Durch genomweite Analysen werden vielfältige gesundheitsrelevante Informationen über eine Person gewonnen. Solche Informationen können die Behandlung von Krankheiten verbessern. Sie ermöglichen aber auch Vorhersagen, ob eine Person und deren Verwandte in Zukunft möglicherweise erkranken werden. Der neuartige Charakter des Informationseingriffs und sein prädiktive Potential bedürfen der ethischen, juristischen und ökonomischen Reflexion, damit diese Technologie zum Wohl der Patienten, der Familienangehörigen und der Solidargemeinschaft eingesetzt werden kann. Die vorliegende Schrift leistet mit ihren interdisziplinären, vom BMBF finanzierten Analysen dazu einen Beitrag. Der Band versammelt Beiträge renommierter Vertreter unterschiedlicher Disziplinen zu der Frage, ob wir tatsächlich einen Zugang zur Wirklichkeit haben oder lediglich von unseren eigenen Konstruktionen der Wirklichkeit umgeben sind. In der Debatte kommt der Sprache eine zentrale Rolle zu. Konstruktivistische Positionen gehen davon aus, dass unsere Wörter und Sätze nie die Dinge an sich bezeichnen, sondern dies immer aus einer bestimmten Perspektive tun. Einer ‚Wirklichkeit an sich‘ nachzujagen, ist zwecklos, als wichtig gilt das Aufzeigen der Perspektiven. Nicht selten geschieht das (...) in aufklärerischer Absicht, wenn etwa Formulierungen wie die von der „Größe eines Volkes“, der „historischen Bestimmung einer Nation“ oder der „Natur des Geschlechts“ kritisch hinterfragt werden. Diesen Versuchen, die Wirklichkeit als interessengeleitet konstruierte auszuweisen, wird mit dem Argument begegnet, der Akt der Aufklärung diene letztlich nur dazu, die jeweils eigene Position als die ‚eigentlich richtige‘ durchzusetzen. Im Folgenden wollen wir nun die Theoriesprache wechseln und unter Anwendung des zuvor entwickelten Systems von Aussagen zum soziologischen Begriff des Rechts und der normativen Ordnung die zuvor dargestellten Merkmale der Scharia rekonstruieren. Wie im ersten Kapitel dargestellt wurde, ist der wissenschaftliche Diskurs über die Erforschung der Scharia von einem rechtswissenschaftlichen Orientalismus geprägt, also der Vorstellung, dass Scharia etwas Exotisches sei, das sich mit der Vorstellung eines „westlichen Rechts“ nicht sinnvoll erklären lasse, wobei sich mit dem Verweis auf eine füreinander (...) unerreichbare Kulturdifferenz die Ergebnislosigkeit der Forschung rechtfertigen lässt. Die Merkmale der Scharia werden in erster Linie der Literatur der Wissenschaftsgeschichte entnommen. Wie oben bereits erläutert, ist ein Rückgriff auf die Rechtsforschung, also die Rechtstatsachenforschung, nur sehr begrenzt möglich. Die bisher bekannte so genannte „traditionelle islamische Rechtwissenschaft“ hat, soweit überliefert, keine wissenschaftlich systematische Rechtsforschung betrieben.

Untersuchungsgegenstand ist das in der Wissenschaft und im Alltag populäre Argument „Scharia ist islamisches Recht“. Der Gebrauch der beiden Begriffe Scharia und Recht führt heute im Alltagsgebrauch kaum zu einem Erklärungsnotstand. Der Begriff Scharia ist für die meisten kein Fremdwort mehr.

Der hier zu erarbeitende Rechtsbegriff hat das Weltrecht im Blick. Dies ist unvermeidbar, da die Frage der Konvergenz von Scharia und Recht Gegenstand dieser Untersuchung ist und nicht schon der Rechtsvergleich. Denn dieser würde voraussetzen, dass der Gegenstand Scharia bereits als Recht qualifiziert worden ist.

Die Islamwissenschaft versteht und übersetzt den Begriff der Scharia (šarīʿa) gewöhnlich als das islamische Recht, in dessen Bedeutung der Begriff auch seinen Weg in die öffentlichen Debatten gefunden hat. Weil der Scharia bescheinigt wird, „der Innbegriff des echt islamischen Geistes, die entscheidendste Ausprägung des islamischen Denkens, der Wesenskern des Islams überhaupt“ zu sein, besitzt der Begriff eine zentrale Bedeutung für die Erforschung des Islams und der islamischen Welt. Die diesem Argument zugrunde liegenden theoretischen Vorannahmen beeinflussen daher einen Großteil der Forschung, (...) den Gang vieler empirischer Untersuchungen und nicht zuletzt auch die so gewonnenen wissenschaftlichen Erkenntnisse. Die unter Anwendung eines soziologischen Normen- und Rechtsbegriffs vorgenommene Rekonstruktion der Scharia hat Einsichten über ihr Verhältnis zum Recht zu Tage befördert, die sich weitgehend inkongruent zur herrschenden Narrative der Islamwissenschaft verhalten.

Fire setting is a significant problem for society, costing many human lives and causing great property damage. One important risk factor of fire setting observed in forensic samples is fire interest. However, less is known about the relationship of fire interest and fire setting to other variables such as personality traits in subclinical samples. In this study, we observed the relationship of potentially important personality traits with fire interest and fire setting in a sample of N = 222 students. In (...) addition to zero-order correlations, we calculated path models and a logistic regression including all predictor variables. From the Dark Tetrad, consisting of psychopathy, narcissism, Machiavellianism, and three facets of sadism, psychopathy, and physical sadism were found to be associated with fire interest and fire setting. Furthermore, vicarious sadism was associated with fire interest. The other Dark Tetrad traits and four sensation seeking facets did not substantially add to the predictions. This confirms the results of previous studies with clinical and forensic samples with psychopathy and sadism as relevant predictors for fire interest and fire setting. Our results also provide evidence for viewing sadism as the multidimensional construct discriminating between vicarious and other forms of sadism, for the distinction of psychopathy and Machiavellianism, and for the Dark Tetrad being linked to object related violence. In the general introduction to the first part of his Philosophie de la Volonté, Le volontaire et l’involontaire Paul Ricoeur writes that the phenomenological or ‘pure description […] of the Voluntary and the Involuntary’ is ‘constituted by bracketing’ two things: first the fault, which is essentially a perversion of the pure nature or the essence of human willing; and second ‘Transcendence which hides within it the ultimate origin of subjectivity’. Evil, the condition of brokenness or the reality of the (...) fault, asks for an empirical description of concrete myths and symbols. He will remove this first bracketing in the second part of his Philosophy of the Will and in the long ‘series of detours’ of his hermeneutical writings. The second bracketing, however, will turn out to be much more difficult to remove. It demands a ‘poetics’, which would threaten Ricoeur’s effort to separate his Christian faith from his ‘autonomous’ philosophizing. In this article I argue that Ricoeur eventually did present his poetics, though only in the epilogue to his penultimate book on ‘Difficult Forgiveness’. The article indicates why this epilogue might fulfil the promise of a poetics, explains why this could only be done in an epilogue and gives at least one possible reason why Ricoeur could write at the end of his oeuvre, what he could not at its beginning. _Killing Time_ is the story of Paul Feyerabend's life. Finished only weeks before his death in 1994, it is the self-portrait of one of this century's most original and influential intellectuals. Trained in physics and astronomy, Feyerabend was best known as a philosopher of science. But he emphatically was not a builder of theories or a writer of rules. Rather, his fame was in powerful, plain-spoken critiques of "big" science and "big" philosophy. Feyerabend gave voice to a radically democratic (...) "epistemological anarchism:" he argued forcefully that there is not one way to knowledge, but many principled paths; not one truth or one rationality but different, competing pictures of the workings of the world. "Anything goes," he said about the ways of science in his most famous book, _Against Method._ And he meant it. Here, for the first time, Feyerabend traces the trajectory that led him from an isolated, lower-middle-class childhood in Vienna to the height of international academic success. He writes of his experience in the German army on the Russian front, where three bullets left him crippled, impotent, and in lifelong pain. He recalls his promising talent as an operatic tenor (a lifelong passion), his encounters with everyone from Martin Buber to Bertolt Brecht, innumerable love affairs, four marriages, and a career so rich he once held tenured positions at four universities at the same time. Although not written as an intellectual autobiography, _Killing Time_ sketches the people, ideas, and conflicts of sixty years. Feyerabend writes frankly of complicated relationships with his mentor Karl Popper and his friend and frequent opponent Imre Lakatos, and his reactions to a growing reputation as the "worst enemy of science.". The search for the concept of Christian school leadership is an ongoing endeavour. The main issue is that the models developed lack a biblical foundation and do not reflect the context and issues of Indonesia. Therefore, the idea of Paul’s transformational leadership and the spatial-temporal education concept adopted from Wendell Berry’s theo-ecological perspective serve as alternative approaches worth considering. In this regard, the Tonaas and Walian leadership models in Minahasa have long been embedded in the local community and can (...) serve as a reference point for Paul’s transformational leadership and Wendell Berry’s ecological perspective. Ultimately, transformational leadership that is spatial-temporal and rooted in Minahasa traditions can serve as an alternative concept for leadership in the context of Christian education management in Indonesia. Contribution: The spatial-temporal transformational leadership model is relevant to education in Indonesia, integrating Christian, local, spiritual and ecological values. This approach aligns with the Minahasan leadership traditions, such as Tonaas and Walian, which emphasise balance between humanity, nature and spirituality. During the 1950s, the Eisenhower Administration used American religion in the global ideological war against Communism as a propaganda tool. Where genuine spirituality flourished, they contended, communist ideology would naturally be rejected. Thus, a host of efforts–both overt and covert–were undertaken to strengthen religious faith both in the United States and abroad. Recent studies of this government-sponsored religion have tended to focus on the most visible elected politicians and cabinet members who lauded American faith and encouraged inclusive religiosity. This article (...) takes a different approach, focusing primarily on several lesser-known promoters of religious anti-communism who worked closely with the Eisenhower Administration to translate public rhetoric into practice. It demonstrates that all were theologically astute intellectuals whose concepts of religion and American exceptionalism were shaped, in part, by Paul Tillich in different but significant ways. Their critical use of Tillich’s theological formulations presents a more nuanced picture of America’s religious cold warriors than is normally portrayed. I contend that, by examining these under-evaluated individuals, we gain a clearer understanding of the essence of American civil religion as it developed during the early Cold War. (shrink)

I explore some of the ways that assumptions about the nature of substance shape metaphysical debates about the structure of Reality. Assumptions about the priority of substance play a role in an argument for monism, are embedded in certain pluralist metaphysical treatments of laws of nature, and are central to discussions of substantivalism and relationalism. I will then argue that we should reject such assumptions and collapse the categorical distinction between substance and property.

Paul and Religion demonstrates the continuing and contemporary relevance of the most important, and most controversial, figure of early Christianity. Paul Gooch interrogates the Pauline writings for their meaning as well as implications for religion as an entire form of life, a stance on the world expressed in distinctive practices. The format of this Library of Living Philosophers volume differs from that of its fifteen predecessors. Because of Sartre's failing eyesight, it was not possible for him either to read the critical essays or to respond in the usual way to his critics. Nor did he feel able to prepare an autobiography. Thus, in order to collect the material needed for the volume, it was necessary to conduct personal taped interviews with Sartre and then to have those interviews translated, edited, (...) and arranged in an order that would approximate as closely as possible the customary format of the volumes in the Library of Living Philosophers series. Skillfully and conscientiously conducted, the interviews themselves resulted in a unique and valuable document. At the time they occurred, Sartre was in good health except for his near-blindness, and he answered questions in a lively and easy manner. Although he seemed most comfortable when talking autobiographically, he nevertheless responded to many of the philosophical questions raised by the contributors to this volume. (shrink)

Paul Thompson’s excellent book, From Field to Fork: Food Ethics for Everyone, argues that contemporary food ethics persistently ignores the nature and actual impact of GMOs, Concentrated Animal Feeding Operations, food aid to developing countries, and more. On Thompson’s view, such philosophical analyses must incorporate empirical knowledge. Additional strengths of Thompson’s book: its attention to quality-of-life issues, its openness to the concerns of the marginalized, and its emphasis on the interconnectedness of problems in food ethics. I raise one area (...) of disagreement with Thompson: his treatment of GMOs is, I argue, insufficiently skeptical. I suggest a three-fold revision of the book’s treatment of the precautionary principle, and I levy an additional argument against GMOs, the Inductive Argument. Using the herbicide Roundup as a case study of the ways in which industry urges the use of technologies that have not been fully vetted or monitored, I argue that products originally seen as safe often turn out instead to be harmful to the environment and health. Significant inductive experience with similar cases gives people additional reason to be even more suspicious of GMOs than Thompson suggests. (shrink)

Paul Elmer More's philosophy was self-styled ‘dualism’, and because developed initially from a student's enthusiasm instigated by a book on Manicheism, has often been misinterpreted. In this paper, on the basis of More's long development, I shall try to survey the nuances of his ‘dualism’ or ‘dualisms’, the various aspects of ‘dualism’ which he developed largely through case studies of thinkers of the past. In a significant way, to parody William James, the Shelburne Essays might well be called ‘The (...) Varieties of Dualistic Experience’, and of course for More ‘dualistic’ was virtually a synonym for ‘religious’. Out of these studies issued a Christian Platonism, or more precisely, a philosophy of the Incarnation, particularly in Christ the Word . The subsequent volume in a series called ‘The Greek Tradition: From the Death of Socrates to the Council of Chalcedon’ is The Catholic Faith . Although More called his dualism ‘absolute’, and it is sometimes presented as ‘absolute dualism’, the ‘sacramental idea’ at the heart of Christianity is said to rest ‘ultimately upon a dualistic conception of the world, in accordance with which matter and spirit are essentially distinct yet mutually interdependent. It implies on the one side that matter can be indefinitely adapted to spiritual uses, and on the other side that spirit requires now, and, so far as our knowledge and imagination reach, will always require the aid of some sort of corporeal instruments. It points to a divine purpose unfolding itself in a continuous process wherein the stuff of existence is…transmuted into an ever finer medium of order and beauty and righteousness and joy. (shrink)

Der protestantische Faschismus sowie das Konfliktfeld zwischen Katholizismus und faschistischer Ideologie werden auch (...) thematisiert.In the historiographical debates about the different streams of ideology in the first half of the 20th century, the term “Catholic fascism” has been used on occasion to refer to a specific version of fascism and Catholicism in the 1920s, 1930s and 1940s. The following article analyzes this concept in historical and historiographical perspective, drawing attention to the religious background, the various conceptual distinctions, key events and ideological interrelationships. Protestant fascism is also addressed along with the ideological conflict between Catholicism and fascist ideology.
