The relation of law and knowledge is not a well-developed field of legal theory and legal research. This might be a legacy of the methodological approach of German legal theory, which leaves little room for a shift to perceive law as a knowledge generating procedure. The application of law is based on shared conventions and meanings, which give a semblance of stability. This semblance erodes in dynamic environments. In such situations, instead of drawing on consolidated knowledge, the law establishes and (...) frames knowledge generating procedures and infrastructures to secure the necessary knowledge, e. g. for regulation. This also applies to Europeanisation and internationalisation of law. Law itself often institutionalises a kind of reflexive and learning structure in order to assure its common application. At the end of my essay, a short outline of changes in knowledge generating procedures through digitisation is given. (shrink)

Understanding Music summarizes Eggebrecht's thoughts on the relationship between music and cognition.

Inspite of growing interest in research on language universals the concept of language universal itself has not been clarified beyond its status in Greenberg 1966. The present paper is an attempt at further clarification. The concept of language universal presents at least the following basic problems : Which entities are to be called universal? How can universality statements be deductively related to statements on individual languages and to non-linguistic statements, e.g. psychological ones? How are we to conceive the relation between (...) the 'empirical' and the 'non-empirical' in universality research? It is argued that the universal entities should be properties of languages. Three conceptions of universals are characterized: The Naive View , the Semantic View , and the Pragmatic View proposed by the author . It is argued that the Naive View and the Semantic View do not, and that the Pragmatic View may solve the basic problems formulated in Part I. Combining the Pragmatic View with the conception of theories developed in Lieb to appear the author characterizes the ultimate aim of universality research as defining a set of properties that, if taken as universal by any linguist, maximize the fruitfulness of any theory of language. The main task of universality research consists in making universality proposals that are well-founded with respect to that aim. Various principles are suggested by which the well-foundedness of universality proposals can be judged. (shrink)

This volume is in the series of scholarly catalogues of The Thyssen-Bornemisza Collection deals with some of the most innovative artworks of the first half of the twentieth century. More than forty artists from ten countries, including France, Spain, Italy, Britain and the Netherlands, are represented, and the catalogue throws fresh light on a period of intense creative ferment in the visual arts. An illustrated catalogue of 97 works by more than 40 artists: Georges Braque, Salvador Dalí, Theo van Doesburg, (...) Juan Gris, Piet Mondrian, Picasso. Christopher Green's introductory essay presents a valuable overview of the complex period, teasing out the various lines of inquiry and elucidating the central themes. His catalogue offers new research on significant groups of works by Braque, Ernst, Gris, Kupka, Leger, Picasso, and Schwitters, as well as important discoveries concerning major paintings by Balla, Bomberg, Dali, Miro and Wadsworth. A special feature of many entries is the use of technical investigations to address questions concerning processes of conception and making. Fresh light is thrown on the so-called 'automatist' procedures of the leading Surrealists (especially Ernst), on the open-ended working methods of the leading Cubists and Mondrian, and on the explicitly mechanistic methods of artists like Van Doesburg or Servranckx. Based on extensive documentary and archival research, this latest catalogue of The Thyssen-Bornemisza Collection makes a major contribution to twentieth century art history. (shrink)

Scientific policy advice is usually perceived as a formalized advisory process within political institutions. Politics has benefited from this arrangement because the science-based rationalization of policy has contributed to its legitimacy. However, in Western democratic societies, scientific expertise that is routinely mobilized to legitimate political positions has increasingly lost its power due to controversial expertise in the public sphere in particular within the mass media. As a consequence of the medialization of science, political decision makers are increasingly confronted with mass-mediated (...) expertise. Empirical results of a qualitative survey among decision makers in the German political and administrative system, presented in this article, support the hypothesis that mass-mediated expertise has a significant impact on policy processes. Five functions of media coverage on science-based issues for policy making were identified. Mass-mediated expertise has therefore altered the established relations between scientific policy advisors and political decision makers and can be seen as informal policy advice complementing institutionalized advisory arrangements. A series of dialogues with the most exciting and controversial German philosopher writing today. Peter Sloterdijk first became known in this country for his late 1980s Critique of Cynical Reason, which confronted headlong the “enlightened false consciousness” of Habermasian critical theory. Two decades later, after spending seven years in India studying Eastern philosophy, he is now attracting renewed interest for his writings on politics and globalization and for his magnum opus Spheres, a three-volume archaeology of the human attempt to dwell (...) within spaces, from womb to globe: Bubbles, 1998; Globes, 1999; Foam, 2004, all forthcoming from Semiotext. In Neither Sun nor Death, Sloterdijk answers questions posed by German writer Hans-Jürgen Heinrichs, commenting on such issues as technological mutation, development media, communication technologies, and his own intellectual itinerary. Iconoclastic and provocative, alternatively sparkling and bombastic, a child of '68 and a libertarian, Sloterdijk is the most exciting and controversial German philosopher to appear on the world scene since Nietzsche and Heidegger. Like Nietzsche, Sloterdijk remains convinced that contemporary philosophers have to think dangerously and let themselves be “kidnapped” by contemporary “hypercomplexities”; they must forsake our present humanist and nationalist world for a wider horizon at once ecological and global. Neither Sun nor Death is the best introduction available to Sloterdijk's philosophical theory of globalization. It reveals a philosophe extraordinaire, encyclopedic and provocative, as much at ease with current French Theory as with Heidegger and Indian mystic Osho Rajneesh. (shrink)

Johann Heinrich Lambert (1728–1777) galt schon den Zeitgenossen als Universalgenie von europäischem Rang. Tatsächlich forschte und publizierte Lambert als Mathematiker und Philosoph, und zwar vor allem zur Logik und Metaphysik, zur Erkenntnis- und Sprachtheorie, als Astronom und Physiker. Seinem Aufklärungsverständnis gemäß wirkte er nicht nur mit einer Vielzahl von Publikationen in die Wissenschaften, sondern als Popularphilosoph darüber hinaus auch in die sich ent- wickelnde Gesellschaft und den Staat der Aufklärung hinein. Dass Lambert vor dem Hintergrund dieses Selbstverständnisses als Aufklärer (...) auch Gedichte verfasste, überrascht dabei nicht. Der Band versammelt erstmals Studien zu allen Werkteilen des Berliner Gelehrten. (shrink)

The aim of the present study is (1) to show, on the basis of a number of unpublished documents, how Heinrich Scholz supported his Warsaw colleague Jan ?ukasiewicz, the Polish logician, during World War II, and (2) to discuss the efforts he made in order to enable Jan ?ukasiewicz and his wife Regina to move from Warsaw to Münster under life-threatening circumstances. In the first section, we explain how Scholz provided financial help to ?ukasiewicz, and we also adduce evidence (...) of the risks incurred by German scholars who offered assistance to their Polish colleagues. In the second section, we discuss the dramatic circumstances surrounding the ?ukasiewiczes' move to Münster in the summer of 1944. (shrink)

Johann Georg Heinrich Feder (1740–1821) zählte zu den prägenden Philosophen und Publizisten der europäischen Aufklärung zwischen 1770 und 1800, und zwar sowohl innerhalb weiter Teilbereiche der Fach- und Schulphilosophie als auch im Zusammenhang literarischer und popularphilosophischer Diskurse der sich entwickelnden Öffentlichkeit. Feder nahm entscheidenden Einfluss auf wichtige Debatten, Kontroversen und Forschungsentwicklungen seiner Zeit.

BackgroundThe German Medical Informatics Initiative (MII) introduced a standardised Broad Consent (BC) form encompassing medical data, insurance data, contact information and biomaterials for health data research. This study assesses the feasibility of MII-BC in emergency departments (EDs), examining patient understanding and identifying implementation facilitators and barriers. Recommendations for implementation of MII-BC in EDs will be derived.MethodsMixed-method data were collected in EDs of four German university hospitals (UHs) using pseudonymised participant observation with a focus on patient perspective and surveys from patients. (...) Data included MII-BC acceptance rates, patient understanding, motivation to consent and implementation facilitators and barriers. Quantitative data were analysed descriptively; qualitative data underwent content analysis with deductive–inductive category formation.ResultsThe exploratory study involved 12 participant observations from four tertiary UHs, surfacing five key themes: (1) MII-BC patient information in the ED, (2) facilitators and (3) barriers in obtaining MII-BC in the ED, (4) patient perspectives on MII-BC and (5) recommendations for implementing MII-BC in EDs. Survey results (n=225) showed that most patients (89.8%) demonstrated high understanding of MII-BC patient information. Facilitators include empathetic engagement, clear communication and encouragement for questions. Hindering factors include estimating study time frames, ambient noises and study procedure interruptions. Adequate resources, such as trained staff and suitable premises, are crucial.ConclusionImplementing MII-BC in the ED is feasible with appropriate resources, though ED-specific challenges must be addressed. Successful MII-BC implementation in EDs hinges on ensuring access to comprehensible information materials, transparent communication and a calm recruitment environment.Trial registration numberDRKS00030054.
