According to one view of linguistic information, a speaker can convey contextually new information in one of two ways: by asserting the content as new information; or by presupposing the content as given information which would then have to be accommodated. This distinction predicts that it is conversationally more appropriate to assert implausible information rather than presuppose it. A second view rejects the assumption that presuppositions are accommodated; instead, presuppositions are assimilated into asserted content and both are correspondingly open to (...) challenge. Under this view, we should not expect to find a difference in conversational appropriateness between asserting implausible information and presupposing it. To distinguish between these two views of linguistic information, we performed two self-paced reading experiments with an on-line stops-making-sense judgment. The results of the two experiments—using the presupposition triggers the and too—show that accommodation is inappropriate relative to non-presuppositional controls when the presupposed information is implausible but not when it is plausible. These results provide support for the first view of linguistic information: the contrast in implausible contexts can only be explained if there is a presupposition-assertion distinction and accommodation is a mechanism dedicated to reasoning about presuppositions. This paper criticizes the dominant approaches to presupposition projection and proposes an alternative. Both the update semantics of Heim and the discourse representation theory of van der Sandt have problems in explicating the presuppositions of disjunctions. Moreover, Heim's approach is committed to a conception of accommodation that founders on the problem of informative presuppositions, and van der Sandt's approach is committed to a conception of accommodation that generates over-interpretations of utterances. The present approach borrows Karttunen's idea that instead (...) of associating presuppositions with sentences, we should define the conditions that contexts must meet in order to satisfy-the-presuppositions-of a sentence. However, in place of Karttunen's conception of contexts in terms of common ground, the present theory substitutes a conception of contexts as objective entities that are independent of the attitudes of the interlocutors. Contexts, so conceived, may be defined as containing sets of relevant possibilities. This allows us to define the conditions under which a context satisfies-the-presuppositions-of a disjunction. This chapter focuses on four questions which help to understand the presupposition accommodation as Lewis defines it. The first is a question about how we recognize that an utterance involves a presupposition. The second question is about what it is to accommodate. The third question has to do with the role of scoreboard in accommodation. The fourth question has to do with Lewis's ceteris paribus condition. The chapter considers the characterization of accommodation due to Thomason, and argues (...) that it appropriately extends the range of phenomena taken to involve accommodation. It discusses a theory of the scoreboard building on Lewis's characterization which crucially reflects the interlocutors’ recognized goals and plans in language game, and argues that this type of scoreboard plays a natural role in facilitating and constraining accommodation. One of the central claims of the neurodiversity movement is that society should accommodate the needs of autistics, rather than try to treat autism. People have variously tried to reject this accommodation thesis as applicable to all autistics. One instance is Pier Jaarsma and Stellan Welin, who argue that the thesis should apply to some but not all autistics. They do so via separating autistics into high- and low-functioning, on the basis of IQ and social effectiveness or functionings. I (...) reject their grounds for separating autistics. IQ is an irrelevant basis for separating autistics. Charitably rendering it as referring to more general capacities still leaves us mistaken about the roles they play in supporting the accommodation thesis. The appeal to social effectiveness or functionings relies on standards that are inapplicable to autistics, and which risks being deaf to the point of their claims. I then consider if their remaining argument concerning autistic culture may succeed independently of the line they draw. I argue that construing autistics' claims as beginning from culture mistakes their status, and may even detract from their aims. Via my discussion of Jaarsma and Welin, I hope to point to why the more general strategy of separating autistics, in response to the accommodation thesis, does not fully succeed. Finally, I sketch some directions for future discussions, arguing that we should instead shift our attention to consider another set of questions concerning the costs and extent of change required to accommodate all autistics. This paper examines the famous doctrine that independent prediction garners more support than accommodation. The standard arguments for the doctrine are found to be invalid, and a more realistic position is put forward, that whether evidence supports or not a hypothesis depends on the prior probability of the hypothesis, and is independent of whether it was proposed before or after the evidence. This position is implicit in the subjective Bayesian theory of confirmation, and the paper ends with a brief (...) account of this theory, and answer to the principal objections to it. (shrink)

When should burdened social practices be granted special accommodation? One issue of concern—raised by Okin and others—is that some social practices involve domination, and so the accommodation of those practices might (inadvertently, perhaps) support social injustice. Suppose one wants to take this concern very seriously. Starting from the assumption that freedom from domination is an especially important value, this article examines whether cultural accommodation would ever be advisable. Approaching the problem of multicultural accommodation from this point (...) of view greatly clarifies the debate and yields some interesting results. In particular, the discussion concludes that there are circumstances under which the goal of minimizing domination itself would be furthered by policies of special accommodation. (shrink)

With some qualifications, this article endorses Brian Leiter’s argument that religious accommodation should not shift burdens from believers to non-believers. It argues that religious believers should take responsibility for their beliefs and for meeting the demands of their beliefs. It then examines the implications of that argument for British law on indirect discrimination as it relates to religion or belief: burden-shifting from believers to employers and providers of goods and services should be deemed acceptable only insofar as the burden (...) incurred by the employer or provider is ‘insignificant’. Legal exemptions should satisfy a similar test. Why should there be religious accommodation at all, even if it entails no significant burden-shifting? The author agrees with Leiter in finding the most plausible answer in the claims of conscience rather than in general theories of equality or features special to religion. Those claims can reasonably be made in respect of liberty of conscience but also when conscience is merely disadvantaged. (shrink)

Debates about the ethics of health care and medical research in contemporary pluralistic democracies often arise partly from competing religious and secular values. Such disagreements raise challenges of balancing claims of religious liberty with claims to equal treatment in health care. This paper proposes several mid-level principles to help in framing sound policies for resolving such disputes. We develop and illustrate these principles, exploring their application to conscientious objection by religious providers and religious institutions, accommodation of religious priorities in (...) biomedical research, and treatment of patients’ religious views in doctor–patient encounters. Given that no sound set of guiding principles yields precise solutions for every policy dispute, we explore how morally sound democracies might deliberatively resolve such policy issues, following our proposed principles. Taken together and carefully interpreted, these principles may help in guiding difficult decision making in the indefinitely large realm where government, medical providers, and patients encounter problems concerning religion and medicine. Accommodation is a process whereby the context of an utterance is adjusted or repaired in order to maintain the default assumption that the utterance constitutes an appropriate conversational move of a certain type. It involves a kind of redressive action on the part of the audience and, depending on what the appropriateness of a speech act requires, results in providing missing contextual elements such as referents for anaphoric expressions, presuppositions, suppositions, deontic facts, pragmatically enriched contents, and so on. It (...) remains to be determined, however, what is the source of the contextual requirements whose recognition motivates and guides the accommodating context-change. The aim of this paper is to address this question - which expresses the so-called triggering or constitution problem - and suggest that it can be adequately answered by a speech act-based model, whose central idea is that the requirements in question are structural components of patterns, scripts or procedures for the performance of speech acts. The paper consists of four parts. Section 1 introduces the notion of accommodation and discusses three examples of accommodating phenomena. Section 2 develops a more elaborated description of the examples discussed in the previous section and proposes a list of questions that an adequate model of accommodation is expected to answer. Section 3 offers a critical examination of three alternative models of accommodation, i.e., David Lewis’s score-keeping model, Robert Stalnaker’s sequential update model, and Richmond Thomason’s enlightened update model; in particular, it considers how they account for the constitution of contextual requirements that trigger and guide mechanisms of context-redressive changes. Finally, Section 4, suggests basic elements of a speech actbased model; it also argues that the proposed framework can be used to explain a wide range of accommodating phenomena and can shed a new sort of light on the constitution of accommodation-triggering requirements. What normative principles should multicultural states be guided by in responding to minority claims for the accommodation of cultural and religious social practices? This article explores how theories of non-domination can contribute to debates on this question in the multiculturalism literature. It examines Philip Pettit’s, Cecile Laborde’s and Frank Lovett’s republican theories and argues that non-domination-based approaches to multicultural accommodation are more suitable to assess the dynamic of intra- and inter-group relations than the prominent liberal–multiculturalist alternative. However, their (...) advantages are not contingent on the wider theories from which they emerge, but rather related to generalizable features of the non-domination ideal. This suggests that non-domination should also be appealing to non-republicans, who can adopt it minimally as a critical principle to determine illegitimate policies. (shrink)

This paper considers what concept of accommodation is necessary to identify and address discrimination, disadvantages and disparities in such a way that the plurality of religious people with their beliefs, values and practices may be justly accommodated in healthcare. It evaluates threats to the possibility of such accommodation pertaining by considering what beliefs and practices might increase the risk of unjust discrimination against and disadvantage for religious people, whether as individuals or as groups; and the risk of disparities (...) between the care provided to religious people. The claim is that there is an important cluster of risks that are political in kind and emergent within philosophical bioethics. While not amounting (yet) to a trend, they are sufficiently threatening to a just civic life for patients and healthcare staff as to warrant scrutiny. After an Introductory Section 1, Section 2 evaluates a criticism of ‘accommodation’ and the apparently additional health-related requirements that those of religious faith demand, when compared with other people. It does so by comparing Lori Beaman's idea of agonism with that of a distinct and somewhat complementary approach in Jonathan Chaplin's political philosophy, before examining the role of established religion in setting the conditions for the accommodation of religion and belief in healthcare. Section 3 examines risks to such accommodation by engaging critically with three health-related instantiations of political philosophy that differ radically from both Beaman and Chaplin. A concluding Section 4 focusses on appropriate modes of communicating about religious and other beliefs in healthcare. (shrink)

Many philosophers have argued that a hypothesis is better confirmed by some data if the hypothesis was not specifically designed to fit the data. ‘Prediction’, they argue, is superior to ‘accommodation’. Others deny that there is any epistemic advantage to prediction, and conclude that prediction and accommodation are epistemically on a par. This paper argues that there is a respect in which accommodation is superior to prediction. Specifically, the information that the data was accommodated rather than predicted (...) suggests that the data is less likely to have been manipulated or fabricated, which in turn increases the likelihood that the hypothesis is correct in light of the data. In some cases, this epistemic advantage of accommodation may even outweigh whatever epistemic advantage there might be to prediction, making accommodation epistemically superior to prediction all things considered. We describe a number of conscientious objection cases in a liberal Western democracy. These cases strongly suggest that the typical conscientious objector does not object to unreasonable, controversial professional services—involving torture, for instance—but to the provision of professional services that are both uncontroversially legal and that patients are entitled to receive. We analyse the conflict between these patients' access rights and the conscientious objection accommodation demanded by monopoly providers of such healthcare services. It is implausible that professionals who voluntarily (...) join a profession should be endowed with a legal claim not to provide services that are within the scope of the profession's practice and that society expects them to provide. ABSTRACT In ‘Scorekeeping in a Pornographic Language Game’, Rae Langton and Caroline West borrow ideas from David Lewis to attempt to explain how pornography might subordinate and silence women. Pornography is supposed to express certain misogynistic claims implicitly, through presupposition, and to convey them indirectly, through accommodation. I argue that the appeal to accommodation cannot do the sort of work Langton and West want it to do: Their case rests upon an overly simplified model of that phenomenon. Explanatory pluralism is the view that explanations come in two or more different types. This chapter clarifies two versions of explanatory pluralism and considers two very different attempts to make sense of it. On the one hand, an ontic approach isolates genuine explanations only by appeal to facts that obtain in the world. The most promising way for an ontic approach to accommodate explanatory pluralism is to posit different sorts of objective dependence relations. On the other hand, an epistemic approach (...) requires that features of agents appear in any analysis of what a genuine explanation is. This chapter argues that there is a version of an ontic account and a version of an epistemic account that do make sense of explanatory pluralism in their own terms. At the same time, pluralism raises problems for each approach that require further consideration. (shrink)

Many of us think we have agent-centred options to act suboptimally. Some of these involve favouring our own interests. Others involve sacrificing them. In this paper, I explore three different ways to accommodate agent-centred options in a criterion of objective permissibility. I argue against satisficing and rational pluralism, and in favour of a principle built around sensitivity to personal cost.

In this paper I elaborate on previous criticisms of the influential Stalnakerian account of presuppositions, pointing out that the well-known practice of informative presupposition puts heavy strain on Stalnaker’s pragmatic characterization of the phenomenon of presupposition, in particular of the triggering of presuppositions. Stalnaker has replied to previous criticisms by relying on the well-taken point that we should take into account the time at which presupposition-requirements are to be computed. In defense of a different, ‘semantic’ account of the phenomenon of (...) presupposition, I argue that that point does not suffice to rescue the Stalnakerian proposal, and I portray Lewisian ‘accommodation’ as one way in which speakers adjust themselves to one another in the course of conversation. A widely endorsed thesis in the philosophy of science holds that if evidence for a hypothesis was not known when the hypothesis was proposed, then that evidence confirms the hypothesis more strongly than would otherwise be the case. The thesis has been thought to be inconsistent with Bayesian confirmation theory, but the arguments offered for that view are fallacious. This paper shows how the special value of prediction can in fact be given Bayesian explanation. The explanation involves consideration of the (...) reliability of the method by which the hypothesis was discovered, and thus reveals an intimate connection between the 'logic of discovery' and confirmation theory. This research explores the experiences of UK NHS healthcare professionals working with asylum applicants housed in contingency accommodation during the COVID-19 pandemic. Using a critical understanding of the concept of moral resilience as a theoretical framework, we explore how the difficult circumstances in which they worked were navigated, and the extent to which moral suffering led to moral transformation. Ten staff from a general practice participated in semistructured interviews. Encountering the harms endured by people seeking asylum prior to arrival (...) in the UK and through the UK’s ‘Hostile Environment’ caused healthcare staff moral suffering. They responded to this in several ways, including: (1) feeling grateful for their own fortunes; (2) defining the limitations of their professional obligations; (3) focusing on the rewards of work and (4) going above and beyond usual care. Although moral resilience is reflected in much of the data, some participants described how the work caused ideological transformations and motivated challenges to systems of oppression. We show how current moral resilience theory fails to capture these transformative political and social responses, warning of how, instead, it might encourage healthcare staff to maintain the status quo. We caution against the widespread endorsement of current formulations of moral resilience in contemporary social and political climates, where the hostile and austere systems causing suffering are the result of ideological political decisions. Future work should instead focus on enabling working conditions to support, and developing theory to capture, collective resistance. (shrink)

In her chapter “Beyond Belief: Pragmatics in Hate Speech and Pornography”, Rae Langton proposes a development of David Lewis’ scorekeeping model, according to which speakers can not only presuppose certain beliefs on the part of the hearers but also certain desires and feelings. This should then explain how speech, and in particular hate speech, can change the hearers’ desires and feelings about the group targeted for hate using presupposition accommodation. Against Langton’s proposal, I will object that, although we have (...) a good understanding of what it means for an utterance to presuppose certain beliefs on the part of the hearers, we basically have no understanding of what it means to presuppose certain desires or feelings. What is even more problematic is that Langton does not provide any concrete examples of utterances presupposing a desire or feeling. This leads to the question of whether there is such a thing as presupposed desires and feelings. Although I will answer this question affirmatively, contrary to Langton’s explanation, this will not require that, in addition to common beliefs, conversational score also includes common desires or feelings. Rather, presupposed desires and feelings will be reduced to presupposed beliefs. Thus, to adjust their beliefs, hearers may sometimes be forced to adjust their desires and feelings. This will provide an explanation of the fact that, in addition to the hearers’ beliefs, hate speech also changes their desires and feelings. (shrink)

This article offers a normative analysis of the state of religious accommodation law in the UK. It identifies five ‘normative gaps’ in the law where the legal discussion could benefit by employing the analytical lens of political theory. These gaps concern (i) what sorts of religious (or non-religious) beliefs should enjoy protected status; (ii) how the law should address issues of individual choice and responsibility; (iii) whether there is a genuine distinction between manifesting and being motivated by one’s beliefs; (...) (iv) what sorts of interests count against accommodation claims; and (v) the relationship between human rights and discrimination law, the two pillars of religious accommodation law in the UK. The first half of the article sets out these issues, while the second half offers some preliminary conclusions and ways of resolving them. Suppose we suffer or witness an injustice. Often we will respond with a combination of anger, grief, resentment, indignation, or horror. And it seems that this is how it should be: the injustice is the reason for our emotional response. However, it is a striking fact that our anger, grief, or horror will diminish over time, often fairly quickly, even if the injustice persists. We accommodate ourselves to the injustice. Indeed, this is good for us, and it may even seem (...) appropriate; it is often wrong to dwell on a wrong. But how could accommodation be appropriate if the injustice remains unchanged? And how could we make sense of accommodation when we anticipate it? This chapter argues that accommodation to injustice poses an insurmountable problem for understanding our emotional response to injustice and reveals something incomprehensible at the heart of our moral outlook. We propose to analyze well-known cases of "imaginative resistance" from the philosophical literature (Gendler, Walton, Weatherson) as involving the inference that particular content should be attributed to either: (i) a character rather than the narrator or, (ii) an unreliable, irrational, opinionated, and/or morally deviant "first person" narrator who was originally perceived to be a typical impersonal, omniscient, "effaced" narrator. We model the latter type of attribution in terms of two independently motivated linguistic mechanisms: accommodation of a discourse referent (Lewis, (...) Stalnaker, Kamp) and 'cautious' updating as a model of non-cooperative information exchange (Eckardt). (shrink)

Wong also talks about some limits of being tolerated in Lecture 3. Confucian accommodation is limited by Confucian rituals. Wong also mentions some online discussion platforms to be the examples of unsettling hierarchies in Daoist insights in Lecture 5. This kind of high technology might create another hierarchy. In Wong’s lectures, he (...) has also discussed many good examples in traditional Chinese philosophies and modern societies to explain how to unsettle hierarchies. Family accommodation refers to the attempt of family members to prevent their child’s distress related to psychopathology. Family accommodation can limit meaningful participation in personal and social routines and activities. Accommodation has been studied extensively in the context of childhood anxiety and has been linked to greater impairment, and poor intervention outcomes. Like anxiety, sensory over-responsivity symptoms are associated with heightened distress and thus, may also be accommodated by family members. The current study describes the validation of (...) a new pediatric family accommodation scale for SOR. Parents of 301 children ages 3–13 years completed an online survey, of which 48 had medical or developmental conditions. The survey included the Child Sensory Profile 2 and the newly developed family accommodation scale for sensory over-responsivity. Three Sensory Profile 2 scores were analyzed: SOR, sensory under-responsivity and sensory seeking. The FASENS consists of 18 items; 12 describing the frequency of accommodation behaviors and 6 describing the impact of the accommodation on the wellbeing of the family and the child. Results indicated that the FASENS has high internal consistency as well as a significant 3-factor confirmatory model fit: accommodations, family impact, and child impact. FASENS scores significantly correlated with SOR symptoms. However, they also correlated with under-responsivity and seeking. Parents of children with health conditions reported significantly higher FASENS scores, which corresponded with their child’s significantly higher sensory scores. Family accommodations for SOR occur to some extent in the general population, but their prevalence and impact are significantly greater when the child has a health condition, in addition to SOR. Additional research is needed to explore whether these accommodations are adaptive and whether families and children would benefit from learning to reduce them, as with anxiety. (shrink)

The purpose of this paper is to present and discuss a puzzle involving accommodation. The puzzle is based on three assumptions. The first assumption is that accommodation takes place after an utterance. The second assumption is that accommodation can make a difference to the truth-value of an utterance even if the utterance is not about the future. The third assumption is that something that takes place after an utterance cannot make a difference to the truth-value of the (...) utterance unless the utterance is about the future. Since these assumptions are jointly inconsistent, one of them must be false. The question is which one we ought to reject. The majority of the discussion is devoted to discussing each of the options, and the tentative conclusion is that the most plausible strategy is to reject the third thesis. That amounts to saying that something that takes place after an utterance can make a difference to the truth-value of the utterance even if the utterance is not about the future. (shrink)

A not unpopular thesis, when it comes to the confirmation of scientific theories, is that data which were used in the construction of a theory afford poorer support for that theory than data that played no role. The paper develops a non-Gricean account of accommodation: a contextadjusting process guided by the assumption that the speaker’s utterance constitutes an appropriate conversational move. The paper is organized into three parts. The first one reconstructs the basic tenets of Lepore and Stone's non-Gricean model of meaningmaking, which results from integrating direct intentionalism and extended semantics. The second part discusses the phenomenon of accommodation as it occurs in conversational practice. The third part uses the tenets of the non-Gricean model (...) of meaning-making to account for the discursive mechanisms underlying accommodation; the proposed account relies on a distinction between the rules of appropriateness, which form part of extendedgrammar, and the Maxim of Appropriateness, which functions as a discursive norm guiding our conversational practice. Contextualists and relativists about predicates of personal taste, epistemic modals, and so on (“CR-expressions”) agree that the interpretation of these expressions depends, in some sense, on context. Relativists claim that the sort of context-sensitivity exhibited by CR-expressions is importantly different from that exhibited by paradigm context-sensitive expressions. This bifurcation is often motivated by the claim that the two classes of expressions behave differently in patterns of agreement and disagreement. I provide cases illustrating that the same sorts of discourse phenomena that (...) have been thought problematic for contextualists can arise with paradigm context-sensitive expressions. Since Mendeleev’s discovery in 1869, the periodic table has figured as the ultimate paper tool in chemical research. It has proved to be a vital research instrument in the arsenal of the chemical community. No chemistry textbook, lecture theatre or scientific laboratory is complete without a copy of the periodic table of the elements. -/- This however, should not necessarily imply that the periodic table has never had to contend with problems. In this thesis, the history of the accommodation (...) of the rare-earth elements in the periodic table will be addressed. When Mendeleev published his periodic table in 1869, the rare earths already constituted a major obstacle. Mendeleev was able to include only four members of the rare earths and he experienced great difficulties in positioning these elements. Question marks and wrong atomic weights reigned in the last rows of Mendeleev’s system. -/- This problematic accommodation quickly grew into one of the most serious threats for the periodic law. For over fifty years, chemists continually struggled with the placement of these maddeningly similar elements. As a consequence, a lot of chemists started to question the validity of the periodic law, but others took it as a sign that the concept of a chemical element had to be reconsidered. As a result, this work intends to retrace the mutual influence of the philosophical ideas about the nature of chemical elements and the development of the periodic table from its inception in 1869 to the discovery of Moseley’s law in 1913 and Bohr’s publication of his landmark paper On the Constitution of Atoms and Molecules. -/- The aim of this thesis is to show how, on the one hand, the periodic table (as a research instrument) helped in reformulating the contemporary ideas about chemical elements, and how it aided in developing a new research program in order to resolve the rare earth crisis. On the other hand, the question will be taken up to what extent Crookes’ evolutionary ideas about meta elements helped in saving the periodic table from a severe downfall by solving the gnawing problem of the rare-earth elements. In particular, this work will also focus on the investigations of the Czech chemist, Bohuslav Brauner. It will be shown how Brauner, under the influence of Crookes’ ideas, was led to his formulation of the Asteroid Hypothesis, according to which all the rare-earth elements should be placed in a single case of the periodic table. The opinion of the American Medical Association (AMA) Council on Ethical and Judicial Affairs (CEJA) on the accommodation of conscientious objectors among medical doctors aims to balance fairly patients’ rights of access to care and accommodating doctors’ deeply held personal beliefs. Like similar documents, it fails. Patients will not find it persuasive, and neither should they. The lines drawn aim at a reasonable compromise between positions that are not amenable to compromise. The results of the study show that looking at the characteristics of losses arising from the marketing and supply of digital tourism accommodation services based on the legal system of business competition in Indonesia is considered inappropriate and must be reconceptualized, Furthermore, the regulation of marketing and supply of digital tourist accommodation services that are healthy and fair is still experiencing a vacuum of norms, so it is necessary to formulate the regulation of marketing and supply of tourist accommodation services for all business actors of tourist accommodation services as a means of legal protection in terms of preventing and controlling the potential for unfair business competition practices in the regulation of marketing and supply of digital tourist accommodation services. This article explores how women seek power through both resisting and accommodating mainstream norms for female hair and delineates the strengths and limitations of these strategies. The data help to illuminate the complex role the body plays in sustaining and challenging women's subordinate position, how accommodation and resistance lie buried in everyday activities, the limits of resistance based on the body, and why accommodation and resistance are best viewed as coexisting variables rather than as polar opposites. This chapter gives an overview of the evolution of the position of the rare-earth elements in the periodic system, from Mendeleev’s time to the present. Three fundamentally different accommodation methodologies have been proposed over the years. Mendeleev considered the rare-earth elements as homologues of the other elements. Other chemists looked upon the rare earths as forming a special intraperiodic group and therefore clustered the rare-earth elements in one of the groups of the periodic table. Still others adhered to the (...) intergroup accommodation of the rare earths, according to which the rare-earth elements do not show any relationship with the other elements, so that they had to be placed within the periodic table as a separate family of elements. The intergroup accommodation became the preferred one in the twentieth century. The advantages and disadvantages of the different representations of the modern periodic table are discussed. (shrink)

Conflicts of interest. None to report. Despite widespread acceptance in the United States of neurological criteria to determine death, clinicians encounter families who object, often on religious grounds, to the categorization of their loved ones as “brain dead.” The concept of “reasonable accommodation” of objections to brain death, promulgated in both state statutes and the bioethics literature, suggests the possibility of compromise between the family’s deeply held beliefs and the legal, professional and moral values otherwise directing clinicians to withdraw (...) medical interventions. Relying on narrative to convey the experience of a family and clinical caregivers embroiled in this complex dilemma, the case analyzed here explores the practical challenges and moral ambiguities presented by the concept of reasonable accommodation. Clarifying the term’s meaning and boundaries, and identifying guidelines for its clinical implementation, could help to reduce uncertainty for both health care professionals and families and, thereby, the incremental moral distress such uncertainty creates. Since its inception in 1968, the concept of whole-brain death has been contentious, and four decades on, controversy concerning the validity and coherence of whole-brain death continues unabated. Although whole-brain death is legally recognized and medically entrenched in the United States and elsewhere, there is reasonable disagreement among physicians, philosophers, and the public concerning whether brain death is really equivalent to death as it has been traditionally understood. A handful of states have acknowledged this plurality of viewpoints and enacted “conscience (...) clauses” that require “reasonable accommodation” of religious and moral objections to the determination of death by neurological criteria. This paper argues for the universal adoption of “reasonable accommodation” policies using the New Jersey statute as a model, in light of both the ongoing controversy and the recent case of Jahi McMath, a child whose family raised religious objections to a declaration of brain death. Public policies that accommodate reasonable, divergent viewpoints concerning death provide a practical and compassionate way to resolve those conflicts that are the most urgent, painful, and difficult to reconcile. Should we insist on prediction, i.e. on correctly forecasting the future? Or can we rest content with accommodation, i.e. empirical success only with respect to the past? I apply general considerations about this issue to the case of economics. In particular, I examine various ways in which mere accommodation can be sufficient, in order to see whether those ways apply to economics. Two conclusions result. First, an entanglement thesis: the need for prediction is entangled with the methodological role (...) of orthodox economic theory. Second, a conditional predictivism: if we are not committed to orthodox economic theory, then we should demand prediction rather than accommodation – against most current practice. (shrink)

The unconscionability doctrine in contract law enables a court to decline to enforce a contract whose terms are seriously one-sided, exploitative, or otherwise manifestly unfair. It is often criticized for being paternalist. The essay argues that the characterization of unconscionability doctrine as paternalist reflects common but misleading thought about paternalism and obscures more important issues about autonomy and social connection. The defense responds to another criticism: that unconscionability doctrine is an inappropriate, because economically inefficient, egalitarian tool. In psychology, measurement instruments are constructed from scales, which are obtained on the grounds of exploratory and confirmatory factor analysis. Looking at the literature, one can find various recommendations regarding how these techniques should be used during the scale construction process. Some authors suggest to use exploratory factor analysis on the entire data set while others advice to perform an internal cross-validation by randomly splitting the data set in two and then either perform exploratory factor analysis on both parts or (...) exploratory factor analysis on the first part and confirmatory factor analysis on the other. In spite of all these divergent recommendations, there is no consensus on which method yields the best result. In this paper, we analyze this issue in light of the prediction versus accommodation debate and argue that the answer to this question depends on one’s conception of the criteria that should be used to achieve the goals of the scientific enterprise. Additive particles are generally infelicitous in out-of-the-blue contexts. Kripke (in _Linguistic Inquiry_ 40(3):367–386, 2009 ) puts forward an influential idea that the additive presupposition they trigger has an anaphoric component that cannot be accommodated. Ruys (in _Linguistic Inquiry_ 46(2):343–361, 2015 ) proposes an alternative analysis that the observation can be explained in terms of conditions on deaccenting, claiming that in light of exceptional cases where additive particles can be used felicitously out of the blue, it is better to analyse the (...) additive presuppositions as existential presuppositions. However, such exceptional cases have not been given a systematic explanation so far. In this paper, we closely examine existing and novel examples where additive presuppositions are felicitously used out of the blue and argue that Ruys’s existential analysis as well as the Kripkean anaphoric approach face empirical issues. We propose a new analysis, according to which the _sui generis_ infelicity of additive particles in out-of-the-blue contexts is due to their focus sensitivity. Specifically, when an additive particle is used, two interpretive processes take place: (i) identification of a contextually relevant set of focus alternatives, and (ii) evaluation of the additive presupposition based on the focus alternatives so identified, which may result in accommodation. We claim that the felicity conditions on out-of-the-blue uses of additive particles emerge from the interplay between (i) and (ii). (shrink)

The “Authority Problem” is the problem that arises when speakers who lack authority successfully perform speech acts that require speaker authority in order to be felicitous. One solution that has been offered to the Authority Problem holds that the non-authoritative speaker of a successful authoritative illocution comes to have authority through a process of presupposition accommodation. I call this solution the Authority Accommodation Analysis, or AAA. In this paper, I argue that there is no Authority Problem, and thus, (...) no need for an AAA. The appearance of the problem relies on a conflation between the _felicity_ of speech acts and their _success_. Yet a speech act can be successfully performed even in the absence of felicity. While authority is often a felicity condition for certain speech acts, I argue that it need not be a success condition. Ultimately, the consequence of my argument is that I must reject conventionalism about illocutionary success. (shrink)

In interactive situations, agents can “learn” something that is not a preexisting truth. They can converge to an arbitrary convention, or tacit agreement. Once established they may even view it as an objective truth. Here we investigate accommodation dynamics for interpersonal comparisons of utility intervals. We show, for a large class of dynamics, convergence to a convention.

There are at present two ways in which to evaluate religiously-based claims to accommodation in the legal context. The first, objective approach holds that these claims should be grounded in « facts of the matter » about the religions in question. The second, subjective approach, is grounded in an appreciation by the courts of the sincerity of the claimant. The first approach has the advantage of accounting for the difference between two constitutional principles : freedom of conscience on the (...) one hand, and freedom of religion on the other. It has the disadvantage of transforming courts into expert bodies on religious matters. The subjective approach has a harder time accounting for the distinction. It also risks giving rise to a proliferation of claims. A plausible synthesis between the two approaches requires that we uncover the normative grounds justifying the granting by liberal democracies of religious accommodation. An analogous argument to that put forward by Kymlicka in the case of minority nations identifies the interest that citizens have in being able to exercise their « cultural agency » : the creative reappropriation and reinterpretation of the rituals, practices and norms of religious traditions.Il existe à l’heure actuelle dans le contexte juridique deux principales approches à l’évaluation de la légitimité des demandes d’accommodement pour des motifs religieux. La première, objective, affirme que ces demandes doivent pouvoir s’appuyer dans des faits concernant la religion en question. La seconde, subjective, s’appuie sur l’appréciation de la sincérité de la demande faite par le requérant. La première approche a l’avantage de rendre compte de la distinction entre les deux principes constitutionnels que sont, d’une part, la liberté de conscience, et de l’autre, la liberté de religion. Elle a l’inconvénient de tendre à ériger les tribunaux en « experts » sur des questions religieuses. L’approche subjective rend plus difficilement compte de la distinction entre les deux principes, et de plus risque de donner lieu à une prolifération de demandes. Pour atteindre une synthèse plausible de ces deux approches, il nous faut identifier les fondements normatifs justifiant l’intérêt que les démocraties libérales ont à reconnaître une telle catégorie d’accommodements. En prenant appui dans le célèbre argument de Kymlicka justifiant les droits de nations minoritaires, nous pouvons identifier un intérêt que ces types d’État ont à protéger les conditions permettant aux citoyens de manifester leur « agentivité culturelle », leur capacité à s’identifier en se les réappropriant et en les réinterprétant les normes, pratiques et rites issues de traditions religieuses.
