This is a critical review of the book Legally Wed: Same Sex Marriage and the Constitution, by Mark Strasser. It discusses the book as well as legal cases and legal and moral reasoning relevant to deciding against the Constitutionality of prohibitions of same sex marriage. Such prohibitions were operative in states until the 2015 landmark U.S. Supreme Court decision in Obergefell v. Hodges struck them down and upheld a fundamental right to marry for same sex couples.

From 1750–1850, a philosophical theology rooted in the work of Jonathan Edwards dominated speculative thought in America. A group of Edwards's students, followers of ‘New Divinity,’ were led by Joseph Bellamy, Samuel Hopkins, and Nathaniel Emmons, who defended both God's sovereignty and human free will. They eventually professionalized in schools of theology led by Charles Hodge at Princeton, and, at Yale by Nathaniel William Taylor, a brilliant innovator and expositor of ideas that injected Scottish realism into theological debate.

[Wilfrid Hodges] During the last forty or so years it has become popular to offer explanations of logical notions in terms of games. There is no doubt that many people find games helpful for understanding various logical phenomena. But we ask whether anything is really 'explained' by these accounts, and we analyse Paul Lorenzen's dialogue foundations for constructive logic as an example. The conclusion is that the value of games lies in their ability to provide helpful metaphors and representations, (...) rather than in any true conceptual analysis. In fact some of the standard explanations of logical notions in terms of competitive games simply don't work. /// [Erik C. W. Krabbe] In an attempt to redeem the Lorenzen-type dialogues from their detractors, it is perhaps best first to provide a survey of the various benefits these dialogues have been supposed to yield. This will be done in Section I. It will not be possible, within the confines of this paper, to scrutinize them all, but in Section II we shall delve deeper into the capacity of this type of dialogue to yield a model for the immanent criticism of philosophical positions. Section III will extend the concept of a dialogue in such a way as to conform better with our intuitive conceptions of what a rational discussion of a position should contain. This will be followed up by a concept of 'winning a dialogue' that takes position midway between the old conception of 'winning one play' and that of the full-fledged presentation of a winning strategy. Concepts of 'rational discussion' are thus shown to be, plausibly, more fundamental than those of proof. In Section IV, I shall discuss the specific problems about dialogical foundations put forward by Wilfrid Hodges. (shrink)

BackgroundMoral distress (MD) is an emotional and psychological response to morally challenging dilemmas. Moral distress is experienced frequently by nurses in the intensive care unit (ICU) and can result in emotional anguish, work dissatisfaction, poor patient outcomes, and high levels of nurse turnover. Opportunities to discuss ethically challenging situations may lessen MD and its associated sequela.ObjectiveThe purpose of this project was to develop, implement, and evaluate the impact of nursing ethics huddles on participants’ MD, clinical ethics knowledge, work satisfaction, and (...) patient care among ICU nurses.Sample and SettingThe sample, 32 nurses from three ICU settings in an 800-bed tertiary academic medical center, participated in six nursing ethics huddles over a two-month period.MethodsAlvita K. Nathaniel’s Theory of Moral Reckoning guided development of the nursing ethics huddle process.1 The Moral Distress Thermometer was administered at three data points: baseline level of MD, and pre- and post-huddle to determine changes in the subjects’ level of MD.2 Focused content analysis was used to analyze qualitative responses from questionnaires about the subjects’ perception of the effect of the huddles on work satisfaction and patient care. Knowledge attainment was evaluated via open-ended short-answer questions.ResultsOverall, use of nurse-ethicist-led nursing ethics huddles was associated with improved quality of work life, patient care, and clinical ethics knowledge. The change in pre- and post-nursing ethics huddles MD scores was statistically significant (p < 0.0001). (shrink)

In Baghdad in the mid twelfth century Abū al-Barakāt proposes a radical new procedure for finding the conclusions of premise-pairs in syllogistic logic, and for identifying those premise-pairs that have no conclusions. The procedure makes no use of features of the standard Aristotelian apparatus, such as conversions or syllogistic figures. In place of these al-Barakāt writes out pages of diagrams consisting of labelled horizontal lines. He gives no instructions and no proof that the procedure will yield correct results. So the (...) reader has to work out what his procedure is and whether it is correct. The procedure turns out to be insightful and entirely correct, but this paper may be the first study to give a full description of the procedure and a rigorous proof of its correctness. (shrink)

This paper explores the hypothesis that first-order linguistic activities are better understood in terms of ecological, values-realizing dynamics rather than in terms of rule-governed processes. Conversing, like other perception-action skills is constrained by multiple values, heterarchically organized. This hypothesis is explored in terms of three broad approaches that contrast with models of language which view it as a cognitive system: conversing as a perceptual system for exploring dialogical arrays ; conversing as an action system for integrating diverse space-time scales ; (...) and conversing as a caring system for embodying the context-sensitivity and interdependency necessary to realize values. Approaching language as a caring action-perception system leads to a reconsideration of cognitive dimensions of linguistic activities, including consciousness, pragmatics, suffering, and hope. Ibn Sīnā proposed an analysis of arguments by reductio ad absurdum. His analysis contains, perhaps for the first time, a workable method for handling the making and discharging of assumptions in a formal proof. We translate the relevant text of Ibn Sīnā and put his analysis into the context of his general approach to logic.

In 2003 Zia Movahed pointed to a passage of Avicenna, written probably in 1022, which Movahed claimed anticipated the modal formula of Barcan (that ‘For every |$x$| necessarily |$\phi $|’ entails ‘Necessarily for every |$x$||$\phi $|’), and its converse. Since 2003, examination of early logical writings of Avicenna has clarified how he understood entailments between modal sentences, using his own new temporal language to provide a kind of semantics. In the light of that, Movahed’s claim for the Barcan formula needs (...) some tidying up but is basically correct. But by his semantics Avicenna should not have claimed the converse Barcan formula and probably didn’t claim it. (shrink)

We trace two logical ideas further back than they have previously been traced. One is the idea of using diagrams to prove that certain logical premises do—or don’t—have certain logical consequences. This idea is usually credited to Venn, and before him Euler, and before him Leibniz. We find the idea correctly and vigorously used by Abū al-Barakāt in 12th century Baghdad. The second is the idea that in formal logic, P logically entails Q if and only if every model of (...) P is a model of Q. This idea is usually credited to Tarski, and before him Bolzano. But again we find Abū al-Barakāt already exploiting the idea for logical calculations. Abū al-Barakāt’s work follows on from related but inchoate research of Ibn Sīnā in eleventh century Persia. We briefly trace the notion of model-theoretical consequence back through Paul the Persian and in some form back to Aristotle himself. (shrink)

Linguists started to handle the semantics of linguistic constructions with the proper generality only in the twentieth century. Leonard Bloomfield approaches the notion of a construction via the notion of a constituent. A “constituent” of a linguistic form e is a linguistic form, which occurs in e and also in some other linguistic form. It is an “immediate constituent” of e if it appears at the first level in the analysis of the form into ultimate constituents. A “construction” combines two (...) or more linguistic forms as immediate constituents of a more complex form. Bloomfield's notion of a “pronounceable” string of sounds is purely phonetic. So the entire work of distinguishing grammatical from ungrammatical expressions of the language L rests on the question whether they are “meaningful.”. (shrink)

In a recent paper Johan van Benthem reviews earlier work done by himself and colleagues on ‘natural logic’. His paper makes a number of challenging comments on the relationships between traditional logic, modern logic and natural logic. I respond to his challenge, by drawing what I think are the most significant lines dividing traditional logic from modern. The leading difference is in the way logic is expected to be used for checking arguments. For traditionals the checking is local, i.e. separately (...) for each inference step. Between inference steps, several kinds of paraphrasing are allowed. Today we formalise globally: we choose a symbolisation that works for the entire argument, and thus we eliminate intuitive steps and changes of viewpoint during the argument. Frege and Peano recast the logical rules so as to make this possible. I comment also on the traditional assumption that logical processing takes place at the top syntactic level, and I question Johan’s view that natural logic is ‘natural’. (shrink)

We record the advances made by the eleventh century Persian logician Ibn Sina—known in the West as Avicenna—away from a purely cognitive view of proofs and towards a more computational view, and the kinds of consideration that led him to these advances. Some of Ibn Sina’s new logics, which stand somewhere between Aristotle’s categorical syllogisms and modern first-order logic, can serve as a kind of laboratory for testing what are the differences between Aristotelian and modern logic, and where these differences (...) come from. We reconstruct as much as we can the part of al-Fārābī's treatment of modal logic that is missing from the surviving pages of his Long Commentary on the Prior Analytics. We use as a basis the quotations from this work in Ibn Sīnā, Ibn Rushd and Maimonides, together with relevant material from al-Fārābī's other writings. We present a case that al-Fārābī's treatment of the dictum de omni had a decisive effect on the development and presentation of Ibn Sīnā's modal logic. (...) This article examines the phenomenon of collective or aggregate civil litigation, manifested in different forms as a class action, representative action, or group action. Different countries have adopted different models of collective civil litigation. This diversity presents a challenge in drawing comparisons, and raises the need to study the different techniques involved. This article summarizes the adoption of a technical perspective. Following this, the article reviews the availability and limitations of the research techniques in relation to what we want. It (...) discusses the questions of goals of collective procedures, levels of need, technical modes of operation, and evaluation. The ultimate goal is to be able to compare different techniques and decide which ones might work best and in what circumstances or types of situation. Social and ecological research and theory are used to elaborate and enrich two important sets of accounts of language origins. One is the interdependence and shared intentionality hypothesis (e.g.,Tomasello, 2014a) of the ways in which humans became cooperative and conforming in ways that other apes did not, eventually leading to language. A second set of accounts addresses the emergence of bipedalism and its connections to language and to many other anatomical, cognitive, and social features that are distinctive in humans. Particular (...) attention is given to the carrying and caretaking of infants. Research and theory challenging common assumptions about the role of conformity in cooperation and conversation are reviewed and integrated into these accounts. Together these varying perspectives point toward a more dialogical, dynamic, and distributed understanding of social interactions and the values that motivate and constrain humans’ social and linguistic skills. We consider two formalisations of the notion of a compositionalsemantics for a language, and find some equivalent statements in termsof substitutions. We prove a theorem stating necessary and sufficientconditions for the existence of a canonical compositional semanticsextending a given partial semantics, after discussing what features onewould want such an extension to have. The theorem involves someassumptions about semantical categories in the spirit of Husserl andTarski.

In this introduction to this special issue the central issue of professional identity is defined, and a brief commentary is provided. Each of the essays in this issue is summarized in the commentary in regard to the notion the formation of a professional identity in the education and training of clinical ethics consultants. The second part of the introduction brings some historical and critical context to the issue by way of pointing to a loss of heterogeneity among clinical consultants.

Responding to an invitation from Peter Schroeder-Heister, the paper reacts to some criticisms of ‘model theory’ voiced among proof theorists interested in proof-theoretic semantics. It argues that the criticisms are poorly targeted: they conflate model theory with model-theoretic semantics and with the model-theoretic definition of logical consequence, which are three largely unrelated areas of study. On defining the meanings of logical constants, and of natural language expressions in general, the paper lays out some methodological requirements that any satisfactory definitions would (...) need to meet, for example about generalisability from one context of use to other contexts. On defining logical consequence, the paper argues that some points made recently by Schroeder-Heister and Kosta Došen are largely sound and probably uncontroversial if clearly stated, but their impact is blurred by some question-begging formulations. When Solomon Feferman began his research with Alfred Tarski in the early 1950s, model theory was still in process of becoming a distinct part of mathematical logic. Although Feferman’s doctoral thesis was not in model theory, his interests included model theory from the start, and he published a paper in the field roughly once every six years throughout his career. His earliest work in model theory is recognised in the name ‘Feferman-Vaught theorem’, which stems from some very detailed bare-hands work (...) on sums and products of structures. During the 1960s and 1970s he worked on applications of many-sorted interpolation theorems, in particular to derive results relating implicit and explicit definability in various contexts. In the 1980s he edited with Jon Barwise a monumental collection of essays on ‘Model-theoretic logics’. In more recent papers he reflected on the conceptual basis of model theory from a historical point of view. (shrink)

ABSTRACT This article argues that architecture makes possible a unique form of aesthetic experience, one involving what I will call, departing from a Kantian perspective, embodied free play. I argue that architecture's purpose is to encourage, cultivate, and enable human activities while also becoming crystallizations of those very activities. I will show that the living system of such interaction is called “place,” as I explore the role of artifacts, movement, activities, and the environment in place creation.
