Biography
Nicholas Gaither was born about 1756, probably on the plantation Benjamins Lott that his father Edward Gaither was living on when willed to him by his father Benjamin Gaither in 1741. At the time of the will it was stated to be in Prince George's County, and became part of Frederick County in 1748.
From his father Edward's 1777 will in Montgomery County, he was willed several tracts of land that were to be divided between Greenbury Gaither, Nicholas Gather, Burgess Gather, Jonsey Gather and Brice Gather, and was under age 21.[1][2]
He was listed in the 1778 Maryland Census as being in Montgomery County but without township information. [3]
On 26 October 1779 he was married to Eleanor Greenfield by the Rev, Joseph Threlkeld in Montgomery County, Maryland.[4][5]
In 1787 he was granted 300 acres of land on both sides of the South Yadkin and remitted a fee of 50 shillings per 100 acres. About the same time he purchased for £200 land on Beaver Dam Creek, a branch of the South Yadkin from Charles Baley of Rowan County. At the formation of Iredell county in 1788 from Rowan, most, if not all, of his land fell into the former county. There he died in 1793. His will, dated January 4, 1793, devised his entire estate to his wife, Nelly, and at her decease to his four sons, Edward, Libetious, Horatio and Walter, all minors at that time. His widow soon married his cousin, Jeremiah Gaither, and had issue. In February 1829, she released her life interest in the estate for her first husband to her four sons and lived until her 97th year. She died testate on October 9, 1850, in Iredell County, naming her son Libitious, children of her son Horatio, and son Elam.[6]

Will
Nicholas Gaither wrote his will on 4 January 1793 in Iredell County, North Carolina.[8] The will was proved on 24 May 1793.[9]
"In the name of God Amen I Nicholas Gaither of the County of Iredell and State of North Carolina being sick & weak on body but of perfect mind & memory, thanks to God, Calling to mind the morality of my body & knowing it is appointed for men to die, do make and ordain this to be my last will & testament that is to say first of all I principally give my soul Into the hands of almighty god that gave it, & my Body I recommend to the earth to be Buried in a Christian Decent manner at the Discretion of my executor. Nothing Doubting but I shall receive the same again at the resurrection by the power of almighty God. -- & as touching such worldly estate herewith it has pleased almighty god to bless me in this life with I give Devise and dispose of the same in the following manner & form.
First I give & bequeath to Nelly my dearly Beloved Wife after my lawful Debts is Paid A Bay Horse known by the name of Jolly, two mills Corn & the furniture belonging to the kitchen the plantation to be rented for the term of two years & after that to be for the use of my wife during her natural Life. & the rents from Said Land to be for the use of the family.
Secondly I give & bequeath to my four sons, Edward, Lebitious, Oratio & Walter, A Bed without furniture to each of them the remainder of my property to be sold at the discretion of my executors Equally divided between my four above Named sons the plantation to be sold at the death of my wife Except her disease should be before the youngest bornes to age if that should happen at the time they become of age to be equally divided as above except so much of the whole amount of sail as shall purchase such articles as shall necessary for to work the plantation with at any time at the discretion of my executors before any division is made.
I will that my Children be schooled at the discretion of my executors & thereby ordain constitute I appoint my Dearly beloved wife& my true & trusty friend Jacob Nichols to be my whole & sole executor of this last will & testament & I do hereby Publish, Pronounce & declare this & no other to be my last will & testament on witness whereof I have set my hand & affixed my seal this fourth day of January in the year of our Lord one thousand seven hundred & ninety three. Nicholas was buried in Bethany Presbyterian Church Cemetery, Statesville, Iredell County. His headstone contains no birth or death dates, but stated he was in Murdock's Regiment, Revolutionary War.[10]
