Conversation analysts have noted that, in psychotherapy, formulations of the client's talk can be a vehicle for offering a psychological interpretation of the client's circumstances. But we notice that not all formulations in psychotherapy offer interpretations. We offer an analysis of formulations that are diagnostic: that is, used by the professional to sharpen, clarify or refine the client's account and make it better able to provide what the professional needs to know about the client's history and symptoms. In doing so, (...) these formulations also have the effect of shepherding the client's account towards subsequent therapeutic interpretation. In a coda, we notice that sometimes the formulations are designed discreetly. We examine one such discreet formulation in detail, and show how its very ambiguity can lead to its failure as a diagnostic probe. (shrink)

In his Encomium of Helen and On Not Being, Gorgias of Leontinoi discusses the nature and function of speech more extensively than any other surviving author before Plato. His discussions are not only surprising in the way they characterize the power of logos and its effects on a listener but also in how the two descriptions of speech seem to contradict one another. In the Helen, Gorgias claims that logos is a very powerful entity, capable of affecting a listener in (...) whatever way it wants. In On Not-Being, he makes the very different (but no less exaggerated) claim that logos is a non-entity, incapable of referring to anything other than itself. In this essay I show how these apparently contradictory accounts might be brought into harmony with one another.2 In the first part I address some of the interpretive difficulties with the text of Gorgias’s On Not Being (henceforth ONB) and the role that irony plays in the work. In particular I argue (as others have before) that Gorgias’s remarks about the impotency of speech are not meant to be taken seriously. Instead, they are aimed more squarely at raising questions about how exactly speech is thought to function and, more specifically, how linguistic reference works—i.e., how words somehow correspond to things, on one level, and to our ideas about things, on another. In the second and third parts of this paper, I illustrate how Gorgias’s concern with linguistic reference in ONB goes on to inform his notion of logos in the Encomium of Helen. I point specifically to evidence found in an important and often overlooked exit clause at the close of ONB regarding the difference between words and things. There, Gorgias insists that if words manifest meaning at all, they must appeal to their own sort of sense organ. In the Helen, he draws on the concepts of soul (psychē) and opinion (doxa) in order to construct this alternative, psychagogic account in which utterances are actually apprehended in ways akin to sense perception. Whether or not one is convinced by Gorgias’s alternative account of how speech works, the description he gives of logos does notionally circumvent the problem of linguistic reference and, in doing so, pushes one to think beyond the potentially constrictive framework of nomen et nominatum. I argue that, when read in this way, these two early discussions of logos represent a unified progression of serious thought about how speech works. (shrink)

This article argues that the word ψυχαγωγία and its cognates which are found in the writings of Philodemus retain a semantic connection to the domain of magic and are best translated in terms of ‘enchantment’ rather than the more generic sense of ‘entertainment’.

A survey of employees at two Fortune 500 companies measures employee perception of their company’s public image based upon their corporate social responsibility and employee commitment to the organization. The study shows a statistically significant correlation between the independent and depend variables at the 0.01% CL.

California, Arizona, and several other states have recently legalized medical marijuana. My goal in this paper is to demonstrate that even if one grants the opponents of legalization many of their contentious assumptions, the federal government is still obligated to take several specific steps toward the legalization of medical marijuana. I defend this claim against a variety of objections, including the claims: that marijuana is unsafe, that marijuana cannot be adequately tested or produced as a drug, that the availability of (...) synthetic THC makes marijuana superfluous, and especially that legalizing medical marijuana will increase recreational use by ‘sending the wrong message ’. I then go on to argue that given the intransigent position of the federal government on this issue, state governments are justified in unilaterally legalizing medical marijuana as an act of civil disobedience. A large portion of this paper consists of an extensive response to the objection that legalizing medical marijuana will ‘send the wrong message ’– which I take to be the primary impediment to legalization. This objection basically claims that the consequences of withholding legalization (especially preventing increased recreational use) are superior to those of legalizing medical marijuana. I argue that legalization is justified even if one were to grant both that the harms of legalization outweighed its benefits and that utilitarianism is true. This requires a subtle and somewhat extended discussion of utilitarian moral and political theory. (shrink)

Moral theorists and game theorists are both interested in situations where rational agents are to constrain their future actions and co-operate with others instead of being free riders. These theorists have constructed a variety of hypothetical games which illuminate this problem of constraint. In this paper, I draw a distinction between like the Newcomb paradox and like Kavka's toxin puzzle, a prisoner's dilemma and Parfit's hitchhiker example. I then employ this distinction to argue that agents who subscribe to the orthodox (...) theory of rationality do significantly better in disposition games than those who subscribe to revisionist theories like David Gauthier's, while revisionist agents do marginally better in behaviour games. I argue that because of agents' ability to manipulate their own weakness of will, orthodox agents do better at all of these games than has previously been thought. And, by elucidating the distinction between behaviour games and disposition games, I uncover the virtues that underlie the success of each theory of rationality. (shrink)

An adequate moral theory must provide for cooperation and trust between moral agents, but a tension exists between cooperating and maximizing. This tension is prominent in utilitarianism and contractarianism. Various puzzles illustrate this tension, and both utilitarians and contractarians must solve these to present a coherent moral theory. These puzzles include new and resilient versions of classic objections to utilitarianism, such as the claims that utilitarian agents cannot be trusted to keep promises and cannot take rights seriously. They also include (...) the contractarian puzzle of why rational agents would cooperate by making and keeping impartial contracts. In solving these problems, utilitarians and contractarians alike must choose between traditional and revisionary maximizing theories. ;In light of these problems: David Gauthier urges contractarians to appeal to a revisionary theory of rationality, Donald Regan has developed a new variety of utilitarianism, and many other theorists still argue for the revisionary theory of rule utilitarianism. These people underestimate the potential of traditional theories. Although traditional theories like act utilitarianism look only to the future--while revisionary theories sometimes take prior acts such as promises, deliberations, and intentions to justify action--traditional theories are still able to solve these puzzles and furnish a satisfactory account of cooperation and trust. Surprisingly, even though these puzzles were developed as objections to the traditional theories and the revisionist theories were designed to deal with these puzzles, the traditional theories provide superior solutions. ;This defense of traditional theories has broad implications in philosophy and elsewhere, but I specifically discuss two significant implications for modern moral theory and two implications for applied ethics. I reject the criticism that act utilitarianism fails on its own terms and argue that it has previously unnoticed advantages over rule utilitarianism. I also reformulate Gauthier's moral theory using the traditional theory of rationality, thereby answering a major criticism of his theory. In addition, I apply my understanding of traditional maximizing theories to the utilitarian theory of rights and then to the strategic problems of nuclear deterrence and of threats in general. This 1994 study of 1,572 household interviews in five U S. cities found that consumers had a greater attraction to conducting business with companies regarded as doing something "good" for the community, as opposed to consumer decisions not to buy products or do business with companies regarded as taking part in activities that were detrimental to the community. Forty percent of the respondents reported that their purchasing decisions were strongly affected by a company's community relations program. Of these, women were (...) more responsive than men to patronizing businesses who were socially responsible. Highest mean scores went to those who reported that they lived in their respective communities "one year or less," suggesting that new residents look for good companies to do business with when moving into a new community.The findings of this study provide marketing evidence of a link between good corporate social responsibility and consumer behavior which has an effect upon the "bottom-line.". In this paper, we consider the way that web documents seeking to persuade readers of certain science claims provide information about the sources of the arguments. Our quantitative analysis reveals that web documents in our sample include hundreds of examples in which the reader is provided information regarding the trustworthiness of sources. The web documents also contain a large number of examples in which the reader is provided with information about how many individuals hold a particular belief. We discuss ad (...) hominem, ad verecundiam, and ad populum arguments, and the way that the examples found in our sample of documents are related to these argumentation schemes. (shrink)

This article examines the design and situated employment of reported `private thoughts' in both everyday and institutional interaction. By reported `private thoughts' we mean the `active voicing' of utterances characterized as `private thought' done in the first place for the speaker-feeler, rather than the listener. Examples are drawn from a large UK collection of over 240 instances from domestic telephone calls, interview talk, therapy sessions, and patient—provider interactions. Instead of treating reported `private thoughts' as neutral and transparent descriptions of the (...) inner mind, we focus on their `brought off ' nature. Drawing on the cumulative resources of conversation analysis and discursive psychology, we focus on lexical and non-lexical features of their design and its similarity to direct reported speech. We go on to illustrate the flexibilities of positioning reporting `private thoughts' affords, that is, how they can be done for the self as a `one-off ', as generalized or hypothetical and how they can be done for others. Our analyses draw attention to how `private thoughts' might be considered as a speaker's resource for handling everyday rational accountability in reporting and explaining actions and events. (shrink)
