Trenton Merricks has recently argued that substance dualist accounts of embodiment and humanness do not cohere well with the Incarnation. He has also claimed that physicalism about human persons avoids this problem, which should lead Christians to be physicalists. In this paper, I argue that there are plausible dualist accounts of embodiment and humanness that avoid his objections. Furthermore, I argue that physicalism is inconsistent with the Incarnation.

The Incarnation is the doctrine that the second person of the Trinity (SPT) became fully human while remaining fully divine. An orthodox model of the Incarnation must maintain the omnipotence and omniscience of SPT throughout the period of humiliation. Concretists tend to think of the Incarnation in mereological terms, claiming that SPT came to stand in a mereological relation to a particular human being. As an animalist, Trenton Merricks claims that at the point of Incarnation, SPT became an animal, a (...) composite material object. To adapt a frequent comment of Plantinga's, “Materialism is all the rage these days”. This is true even among Christian theologians and philosophers more elaborate versions and defenses of materialist Christology in the future. Nevertheless, these projects are misguided. The Incarnation, the central doctrine of the Christian faith, is a very poor fit with materialism. It fits quite well with Cartesian dualism, however, so Christians should be dualists. (shrink)

Many have thought that there is a problem with causal commerce between immaterial souls and material bodies. In Physicalism or Something Near Enough, Jaegwon Kim attempts to spell out that problem. Rather than merely posing a question or raising a mystery for defenders of substance dualism to answer or address, he offers a compelling argument for the conclusion that immaterial souls cannot causally interact with material bodies. We offer a reconstruction of that argument that hinges on two premises: Kim’s Dictum (...) and the Nowhere Man principle. Kim’s Dictum says that causation requires a spatial relation. Nowhere Man says that souls can’t be in space. By our lights, both premises can be called into question. We’ll begin our evaluation of the argument by pointing out some consequences of Kim’s Dictum. For some, these will be costs. We will then present two defeaters for Kim’s Dictum and a critical analysis of Kim’s case for Nowhere Man. The upshot is that Kim’s argument against substance dualism fails. (shrink)

In their recent article, Graber and Golemon (_Sophia_ 1–18, 2019 ) argue that any attempted evolutionary debunking of naturalism faces a dilemma. First, in order to be evolutionarily plausible, the skeptical implications must not be too broad. Second, in order to constitute a genuine challenge to scientific realism, the skeptical implications must not be too narrow. Graber and Golemon further develop an evolutionary debunking argument that avoids both horns of this dilemma. De Ray (_Erkenntnis_ 1–21, 2020 ) criticizes Graber and (...) Golemon’s debunking argument then develops his own, competing debunking argument. We first respond to de Ray’s criticisms by showing how Graber and Golemon’s argument can be extended so as to avoid de Ray’s critique. We then show that de Ray’s argument debunking argument is impaled by both horns of Graber and Golemon’s dilemma. The ultimate result will be both a better understanding of the desiderata and the argumentative contours of a successful evolutionary debunking argument. (shrink)

The best arguments for a nation-state’s right to exclude unwanted outsiders actually condemn nation-level regimes of restriction. Two argumentative steps lead to this conclusion. The first points out that the best arguments for exclusion generalize: if they show that nation-states have the right to exclude, they perform the same service for a great many towns, cities, subnational states, and provinces. The second step constructs a dilemma. The right to exclude is important enough to justify the suffering of would-be immigrants, or (...) it is not. If it is, the right to exclude is very important indeed–would-be immigrants often suffer grievously. But nation-level regimes would then be a serious moral problem: they would deprive a great many municipalities of a right that matters a great deal. Turning to the dilemma’s second horn, if the right to exclude is not important enough to justify the suffering of would-be immigrants, nation-level regimes are straightforwardly immoral. Either way, we arrive at this paper’s central thesis: the best arguments for a nation-states right to exclude actually condemn nation-level regimes of exclusion. (shrink)

Philosophers have spent a great deal of time debating whether intransitive preferences can be rational. I present a risky decision that poses a challenge for the defender of intransitivity. The defender of intransitivity faces a trilemma and must either: (i) reject the rationality of intransitive preferences, (ii) deny State‐wise Dominance, or (iii) accept the bizarre verdict that you can be required to pay to relabel the tickets of a fair lottery. If we take the first horn, then we have (...) a synchronic refutation of intransitivity, an improvement on widely criticized diachronic arguments. I sketch possible responses that may rescue intransitivity and argue that each response is possible but generates an explanatory debt. I conclude by showing how the challenge here clarifies the foundations of decision theory without transitivity, conditional on some explanatory debt being payable. (shrink)

Background In the UK, the solidaristic character of the NHS makes it one of the most trusted public institutions. In recent years, the introduction of data-driven technologies in healthcare has opened up the space for collaborations with private digital companies seeking access to patient data. However, these collaborations appear to challenge the public’s trust in the. Main text In this paper we explore how the opening of the healthcare sector to private digital companies challenges the existing social contract and the (...) NHS’s solidaristic character, and impacts on public trust. We start by critically discussing different examples of partnerships between the NHS and private companies that collect and use data. We then analyse the relationship between trust and solidarity, and investigate how this relationship changes in the context of digital companies entering the healthcare system. Finally, we show ways for the NHS to maintain public trust by putting in place a solidarity grounded partnership model with companies seeking to access patient data. Such a model would need to serve collective interests through, for example, securing preferential access to goods and services, providing health benefits, and monitoring data access. Conclusion A solidarity grounded partnership model will help establish a social contract or licence that responds to the public’s expectations and to principles of a solidaristic healthcare system. On 26 February 2020, the German Constitutional Court rejected a law from 2015 that prohibited any form of ‘business-like’ assisted suicide as unconstitutional. The landmark ruling of the highest federal court emphasised the high priority given to the rights of autonomy and free personal development, both of which constitute the principle of human dignity, the first principle of the German constitution. The ruling echoes particularities of post-war Germany’s end-of-life debate focusing on patient self-determination while rejecting any discussion of active assistance (...) to die through a lethal injection administered by a doctor. For over four decades feminist linguists and philosophers of language have addressed the semantic, cognitive, and political factors associated with gender asymmetries in nominal and pronominal choice. The sociolinguistic spotlight has focused on the history, extent, and implications of the prescriptively sanctioned use of man and he for sex-neutral reference—he/man language in Martyna ’s term. Bare singular and simple indefinite man in exemplify this use, while the bare singulars in yield the male-specific meaning exhibited by the man or that man.

Pragmatic comparative effectiveness randomized controlled trials evaluate the effectiveness of one interventions under real-world clinical conditions. The results of ceRCTs are often directly generalizable to everyday clinical practice, providing information critical to decision-making by patients, clinicians, and healthcare policymakers. The PRECIS-2 framework identifies nine domains that serve to score a trial on a continuum between very explanatory to very pragmatic. Solidarity has for a long time been referred to as the core value underpinning European health and welfare systems. But there has been debate in recent years about whether solidarity, with its alleged communitarian content, can be reconciled with the emphasis on individual freedom and personal autonomy. One may wonder whether there is still a place for solidarity, and whether the concept of justice should be embraced to analyse the moral issues regarding access to health care. In this article, I (...) will answer this question by analysing the normative foundations of the concept of justice, followed by a deeper examination of the concept of solidarity in continental philosophy. More specifically, I will compare the philosophical traditions rooted in Kant to approaches rooted in Hegel. In addition, I will present the work of Avishai Margalit on the decent society to criticize a predominantly liberal approach to access to health care. The importance of solidarity lies particularly in its emphasis on relational aspects and the role of recognition in care practices, which are usually ignored in liberal approaches to justice. However, the article will argue that solidarity is not an alternative to a rights-based concept of justice, but must be considered as a necessary complement to it. (shrink)

In this short response, I agree with Cavaliere’s recent invitation to consider ectogenesis, the process of gestation occurring outside the body, as a political perspective and provocation to building a world in which reproductive and care labour are more justly distributed. But I argue that much of the literature Cavaliere addresses in which scholars argue that artificial wombs may produce greater gender equality has the limitation of taking a fixed, binary and biological approach to sex and gender. I argue that (...) in taking steps toward the possibility of more just practices of caregiving and family making, we must look first not to artificial womb technologies but to addressing the ways that contemporary legal and social practices that enforce essentialising, binary ways of thinking about reproductive bodies inhibit this goal. In 2016, a law came into force in France granting terminally ill patients the right to continuous deep sedation (CDS) until death. This right was proposed as an alternative to euthanasia and presented as the ‘French response’ to problems at the end of life. The law draws a distinction between CDS and euthanasia and other forms of sympton control at the end of life. France is the first country in the world to legislate on CDS. Addresses issues that emerged as result of research in pragmatics proper and neighboring fields such as cognitive psychology, philosophy, bilingualism and communication. This book discusses theoretical and empirical work in these paradigms which directed attention to questions that warrant reexamination and revision of some tenets of the field.

The word “populism” commonly elicits images of hordes of angry townspeople with pitchforks and torches. That is the classic picture of “the mob,” bolstered by countless movie and television productions, and it is clearly based on such historical events as the English civil wars, the sans-culottes’ terror, the Bolshevik revolution, and the recent genocides in Rwanda and Burundi. Many of the leaders involved in fostering such horrors are seen as radical democrats whose successors today should also be feared. In this (...) paper, I argue that any mob takeovers of the feared sort are actually antithetical to radical democracy. This is because an authentically democratic regime, even of the most extreme type, is necessarily inconsistent with “mobocracy” or any sort of “tyranny of the majority” given its essential procedural aspects. It is argued, in fact, that leaders of legitimately democratic movements have generally been quite vapid because of the fallibilistic, plebiscitary proceduralism inherent in any authentic attempt to require government policy to reflect the “general will.” And this vapidity is argued to inhere regardless of the extent of rhetorical powers of the advocate or advocacy. Werner Jaeger (1888–1961) was at his time the most brilliant and the most influential German classicist. His most important project was a tripartite study that he finally published under the title of Paideia. Die Formung des griechischen Menschen (1933–1947). Paideia was much more than a detailed scholarly book on pedagogy in the ancient world. It was an attempt to interpret the history of ancient thought—from Homeric epics to Attic tragedy and Platonic philosophy—as rooted in the intention to educate (or rather (...) to ‘form’) human beings. And it was the attempt to contribute to a contemporary German movement called ‘Third Humanism’. In this article, I give a critical overview of this work, its strengths and its shortcomings. (shrink)

Kant formuliert nirgends ein individuelles Recht auf Leben, auf körperliche und psychische Integrität, auf Eigentum, Meinungsfreiheit, Religionsfreiheit, Freizügigkeit usw. Wenn es aber zutrifft, dass Kant keine Konzeption der Menschenrechte in unserem modernen Sinn besitzt, stellt sich die Frage nach den Gründen. Im vorliegenden Aufsatz wird gezeigt, dass sich auch der Versuch, ein Kantisches Menschenrecht im „angeborenen Recht auf Freiheit“ zu identifizieren, als aussichtslos erweist (I.). Sodann wird eine Erklärung dafür angeboten, weshalb es verfehlt ist, von Kant eine Konzeption der Menschenrechte (...) überhaupt zu erwarten (II.). Diese Erklärung beruht auf zwei Punkten: (a) Kant wählt seinen theoretischen Ausgangspunkt bei den Pflichten, nicht bei den Rechten; und (b) er fasst das Haben von Rechten nicht als die Zusicherung oder Gewährleistung bestimmter moralischer Güter für das Individuum auf. Und schließlich (III.) wird der pflichtentheoretische Rechtsbegriff Kants näher charakterisiert, auf dem sein ‚deontologischer Liberalismus‘ beruht. In spite of the intuitiveness of epistemic closure, there has been a stubborn stalemate regarding whether it is true, largely because some of the “Moorean” things we seem to know easily seem clearly to entail “heavyweight” philosophical things that we apparently cannot know easily—or perhaps even at all. In this paper, I will show that two widely accepted facts about what we do and don’t know—facts with which any minimally acceptable understanding of knowledge must comport—are jointly inconsistent with the truth (...) of CLR. The proof works by supposing the truth of “Categorialism,” a thesis about the relation between basic categories and common nouns and predicates, which is itself a heavyweight claim that cannot be easily known to be either true or false. A growing body of scholarship argues that by disentangling gestation from the body, artificial wombs will alter the relationship between men, women, and fetuses such that reproduction is effectively ‘degendered’. Scholars have claimed that this purported ‘degendering’ of gestation will subsequently create greater equity between men and women. I argue that, contrary to the assumptions made in this literature, it is law, not biology, that acts as a primary barrier to the ‘degendering’ of gestation. With reference to contemporary case law (...) involving disputes over frozen embryos, I demonstrate that though reproductive technologies have already made it possible for gendered progenitors to have an ‘equal’ say in gestation, law mires the possibilities of these technologies in traditional stories of gendered parenthood. Looking to the way binary assumptions about gender limit the self-determination of trans men and nonbinary and genderqueer people who are gestational parents, I argue the ‘degendering’ of gestation will come not with artificial wombs but with the end of limited legal paradigms for gendered gestational parenthood. Many philosophers have argued that moral disagreement raises metaphysical and/or epistemological challenges for moral realism. In this paper, I consider whether widespread moral disagreement raises a different sort of challenge by threatening the semantic commitments of moral realism. In particular, I suggest that the character of many moral disagreements gives us reason to suspect that not all competent moral speakers pick out the same properties as one another when they use moral terms. If this is so, both sides of a (...) moral dispute may speak truly, and the standard realist diagnosis of such disputes—that at most one party can be correct—is mistaken. My argumentative strategy is to first isolate some features of linguistic exchanges that provide evidence of a lack of co-reference, and then argue that many moral disputes have these features. I conclude by suggesting that there are plausible accounts of moral disputes that do not require co-reference. (shrink)

The ethics of the Flexibility In duty hour Requirements for Surgical Trainees trial have been vehemently debated. Views on the ethics of the FIRST trial range from it being completely unethical to wholly unproblematic. The FIRST trial illustrates the complex ethical challenges posed by cluster randomised trials of policy interventions involving healthcare professionals. In what follows, we have three objectives. First, we critically review the FIRST trial controversy, finding that commentators have failed to sufficiently identify and address many of the (...) relevant ethical issues. The 2012 Ottawa Statement on the Ethical Design and Conduct of Cluster Randomized Trials provides researchers and research ethics committees with specific guidance for the ethical design and conduct of CRTs. Second, we aim to demonstrate how the Ottawa Statement provides much-needed clarity to the ethical issues in the FIRST trial, including: research participant identification; consent requirements; gatekeeper roles; benefit-harm analysis and identification of vulnerable participants. We nonetheless also find that the FIRST trial raises ethical issues not adequately addressed by the Ottawa Statement. Hence, third and finally, we raise important questions requiring further ethical analysis and guidance, including: Does clinical equipoise apply to policy interventions with little or no evidence-base? Do healthcare providers have an obligation to participate in research? Does the power-differential in certain healthcare settings render healthcare providers vulnerable to duress and coercion to participant in research? If so, what safeguards might be implemented to protect providers, while allowing important research to proceed? (shrink)

It is customary to think that Objective List (“OL), Desire-Satisfaction (“D-S”) and Hedonistic (“HED”) theories of prudential value pretty much cover the waterfront, and that those of the three that are “subjective” are naturalistic (in the sense attacked by Moore, Ross and Ewing), while those that are “objective” must be Platonic, Aristotelian or commit the naturalist fallacy. I here argue for a theory that is both naturalistic (because voluntaristic) and objective but neither Platonic, Aristotelian, nor (I hope) fallacious. In addition, (...) this proposal, called “CHOICE,” is an example of neither an OL, D-S, nor HED theory. It is a theory according to which uncoerced choosings create objective values that we (even everyone) may be wrong about, because valuations are conative rather than epistemic activities. On this view, intrinsic prudential goods necessarily involve likely (pursuant to lawlike regularities) net increases in successful free choosings . (shrink)

Die Art und Weise, wie Tiere in der Antike im allgemeinen Bewusstsein betrachtet wurden und wie man sie faktisch im Alltag behandelt hat, divergiert ganz erheblich von unseren eigenen landläufigen Auffassungen.

Homer'sIliadis an epic poem full of war and battles, but scholars have noted that ‘[t]he Homeric poems are interested in death far more than they are in fighting’. Even though long passages of the poem, particularly the so-called ‘battle books’ (Il.Books 5–8, 11–17, 20–2), consist of little other than fighting, individual battles are often very short with hardly ever a longer exchange of blows. Usually, one strike is all it takes for the superior warrior to dispatch his opponent, and death (...) occurs swiftly. The prominence of death in Homeric battle scenes raises the question of how and in which terms dying in battle is being depicted in theIliad: for while fighting can be described in a straightforward fashion, death is an abstract concept and therefore difficult to grasp. Recent developments in cognitive linguistics have ascertained that, when coping with difficult and abstract concepts, such as emotions, the human mind is likely to resort to figurative language and particularly to metaphors. In Norway, priority for health interventions is assigned on the basis of three official criteria: health benefit, resources, and severity. Responses to the COVID-19 pandemic have mainly happened through intersectoral public health efforts such as lockdowns, quarantines, information campaigns, social distancing and, more recently, vaccine distribution. The aim of this article is to evaluate potential priority setting criteria for public health interventions. We argue in favour of the following three criteria for public health priority setting: benefit, resources and improving the (...) well-being of the worse off. We argue that benefits and priority to the worse off may reasonably be understood in terms of individual well-being, rather than only health, for public health priority setting. ZusammenfassungIn this article, I defend a version of moral constitutivism that is based on a theory of goods. It is inspired by ancient philosophy both in claiming that action theory should be formulated in teleological terms and in the idea that a sound theory of goods should be a eudaemonist one. Additionally I argue that morality can be understood on the basis of such an approach.

Some defenders of legal abortion claim that even if the human fetus is a human being with the same right to life as an adult, abortion is not necessarily morally impermissible. They argue that abortion can be considered a form of indirect killing that results from the refusal to provide life support through one’s own body, which another person has no right to receive. While Catholic moral theology does not require people to donate organs against their will, this principle does (...) not justify direct abortion. (shrink)

This is a review of Lee Drutman's recent book endorsing multi-party democracy in America.

Background: The Parkinsonian [i.e., Parkinson's disease ] gait disorder represents a therapeutical challenge with residual symptoms despite the use of deep brain stimulation of the subthalamic nucleus and medical and rehabilitative strategies. The aim of this study was to assess the effect of different DBS modes as combined stimulation of the STN and substantia nigra and environmental rehabilitative factors as footwear on gait kinematics.Methods: This single-center, randomized, double-blind, crossover clinical trial assessed shod and unshod gait in patients with PD with (...) medication in different DBS conditions during different gait tasks and compared gait characteristics to healthy controls. Notably, 15 patients participated in the study, and 11 patients were analyzed after a dropout of four patients due to DBS-induced side effects.Results: Gait was modulated by both factors, namely, footwear and DBS mode, in patients with PD. Footwear impacted gait characteristics in patients with PD similarly to controls with longer step length, lower cadence, and shorter single-support time. Interestingly, DBS exerted specific effects depending on gait tasks with increased cognitive load. STN+SN DBS was the most efficient DBS mode compared to STIM OFF and STN DBS with intense effects as step length increment during dual task.Conclusion: The PD gait disorder is a multifactorial symptom, impacted by environmental factors as footwear and modulated by DBS. DBS effects on gait were specific depending on the gait task, with the most obvious effects with STN+SN DBS during gait with increased cognitive load. (shrink)

In light of the already-here disasters of the Anthropocene, what might it mean to define “ground” phenomenologically? That is, if one is to get beyond the ‘merely rational’ and enter into the ‘dustier’ matters of ecological philosophizing, how might one phenomenologically consider the ground? This article will dwell on the nature of the earth-ground—or, soil—as a rematerialized grounding principle for phenomenology in this age of climate crisis. Contending with Heidegger, among others, this poietic article limns possibilities for a ‘grounded’ phenomenology.

Considering his status as the best fighter on the Trojan side, Hector’s flight in “Iliad” 22.131-7 is unexpected and surprising, even though Hector is never overtly reproached for his reaction. This article proposes a psychological explanation for Hector’s behaviour, drawing on recent insights concerning combat stress reaction (CSR) and post-traumatic stress disorder (PTSD): Hector does not flee from fear of death, but from the “Wind of Hate”, i. e. the terror felt when confronted with direct and personal aggression. An examination (...) of the actions of Achilles in the “Iliad” supports this conclusion, for Achilles exhibits behaviour which would qualify for a diagnosis of antisocial personality disorder. The intense personal hatred of Achilles is sufficient to shock Hector into flight, even if he ultimately recovers and heroically faces Achilles in battle. Thus, the scene bears testimony to the “Iliad”’s understanding of the universal human experiences of warfare and aggression. (shrink)

In the epistemology of his middle period, Plato repeatedly describes the alleged ‘intellection of true reality’ in terms of sight, vision, illumination, or touch. Does this show more than Plato’s preference for optic and haptic metaphors? Should we assume that this goes back to a specific reason to be found in his underlying epistemological position? On the traditional reading, Plato actually wants to defend a sort of intuitionism. According to this still wide-spread reading, he claims that there is a very (...) particular way of grasping Forms: Philosophers manage to come into a sort of direct contact with intelligible objects. Intellection is thus conceived as a quasi-visual presence of intelligible Forms. In our contribution, we want to challenge this interpretation by raising several objections against it. Surprisingly, there exists a close parallel in Aristotelian scholarship: Although Aristotle’s epistemology is built on considerably different foundations, there is an interpretative tradition according to which one has to assume a strict discontinuity between the methodical procedure and the intellection of the highest epistemic objects. As for Plato, we want to refuse an interpretation of Aristotle based on a concept of intuition characterized by the following features: Intuition is a specific way of gaining knowledge. It is independent of empirical conditions and leads to apriori knowledge. It consists of some experience of evidence or is accompanied by it. Knowledge gained by this kind of intuition does not need any further argument or justification. (shrink)

Vor dem Hintergrund der aktuellen Frage nach einer angemessenen Einladungspolitik für akademische Veranstaltungen wird zunächst betont, dass das Recht auf freie Meinungsäußerung zum absoluten Kern jeder liberalen politischen Ordnung gehört. Seine Wahrnehmung unterliegt jedoch zugleich klaren Bedingungen und weist Legitimitätsgrenzen auf. Im vorliegenden Artikel werden fünf solche Bedingungen genereller Art formuliert, nämlich ein a) Moralitätskriterium, b) ein Reziprozitätskriterium, c) ein Legalitätskriterium, d) ein republikanisches Gemeinwohlkriterium und e) ein Relevanzkriterium. Es folgen weitere sechs Kriterien für die Limitierung des wissenschaftstypischen Gebrauchs von (...) Meinungsfreiheit: f) das Sozialisationskriterium, g) das Expertisekriterium, h) das Einschlägigkeitskriterium, i) das Methodenkriterium, j) das Qualitätskriterium und k) das Objektivitätskriterium. Illiberale Positionen werden sodann als solche definiert, die das Prinzip des Vorrangs der Grundfreiheiten nicht anerkennen. Schließlich stelle ich Überlegungen zum Toleranzbegriff mit dem Ergebnis an, dass gegenüber illiberalen Positionen Toleranz in der Regel nicht angemessen ist. (shrink)
