In this study we examine (1) how a manager’s risk behavior is influenced by developing success (or failure) as an impending settling up deadline to report performance approaches, (2) how willingness to provide transparent accountability is negatively affected by perceived risk and eroding trust, and (3) how others interpret and respond to reduced transparency. As perceptions of high levels of risks suggest a lack of environmental control of a firm’s destiny in contemporary settings, we adopt a historical approach to examine (...) these issues. In this respect we draw on primary sources found in library archives in Spain and Argentina. Our focal case refers to the contract signed and executed between the South Sea Company and Captain José de Salinas (1731–1735) to walk 408 Negroes from Buenos Aires to Potosí and sell them en route or at destination. Drawing on this evidence, we examine how bring about unethical conduct featured by increasingly risky business practices, and how eroding trust conditions lead to only summary record-keeping and delayed reporting. In turn, diminished accountability further undermined trust. Our findings have implications for further research in this area as well as for contemporary cases of accounting failures. (shrink)

In environmental ethics, the legal and political representation of non-humans is a widespread aspiration. Its supporters see representative institutions that give voice to non-humans’ interests as a promising strategy for responding to the illegitimate worldwide exploitation of non-human beings. In this article I engage critically with those who support this form of representation, and address two issues central to any account concerned with the legal and political representation of non-human living beings: what should be represented? And what are the conditions (...) of such a representation? The answers I provide to these queries count as a first step towards a comprehensive account of the institutional representation of non-human nature. (shrink)

The climate crisis has implications for the idea of justice. The paper explores this idea to inquire whether climate change wrongs animals and, if it does, how these wrongs are constitutive of an injustice. The first question is answered in the positive to then propose an answer to the second question through an account of climate injustice articulated as a problem of distribution of ecological space. On that basis, the general conclusion of the paper is that at least some harms (...) suffered by animals are constitutive of climate distributive injustices. They are cases of wrongful appropriation of ecological space, that is, of the benefits that the Earth’s life-support systems and its physical resources provide to sentient animals. Life with chronic disease and chronic care is hard and people who live in disadvantage may lack the freedom to prioritise their care because of increased c.

This paper starts by establishing a prima facie case that disadvantaged groups or individuals are more likely to get a chronic disease and are in a disadvantaged position to adhere to chronic treatment despite access through Universal Health Coverage. However, the main aim of this paper is to explore the normative implications of this claim by examining two different but intertwined argumentative lines that might contribute to a better understanding of the ethical challenges faced by chronic disease health policy. The (...) paper develops the argument that certain disadvantages which may predispose to illness might overlap with disadvantages that may hinder self-management, potentially becoming disadvantageous in handling chronic disease. If so, chronic diseases may be seen as disadvantages in themselves, describing a reproduction of disadvantage among the chronically ill and a vicious circle of disadvantage that could both predict and shed light on the catastrophic health outcomes among disadvantaged groups—or individuals—dealing with chronic disease. Chronic diseases are the main disease burden worldwide, leading to premature deaths and poor individual and population health outcomes. Although modern medicine has made significant progress in developing effective treatments, only around 50% of people follow long-term treatment recommendations in high-income countries and presumably even less in low-income and middle-income countries.1 Health outcomes for chronic diseases follow a social gradient across socioeconomic groups, suggesting that the 50% adherence rate distributes unequally across social groups, affecting those who live in disadvantage the (...) most despite universal health coverage.2 Bioethicists have largely ignored inequalities that arise from differences in adherence to long-term treatments and the importance of the ethical dimension of chronicity for clinical practice. As I discuss in detail elsewhere, the concept of ‘chronic disease’ lacks a successful and agreed definition, failing to be structured in a traditional way and allowing for a disjunctive group of diseases to fall under the concept.3 Still, the main element that helps distinguish ‘chronic diseases’ from all other diseases is their long duration, so the noun chronicity can help demarcate and identify the nature of ‘chronic disease’. Drawing on conceptual analysis and phenomenological research on illness that highlight the tension between the cyclical and static elements of chronic disease, I have argued that chronicity has a phenomenological sense beyond its …. According to the brain drain argument, there are good reasons for states to limit the exit of their skilled workers (more specifically, healthcare workers), because of the negative impacts this type of migration has for other members of the community from which they migrate. Some theorists criticise this argument as illiberal, while others support it and ground a duty to stay of the skilled workers on rather vague concepts like patriotic virtue, or the legitimate expectations of their state and co-citizens. In this article, on the contrary, we suggest that the liberal conception of states’ legitimate political authority demands, and not just permits, that developing states from which migration of skilled workers occurs set up contractual mechanisms. These mechanisms will ensure that state-funded training in the health sector is provided against a commitment on the part of future professionals to reciprocate with their services for the benefits obtained. If one of the conditions for the state to maintain legitimate political authority is to provide basic services such as healthcare to its subjects (while respecting at the same time their autonomy and freedom), then this is what developing states affected by the brain drain ought to do. What we call the authority-based approach to the brain drain also helps to clarify the obligations that other states have not to interfere with these contractual mechanisms when they exist, and not to profit from their absence. Inspired by FIFA’s legal instruments of training compensation and solidarity mechanism for the transfer of players, we conclude by suggesting a plausible global policy to complement this authority-based approach. This study compares the restriction of mobility of forced migrants during the COVID-19 pandemic between March 2020 and December 2021 in the United States and Ecuador. Based on the critical discourse analysis of anti-migrant rhetoric in press articles, migrant stories in the press, reports, and border control practices, I examine the Ecuadorian government’s response to the migration flow of Venezuelans and the United States’ enforcement practices against Central American asylum seekers. By exploring Giorgio Agamben’s concept of bare life, I argue (...) that this failure to protect forced migrant’s rights is due to the United States’ and Ecuador’s representations of forced migrants as bare life and carriers of the virus, justifying xenophobia and resistance to humanitarian international law. By drawing on a feminist intersectional approach, I add to recent research on the securitization of forced migration and challenge the race/ethnicity, immigration status, class, and nationality-based discrimination of the measures undertaken during the pandemic. I illustrate how the treatment of forced migrants as bare life was aggravated by their intersectional inequalities. I conclude by providing recommendations that could be considered by the U.S. and Ecuadorian governments to protect the right to freedom of mobility. (shrink)

El artículo explora la socialización de la lectura en la Biblioteca Pública Digital y la Biblioteca Digital Escolar, dos plataformas públicas de lectura digital en Chile. Analizando estos entornos de interacción digital, sus affordances y funcionalidades, mediante la noción de código técnico y entrevistas a usuarios, demostramos que la socialización se ve tensionada entre un paradigma que remedia la lectura de lo impreso y otro, propio del medio digital, que facilita el compartir, comentar y publicar. A pesar de las limitaciones (...) impuestas a la socialización de la lectura, los usuarios diseñan estrategias que dan cuenta de una creatividad modular de las prácticas de lectura. Uriel da Costa analiza las ceremonias como dispositivos de poder que producen una forma de subjetividad determinada marcada por el miedo y por la esperanza. Los mecanismos de esta forma de superstición se parecen a los que Spinoza desarrolla en su Tratado Teológico Político. Este artículo pretende esclarecer los puntos en común y las diferencias entre los análisis que da Costa y Spinoza hacen de la superstición, análisis que, aunque en gran medida similares, parten de postulados antropológicos diferentes.

Sin embargo, la convocatoria al silencio pronto fue rota por una controversia de relatos que difieren en sí sustancialmente. Desde entonces, el debate sobre la pertinencia de narraciones de corte realista, melodramática o cómica, cuando no fantástica, su legitimidad o ilegitimidad y el uso de material de archivo en los filmes sigue generando importantes dudas a la hora de abarcar la representatividad del horror. In recent decades, innovation has reconfigured the ways in which public policies are designed and implemented, citizen participation is managed, and social interventions are produced. Considering the relevance of these new local development experiences, this article presents the results of a research project aimed at identifying and analyzing the innovation practices deployed in a citizen laboratory. This is a qualitative research based on a case study, in which semi-structured interviews were conducted with 17 members of the organization. The results identify (...) four forms of innovation: affective-community innovation, pragmatic-institutional innovation, self-formative-creative innovation, and infrastructural-contested innovation. It is concluded that these forms should not be understood as mutually exclusive categories or as distinct ideal models, but rather as ways of doing that coexist and are dynamically assembled within situated contexts, shaping a practical field traversed by relations of tension, articulation, and mutual dependence. One of the first things striking readers of Criminal Law Conversations is its unusual methodology. The editors of this volume have put together 31 conversations around as many cutting edge and influential articles. This article considers critically some discussions representative of each of the book’s three parts: Principles, Doctrine, Administration and provide a glimpse of the richness and variety of Criminal Law Conversations.

The internet offers adolescents a huge window of opportunities, but these opportunities are not always exempt from risks. Indeed, many young people are nowadays confronted with spam, gruesome or violent images and content including pornography, drugs, racism, and even suicide. We surveyed 815 Flemish 15- to 19-year-olds about the online risks they (may) have been confronted with and on how they cope with these risks. We controlled for digital literacy levels, socio-demographics and personality traits. Interestingly, our research shows that not (...) only adolescents with a high level of internet literacy but also those with lower internet literacy levels, such as youths enrolled in vocational education, tend to be more frequently exposed to online risks. Also worthwhile noting is the fact that a high level of self-confidence positively correlates with exposure to risky online content. In general, adolescents do not consult anybody when it comes to coping with risks and negative experiences online. However, a good parent-child relationship pays off as kids with a good parental relationship encounter aggressive, sexual or value-based content less frequently. (shrink)

Resumen: El presente trabajo intenta analizar los elementos críticos a la base de aquella suerte de prescripción que Edward Said formulara a los intelectuales bajo la célebre consigna de “decir las verdades al poder”, esto es, de interpelar públicamente al poder -político, económico, religioso, militar- frente a toda evidencia de injusticia, inconsistencia o turbia manipulación en su operar. En tanto tal, y a partir de nuestra lectura de Said, delimitamos cinco dilemas que el intelectual ha de resolver, en tanto requisitos (...) para decir las verdades al poder: orientación intramundana versus extramundana, rol profético versus sacerdotal, libertad universalista versus organicidad, racionalidad sustantiva versus instrumental y arrojo versus temor. Se comentan las implicaciones de estos dilemas a la luz de los desafíos y oportunidades que las sociedades contemporáneas -en particular, las latinoamericanas- presentan para el rol del intelectual.: This work analyzes the critical foundations of that quasi-rule posed by Edward Said to intellectuals through the famous motto “speaking truth to power”, that is, of publicly interpellating to power -political, economic, religious, military- whenever its exercise may involve injustice, inconsistency or underhanded manipulation. So, according to our interpretation of Said’s work, we identify five dilemmas the intellectual should resolve in order to be able to speak truth to power: a worldliness orientation versus an otherworldliness one, a prophetic role versus a priestly one, universalist freedom versus organic compromise, a substantive rationality versus an instrumental one, and courage versus fear. Involvements of these dilemmas are discussed according to the challenges and opportunities posed by current societies -in particular, the Latin American ones- to the intellectual’s role. (shrink)

ABSTRACT In this article I explore whether liberal retributive justice should be conceived of either individualistically or holistically. I critically examine the individualistic account of retributive justice and suggest that the question of retribution – i.e., whether and when punishment of an individual is compatible with just treatment of that individual – must be answered holistically. By resorting to the ideal of sensitive reasons, a model of legitimacy at the basis of our best normative models of democracy, the article argues (...) that in modern liberal democracies, punishment of an offender A for f is compatible with just treatment of A only if punishment of an individual for f can be legitimate in A's and A's fellow citizens' eyes. Only once retributive justice is understood in this holistic fashion the imposition of punishment can be made compatible with just treatment of individuals. RESUMO Neste artigo, exploro se justiça retributiva liberal deve ser concebida ou individualista ou de forma holística. Examino criticamente a conta individualista da justiça retributiva e sugiro que a questão da retribuição – quando a punição de um indivíduo é compatível com o tratamento justo desse indivíduo – deve ser respondida de forma holística. Recorrendo ao ideal de razões sensíveis, um modelo de legitimidade na base dos nossos melhores modelos normativos de democracia, argumento que, nas democracias liberais modernas, a punição de um delinquente A para φ é compatível com o tratamento justo de A só se punição de um indivíduo para φ pode ser legítimo aos olhos de A e seus concidadãos. Uma vez que a justiça retributiva é entendida dessa forma holística, a imposição da pena pode ser compatível com o tratamento justo de indivíduos. (shrink)

If neoliberalism can create subjectivities, then it also creates the poor subject. This article asks about the functionality that poverty has in neoliberalism, affirming that poverty served, in the first instance, to weaken the unions, then to create a constant demand for debt and finally, to enhance the discourse of meritocracy.

Subjective well-being is a broad category of phenomena that includes people’s emotional responses, domain satisfactions, and global judgments of life satisfaction. This research investigates how schoolchildren’s subjective well-being is affected by the different types of technology use, in personal contexts, and, concurrently, whether these effects are different when the use of technology is problematic. The central hypotheses are as follows: the use of the Internet affects the subjective well-being of schoolchildren negatively only when this use is problematic and the effect (...) on subjective well-being is different according to the type of Internet use. To respond to the objectives of the research, a survey was applied to 15-year-old adolescents, distributed in 330 public schools, beneficiaries of a government program for the delivery of personal computers and Internet for a year. The different uses of the Internet were measured using frequency scales by type of activity. Problematic use scale measured the perception of negative consequences of the intensity of Internet use on a daily basis. Subjective well-being was measured by the Personal Well-Being Index-School Children. Subsequently, for analytical purposes, three simple mediation models were created, whose dependent variable was PWI-SC, while its independent variables were Internet use scales differentiated by purpose and problematic use as a mediating variable, as well as attributes of the subjects and their social environment, which were incorporated as control variables. The main results show that only if Internet use is expressed as problematic does it negatively affect subjective well-being. On the contrary, when the use of the Internet is not problematic, the effect is positive and even greater than the simple effect between these two variables. This finding is relevant, since it allows us to provide evidence that suggests that, when studying the effect that the intensity of the Internet, firstly, one must consider the mediating effect exerted by the network’s problematic use and, secondly, that not all types of use have the same impact. Therefore, it is useful to enrich the discussion on subjective well-being and social integration of schoolchildren in the digital age. (shrink)

Of the factors that contribute to a lack of awareness and appreciation by the English-reading world of the development of philosophy in Latin America, themost serious is the lack of bibliographical materials. To compile such was the purpose of the Conference on Teaching Materials for the Study of Latin American Thought held recently at the American University in Washington, D.C. Since the majority of the participants were connected with Latin American Studies Programs, the bibliographies proposed for the various projects were, (...) for the most part, in the Spanish and Portuguese languages. This language barrier still excludes the overwhelming majority of those in the English-reading world interested in matters philosophic from learning what has happened and is happening in that field in Latin America. Accordingly, what follows is a bibliographical introduction to works in English, discussed in the order of their appearance, on the study of philosophy in Latin America. Only what this author considers major works will be discussed, as limited space prevents an exhaustive bibliography. (shrink)
