Our 2021 article in Ethical Theory and Moral Practice argued that mutuality, defined as ‘loving attention’ towards a sexual partner, should be a moral standard for ethical sex. We specified that this loving attention should occur in the form of attempting to know what could be knowable about the other person and taking a ‘thick’ view of the other in their particular social and psychological contexts. We contrasted this orientation with the comparatively ‘thin’ view of people from a rights-based ethical (...) perspective that claimed that individuals would have fulfilled their moral duty by acquiring free and informed consent from a partner. Over twenty years of research have examined the cognitive consequences of positive affect states, and suggested that positive affect leads to a broadening of cognition (see review by Fredrickson, 2001). However, this research has primarily examined positive affect that is low in approach motivational intensity (e.g., contentment). More recently, we have systematically examined positive affect that varies in approach motivational intensity, and found that positive affect high in approach motivation (e.g., desire) narrows cognition, whereas positive affect low in approach motivation (...) broadens cognition (e.g., Gable & Harmon-Jones, Citation2008a; Harmon-Jones & Gable, 2009). In this article we will review past models and present a motivational dimension model of affect that expands understanding of how affective states influence attentional and cognitive breadth. We then review research that has varied the motivational intensity of positive and negative affect and found that affect of low motivational intensity broadens cognitive processes, whereas affect of high motivational intensity narrows cognitive processes. As our world becomes increasingly interconnected, threats to global public health continue to proliferate. New and novel risks to health have emerged consistently over the past 30 years. Moreover, our shrinking world now allows health threats to spread more quickly than ever before. Given these realities, efforts to protect and improve global health must be expansive, flexible, and able to take into account the variety of circumstances that may imperil good health. Social relationships are intricately tied to health and well-being and people are motivated to form and maintain interpersonal bonds. While it is clear that social relationships can be highly rewarding, it is equally clear that social relationships or the lack thereof can be the source of much distress. In this article a conceptualization of social motivation that reflects the basic necessity for people to simultaneously manage approaching the incentives and avoiding the threats in social relationships is presented. We then review (...) evidence that the strength of approach and avoidance social motives and goals is strongly linked to social outcomes through several behavioral, cognitive, and affective processes. Human rights courts may be on the cusp of recognizing linkages between the mental health impacts of climate change and human rights. However, several significant obstacles must be overcome before human rights protections are likely to be extended to cover the mental health impacts of climate change. Thus, the push for recognition of human rights protections for people facing mental health harms imposed by climate change must be pursued along with a multifaceted effort that employs regulatory and advocacy strategies alongside (...) litigation, and more clearly establishes the interconnections between mental health, climate change, and human rights. ABSTRACT Sexual assault on college campuses has become a major concern. A common response has been to provide bystander intervention training, which research shows may provide short-term attitude change without reducing the number of assaults. Current curricula and research may neglect the very factors that could play a part in students’ desire and ability to intervene, one of which may be moral motivations. For this qualitative study, we interviewed students (n = 38) who identified as having been bystanders to a (...) ‘sketchy sexual situation’ to understand, from a moral perspective, their decisions to intervene or not. In exploring narratives, we used Moral Foundation Theory to categorize the moral reasoning of participants and explore the voices and motivations that adhere to these categories. Through a thematic/discourse analysis we identified additional discourses. Implications for changes to bystander intervention training are discussed. (shrink)

The Heideggerian critique of onto-theology has attained a semi-canonical status for continental philosophy of religion. But is the critique itself sound, and does it actually result in a richer philosophical and theological discourse concerning God? In this paper, I argue that Heidegger’s onto-theological critique suffers from serious difficulties. First I examine the critique, summarizing and condensing the critique in its essentials. I use Westphal’s fourfold criteria as a way of giving it some precision, while presenting it in relative independence from (...) Heidegger’s own account of Being. In section III, I examine the results of non-onto-theological discourse on God post-Heidegger, suggesting, using the examples of John Caputo and Richard Kearney, that Heidegger’s onto-theological critique has not inspired a less problematic religious discourse. In the fourth and final section, I question the legitimacy of the critique itself. While Heidegger’s critique of onto-theology has the seemingly admirable goal of rendering our discourse about God less instrumental and idolatrous, a careful analysis of the criteria themselves reveals that onto-theology either misinterprets natural theological discourse on God or subjects it to impossible requirements. The emerging global climate crisis threatens human health in unprecedented ways, yet global health concerns have not been sufficiently considered within international climate change efforts. A more collaborative pathway could advance efforts to mitigate and adapt to climate change while protecting public health and social justice.

Pandemics challenge the law and often highlight its strengths or expose its limits. The novel strain of influenza A virus that emerged in the spring of 2009 and rapidly spread around the globe was no exception. The H1N1 pandemic prompted the first significant application of a number of international legal and policy mechanisms that have been developed in the last decade to respond to this kind of event. Furthermore, it presented a considerable test for public health systems at all levels, (...) from global to local.Although initial predictions forecasting high morbidity and mortality from this virus overestimated its eventual impact, the human toll of the pandemic was nevertheless significant. The World Health Organization reported approximately 1.5 million people were infected worldwide in 214 countries, resulting in over 25,000 confirmed deaths, but the actual health impact of the outbreak was certainly much higher. The passage of the Patient Protection and Affordable Care Act in March 2010 represents a significant turning point in the evolution of health care law and policy in the United States. By establishing a legal infrastructure that seeks to achieve universal health insurance coverage in the United States, the ACA targets some of the major impediments to accessing needed health care for millions of Americans and by extension attempts to strengthen the health system to support key determinants of health. Yet, (...) like many newly passed legislative provisions, the ultimate effects and significance of the ACA remain uncertain. Those charged with implementing the ACA face formidable obstacles — indeed, some of the same obstacles that have been erected to impede other major pieces of social legislation in the past — including entrenched political opposition, constitutional challenges, and what will likely be a prolonged struggle over the content and direction of how the law is implemented. As these debates continue, it is nevertheless important to begin to assess the impact that the ACA has already had on health law in the United States and to consider the likely effects that the law will have on public health going forward. In this paper we challenge the idea that valid consent is the golden standard by which a sexual encounter is deemed ethical. We begin by reviewing the recent public focus on consent as an ethical standard, and then argue for a standard that goes beyond legalistic and contractual foci. This is the standard of mutuality which extends beyond the assurance that all parties engaging in a sexual encounter are informed, autonomous, and otherwise capable of making a valid choice: one must (...) also encounter the other with care and loving attention. We develop this claim using Iris Murdoch’s concept of an attitude of “loving attention,” which differentiates our view from the duty of due diligence to ensure that each person is a willing participant in sex, that the rights of others have not been violated, as emphasized by Dougherty. We also address three objections to using mutuality as a measure of ethical sex, namely that it is patronizing, that it is a maximalist position that puts too great a burden on individuals and inhibits their freedom, and that it is an ideal rather than a requirement. We then look at three examples that test the construct of mutuality: the typical college hook-up, sex work, and anonymous sex through glory holes and similar set-ups. (shrink)

ABSTRACTEmotions influence cognitive processes involved in memory. While some research has suggested that cognitive scope is determined by affective valence, recent models of emotion–cognition interactions suggest that motivational intensity, rather than valence, influences these processes. The present research was designed to clarify how negative affects differing in motivational intensity impact memory for centrally or peripherally presented information. Experiments 1 & 2 found that, relative to a neutral condition, high intensity negative affect enhances memory for centrally presented information. Experiment 3 replicated (...) this effect using another high intensity negative affect. Experiment 4 extended this by finding that, relative to a neutral condition, low intensity negative affect enhanced memory for peripherally presented information. “Public health practice” consists of activities and Programs managed by public health agencies to promote health and prevent disease, injury, and disability. Some of these activities might be deemed to fit within the broad definition of “research” under federal regulations, known as the Common Rule, designed to protect human research subjects. The Common Rule defines research as “a systeniatic investigation, including research development, testing and evaluation, designed to develop or contribute to generalizable knowledge.” Public health activities that might under some (...) circumstances be considered research include disease reporting, review of medical records, surveys, interviews, focus groups, specimen collection, and laboratory testing.There are questions about the extent to which the Common Rule applies or was intended to apply to public health practice: and it has been suggested in any case that Common Rule regulation of public health practice may not be socially optimal for both practical and principled reasons. Despite a recent wave in global recognition of the rights of transgender and gender-diverse populations, referred to in this text by the umbrella label of trans*, international law continues to presume a cisgender binary definition of gender — dismissing the lived realities of trans* individuals throughout the world. This gap in international legal recognition and protection has fundamental implications for health, where trans* persons have been and continue to be subjected to widespread discrimination in health care, longstanding neglect of health (...) needs, and significant violations of bodily autonomy. In an emergency, challenges faced by disabled individuals may be exacerbated by ineffective communication, power outages, transportation shortcomings, and inhospitable shelters. During Hurricanes Katrina and Rita, Gulf Coast shelters did not routinely provide closed captioning or sign language interpreters; for individuals with auditory disabilities, understanding instructions issued in these shelters was extremely difficult. Individuals with mobility-related disabilities experienced challenges evacuating from their homes due to public transportation that could not accommodate wheelchairs. After the hurricanes, difficulties arose in identifying wheelchair-accessible trailers (...) and in communicating with disabled trailer residents. Failing to anticipate these challenges intensifies the disadvantaged situation of those with disabilities during an emergency. (shrink)

[Samuel Scheffler] Some egalitarian liberals have proposed a division of moral labour between social institutions and individual agents, but the division-of-labour metaphor has been understood in different ways. This paper aims to disentangle some of these different understandings, with an eye to clarifying the appeal of the egalitarian-liberal project and the challenges that it faces. The idea of a division of moral labour is best understood as the expression of a strategy for accommodating diverse values. It is not an (...) apology for economic self-interest or a device for justifying personal acquisitiveness. /// [Véronique Munoz-Dardé] Are there distinctively political values? Certain egalitarians seem to think that equality is one such value. Scheffler's contribution to the symposium seeks to articulate a division of moral labour between norms of personal morality and the principles of justice that regulate social institutions, and using this suggests that the egalitarian critique of Rawls can be deflected. In this paper, instead, I question the status of equality as an intrinsic value. I argue that an egalitarianism which focuses on the status of equality as valuable in itself embraces a theory of value with the worst elements of utilitarianism while leaving behind any of the intuitive appeal that utilitarianism has. In its place I press that we need a political conception of egalitarianism which stresses the role we engage beyond those found in the norms of personal morality. (shrink)

Samuel Hopkins (1721–1803) was a White Congregationalist theologian who was born in Connecticut and later worked in Massachusetts and Rhode Island. He owned enslaved people for parts of his life but eventually freed them and became a vocal proponent of abolition. Hopkins composed several antislavery texts. This chapter is a selection from his Dialogue Concerning the Slavery of the Africans, published anonymously in 1776, which is a fictional conversation between an enslaver who defends slavery and someone who argues for (...) abolition. Hopkins makes many notable points in this text, for instance about the epistemic situation of enslavers and enslaved people, as well as about racist prejudices. This text is dedicated to the Continental Congress, a joint legislative body of the thirteen colonies that declared independence in 1776 and became the United States. (shrink)

Samuel Sewall (1652–1730) was a White judge and businessman from Massachusetts. He is mostly known today as one of the judges at the Salem Witch Trials, and the only one to later apologize publicly for his involvement. This chapter is nearly the entirety of Sewall’s pamphlet The Selling of Joseph: A Memorial (1700), which appears to be the first antislavery tract to be published in New England. The text argues against transatlantic slavery but also against the integration of Black (...) people into colonial American society. Hence, this pamphlet is an excellent illustration of the ways in which even antislavery authors did not always fully embrace the equality of Black and White people. Sewall’s antislavery arguments are primarily theological, though he also invokes legal principles and ideas from natural law ethics. (shrink)

This work presents the basic arguments and fundamental themes of the political and moral thought of the seventeenth-century philosopher, Samuel Pufendorf--one of the most widely read natural lawyers of the pre-Kantian era. Selections from the texts of Pufendorf's two major works, Elements of Universal Jurisprudence and The Law of Nature and of Nations, have been brought together to make Pufendorf's moral and political thought more accessible. The selections included have received a new English translation, the first for both works (...) in roughly sixty years. The editor, a political scientist, and the translator, a philosopher, have developed a volume that is comprehensive and representative of Pufendorf's thought without being repetitive, fragmented, or obscure. Samuel Kerstein’s recent (2013) How To Treat Persons is an ambitious attempt to develop a new, broadly Kantian account of what it is to treat others as mere means and what it means to act in accordance with others’ dignity. His project is explicitly nonfoundationalist: his interpretation stands or falls on its ability to accommodate our pretheoretic intuitions, and he does an admirable job of handling carefully a range of well fleshed out and sometimes subtle examples. The Irish writer and Nobel Prize winner, Samuel Beckett, assembled for himself a history of western philosophy during the 1930s, just at the point at which his first novel, Murphy, was coming together. The 'Philosophy Notes', together with related notes taken at that time about St. Augustine, thereafter provided Beckett with a store of knowledge, but also with phrases and images, which he took up in the major work that won him international and enduring fame, from the dramas Waiting (...) for Godot and Endgame, through to the late prose works Worstward Ho and Stirrings Still. This edition presents, for the first time, Beckett's full 'Philosophy Notes', which constitute his most extensive unpublished text. The Notes display Beckett's own interests and emphases within the history of western philosophy, from the pre-Socratic Greeks onwards, together with more familiar figures in the study of his work, such as Descartes, Leibnitz, and Geulincx. Here we see Beckett's original thoughts on all of these figures for the first time. The Notes also, tellingly and often comically, display Beckett's impatience with many aspects of philosophy, such as its anthropological or anthropomorphic bias, or the idealism of the Enlightenment and Kant. The Edition contains an extensive Introduction, outlining the origin of Beckett's Notes, his major sources and approach to them, the historical context for his view of philosophy, and the significance of Beckett's 'Philosophy Notes' within his mature writings. This work contains newly translated excerpts from Samuel Pufendor's two major works in political and moral thought, Elements of Universal Jurisprudence and The Law of Nature and Nations. The editor and translator have worked to present a readable and comprehensive introduction to Pufendorf's political philosophy. The new English translation far exceeds what is currently available in terms of sophistication and clarity. A substantive introduction is included to acquaint readers with Pufendorf's ideas.

An important work in the debate between materialists and dualists, the public correspondence between Anthony Collins and Samuel Clarke provided the framework for arguments over consciousness and personal identity in eighteenth-century Britain. In Clarke's view, mind and consciousness are so unified that they cannot be compounded into wholes or divided into parts, so mind and consciousness must be distinct from matter. Collins, by contrast, was a perceptive advocate of a materialist account of mind, who defended the possibility that thinking (...) and consciousness are emergent properties of the brain. This volume is the first scholarly edition of Samuel Johnson’s translation of Jean Pierre de Crousaz’s _Commentaire sur la traduction en vers de M. Abbé Du Resnel, de l’Essai de M. Pope sur l’homme, _published in 1739. Included are notes comparing Johnson’s translation with the French original to show his method of translation and historical annotations. Of special interest are several lengthy footnotes that Johnson added to his translation. Among these are thoughts relating to the problem of evil, particularly (...) the ruling passion and the necessity of free will. Many of the ideas first given expression here were to occupy Johnson’s mind for the remainder of his life. (shrink)

During the winter of 1818-1819, Samuel Taylor Coleridge gave fourteen lectures on the history of philosophy. A shorthand writer took down twelve of them in the most detailed version of Coleridge's lectures known to exist. The transcriptions are imperfect and inaccurate in various ways, but, when they are combined with Coleridge's own notes, as in this edition, the result is a coherent and largely complete whole.The lectures contain Coleridge's interpretation of the history of philosophy. He opposed the idea, widely (...) accepted at the time, that the philosophy of the Enlightenment had advanced by conquering religion. He believed that this view had doomed philosophy to the low esteem in which it was held in Britain, and he wanted to counter it by showing that the philosophy of the Enlightenment was largely derivative and that neither philosophy nor religion could stand alone. This series of lectures was his most systematic attempt to survey the relationship of philosophy to religion from Thales to Kant.The edition presents a fully annotated and indexed text of the lecture series, and it provides in addition the complete texts of the shorthand reports and of Coleridge's own notes (which were omitted from the Coleridge Notebooks), along with newspaper and manuscript reports by people who attended the lectures.
