene is a nanomaterial. "Textual Reasoning" is the name a family of contemporary Jewish thinkers has given to its overlapping practices of Jewish philosophy and theology. Although the movement of textual reasoning is diverse and pluriform, it is characterized at bottom by the pursuit of the claim that there are significant affinities between Jewish forms of reading and reasoning and (...) postmodern thought. These affinities are presently being pursued by scholars throughout Jewish studies, in fields such as Bible, Talmud, Midrash, medieval philosophy, Kabbalah and the Jewish penomenology of Rosenzweig and Levinas among others. As the essays here convey, the work of these scholars has stimulated a lively and creative re-engagement with the philosophical dimensions of Jewish texts and, even more, the textual dimensions of Jewish reasoning. In large part this new energy has come from a conception of the postmodern as a place where some of the most distinctive features of Jewish reasoning can be elucidated as well as challenged. Textual Layering: Contact, Historicity, Critique sets out to rethink our relation to textual tradition against the background of several contemporary developments, including the emergence of digital culture, the increasing spectacularization of psychic as well as social life, the renegotiation of historical thinking, and the precarious position of the theoretical humanities within academia. To this end, the volume re-invests the concept of “layering,” a concept currently used in a wide range of fields, including metaphor studies and linguistics, cybernetics, the social sciences, (...) art, and architecture. Drawing on existing definitions of “layering,” the chapters in this book return to and re-appraise some of the most crucial concerns in the post-1960s theoretical scene: that is, concerns over the strained interplay between writing and the body; textuality and history; critique, différance and the feminine; memory, trace, and the immemorial. Self-plagiarism requires clear definition within an environment that places integrity at the heart of the research enterprise. This paper explores the whole notion of self-plagiarism by academics and distinguishes between appropriate and inappropriate textual re-use in academic publications, while considering research on other forms of plagiarism such as student plagiarism. Based on the practical experience of the authors in identifying academics’ self-plagiarism using both electronic detection and manual analysis, a simple model is proposed for identifying self-plagiarism by academics.

RNAs can do many things. They can store information, act in the world, and respond to the world. Because of these capabilities biologists have proposed a primordial ‘RNA world’ in which RNA, rather than DNA, performed the central role of replicator and repository of adaptive information. Deacon dismisses this hypothesis because replication is not about anything and because the structure of replicating molecules cannot contain information about the environment. I dispute both claims. An RNA and its opposite-sense complement represent each (...) other and, by two rounds of complementation, represent themselves. Although nucleic acid sequences do not change in response to their present environment, these sequences embody information about ancestral environments via the selective filtering of alternative sequences in those environments. The rapid advancement of AI has raised pressing moral considerations, prompting many stakeholders to publish guidelines for responsible development. However, the specific virtues organizations prioritize in their AI policies, and the extent to which they acknowledge AI’s potential role as a moral agent, remain underexplored. We conducted a textual and comparative analysis of AI principles issued by Big Tech corporations (OpenAI, Google, Microsoft and Anthropic) and their global watchdogs. The analysis revealed: (1) commonalities and distinctions in the technomoral virtues emphasized (...) across organizations, drawing on Vallor (2016)’s framework; (2) variation in how specifically those virtues are articulated in AI policies; and (3) divergent views on AI’s role to discuss responsibility – some framing AI purely as a tool, others hinting at AI’s moral status. These findings provide insights into the ethical frameworks guiding AI governance and highlight potential gaps in current AI policy discourse. (shrink)

We focus on the production of efficient descriptions of objects, actions and events. We define a type of efficiency, textual economy, that exploits the hearer’s recognition of inferential links to material elsewhere within a sentence. Textual economy leads to efficient descriptions because the material that supports such inferences has been included to satisfy independent communicative goals, and is therefore overloaded in the sense of Pollack [18]. We argue that achieving textual economy imposes strong requirements on the representation and reasoning used (...) in generating sentences. The representation must support the generator’s simultaneous consideration of syntax and semantics. Reasoning must enable the generator to assess quickly and reliably at any stage how the hearer will interpret the current sentence, with its (incomplete) syntax and semantics. We show that these representational and reasoning requirements are met in the SPUD system for sentence planning and realization. (shrink)

As rational animals, human beings not only have the ability to think but also the capacity to understand. Human rationality, so to speak, is constituted by thinking and understanding. The immediate connotation of rationality, however, is almost always thinking. Hence to speak of man as an animal rationale is to speak of man as a thinking being. But following his mentor Martin Heidegger, Hans-Georg Gadamer insists that man does not only think, but most importantly understands. To understand is an essential (...) part of being human, of being rational. But what is understanding? What does it mean to understand? The issue of human understanding is not something simply epistemological; rather, it is something hermeneutical. That is to say, understanding always relates to the act of interpretation. In his monumental work Truth and Method, Gadamer diligently considers the matter of human understanding from a purely hermeneutical perspective. This paper, then, aims to synthesize Gadamer's hermeneutical theory and argues that for Gadamer, human understanding is essentially characterized by a kind of textual intercourse, that is, a dialogic interaction or an intimate exchange of horizons between an interpreting subject and a text which, in very broad terms, can refer to any object of interpretation.
