Terms & Conditions

1. Definitions

1.1 In these Terms:
•“Booking” means your confirmed reservation for a private tour service.
•“Services” means the bespoke private tour experience provided by Sgùrr Tours.
•“Price” means the total agreed cost of the Services.
•“We / Us / Our” means Sgùrr Tours, Inverness, Scotland.
•“You / Your” means the individual or group making the Booking.
•“Event Outside Our Control” has the meaning given in clause 10.
1.2 References to “in writing” include email correspondence.

2. Formation of Contract

2.1 A binding contract is formed once:
•The required deposit or full payment has been received; and
•We have issued written confirmation of your Booking.
2.2 The confirmed itinerary, dates, and timings form part of the contract.
2.3 It is your responsibility to ensure all booking details are accurate at the time of confirmation.

3. Booking & Payment

3.1 Payment terms are governed by our Cancellation & Refund Policy, which forms part of these Terms.
3.2 We reserve the right to cancel any Booking where payment is not received in accordance with agreed terms.
3.3 All prices are quoted in GBP (£) and are valid at the time of booking confirmation.

4. Provision of Services

4.1 Sgùrr Tours provides private, chauffeur-guided Highland experiences.
4.2 While we endeavour to deliver itineraries as agreed, minor adjustments may be required due to:
•Weather conditions
•Road closures
•Access restrictions
•Operational considerations
4.3 Any such adjustments will be made in the interest of safety and service quality and will not materially diminish the experience.
4.4 We reserve the right to correct errors in marketing materials or correspondence at any time.

5. Guest Conduct

5.1 Guests are expected to conduct themselves respectfully at all times.
5.2 We reserve the right to terminate the Services without refund where behaviour:
•Poses a safety risk
•Is abusive or disruptive
•Compromises the comfort of others
5.3 Guests are responsible for any damage caused to vehicles or property and agree to reimburse repair or replacement costs.
5.4 Sgùrr Tours operates a zero-tolerance policy towards illegal substances and excessive intoxication.

6. Health & Accessibility

6.1 Guests must notify us in advance of any medical conditions, mobility requirements, or accessibility considerations.
6.2 We cannot accept liability for issues arising from undisclosed conditions.
6.3 Participation in outdoor touring activities involves inherent risks which guests acknowledge and accept.

7. Liability

7.1 We are liable for loss or damage resulting from our negligence where such loss is foreseeable.
7.2 Our total liability shall not exceed the total Price paid for the Services.
7.3 We are not responsible for:
•Loss of personal belongings
•Indirect or consequential losses
•Independent travel or accommodation arrangements
7.4 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any matter which cannot legally be excluded under Scottish law.

8. Photography & Media

8.1 We may capture photographs during tours for promotional use.
8.2 Guests may request removal of identifiable images in writing.

9. Events Outside Our Control

9.1 We shall not be liable for delays or cancellations caused by circumstances beyond our reasonable control.
9.2 Where such events occur, we will offer either:
•An alternative date; or
•A refund in accordance with our Cancellation & Refund Policy.

10. Governing Law

10.1 These Terms are governed by Scottish law.
10.2 Any disputes shall be subject to the jurisdiction of the Scottish courts.
