Twentieth century philosophers introduced the distinction between “objective rightness” and “subjective rightness” to achieve two primary goals. The first goal is to reduce the paradoxical tension between our judgments of (i) what is best for an agent to do in light of the actual circumstances in which she acts and (ii) what is wisest for her to do in light of her mistaken or uncertain beliefs about her circumstances. The second goal is to provide moral guidance to an (...) agent who may be uncertain about the circumstances in which she acts, and hence is unable to use her standard moral principle directly in deciding what to do. This paper distinguishes two important senses of “moral guidance”; proposes criteria of adequacy for accounts of subjective rightness; canvasses existing definitions for “subjective rightness”; finds them all deficient; and proposes a new and more successful account. It argues that each comprehensive moral theory must include multiple principles of subjective rightness to address the epistemic situations of the full range of moral decision-makers, and shows that accounts of subjective rightness formulated in terms of what it would reasonable for the agent to believe cannot provide that guidance. -/- . Chapter 1 of this book argued that moral philosophy should be based on seven principles of theory selection adapted from the sciences. Chapter 2 argued that these principles support basing normative moral philosophy on a particular problem of diachronic instrumental rationality: the ‘problem of possible future selves.’ Chapter 3 argued that a new moral principle, the Categorical-Instrumental Imperative, is the rational solution to this problem. Chapter 4 argued that the Categorical-Instrumental Imperative has three equivalent formulations akin to but superior to (...) Kant’s formulations of the Categorical Imperative. Chapter 5 argued that my principle’s three formulations make it rational to adopt a Moral Original Position to derive moral principles. The present chapter derives Four Principles of Fairness from the Moral Original Position--principles of coercion minimization, mutual assistance, fair negotiation, and virtue—and unifies them into a single principle of rightness: Rightness as Fairness. Finally, this chapter argues that Rightness as Fairness entails a novel approach to applied ethics called ‘principled fair negotiation’, illustrating how the theory provides a plausible new framework for addressing applied cases including lying, suicide, trolleys, torture, distribution of scarce resources, poverty, and the ethical treatment of animals. Elinor Mason draws on ethics and responsibility theory to present a pluralistic view of both wrongness and blameworthiness. Mason argues that our moral concepts, rightness and wrongness, must be connected to our responsibility concepts. But the connection is not simple. She identifies three different ways to be blameworthy, corresponding to different ways of acting wrongly. The paradigmatic way to be blameworthy is to act subjectively wrongly. Mason argues for an account of subjective obligation that is connected to the notion (...) of trying - to act rightly is try to do well by morality, to act wrongly (and to be blameworthy) is to fail to try hard enough. Trying involves understanding morality, those who do not grasp morality are in a different category. So agents might also be blameworthy for being oriented away from what really matters. In that case, agents are blameworthy in a different sense, the detached sense. Finally, we can become blameworthy by taking responsibility in cases where our agency is ambiguous. In the final section, Mason gives us an account of taking responsibility and agues that that is an important art of our responsibility practices. (shrink)

In this paper I argue that the disagreement between modern moral philosophers and (some) virtue ethicists about whether motive affects rightness is a result of conceptual disagreement, and that when they develop a theory of ‘right action,’ the two parties respond to two very different questions. Whereas virtue ethicists tend to use ‘right’ as interchangeable with ‘good’ or ‘virtuous’ and as implying moral praise, modern moral philosophers use it as roughly equivalent to ‘in accordance with moral obligation.’ One implication (...) of this is that the possibility of an act being right by accident does not pose a problem for consequentialism or deontology. A further implication is that it reveals a shortcoming in virtue ethics, namely that it does not—yet needs to—present an account of moral obligation. (shrink)

My goal in this paper is to show that two theses that are widely adopted among Kantian ethicists are irreconcilable. The paper is divided into four sections. In the first, I briefly sketch the contours of my own positive view of Kantian ethics, concentrating on the issues relevant to the two theses to be discussed: I argue that agents can perform actions from but not in conformity with duty, and I argue that agents intentionally can perform actions they take to (...) be contrary to duty. In the second, I focus on Barbara Herman’s non-accidental rightness condition from “On the Value of Acting from Duty.” In the third, I focus on Christine Korsgaard’s guise of the objectively good from “Formula of Humanity.” In the fourth, I explain why the positions developed by Herman and Korsgaard are irreconcilable and I make a suggestion about how to move forward. It has become increasingly common for philosophers to distinguish between objective and subjective rightness, and there has been much discussion recently about what an adequate theory of subjective rightness looks like. In this article, I propose a new theory of subjective rightness. According to it, an action is subjectively right if and only if it minimizes expected objective wrongness. This book argues that moral philosophy should be based on seven scientific principles of theory selection. It then argues that a new moral theory—Rightness as Fairness—satisfies those principles more successfully than existing theories. Chapter 1 explicates the seven principles of theory-selection, arguing that moral philosophy must conform to them to be truth-apt. Chapter 2 argues those principles jointly support founding moral philosophy in known facts of empirical moral psychology: specifically, our capacities for mental time-travel and modal imagination. Chapter 2 (...) then shows that these capacities present human decisionmakers with a problem of diachronic rationality that includes but generalizes beyond, L.A. Paul’s problem of transformative experience: a problem that I call “the problem of possible future selves.” Chapter 3 then argues that a new principle of rationality—the Categorical-Instrumental Imperative—is the only rational solution to this problem, as it requires our present and future selves to forge and uphold a recursive, bi-directional contract with each another given mutual recognition of the problem. Chapter 4 then shows that the Categorical-Instrumental Imperative has three identical formulations analogous but superior to Immanuel Kant’s various formulations of his ‘categorical imperative.’ Chapter 5 shows that these unified formulas jointly entail a particular test of moral principles: a Moral Original Position similar to John Rawls’ famous ‘original position’, but which avoids a variety of problems with Rawls' model. Chapter 6 then shows that the Moral Original Position generates Four Principles of Fairness, which can then be combined into a single principle of moral rightness: Rightness as Fairness. This new conception of rightness is shown to reconcile four dominant moral frameworks (deontology, consequentialism, virtue ethics, and contractualism), as well as entail a new method of moral decisionmaking for applied ethics: a method of “principled fair negotiation” according to which applied ethical issues cannot be wholly resolved through principled debate, but must instead be resolved by actual negotiation and compromise. This method is then argued to generate novel, nuanced analyses of a variety of applied moral issues, including trolley cases, torture, and the ethical treatment of nonhuman animals. Chapter 7 then shows that Rightness as Fairness reconciles three leading political frameworks—libertarianism, egalitarianism, and communitarianism—showing how all three embody legitimate moral ideals that can, and should, be fairly negotiated against each other to settle the scope, and nature, of domestic, international, and global justice on an ongoing, iterated basis. Finally, Chapter 8 argues that Rightness as Fairness satisfies all seven of the principles of theory-selected defended in Chapter 1 more successfully than rival theories. (shrink)

This article questions the traditional view that moral rightness and wrongness are discrete predicates with sharp boundaries. I contend that moral rightness and wrongness come in degrees: Some acts are somewhat rightandsomewhat wrong. My argument is based on the assumption that meaning tracks use. If an overwhelming majority of competent language users frequently say that some acts are a bit right and a bit wrong, this indicates that rightness and wrongnessaregradable concepts. To support the empirical part of (...) the argument I use the tools of experimental philosophy. Results from three surveys (n= 715, 578, and 182) indicate that respondents userightandwrongas gradable terms to approximately the same extent as color terms, meaning that rightness and wrongness come in degrees roughly as much as colors do. In the largest study, only 4 percent persistently usedrightandwrongas non-gradable terms. (shrink)

This paper argues against Martin Peterson in favour of the ‘standard view’ of rightness, according to which rightness does not come in degrees. It begins with a defence of the standard view against the charge that it is committed to ‘deontic leaps’. It goes on to claim that greater conceptual parsimony would allow Peterson to avoid certain problems involving equality and related matters that arise out of his conception of moral value, and that Peterson should take the same (...) instrumentalist attitude towards the norms of practical rationality as he does towards the norms of common-sense morality. Li (禮) and yi (義) are two central moral concepts in the Analects. Li has a broad semantic range, referring to formal ceremonial rituals on the one hand, and basic rules of personal decorum on the other. What is similar across the range of referents is that the li comprise strictures of correct behavior. The li are a distinguishing characteristic of Confucian approaches to ethics and socio-political thought, a set of rules and protocols that were thought to constitute the wise (...) practices of ancient moral exemplars filtered down through dynasties of the past. However, even while the li were extensive and meant to be followed diligently, they were also understood as incapable of exhausting the whole range of activity that constitutes human life. There were bound to be situations in life where there would be no obvious recourse to the li for guidance. As part of their reflections on the good life, the Confucians maintained another moral concept that seemed to cover morally upright exemplary behavior in these types of situations. This concept is that of yi or rightness. In this chapter, I begin with a brief historical sketch to provide some context, and will then turn to li and yi in turn. In the end, I will suggest how li and yi were both meant to facilitate the supreme value of social harmony that pervades much of the Analects and serves as its ultimate orientation. (shrink)

Internalism in ethical theory is usually understood as the view that there is a noncontingent connection between moral rightness and motivation. The chapter develops the analogous suggestion that there is a noncontingent connection between moral rightness and responsibility. Externalists about motivation hold that it might be an open question whether people have reason to comply with moral principles. Externalists about responsibility similarly hold that it might be an open question whether there is reason to blame people for failing (...) to comply with moral principles. From the fact that an action would be wrong, for instance, it doesn’t follow that our social relations should be structured in a way that blames people when they perform actions of that type. That an action is wrong is not itself a reason for holding people accountable on the externalist view. The chapter argues against this approach, exploiting the analogy with internalism about motivation in support of an internalist account of responsibility. In particular the chapter suggests that moral principles have it as part of their function to ground responsibility relations between people and that an interpretation of those principles that was ill-suited to this function would be deficient on that account. Morality, on the modern conception of it that this chapter is sketching, is an essentially relational or social phenomenon, and internalism about responsibility is one aspect of its relational character. Goodman and Elgin want truth to be demoted and rightness to be promoted. In the first part of this paper the main reasons they offer for this reorientation are discussed. Goodman once suggestedthat one construe truth as acceptability that is not subsequently lost, but later he quietly dropped this proposal. In the second part of this paper it is argued that ultimate acceptability is indeed neither a necessary nor a sufficient condition for truth.

We express and communicate many attitudes beyond belief, such as amusement, joy, admiration, hatred, and desire. I consider whether there are any general norms that would cover all of these cases. The most obvious generalisation of the most popular norms for assertion, fittingness-based theories, fail in part because it is sometimes an intrinsic good to have certain kinds of mental states. I develop an alternative, rightness-based, approach, according to which it is appropriate to communicate a mental state to an (...) interlocutor when it is right to make the interlocutor have that mental state because of the speech act. This view arises naturally from conversational participants’ common interests, and it helps to make sense of linguistic phenomena like expressives. (shrink)

Motive and Rightness is the first book-length attempt to answer the question, Does the motive of an action ever make a difference in whether that action is morally right or wrong? Steven Sverdlik argues that the answer is yes. His book examines the major theories now being discussed by moral philosophers to see if they can provide a plausible account of the relevance of motives to rightness and wrongness. Sverdlik argues that consequentialism gives a better account of these (...) matters than Kantianism or certain important forms of virtue ethics. In carrying out the investigation Sverdlik presents an analysis of the nature of motives, and he considers their relations to normative judgments and intentions. A chapter is devoted to analyzing the extent to which motives are 'available' to rational agents, and the importance of feelings and unconscious motives. Historical figures such as Kant, Bentham, Mill and Ross are discussed, as well as contemporary writers like Korsgaard, Herman, Hurka, Slote and Hursthouse. Motive and Rightness is unusual in its interweaving of ethical theory, both historical and contemporary, with moral psychology, action theory, and psychology. (shrink)

In this extended examination of the Oxford deontologists' claim that rightness cannot be based upon goodness, Johnson argues that although the deontologists' arguments against the utilitarians are valid, their positive position must be rejected. Because Ross's "ought-can" argument and the "infinite regress" argument break down, the moral goodness of motives must be regarded as a necessary but not sufficient condition for moral rightness. The article reflects upon Michael Krausz’s account of contemporary debates between singularity and pluralism in the determination ofrightness, and uses that occasion to ask after the larger course of which these debates are a part. Looking to the companion effort to determine truth and rightness at law, it finds telling echoes of those debates in the modem history of legal thought, and sketches that history to the end of drawing out its implications for the project at determining rightness (...) more generally. My purpose in the present paper is two-fold: to provide a theoretical framework for understanding the difference between rightness and virtue; and to systematically account for the role of objective rightness in an individual person's decision making. I argue that a decision to do something virtuous differs from a decision to do what's right not simply, as is often supposed, in being motivated differently but, rather, in being taken from a different point of view. My argument to that (...) effect is the following. The 'objectively right' course of action must be right, 'neutrally' speaking, that is right for each of the participants in a given situation: if it is right for you to do A, then it cannot, at the same time, be right for me to prevent you from doing A. But the latter is precisely how things work with virtuous action: for instance, it may be virtuous of you to assume responsibility for my blunder, but it isn't virtuous of me to let you do so. I maintain, on this basis, that, while objectivity does have normative force in moral decision-making, the objective viewpoint is not, typically, the viewpoint from which decisions to act virtuously are taken. In pluralistic societies that lack common ethical, social, and political values, legal interpretation is constantly under siege. Just interpretations—that is, interpretations that reflect a shared vision of justice—may become just interpretations in the sense of mere interpretations, rooted in the orientations and interests of different groups. Confronting this crisis in legal interpretation, _Just Interpretations_ offers a critical appraisal of the principal theoretical trends in contemporary American and European jurisprudence and proposes an alternative approach. Michel Rosenfeld's critique focuses on neoformalism, pragmatism, (...) discourse theory, and legal autopoiesis, and includes discussions of such authors as Habermas, Rorty, Posner, Luhmann, Dworkin, Fish, and Weinrib. To overcome the drawbacks of these theories, Rosenfeld elaborates a theory of "comprehensive pluralism," based on a substantive vision of pluralism. This approach, building on the insights of deconstruction, turns the fact of pluralism into a guiding normative imperative. _Just Interpretations_ will attract the attention of constitutional scholars, political scientists, and critical theorists, and will also address an interdisciplinary audience interested in texts, interpretations, and postmodern concerns with justice. Marcus Arvan’s Rightness as Fairness is a highly ambitious book. In fewer than 230 pages, hopes to demonstrate that we ought to evaluate moral theories in a similar manner to sciences, that existing moral theories fall short on that evaluation, that moral normativity reduces to instrumental rationality, and that a new theory of ‘rightness as fairness’ meets the scientific evaluative standards better than any of the alternatives.

The article concerns the situation of the judicial application of the law where the entity applying the law refers in a decision-making process to moral principles. The decision should be based on the directives of interpretation, which indicate the need for such a determination of the meaning of the applicable norms so that it remains in harmony with commonly accepted moral rules of the society. The equity has one more purpose; namely, it allows for the process of decision-making—and not just (...) for the process of unifying the decisions—since the mere rule does not specify the algorithm of undertaking them. This rule thus assumes that it will be further specified by phronesis judge who in a given situation will determine—for the purposes of a particular decision—a hierarchy between the criteria of substantive justice “embedded” in this rule. The reference to equity stands for the concretization of an unspecified general rule. We deal here with an indefinite general rule, the application of which is facilitated by a reference to rightness. (shrink)
