Cooling is one of the most pressing pain points for data centers. As IT loads climb, so do costs forcing operators to choose between higher OPEX or limiting the power available for workloads. As the U.S. celebrated Independence Day, an important policy milestone was signed into law with the passage of the One Big Beautiful Bill Act (OBBBA) and it brings long-awaited clarity and momentum for the fuel cell and hydrogen industries. The legislation reinstates the Investment Tax Credit (ITC) for all stationary fuel cell technologies under Section 48E. That means: · A straightforward 30% ITC is available for qualified fuel cell property. · Projects using any fuel source (hydrogen of any origin, natural gas, propane, etc.) are now eligible. · The credit applies to projects that begin construction after December 31, 2025, and follows the existing phasedown schedule in Section 48E beginning in 2033. At the same time, OBBBA creates certainty in Section 45V for clean hydrogen projects that begin construction before January 1, 2028, giving the industry the foundation it needs to continue scaling and innovating. This outcome reflects years of sustained advocacy, and HyAxiom, Inc. was proud to be part of the effort.
