BackgroundIn December 2014, China announced that only voluntarily donated organs from citizens would be used for transplantation after January 1, 2015. Many medical professionals worldwide believe that China has stopped using organs from death-row prisoners.DiscussionIn the present article, we briefly review the historical development of organ procurement from death-row prisoners in China and comprehensively analyze the social-political background and the legal basis of the announcement. The announcement was not accompanied by any change in organ sourcing legislations or regulations. As a (...) fact, the use of prisoner organs remains legal in China. Even after January 2015, key Chinese transplant officials have repeatedly stated that death-row prisoners have the same right as regular citizens to “voluntarily donate” organs. This perpetuates an unethical organ procurement system in ongoing violation of international standards.ConclusionsOrgan sourcing from death-row prisoners has not stopped in China. The 2014 announcement refers to the intention to stop the use of organs illegally harvested without the consent of the prisoners. Prisoner organs procured with “consent” are now simply labelled as “voluntarily donations from citizens”. The semantic switch may whitewash sourcing from both death-row prisoners and prisoners of conscience. China can gain credibility only by enacting new legislation prohibiting use of prisoner organs and by making its organ sourcing system open to international inspections. Until international ethical standards are transparently met, sanctions should remain. (shrink)

Through postcolonial studies, indigenous perspectives are finally being heard, challenging various Western views of the world. However, these challenges are often made in the same moralizing voice as the original conlonizations were justified. In keeping with the moralizing-resistant perspectives of Foucault, Benjamin and Derrida The Politics of Moralizing issues a warning about the risks of speaking, writing and thinking in a manner too confident about you own judgments. Can a clear line be drawn between dogmatism and simple certainty and indignation? (...) This collection starts by questioning what has become a popular, even pervasive, cultural narrative told by both the left and the right-the story of the West's moral decline, degeneration or confusion. Beyond declaiming the perils of this approach, each essay goes on to experiment with strategies for warding off moralistic tendencies and effects within our own texts and actions. Contributors even explore the dynamics and dilemmas of moralizing by advocates of liberal causes, including patriotism, environmental protection and women's rights. In a reading of Christopher Nolan’s film Oppenheimer, the essay features a cinematic historiography of the creation of the bomb dropped on Hiroshima. The emphasis is on the role of sound in the film and the interaction of careers, both scientific and military. Much of the analysis is concerned with the contingencies through which Oppenheimer consummated a process that ended in an atrocity: his relationship to Judaism, his love of New Mexico, his aspiration to do applied physics, and his meetings (...) with military officers. Writing Politics is a methods book designed to instruct on politically focused literary inquiry. Exploring the political sensibilities that arise from the way literary fiction re-textualizes historical periods and events, the book features a series of violence-themed inquiries that emphasize forms of writing as the vehicles for politically attuned historiography. Each investigation treats the way the literary genre, within historiographic metafiction, enables political inquiry. It's a form of writing that inter-articulates history and fiction to rework a textual past and unsettle (...) dominant understandings of events and situations. Central to the diverse chapters are fictional treatments of authoritarian, fascist, or zealous mentalities. Featured, for example, are Radovan Karadzic, Reinhard Heydrich, and the Trotsky assassin Ramon Mercader. Michael J. What do we know about war crimes and justice? What are the discursive practices through which the dominant images of war crimes, atrocity and justice are understood? In this wide ranging text, Michael J. Shapiro contrasts the justice-related imagery of the war crimes trial with literary justice: representations in literature, film, and biographical testimony, raising questions about atrocities and justice that juridical proceedings exclude. This innovative volume, by Michael Shapiro, is not about Adam Smith in the sense in which 'about' is usually understood, for it is neither a comprehensive explication of his views nor a careful tracing of the sources of them. Instead it is a confrontation. This is a book about modernity whose vehicle is a reading of Adam Smith—it is an enactment of the convention that despite the contribution Smith made to creating and legitimating the conceptual space for modern, commercial, liberal, (...) and democratic society, his views are inadequate for those who want an effective, politicized understanding of the present. Shapiro's ultimate goal in this examination is to 'exemplify a way of doing political theory—one that challenges some traditional ways of constructing and celebrating the 'political theory cannon.'. Technologies are being developed for significantly altering the traits of existing persons (or fetuses or embryos) and of future persons via germ line modification. The availability of such technologies may affect our philosophical, legal, and everyday understandings of several important concepts, including that of personal identity. I consider whether the idea of personal identity requires reconstruction, revision or abandonment in the face of such possibilities of technological intervention into the nature and form of an individual's attributes. This requires an account (...) of the work done by the concept of personal identity, and an explanation of what “conceptual impacts of technology” and “conceptual reconstruction” might mean. Our existing notions of personal identity and related ideas such as personhood and autonomy may seem unable to comfortably accommodate the possibilities of technologically directed trait formation and development. This is a matter of moral and legal importance because the idea of personal identity embeds major values and reflects value-laden beliefs and attitudes. The assumed endurance of identity underlies interpersonal relationships, the assignment of rewards and punishments, and the very idea of what constitutes an autonomous person. Perhaps radical restructuring or even abandonment of concepts are sometimes called for when the world changes drastically, but I suggest that conceptual modification is not “compelled” for personal identity except under extreme circumstances—the remote possibility of rapid human “shape shifting” where physical and mentational attributes can be transformed quickly and continuously. Efforts to enhance human traits, including merit attributes and other resource-attractive characteristics (e.g., intellectual and athletic aptitudes, physical size and appearance), may generate legal problems wherever the persistence of identity is presupposed. Some advance speculation is thus warranted on how trait change generally will be managed within our legal and socioeconomic systems, and more particularly on rights of access to trait-altering technologies. I mention the possible distributive effects of enhancing highly-resource attractive traits, including the strengthening individual powers to acquire still more increments in such traits in a self-reinforcing cycle. A brief review of some constitutional issues bearing on trait change completes the discussion. I conclude that existing and projected technologies do not impel the abandonment or remodeling of the idea of personal identity. We may, however, have to reconsider some uses of this concept in different settings, to rethink our understandings of ideas of merit and desert, and to deal with the distribution of resources that may enlarge and entrench the “distances” between social and economic groups. In this essay I stage an encounter between Hobbes’s Leviathan and two versions of the “The Werckmeister Harmonies” (a chapter in Laszlo Krasznahorkai’s novel The Melancholy of Resistance [1998] and a film version of the story by the director Bela Tarr [2000]). The story contains a number of Hobbes icons, for example, an enormous stuffed whale and a “Prince,” both of which arrive with a circus that comes to a Hungarian town and precipitates fear and chaos. I argue that the (...) story thinks (differently within the two genres) both with and against Hobbes, enabled by Hobbes’s aesthetic style (which I elaborate) while at the same time challenging the historical prescience of his political philosophy. Sorting the diverse ontologies of the story’s main characters helps us better appreciate Hobbes as a writer and distance ourselves from Hobbes’s solution to political disorder. (shrink)
