En su recorrido por ciudades y pueblos tras la pista de una sociedad suspendida entre la industrialización y la herencia espiritual de la antigüedad hecha de mitos y (...) dioses, Pasolini buscaba los orígenes de la humanidad, rindiendo un homenaje platónico al Hombre de Kibish y, buscando, al mismo tiempo, una humanidad todavía no contaminada por el neocapitalismo. An accessible and thorough introduction to implicatures, a key topic in all frameworks of pragmatics. ABSTRACT:This paper re-examines the import of Rawls’s theory of justice for private sector institutions in the face of the decline of the welfare state. The argument is based on a Rawlsian conception of justice as the establishment of a basic structure of society that guarantees a fair distribution of primary goods. We propose that the decline of the welfare state witnessed in Western countries over the past forty years prompts a reassessment of the boundaries of the basic structure in order (...) to include additional corporate institutions. A discussion centered on the primary good of self-respect, but extensible to power and prerogatives as well as income and wealth, examines how the legislator should intervene in private sector institutions to counterbalance any unfairness that results from the decline of the welfare state. Committees multiply in firms, whether stakeholder boards or committees, multi-stakeholder initiatives, ethics committees, or oversight boards. These arrangements aim to organise and legitimise the social and political activities of corporations. This article raises the question of the appropriate form of such governance structures. The examples above illustrate three possible ways of legitimising corporate quasi-public social and political activities: deliberation within the company, deliberation outside, and an approach we label _corporate constitutionalism_. While the first two models have been tested in practice (...) and assessed in theory, the third one is comparatively more recent, both in practice and in theory. This article focuses on the latter model and asks whether corporate constitutionalism offers a suitable addition, or alternative, to deliberation (with or within firms) for legitimising corporate quasi-public social and political activities. It examines the respective merits of the three models and argues that a corporate constitutional court may mitigate some of the limits of deliberative practices alone. It argues the court is needed in weak regulatory environments, whether they are failing or inherently limited. (shrink)

An emotion-based lengthening effect on the perception of durations of emotional pictures has been assumed to result from an arousal-based mechanism, involving the activation of an internal clock system. The aim of this study was to systematically examine the arousal effect on time perception when different discrete emotions were considered. The participants were asked to verbally estimate the duration of emotional pictures from the International Affective Picture System (IAPS). The pictures varied either in arousal level, i.e., high/low-arousal, for the same (...) discrete emotion (disgust or sadness) or in the depicted emotion, e.g., disgust/fear for pictures matched for arousal (high-arousal). The results systematically revealed a lengthening effect on the perception of the duration of the emotional compared to the neutral pictures and indicated that the magnitude of this effect increased with arousal level. Nevertheless, variations in time perception were observed for one and the same arousal level, with the duration of disgust-inducing pictures (e.g., body mutilation) being judged longer than that of fear-inducing pictures (e.g., snake). These results suggest that arousal is a fundamental mechanism mediating the effect of emotion on time perception. However, the effect cannot be reduced to arousal, since the impact of the content of pictures also plays a critical role. (shrink)

Women philosophers of the past, because they tended not to engage with each other much, are often perceived as isolated from ongoing philosophical dialogues. This has led—directly and indirectly—to their exclusion from courses in the history of philosophy. This article explores three ways in which we could solve this problem. The first is to create a course in early modern philosophy that focuses solely or mostly on female philosophers, using conceptual and thematic ties such as a concern for education and (...) a focus on ethics and politics. The second is to introduce women authors as dialoguing with the usual canonical suspects: Cavendish with Hobbes, Elisabeth of Bohemia with Descartes, Masham and Astell with Locke, Conway with Leibniz, and so on. The article argues that both methods have significant shortcomings, and it suggests a third, consisting in widening the traditional approach to structuring courses in early modern philosophy. ABSTRACT:Singer has recently argued that questions related to corporate governance are beyond the reach of Rawls’s political conception of justice. This is because justice applies to the basic structure of society, understood as society’s legally coercive structures, and because corporate governance cannot be considered part of this structure in political liberalism. This commentary challenges the second part of the argument. First, it suggests that the criterion used to exclude corporate governance from the basic structure—whether employees can exit economic organizations—is not (...) conclusive for corporate governance, notably as institutionalized in corporate law. Second, even if the focus were on corporate governance, it would still be possible to argue that it legally coerces citizens, if not employees, in a relevant way. Thus, the argument is not successful in demonstrating that political liberalism goes beyond its legitimate boundaries when considering that aspects of corporate governance may be matters of justice. Three experiments were conducted in order to validate 56 musical excerpts that conveyed four intended emotions (happiness, sadness, threat and peacefulness). In Experiment 1, the musical clips were rated in terms of how clearly the intended emotion was portrayed, and for valence and arousal. In Experiment 2, a gating paradigm was used to evaluate the course for emotion recognition. In Experiment 3, a dissimilarity judgement task and multidimensional scaling analysis were used to probe emotional content with no emotional labels. The (...) results showed that emotions are easily recognised and discriminated on the basis of valence and arousal and with relative immediacy. Happy and sad excerpts were identified after the presentation of fewer than three musical events. With no labelling, emotion discrimination remained highly accurate and could be mapped on energetic and tense dimensions. This article asks whether firms should contribute to the costs of procreation and parenthood. We explore two sets of arguments. First, we ask what the principle of fair play – central in parental justice debates – implies. We argue that if one defends a pro-sharing view, firms are required to shoulder part of the costs of procreation and parenthood. Second, we turn to the principle of fair equality of opportunity. We argue that compensating firms for costs they incur because their (...) employees decide to procreate or parent may undermine some of the incentives leading to (statistical) discrimination in the workplace. This paper assesses employees’ moral agency within corporate capitalism from a politically liberal standpoint. While political liberalism has spelt out its key institutional implications at state level, it has neglected moral agency at work, assuming that a rights-based state that secures freedom of contract, free choice of occupation and a free labour market within a fair context would protect it sufficiently. Yet two features of corporate capitalism constrain employees’ moral agency: the relation of authority that forms part of the work (...) contract and organisations’ fragmented decision-making processes. Both seem at odds with the liberal ideal of allowing people to live by their own conception of the good. Consequently, this paper examines whether political liberalism should recommend greater safeguards for protecting workers’ moral agency. It proposes a criterion for assessing corporate capitalism: the ‘moral space’ defined as the socially shaped opportunities for action that can be enacted or endorsed from a comprehensive perspective. It argues that liberals should favour arrangements that widen workers’ moral space and suggests institutional designs that may achieve this while remaining within liberal boundaries. (shrink)

In the early modern period, ignorance was commonly perceived as a sin, a flaw, a defect, and even a threat to religion and the social order. Yet praises of ignorance were also expressed in the same context. Reclaiming the long-lasting legacy of medieval doctrines of ignorance and taking a comparative perspective, Sandrine Parageau tells the history of the apparently counter-intuitive moral, cognitive and epistemological virtues attributed to ignorance in the long seventeenth century (1580s-1700) in England and in France. With (...) close textual analysis of hitherto neglected sources and a reassessment of canonical philosophical works by Montaigne, Bacon, Descartes, Locke, and others, Parageau specifically examines the role of ignorance in the production of knowledge, identifying three common virtues of ignorance as a mode of wisdom, a principle of knowledge, and an epistemological instrument, in philosophical and theological works. How could an essentially negative notion be turned into something profitable and even desirable? Taken in the context of Renaissance humanism, the Reformation and the "Scientific Revolution" - which all called for a redefinition and reaffirmation of knowledge - ignorance, Parageau finds, was not dismissed in the early modern quest for renewed ways of thinking and knowing. On the contrary, it was assimilated into the philosophical and scientific discourses of the time. The rehabilitation of ignorance emerged as a paradoxical cornerstone of the nascent modern science. Over the last decades, many scholars, feminist and others, have argued that critique must be reframed in different and more ‘productive’ ways because its ‘conventional’ formulation and practice have outlived its usefulness as a conceptual tool. Instead, they have called for affirmation or affirmative critique and a more generative mode of critical engagement in the search for new imaginaries, transformative potentialities and other futures. New feminist materialist thought’s emergence is, we argue, symptomatic of this contemporary intellectual landscape that claims to (...) move beyond critique. While sympathetic with the desire to rethink a form of critique that speaks to the (urgent) politics of the present and the remaking of political imaginaries, we argue that the theoretical gesture to move beyond critique may offer a potentially troubling remapping organised around certain kinds of repression (of the undetermined and ambivalent work of critique) and amnesia (of feminist genealogies and over different feminist projects’ conceptualisation of matter) that yield a politics without politics. Mary Wollstonecraft argues that women must be independent citizens, but that they cannot be that unless they fulfill certain duties as mothers. This is problematic in a number of ways, as argued by Laura Brace in a 2000 article. However, I argue that if we understand Wollstonecraft's concept of independence in a republican, rather than a liberal context, and at the same time pay close attention to her discussion of motherhood, a feminist reading of Wollstonecraft is not only possible but (...) enriching. I will attempt to show, in particular, that the seeds of a feminist argument for co-parenting are to be found in the Vindication of the Rights of Woman. (shrink)

Motherhood, as it is practiced, constitutes an obstacle to gender equality in political participation. Several options are available as a potential solution to this problem. One is to advice women not to become mothers, or if they do, to devote less time and energy to caring for their children. However this will have negative repercussions for those who need to be cared for, whether children, sick people or the elderly. A second solution is to reject the view that political participation (...) is an important or necessary part of human flourishing, and allow that those who engage in caring activities can live good lives without having a say in how they are ruled. This has negative consequences for the carers who find themselves in a position, if not of direct oppression, of being dominated, and therefore susceptible of being oppressed. The solution I propose, inspired by the writings of Sophie de Grouchy, is that we look for a form of republicanism that regards caring activities as a form of political participation. (shrink)

In this paper I want to investigate further a claim made by Martha Nussbaum and Wayne Booth, amongst others, that good literature can be morally valuable, by applying it to a certain kind of genre fiction: the modern harboiled detective novel.

Addressing the mind-body problem in light of the difficulties raised by Cartesianism, this work traces a route leading from Descartes to contemporary philosophy of mind along with an evaluation of positions that focuses on certain facts and asks whether these positions do or do not make it possible to explain them.

I argue that Plato holds a medical model of virtue as health which does not have themorally unacceptable implications which have led some to describe it as authoritarian.This model, which draws on the educational virtues of the elenchos, lacks anyimplication that all criminals are mad or all mad people criminals – this implication beingat the source of many criticisms of Plato’s analogy of virtue and health. After setting upthe analogy and the model, I defend my argument against two objections. The (...) firstclaims that Plato's picture of virtue as health is unacceptable because it entails that vice isa defect and therefore that criminals are all mad. The second resists Kenny'sinterpretation but does so by attacking its first premise, i.e. that Plato believes virtue issome kind of health. I reply that both objections are misguided. (shrink)

This paper focuses on Hans Kelsen’s reflections on political parties. During the interwar period, Kelsen participated in a controversy over whether political parties were a necessary part of the democratic process. The debate forced Kelsen to produce a defence of political parties to emphasise their functionality and define their place in his particular definition of democracy. This contribution considers the following aspects. First, the reasons why Kelsen thought political parties are necessary for democratic life are explained. Second, the doctrinal oppositions (...) against which he elaborated his defence of political parties are clarified. Third, the programme that Kelsen conceived of to enhance political parties in a constitutional democracy is examined. Finally, the contemporary questions that have arisen in relation to Kelsen’s conception of political parties are scrutinised. Kelsen’s contribution to the debate about the role of political parties was intimately related to the presence of strong criticisms of that role. This makes his reflections even more interesting today, considering the present relative decline of the political role and appeal of parties. (shrink)

The dynamics of knowledge transmission and acquisition, or how different aspects of culture are passed from one individual to another and how they are acquired and embodied by individuals, are central to understanding cultural evolution. In small-scale societies, cultural knowledge is largely acquired early in life through observation, imitation, and other forms of social learning embedded in daily experiences. However, little is known about the pathways through which such knowledge is transmitted, especially during middle childhood and adolescence. This study presents (...) new empirical data on cultural knowledge transmission during childhood. Data were collected among the Baka, a forager-farmer society in southeastern Cameroon. We conducted structured interviews with children between 5 and 16 years of age about group composition during subsistence activities. Children’s groups were generally diverse, although children tended to perform subsistence activities primarily without adults and with same-sex companions. Group composition varied from one subsistence activity to another, which suggests that the flow of knowledge might also vary according to the activity performed. Analysis of the social composition of children’s subsistence groups shows that vertical and oblique transmission of subsistence-related knowledge might not be predominant during middle childhood and adolescence. Rather, horizontal transmission appears to be the most common knowledge transmission strategy used by Baka children during middle childhood and adolescence, highlighting the importance of other children in the transmission of knowledge. This article pays special attention to the large number of references to political theology by Hans Kelsen and Carl Schmitt, particularly in the interwar period, and seeks to interpret these references in a new way. While Schmitt's analogies between God and state are to be expected considering his strong Catholic roots, such comparisons are much more surprising for a positivist like Hans Kelsen, who always tried to relieve state and law from transcendental elements. The article concludes that, far from being (...) marginal in the doctrinal dispute between Schmitt and Kelsen, references to political theology express and summarize their major controversy about the relation between state and law, as well as about the sources of the state's unity. The heart of the disputatio between the two jurists concerned the ability of the political power to emancipate itself from the juridical order. The ‘legal miracle’—in this context meaning the occasional autonomization of the state from law—was for Schmitt the manifestation of sovereign power. However, for Kelsen it represented the negation of the state's essence, whose actions must be determined only by the legal order. (shrink)

An important part of making philosophy as a discipline gender equal is to ensure that female authors are not simply wiped out of the history of philosophy. This has implications for teaching as well as research. In this context, I reflect on my experience of teaching a text by medieval philosopher Christine de Pizan as part of an introductory history of philosophy course taught to Turkish students in law, political science, and international relations. This article asks whether firms should exempt employees when they object to elements of their work that go against their conscience. Fairness requires that we follow the rules of an organization we have joined voluntarily only if these rules express mutual advantage. In corporations, I argue that subordination and exemption provides for mutual advantage better than subordination plus right of exit. This is because agents want to protect their conscientious convictions, even in hierarchical organizations geared towards efficient preference satisfaction. In view of recent articles citing the Stoics as a defence or refutation of cosmopolitanism it is legitimate to ask whether the Stoics did in fact have an argument for cosmopolitanism which may be useful to contemporary political philosophers. I begin by discussing an interpretation of Stoic views on cosmopolitanism by Martha Nussbaum and A.A. Long and show that the arguments they attribute to the Stoics are not tenable in the light of present day philosophy. I then argue that the (...) Stoics did offer a very different argument for cosmopolitanism which is both more interesting and more plausible in that it draws on a conception of human nature similar to Aristotles and contemporary virtue ethics. Lastly I consider an objection made to their particular brand of cosmopolitanism by Martha Nussbaum, namely that a Stoic cosmopolitan life is devoid of personal affiliation and therefore unbearably lonely. In the Statesman, Plato seems to be advocating that in the absence of a true king who will rule independently of laws, the next best thing as far as just rule is concerned is to ad here rigidly to existing laws, whatever they are. The rule of the true king is given as an example of virtuous rule in the sense that virtue politics or jurisprudence holds that laws cannot always deal justly with particular cases. But Plato’s view of what (...) we must do when there are no true kings forthcoming seems to preclude a virtue theoretical understanding of politics and laws. In this paper I will investigate the view that the image of the true king, who relies on written laws for convenience only, provides a model for a more realistic appeal to virtue in jurisprudence, that is, a respect of laws that is compatible with equity, in the sense understood by Aristotle.Čini se da Platon u Državniku zagovara shvaćanje prema kojemu u odsutnosti istinskog kralja koji će vladati neovisno o zakonima druga najbolja stvar, što se tiče pravedne vladavine, jest strogo pridržavanje postojećih zakona, što god oni bili. Uloga istinskog kralja navodi se kao primjer vrle vladavine u tom smislu što politika ili jurisprudencija koje se zasnivaju na vrlini drže da zakoni ne mogu uvijek pravedno izlaziti na kraj s pojedinačnim slučajevima. No čini se da Platonovo shvaćanje toga što moramo činiti kada ne postoje istinski kraljevi sprječava razumijevanje politike i zakonâ koje se zasniva na teoriji vrline. U ovom članku ispitujem shvaćanje prema kojemu slika istinskog kralja, koji se na pisane zakone oslanja samo iz praktičnih razloga, pruža model za realističnije pozivanje na vrlinu u jurisprudenciji, to jest poštivanje zakonâ koje je spojivo s nepristranošću u onom smislu u kojem to razumije Aristotel. After analyzing the contributions and limitations of these authors, she suggests a different method of distinguishing publicity from transparency by drawing on the polyvalence in the semantics of the latter. Il s’agit de proposer une confrontation entre deux pensées au premier abord sans grand rapport : les travaux critiques de J. Butler qui mettent au jour le rôle constitutif et assujettissant de normes sociales qui passent pour naturelles d’une part et, d’autre part, la pensée stoïcienne, indéniablement naturaliste et conservatrice. C’est le motif de la performance – exhibition du Cynique ou du drag, incarnation des normes de genre chez Butler ou d’un rôle par l’acteur stoïcien – qui retient notre attention. (...) On cherche à montrer qu’une certaine articulation est possible entre des usages stoïciens et des usages contemporains de la performance et que cette articulation est féconde pour notre manière de comprendre notre actualité. ABSTRACT: Can virtue ethics say anything worthwhile about laws? What would a virtue-ethical account of good laws look like? I argue that a plausible answer to that question can be found in Plato’s parent analogies in the Crito and the Menexenus. I go on to show that the Menexenus gives us a philosophical argument to the effect that laws are just only if they enable citizens to flourish. I then argue that the resulting virtue-ethical account ofjust laws is not viciously (...) paternalistic. Finally, I refute the objection that the virtue-ethical account I am proposing is not distinct from a consequentialist account.RÉSUMÉ: Peut-on construire une théorie de la loi à partir de l’éthique de la vertu? Qu’est ce qu’une bonne loi? Je dis que l’on trouvera une réponse à la question dans l’analogie entre les lois et les parents présentée par Platon dans le Criton et le Ménéxène. Dans §2, je montre que le Ménéxène apporte une défense philosophique de l’argument que les lois sont bonne seulement si elles amènent les citoyens a la vertu.Dans §3, je montre que celte théorie des lois selon la vertu n’est pas outre mesure paternaliste. Dans la dernière section, je réponds a l’objection suivante : que la théorie que je défend n’est ni plus ni moins qu’une théorie conséquentialiste. (shrink)
