Three claims about love and justice cannot be simultaneously true and therefore entail a paradox: (1) Love is a matter of justice. (2) There cannot be a duty to love. (3) All matters of justice are matters of duty. The first claim is more controversial. To defend it, I show why the extent to which we enjoy the good of love is relevant to distributive justice. To defend (2) I explain the empirical, (...) conceptual and axiological arguments in its favour. Although (3) is the most generally endorsed claim of the three, I conclude we should reject it in order to avoid the paradox. (shrink)

The focus of this essay is on how we overcome the past by dealing with it. In this setting, the analysis is of the relationship between ‘moral transactions’ concerning blame, guilt, responsibility, apology and forgiveness and the possibility of transition away from states of trauma. The first section draws on previous work to set out a position on human love as the basis for an understanding of guilt and the ‘moral grammar’ of justice. The second section considers Martha (...) Nussbaum’s claim in Anger and Forgiveness that the idea of transition should be prioritized at the cost of a moral transactional analysis that would engage the moral grammar of blame, guilt, responsibility, apology and forgiveness. The latter is seen as potentially obstructing the transition to a better world. I suggest to the contrary there are grounds for thinking that a successful transition requires relevant moral transactions. (shrink)

A common theme in twentieth century Christian ethics was that the agapic love for the neighbor that Jesus commands is to be understood as gratuitous benevolence, and that love, so understood, is in tension with justice. The author argues that this is a misinterpretation of Jesus’ love command, and that when agapic love is rightly understood, there is no conflict between love and justice. Jesus’ second love command is a quotation from Leviticus (...) 19. When we look at the context of the command in Leviticus, we see that doing justice is not pitted against love but is instead an example of love. The author concludes by proposing that agapic love be understood as care rather than gratuitous benevolence. When we care about someone, we see to it that they are treated justly. (shrink)

This essay examines two tendencies in lesbian ethics as differing visions of community, as well as contrasting views of the relationship between the erotic and the ethical. In addition to considering those authors who make explicit claims about lesbian ethics, this paper reflects on the works of some lesbians whose works are less frequently attended to in discussions about lesbian ethics, including lesbians writing from the perspectives of theology and of literature.

In Justice in Love, Nicholas Wolterstorff argues for a unique ethical orientation called “care-agapism.” He offers it as an alternative to theories of benevolence-agapism found in Christian ethics on the one hand and to the philosophical orientations of egoism, utilitarianism, and eudaimonism on the other. The purported uniqueness and superiority of his theory lies in its ability to account for the conceptual compatibility of love and justice while also positively incorporating self-love. Yet in attempting to (...) articulate a “bestowed worth” account of human dignity—in which dignity is given by divine love and respected in acts of justice—Wolterstorff leans on an unstable characterization of how love and the good are conceptually interwoven. As a result, his reader cannot be sure about the theoretical superiority of care-agapism. Moreover, Wolterstorff's attempt to value self-love and at the same time reject eudaimonism depends on a dubious interpretation of Augustine carried over from Justice: Rights and Wrongs, which itself further depends on a mischaracterization of the possible varieties of eudaimonism. This mistake is unfortunate because, on a closer reading of Augustine, one finds an agapistic account of eudaimonism that could have significantly helped Wolterstorff's overall account of the complementary relation of love and justice. Faith, hope, and love, traditionally called theological virtues, are central to Christianity. This book renews faith, hope, and love in the context of the many contemporary challenges in many unique ways. It is an ecumenical collection of papers, equally divided between Catholic and Protestant positions, that seek to radically renew the classical doctrine of faith, hope, and love, and argues for their essential connection to the praxis of justice. It contains eight different approaches, each represented by (...) a distinguished theologian and addressing different aspects of the issues and followed by insightful and critical responses. It does not merely seek to renew the theological virtues but to also reconstruct them in the demanding context of justice and the contemporary world, nor is it simply a treatise on justice but a theoretical and practical reflection on justice as vital expressions of faith in God, hope in God, and love of God. A non-dogmatic and non-ideological approach, it accommodates both conservative and liberal positions, and avoids the separation of the theological virtues from the demands of the contemporary world as well as the separation of justice talk from the theological context of faith, hope, and love. It seeks above all to renew, not merely repeat, the classical doctrine of faith, hope, and love in the contemporary context of the urgency of justice, and to do so ecumenically, comprehensively, and from a variety of perspectives and aspects. I argue that justice and love are interconnected, where one makes little sense in isolation from the other. Love and justice have often been conceived as not only sharply distinct, but divergent in their aims and sometimes, conflicting in their demands. Justice has been perceived as having no place in loving relations, while some have argued that the particularistic and partial nature of loving is inconsistent with impartial, universal morality. I refer to this perceived contrast (...) as the “love and justice dichotomy,” LJD. I will briefly examine a few theories of love and care to illustrate the history of the LJD, and explore those theorists whose work challenges the LJD, particularly Velleman’s. I then argue for the beginnings of in what a feminist-focused theory of love consists (empowering and promoting the autonomy of the beloved), resulting in a further breaking down of the LJD. Drawing upon these challenging works and my own conception of love, I argue that the LJD is an illusion. (shrink)

Drawing from our interdisciplinary qualitative study of LGBTI conservative Christians and their allies, we name an especially toxic form of shame—what we call sacramental shame—that affects the lives of LGBTI and other conservative Christians. Sacramental shame results from conservative Christianity's allegiance to the doctrine of gender complementarity, which elevates heteronormativity to the level of the sacred and renders those who violate it as not persons, but monsters. In dispensing shame as a sacrament, nonaffirming Christians require constant displays of shame as (...) proof that LGBTI church members love God and belong in the community. Part of what makes this shame so harmful is that parents and pastors often dispense it with sincere expressions of care and affection, compounding the sense that one's capacity to give and receive love is damaged. We foreground LGBTI Christian movements to overcome sacramental shame by cultivating nonhubristic pride, and conclude by discussing briefly their new understandings of love and justice that could have far‐reaching benefits. Through the framework of Ricoeur’s philosophy, Fredriksson and Eriksson develop an influential ethics of the caring conversation, which instructs nurses to have caritas, self-esteem, and autonomy on one hand and to engage respectfully and responsibly in caring conversations on the other. This article brings the ethics of the caring conversation into dialogue with Ricoeur’s philosophy again. While Fredriksson and Eriksson draw upon Ricoeur’s little ethics, this article relies on Ricoeur’s dialectic of love and justice. The dialogue throws light (...) on other aspects of caritas, which is vital in Fredriksson and Eriksson’s ethics. The purpose of this paper is an attempt to present and analyse one of the most intriguing and unique elements of Leibniz’s philosophy of right—the relationship between love and justice —mainly based on selected excerpts from the Elementa Iuris Naturalis and the preface to the Codex Iuris Gentium Diplomaticus. The author presents the characteristics of this close connection and she tries to answer the question about the reasons for this relationship referring to the metaphysical assumptions and principles of (...) Leibniz’s philosophy. The relationship between love/care and justice was one of the key tensions from which care ethics originated; to this very day it is subject of debate between various streams of thought within care ethics. With some exceptions (e.g. Christa Schnabl) most approaches have in common the belief that care and justice are mutually exclusive concepts, or at least as so different that their application is situated on different levels. Hence, both are complementary, but distinct, so that there (...) is no real interaction. This paper aims to investigate whether, and if so, how, a deeper understanding of Ricoeur’s thoughts on this matter enriches the relationship between care and justice with respect to care ethics. This connection suggests itself from Ricoeur’s interpretation of the relationship as a dialectical one in which the logic of superabundance (love) and the logic of equivalence (justice) meet. Care enables people to see the face and individuality of the one, ‘le chacun,’ within the anonymous structures of justice that tend to reduce all human beings to the anonymous each, ‘le on’; justice in its turn is the precondition for love to become incarnated and made real. What may this view—of care and justice standing in close connection, in which they correct and strengthen each other—add to the understanding of concrete practices of care? (shrink)

This book seeks to reframe our understanding of the lawyer's work by exploring how Martin Luther King, Jr built his advocacy on a coherent set of moral claims regarding the demands of love and justice in light of human nature. King never shirked from staking out challenging claims of moral truth, even while remaining open to working with those who rejected those truths. His example should inspire the legal profession as a reminder that truth-telling, even in a society (...) that often appears morally balkanized, has the capacity to move hearts and minds. At the same time, his example should give the profession pause, for King's success would have been impossible without his substantive views about human nature and the ends of justice. The planet seems to be heading into an ecological catastrophe, in which the earth will become uninhabitable for many species, including human beings. At the same time we humans are beset by appalling injustices. The Rio Declaration which addressed both these sets of problems contains conceptual contradictions about ‘development and ‘nature’. This paper addresses the issue of whether it is logically possible to work for both global justice and ecological sustainability. The article proposes a way of responding to the (...) spirit of the Rio Declaration without reinstating its contradictions; considers a posthuman perspective on the issue; and proposes a phenomenological approach to ethics and justice which would include both the human and more-than-human parts of the world. ABSTRACT The law, serving as a codification of the commitments and values of “White space,” often treats love and justice as separable and separate values, experiences, and institutions. Black love, on the contrary, is bound up with and, even, identified with justice. This inextricability is painted masterfully in the interstices of Zora Neale Hurston's, Their Eyes Were Watching God. The story, widely framed as a woman's journey to autonomy and love, is just as much the (...) story of her search for justice. This article uses Hurston's narrative of love and justice, Paulo Freire's critical pedagogy of humanization, and law to illustrate the implications of Black love for engaging legal justice in White space. In this paper I take up the question about the unity of justice in Aristotle and advocate for a robust relationship between lawfulness and equality, the two senses of justice that Aristotle distinguishes in Nicomachean Ethics V. My strategy is to focus on Aristotle’s indication in NE V 2 that “other-relatedness” is the common element shared by the two justices and turn to Aristotle’s discussion of the notion of self-love in EN IX 8 to explain what that (...) means. I argue that the other-relatedness of justice can be characterized in terms of proper self-love. Concretely, the discussion of self-love makes clear that those who are concerned with the well-being of others in their community over their own material gain—i.e., those who are lawful and not grasping or pleonectic—are able to see that their own self-interest is in harmony with acting in benefit of their community. This shows that there is an intimate link between lacking pleonectic inclinations and being able to act for the sake of the common good—and in general, between lacking pleonectic inclinations and being virtuous in relation to others. For centuries, Christian piety was centred on the notion of charity, which indicated both God’s love for humankind and human charitable works towards fellow human beings. Both events were certain. At the end of the fifteenth century, this system began to collapse. As both the self-evidence of divine love and the value of charitable works were questioned, a widespread crisis shook the religious life of many devout Christians. Anxiety, insecurity, inadequacy, predestination, divine justice, punishment, eternal perdition, and (...) questions over the worthiness of neighbourly love itself became the main ingredients of religious piety. The inability of the ecclesiastical institutions to offer valid answers further exacerbated the crisis. A secular priest Gabriele Biondo tried to offer his own solution to this widespread crisis that had reached his own parish. (shrink)

ABSTRACT There could hardly have been a more influential twentieth-century philosophical essay than Elizabeth Anscombe’s ‘Modern moral philosophy’, in which she condemned the prevailing and competing ethics of duty and utility of her day and urged moral philosophers to abandon the search for any general conception of ‘morality’ in favour of return to Aristotle’s more particular focus on virtue and virtues as powers or qualities of good human character. While moral philosophers have not been slow to rally to this banner—with (...) timely and useful attention to a wide range of character virtues—it was inevitable that moral educationalists would also soon turn towards understanding virtuous character to be a prime if not main concern of moral education. However, without denying that recent moral philosophical attention to virtue and virtues has been worthwhile, it is crucial to appreciate that in and of themselves such qualities mostly fall short of moral status and value and that some independent criterion of the moral cannot, as Anscombe recommended, be renounced. In this spirit, the present paper also attempts to comprehend such moral and educational significance by reference to interlinked concepts of love, knowledge and justice. (shrink)

This paper provides an overview of the Integrative Justice Model (IJM) for impoverished populations that was introduced in the marketing literature in the year 2009. The IJM was developed as a normative ethical framework to guide the growing corporate interest in the base of the pyramid (BoP) market to be fair and just to all parties but particularly the impoverished customer. In an impersonal marketplace that often exploits the less advantaged participant, the IJM provides five characteristics of “just” market (...) situations. These are an authentic non-exploitative engagement, value co-creation, investment in future consumption, stakeholder interest representation and long-term profit management. At the heart of the IJM is love that flows from a recognition of the inherent dignity of those at the BoP and the need to respect and uphold that dignity in the marketplace. The hope is that as companies embrace the IJM in their functioning it will result in a marketplace that is fair, just, humanistic and loving. (shrink)

His call for new creation, then, is not an attempted escape from earthly life, but for the transformation of the ethos of autonomy, prestige, and wealth that has led to the degradation of self, city, and creation. In place of the self-made gentleman and independent sage, Paul extols the vulnerable and related body of Christ animated by love. Rawls's congruence arguments attempt to show that in the well-ordered society, the reasons citizens have for maintaining a sense of justice are decisive. This chapter develops an interpretation of ‘decisiveness’. It then reconstructs the first of Rawls's two main arguments for congruence, referred to here as “the Argument from Love and Justice”. That argument, when properly reconstructed, sheds light on Rawls's enigmatic claim that justice is continuous with the love of mankind. For Rawls, the demands of justice compete with moral and religious obligations that are part of citizens’ comprehensive doctrines. The ways we love are shaped by our comprehensive doctrines; however, love can also stand in opposition to our moral and religious beliefs. I will argue that love – spousal, familial and associational – constitutes its own register of values along with its own set of obligations. For this reason love confronts not only our moral and (...) religious beliefs, it also confronts the demands and requirements of justice. Rawls has worked out a negotiated peace between the obligations of justice and the demands of citizens’ comprehensive doctrines in the form of an overlapping consensus on a free-standing political conception of justice. Although no one unified anarchist theory exists, educational approaches can be taken to support the full liberation of the self and the construction of an interconnected community that strives to rid itself of eco-sociocultural oppressions. An anarchist pedagogical approach could be one that is rooted in a love/rage unit of analysis occurring along a spectrum of various types of actions and contributions within a community. Anarchism as a violent destruction of the state is a stereotypical view that has perhaps (...) led to its own early demise as a social movement. Anarchism that embraces adaptation through more inclusive forms of resistance, including a reconstruction for the K?12 classroom context, is one that stands a chance in evolving a society toward love, justice, and empowerment. This article explores those possibilities aiming for accessibility while still honoring core anarchist calls for strong, localized democratic participation and decision-making outside of permanent hierarchies. This book interrogates the theological statement of God loving diversity and justice from the multi-religious, multi-ethnic, multi-disciplinary, and multi-gendered identities of the contributors. They engage selectively the various sources of their diverse traditions, including the Sikh scriptures, the Bible, the Qur’an, the movies, the Declaration of Human Rights, and the transgender movement. The result is a serious historical, literary, cultural, and religious discourse that fends against intellectually rigid thought and simplistic belief systems.

This essay seeks to start a dialogue between two traditions that historically have interpreted the economy in opposing ways: the individualism of classic economic liberalism (CEL), represented by Adam Smith and Milton Friedman, and the communitarianism of Catholic social teaching (CST), interpreted primarily through the teachings of popes and secondarily the U.S. Catholic bishops. The present authors, an economist and a moral theologian who identify with one or the other of the two traditions, strive to clarify objectively their similarities and (...) differences with the opposing perspective. Section one focuses on each position''s perspective of love of self and love of others. We find both CEL and CST saying that self-love, rightly understood, constitutes a moral good and that the love of others serves as an important principle in the political economy. We find less agreement in section two regarding justice and rights, but even here, we discover a few surprises. Both traditions uphold justice (giving to each party what is due) as essential to the political economy, and recognize some similarity in that type of justice called commutative. We note, however, substantial differences regarding a second type of justice that we call "public justice." First, they differ over the extent to which government should be involved. Here the meaning of rights, especially that of individual freedom, arises. Secondly, the traditions diverge over whether benevolence as a motivator ought to serve as a partner for public justice. Thirdly, CEL in general opposes CST''s emphasis on social justice that calls upon institutions to be proactive in helping citizens and groups to become active participants in the economy. We conclude our essay by summarizing our discoveries and by suggesting areas for further dialogue. (shrink)
