Despite claims of ‘evidence based policy’, the place of empirical evidence in family law reform is ambiguous. There is ongoing socio-legal analysis of the differential value and uses of quantitative data and anecdote in detailing women’s experiences and advocating for change. In this paper, we engage with these issues through a focus on how data were constructed in a key government report, Every Picture Tells a Story, which was used to officially define the problem and outline recommendations in the controversial (...) 2006-08 reform of the Australian Child Support Scheme. Our discussion focuses on two questions: what legitimacy is accorded to different kinds of evidence in family law reform processes?; and, how is this legitimacy gendered? We applied feminist critical discourse analysis to the type, source and claims of the data included in the child support chapter of the report. Our findings indicate that both quantitative data and anecdote were used to privilege fathers’ financial interests and autonomy; in contrast, women’s voices and interests were marginalised. Thus, we argue the legitimacy of data is ascribed through its relationship to the gendered definition of the ‘problems’ of child support, rather than the type of data per se. (shrink)

Views of self (using Gilligan's paradigm) and of the Christian God (using a similar, newly-developed paradigm) were explored in 44 first-year and senior Christian college students. Men aligned with a self-ethic of justice; women, more often with justice than predicted. Moral voice thus appears contextually dependent, contrary to Gilligan's earlier predictions. Senior students integrated both views of self, but not both views of God, more often than first-year students. This suggests that the Christian liberal arts context nurtures integrated and complex (...) views of the self, but authoritative views of God. All but one student described God as authoritative; most did not see God as relational. This preference for authoritative views of God perhaps shaped the heavy justice self-ethic. Consistent with earlier findings, justice views of the self were generally elicited by impersonal dilemmas; authoritative views of God, in contrast, were equally associated with both impersonal and personal dilemmas. The recent “turn to matter” evident in material feminist theories of the more‐than‐human world offers distinct posthuman understandings of the world as continuously relationally entangled, emergent or materializing. In this paper, I consider how these premises both trouble conventional understandings of matter and/or materials, but likewise potentially revise and revitalize understandings of the political for health and inequalities, and for nursing. This is both timely and much needed given contemporary contexts of austerity‐driven neoliberalism in health care and the unprecedented growth (...) in disparities of wealth and well‐being. I wish to explore whether material feminisms allow us to retheorize connections between abstract theory and material concerns like health and inequalities, differently. This is not theory in opposition to practice or activism, but theory conceptualized as sets of entangled emergent practices, but also what constitutes the political, as more fully relational to and in praxis with health‐related activism. I will argue these theories further justify how practitioners can visibly care for and care more about social and health inequalities. Drawing mainly on the work of material feminist, Karen Barad, and her bringing together of queer and feminist theory, as well as feminist new materialisms and understandings of posthumanism, I discuss how this turn to matter together with meaning might transform understandings of health and inequalities. I outline some of my work and results on my matter-gravity entanglement hypothesis, according to which the entropy of a closed quantum gravitational system is equal to the system’s matter-gravity entanglement entropy. The main arguments presented are: that this hypothesis is capable of resolving what I call the second-law puzzle, i.e. the puzzle as to how the entropy increase of a closed system can be reconciled with the asssumption of unitary time-evolution; that the black hole information loss puzzle may be (...) regarded as a special case of this second law puzzle and that therefore the same resolution applies to it; that the black hole thermal atmosphere puzzle can be resolved by adopting a radically different-from-usual description of quantum black hole equilibrium states, according to which they are total pure states, entangled between matter and gravity in such a way that the partial states of matter and gravity are each approximately thermal equilibrium states ; that the Susskind–Horowitz–Polchinski string-theoretic understanding of black hole entropy as the logarithm of the degeneracy of a long string cannot be quite correct but should be replaced by a modified understanding according to which it is the entanglement entropy between a long string and its stringy atmosphere, when in a total pure equilibrium state in a suitable box, which ) goes over, at strong-coupling, to a black hole in equilibrium with its thermal atmosphere. The modified understanding in is based on a general result, which I also describe, which concerns the likely state of a quantum system when it is weakly coupled to an energy-bath and the total state is a random pure state with a given energy. This result generalizes Goldstein et al.’s ‘canonical typicality’ result to systems which are not necessarily small. (shrink)

The genetically-modified-organism (GMO) experience has been prominent in motivating science, industry, and regulatory communities to address the social and ethical dimensions of nanotechnology. However, there are some significant problems with the GMO-nanotech analogy. First, it overstates the likelihood of a GMO-like backlash against nanotechnology. Second, it invites misconceptions about the reasons for public engagement and social and ethical issues research as well as their appropriate roles in nanotech research, development, application, commercialization, and regulatory processes. This paper takes as its starting point the thesis that one is responsible for one’s actions insofar as one has the ability to act for good reasons. Such a view faces a challenge: it is plausible that only beings with the ability to reflect are responsible agents, and yet it seems that not only is it possible to act for reasons without reflecting, it seems to happen quite frequently. Thus, advocates of the rational-ability view of responsibility must either reject as (...) a necessary condition that responsible agents must have the ability to reflect, or locate a plausible role for reflective ability. In this paper, I propose and assess a variety of ways to meet this challenge. (shrink)

The problem of synthetic judgements touches on the question of whether philosophy can draw independent statements about reality in the first place. For Kant, the synthetic judgements a priori formulate the conditions of the possibility for objectively valid knowledge. Despite the principle fallibility of its statements, modern science aims for objective knowledge. This gives the topic of synthetic a priori unbroken currency. This paper aims to show that a modernized version of transcendental philosophy, if it is to be feasible at (...) all, must “bid farewell” to the concept of being “free of empiricism” or the “purity” of the a priori. Approaches to this end can already been found in Kant’s reflections on non-pure synthetic knowledge. Moreover, the a priori validity of knowledge does not exclude the possibility that it can be discovered empirically. In keeping with Kant, Fries and Nelson anticipated this separation (usually first attributed to Reichenbach) between the validity and discovery context of knowledge and pointed out that the a priori could be discovered empirically, but never proven. There are currently still good reasons why transcendental philosophical concepts are of fundamental importance for modern science, although it must not be overlooked that even within the framework of a modernized transcendental philosophy, several unsolved problems remain or are raised. For example, the irredeemability of the universal validity and necessary claims of the a priori, the problem of a clear demarcation between the phenomenal and noumenal world. Moreover, the “beautiful structure” or the Kantian system, which constituted its persuasive power, is lost. (shrink)

This publication is an appreciation of the natural philosophy and epistemology of the philosopher Grete (Henry-)Hermann. A student of the mathematician Emmy Noether and the philosopher Leonard Nelson, she was one of the early interpreters of quantum mechanics. Werner Heisenberg memorialized her in his book "The Part and the Whole". For the first time, her writings on natural philosophy and epistemology are collected in one volume. An extensive introduction by various authors introduces the work of Grete Henry-Hermann. The author means to show how focusing on the sense of hearing can sharpen our understanding of Kierkegaard’s argument – in the first portion of Either/Or – that Don Giovanni ranks supreme among works of art. After explaining how he takes Kierkegaard’s case to rest on the issue of the ear being the “most spiritually qualified sense,” he shows how attending to the importance of hearing within the original Don Juan myth, as well as within Mozart and Da Ponte’s treatment (...) of it, can help us understand the myth’s dependence on and repudiation of Christianity: unlike sight, hearing places us in close spiritual intimacy with its source, even as it also opens up specific possibilities of theatricality and deceit. He concludes by arguing why hearing should be regarded as the paradigmatic sense in relation to which Kierkegaard understands the task of philosophy itself, in contrast to earlier philosophical emphases on visible intelligibility. In this paper I take up a critical position in regard to the theme of debility around which this collection is framed. I argue that theorisations of ‘debility’ do little to progress theory and policy in regard to disability and share many of the problems inherent to the social model. I also suggest that the theorisation of debility is rooted in and reinforces ablebodied privilege. I begin with a critical analysis of the social model of disability and explore the dualisms (...) by which it either negates the body altogether or can only conceive the disabled body in negative terms. I then go on to explore how Puar's work on debility continues this negation of the disabled body. From this position I use the work of Inahara to excavate the foundations of ablebodied privilege. In Inahara's work gender is the analytic starting point, but for me white privilege is a much more effective mechanism through which to understand the impact and reproduction of ablebodied privilege— what McRuer refers to as ‘compulsory ablebodiedness'—which I argue underpins Puar's work. I conclude with some reflections upon how a critical analysis of ablebodied privilege might function and I reiterate its importance for a critical theory that goes beyond the mere repetition of binary structures of ablebodiedness and disability. Concentration of the world’s wealth in the hands of a few, corporate owners as heads of state – these are facts that lend plausibility to Marx' pronouncements. Yet, how should we evaluate his ideas from today’s vantage point?

We provide a suitable theoretical foundation for the notion of the quantum coherent state which describes the electrostatic field due to a static external macroscopic charge distribution introduced by the author in 1998 and use it to rederive the formulae obtained in 1998 for the inner product of a pair of such states. (We also correct an incorrect factor of 4π\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$4\pi$$\end{document} in some of those formulae.) Contrary to what one might expect, (...) this inner product is usually non-zero whenever the total charges of the two charge distributions are equal, even if the charge distributions themselves are different. We actually display two different frameworks that lead to the same inner-product formulae, in the second of which Gauss’s law only holds in expectation value. We propose an experiment capable of ruling out the latter framework. We then address the problem of finding a product picture for QED—i.e. a reformulation in which it has a total Hamiltonian, arising as a sum of a free electromagnetic Hamiltonian, a free charged-matter Hamiltonian and an interaction term, acting on a Hilbert space which is a subspace (the physical subspace) of the full tensor product of a charged-matter Hilbert space and an electromagnetic-field Hilbert space. (The traditional Coulomb gauge formulation of QED isn’t a product picture in this sense because, in it, the longitudinal part of the electric field is a function of the charged matter operators.) Motivated by the first framework for our coherent-state construction, we find such a product picture and exhibit its equivalence with Coulomb gauge QED both for a charged Dirac field and also for a system of non-relativistic charged balls. For each of these systems, in all states in the physical subspace (including the vacuum in the case of the Dirac field) the charged matter is entangled with longitudinal photons and Gauss’s law holds as an operator equation; albeit the electric field operator (and therefore also the full Hamiltonian) while self-adjoint on the physical subspace, fails to be self-adjoint on the full tensor-product Hilbert space. The inner products of our electrostatic coherent states and the product picture for QED are relevant as analogues to quantities that play a rôle in the author’s matter-gravity entanglement hypothesis. Also, the product picture provides a temporal gauge quantization of QED which appears to be free from the difficulties which plagued previous approaches to temporal-gauge quantization. (shrink)

Dieser Aufsatz will zeigen, dass die Beiträge von Jakob Friedrich Fries (1773–1843) zur Psychiatrie leider (zu Unrecht) vergessen, aber überaus aktuell sind. Seine Überlegungen sowie die der Wissenschaftler, die ihm gefolgt sind, haben in den Darstellungen der Geschichte der Psychiatrie mehr Beachtung verdient.

El presente trabajo tiene como objetivo describir la funcionalidad discursivo-pragmática de sujetos adultos mayores sanos y con demencia leve, en sus aspectos de coherencia y coherencia pragmática, a través del análisis de producción lingüística oral, de ambos grupos, mediante la tarea denominada “monólogo audible” del protocolo MetAphAs. La muestra fue seleccionada de la base de datos NEUROLEN, en la cual se eligieron 9 sujetos sanos y 9 sujetos con demencia leve. Los datos fueron analizados desde una perspectiva de investigación cualitativa (...) descriptiva, con base en la funcionalidad discursiva-pragmática y la comparación con el marco teórico disponible. Los resultados arrojaron diferencias significativas en el desempeño de ambos grupos de senescentes. A pesar de presentar fallas en la producción del lenguaje a causa del envejecimiento fisiológico, los adultos mayores sanos son capaces de desarrollar comunicación funcional con su entorno, no ocurre lo mismo en el caso de los sujetos con demencia, debido a su deterioro cognitivo, el cual generaría dificultades en la producción discursiva. COVID-19 created a global crisis of unprecedented comprehensiveness affecting personal and professional lives of individuals worldwide. The pandemic and various governmental guidelines associated with it had numerous consequences for the workplace and the marketplace. In light of the global nature and multiplicity of the consequences of the pandemic, this study examines the impact of individual characteristics of respondents from three countries from various areas of the world: China, Israel, and the USA toward COVID-19 related business ethics decisions in three different (...) spheres: human resources, marketing, and social responsibility. Data from 374 respondents in these three countries indicated that moral disengagement was negatively related to all of the ethical decisions presented, with national pride moderating the above. Possible implications of these findings and future research directions are presented. (shrink)

Given the extraordinary politicization of culture in an era of globalization, it is surprising that Sesame Street has gained acceptance and legitimacy in more than fifty countries during the last five decades. Sesame Street’s ubiquity around the world presents us with the question I address in this article: how do partner organizations work together, on the ground, to locally adapt a hybrid cultural product? Using data from real-time interactions between NY staff and partners, I show how teams from different cultures (...) who do not share collective representations are able to create them through transnational interaction by: (1) constructing value to align their interests (2) exchanging complex cultural knowledge to customize and build alliances together. The Sesame Street case, then, allows us to grapple with “culture in interaction” at the transnational level, shedding light on culture in transnational interaction. (shrink)

Each year millions of nonhuman animals are exposed to suffering in universities as they are routinely used in teaching and research in the natural sciences. Drawing on the work of Giroux and Derrida, we make the case for a critical pedagogy of nonhuman animal suffering. We discuss critical pedagogy as an underrepresented form of teaching in universities, consider suffering as a concept, and explore the pedagogy of suffering. The discussion focuses on the use of nonhuman animal subjects in universities, in (...) particular in teaching, scientific research, and associated experiments. We conclude that a critical pedagogy of nonhuman animal suffering has the capacity to contribute to the establishment of a practical animal ethics conducive to the constitution of a radically different form of social life able to promote a more just and non-speciesist future in which nonhuman animals are not used as resources in scientific research in universities. One of the lasting influences of German Idealism has been the transformation of aesthetics into a central philosophical concern. My aim here is to show how and why Kant’s and Schiller’s formulations of the problems of moral agency, in particular, constitute an important episode of this development. I argue, first, that it is in the context of Kant’s view of moral agency that aesthetics gains larger purchase than it formerly had (as a response to the problem of the identification of (...) an agent with his external action); second, that Schiller expands the role of aesthetics (in response to Kant’s formulation of it) by intensifying a demand for aesthetic abandon in the agent as a bulwark against the threat of its possible “theatricalization.” It is these heightened demands on the first-personal content of agency that thus began the process of transforming the question of moral agency into an aesthetic one. This paper proposes an alternative view to the influential one of air or breath as inspiration that produces an imagined inner vision of the desired object. Instead, it outlines a poetics where air and inspiration connect with voice, language and music, thereby privileging sound over sight. A genealogy for this account is traced through Aristotle and various treatises connected to him, and an example of its operation is discussed in a song by the troubadour Bernart Marti. Voice is theorized as (...) a kind of sound, including non-human sound, made by striking air, which expresses the soul's passions and marks both the boundary and the connection between air and soul. Poetry and song form soundscapes whose implications exceed the acoustic. (shrink)

Mrs. G. Henry, former Miss Hermann, has been a student in my department at Goettingen University. She has got a Ph. D. degree in 1925, talking Mathematics as chief subject, and Physics and Philosophy in addition. In the same year she passed the state examinations for teachers license in the same subjects.

Ce faisant, il a prétendu accomplir d’autres tâches, sur les plans métaphilosophique, pédagogique et polémique : justifier les questions qui l’occupaient, communiquer sa pensée correctement et répondre aux incompréhensions de ses adversaires.
