This paper presents a concept for pattern matching based on a parameter optimization system for approximative numerical calculation of some parameter combination under soft and hard constraints. The concept uses a non-linear parameter optimization method with an iterative variation of parameters. The paper focuses on the information modeling process to migrate problem-domain specific criteria into optimization-compatible objects suitable for a standardized parameter optimization procedure. A step-by-step transformation process is presented and implemented in object-oriented programming: classes and interfaces. In this revised edition of his 1979 classic Political Theory and International Relations, Charles Beitz rejects two highly influential conceptions of international theory as empirically inaccurate and theoretically misleading. In one, international relations is a Hobbesian state of nature in which moral judgments are entirely inappropriate, and in the other, states are analogous to persons in domestic society in having rights of autonomy that insulate them from external moral assessment and political interference. Beitz postulates that a theory of (...) international politics should include a revised principle of state autonomy based on the justice of a state’s domestic institutions, and a principle of international distributive justice to establish a fair division of resources and wealth among persons situated in diverse national societies. Human rights have become one of the most important moral concepts in global political life over the last 60 years. Charles Beitz, one of the world's leading philosophers, offers a compelling new examination of the idea of a human right.

Professor Flathman's main aim in this interesting paper is to set forth what we might call the “moderation thesis.” It holds that there may be occasions when the best thing to do, all things considered, is to violate a right – at least if the violation takes the form of what Flathman calls “civil encroachment” or “civil non-enforcement.” Moreover, it would be desirable, in a society whose practices include rights, for this belief to be generally accepted, so that those who (...) engaged with good reason in “civil encroachment” would receive the sympathetic support of the community. Let me begin by trying to explain the source of the problem to which this thesis is a response. As Flathman notes, rights have a discretionary character: if I have a right to do or to have something, it is up to me whether to do it or to have it. Having a right, I am entitled to make a choice. Since we cannot say, in advance, what choice I will make, we cannot say, in advance, what will be the state of the world after I make it. But since it seems plain that some states of the world are more desirable than others, it will always be possible that the consequences of my choice will be worse, on the whole, than the consequences of some other choice that I might have made but did not. To moderate rights is apparently to act in ways that redress or compensate for the undesirable results of their exercise. (shrink)

This book is meant to help resolve a couple of uncertainties.

Disquieting symptoms of democratic failure abound in America today with gridlocked political institutions, high levels of political polarization, and pressing but unresolved problems such as immigration, inequality, and gun violence. Are these the results of political institutions that cannot provide effective democratic representative? For the People takes a realistic look at American democracy by linking the findings of political scientists to the scrutiny of political theorists. Charles Beitz provides the core analysis showing that there are truly democratic failures (alternatively (...) the misadventures of American politics could be due to changing times that would stress any system) and that there are possibilities for better democratic competition that could improve democratic representation. Additional chapters by a political scientist, Martin Gilens, a political theorist, Jane Mansbridge, and a lawyer, Pamela S. Karlan, sharpen the analysis by providing empirical results, additional standards for successful democracy, and concerns about two non-majoritarian American institutions, the Senate and the Electoral College. "The Moral Standing of States" is the title of an essay Michael Walzer wrote in response to four critics of the theory of nonintervention defended in "Just and Unjust Wars." It states a theme to which he has returned in subsequent work. Beitz offers four sets of comments.

Philosophical attention to problems about global justice is flourishing in a way it has not in any time in memory. This paper considers some reasons for the rise of interest in the subject and reflects on some dilemmas about the meaning of the idea of the cosmopolitan in reasoning about social institutions, concentrating on the two principal dimensions of global justice, the economic and the political.

Global economic and political inequalities are in most respects greater today than they have been for decades. From one point of view inequality is a bad thing simply because it involves a deviation from equality, which is thought to have value for its own sake. But it is controversial whether this position can be defended, and if it can, whether the egalitarian ideal on which the defense may depend applies at the global level as in individual societies. Setting aside directly (...) egalitarian reasons for concern about global inequality, this paper explores several reasons for concern that derive from nonegalitarian values – primarily those associated with poverty and material deprivation, humiliation, the impact of inequality on the capacity for self‐control and self‐government, and the unfairness of political decision‐making procedures with large economic inequalities in the background. James's Fairness in Trade seeks to offer an account of fair trade that is “internal” to an existing practice he describes as “mutual market reliance.” This paper distinguishes several senses of the distinction between “internal” and “external” that occur in the book and asks how, in its various senses, the distinction shapes and influences judgments about the fairness of the practice.

Global Basic Rights brings together many of the most influential contemporary writers in political philosophy and international relations to explore some of the most challenging theoretical and practical questions provoked by Henry Shue's classic book Basic Rights.

The “democratic deficit view” of global political justice holds that the existing structure of world political order is insufficiently democratic. Institutions should be reformed or restructured so that individuals whose interests are substantially affected by political decisions are provided with procedural means of exerting leverage over the mechanisms by which these decisions are made. This view rests on the precept that people whose interests are put at risk by the decisions of others should have a share of control over these (...) decisions. But it is a mistake to extract this precept from its place within a broader theory of democracy and to rely on it as if it were a stand-alone principle. In its exclusive focus on the formal relationship between those affected by political decisions and the mechanisms through which these decisions are reached, the democratic deficit view conveys an excessively simple idea of the deficiencies of the existing structure and focuses attention on strategies for reform that do not realistically address the deficiencies. Once we grasp the complexity of these reasons we can see that the range of institutional remedies is broader and perhaps more achievable than it may have appeared. (shrink)

A ‘practical’ theory of human rights should make sense of two claims: a ‘practice claim’ – that international human rights can fruitfully be regarded as an existing social practice – and an ‘authority claim’ – that participants in the practice have reasons to adhere to its norms. I elaborate both of these claims in this paper, taking into account important developments in the empirical study of international human rights in the last decade.

Today's international community may well view covert action and democracy as mutually exclusive policies. This article examines the practice of covert action in American foreign policy in light of events of the mid-1970s and 1980s, focusing on the scandalous misuse of executive authority and lack of accountability associated with covert means. Often manipulative and sometimes anonymous, covert operations raise critical morality concerns in a democratic society. Whether "any form of accountability is likely to be sufficient to bring the unauthorized use (...) of executive power under control" is the crucial issue to be addressed when examining the practicality of covert actions by the executive branch. The settlement of the Second World War yielded two important changes in the normative order of international relations. These are the prohibition of war except in self‐defence, expressed in the UN Charter and the limitation of sovereignty by a common set of protections of individuals, expressed in the Universal Declaration of Human Rights (UDHR). Looked at in historical perspective, these innovations are two dimensions of a single movement – a collective effort at the global level to impose discipline on the (...) external and internal behaviour of states. Neither innovation lacks ambition, but of the two, the more far‐reaching is certainly the doctrine of human rights. It aims to bring the domestic conduct of governments under agreed international norms – to define and establish ‘a common standard of achievement for all peoples and all nations’ (UDHR, Preamble) to which the organized international community can hold individual governments accountable. Lehren und Lernen, verstanden als komplexe Vermittlung und Verarbeitung von Inhalten, finden immer in räumlichen Kontexten statt, die hinderlich oder förderlich sein können.
