offending commit: git.kernel.org/pub/scm/linux/kernel/git/stable/linux.git/commit/… . Dates all the way back to the initial implementation of network namespaces in 2007 as a failsafe before implementation. Many such failsafes were removed (eg: arp, ipv4, ipv6, bridge bpdu ...) but not this one.
