One of the problems in economics that economists have devoted a considerable amount of attention in prevalent years has been to ensure consistency in the models they employ. Assuming markets to be generally in some state of equilibrium, it is asked under what circumstances such equilibrium is possible. The fundamental mathematical tools used to address this concern are fixed point theorems: the conditions under which sets of assumptions have a solution. This book gives the reader access to the mathematical techniques (...) involved and goes on to apply fixed point theorems to proving the existence of equilibria for economics and for co-operative and noncooperative games. Special emphasis is given to economics and games in cases where the preferences of agents may not be transitive. The author presents topical proofs of old results in order to further clarify the results. He also proposes fresh results, notably in the last chapter, that refer to the core of a game without transitivity. This book will be useful as a text or reference work for mathematical economists and graduate and advanced undergraduate students. (shrink)

Some proponents of global justice question that opening borders is an effective strategy to alleviate global poverty and reduce inequalities between countries. This article goes a step further and asks whether an open borders policy is compatible with the objectives of global distributive justice. The latter, it will be argued, entails the ordering of needs, the assignment of priorities and the preference or subordination of some interests over others. In other words, global justice requires the establishment of conditions (...) and restrictions on mobility. On the contrary, open borders claim an unrestricted and unconditional (not unqualified) freedom of movement, limited only by public health considerations, serious threats to national security or democratic institutions, but not by an aspiration for maximizing global redistributive utility. The main point is that not only would freedom of movement be instrumentalized, losing its presumptive moral force, but ultimately open borders as a remedy of global justice are an oxymoron. Ecological refugees are expected to make up an increasing percentage of overall refugees in the coming decades as predicted climate change related disasters will displace millions of people. In this essay, I focus on those rights ecological refugees may claim on the basis of collective self-determination. To this end, I will focus on a few specific cases that I call cases of ‘ecological refugee states’. Tuvalu, the Maldives, and to a certain extent, Bangladesh are predicted to be ecological refugee states (...) in the near future. These are states whose entire (or close to it) geographical territory is predicted to be lost to rising sea levels; the collective body of the people will itself become an ecological refugee.The question is: what may the people of an ecological refugee state legitimately claim on the basis of their right to self-determination? Should we redraw state borders to accommodate a New Tuvalu? I argue that a plausible position regarding territorial rights is that when (1) a people clearly is (or recently was) self-determining and has a legitimate claim to continue to be self-determining, and (2) the self-determination of a people is existentially threatened because the people lacks territorial rights, that (3) the people becomes a candidate for sovereign over a new territory. The result is that existing state borders may need to change to accommodate something like a New Tuvalu. To generate these results on behalf of ecological refugee states, I examine the principles of the system of territorial states. Because the system of territorial states is a system of exclusive rights over goods, especially land, it is possible that it is subject to the conditions of a Lockean proviso mechanism. The open borders view is frequently dismissed for making infeasible demands. This is a potent strategy. Unlike normative arguments regarding open borders, which tend to be relatively intractable, the charge of infeasibility is supposed to operate as what we call a "normative argument-stopper." Nonetheless, we argue that the strategy fails. Bringing about open borders is perfectly feasible on the most plausible account of feasibility. We consider and reject what we take to be the only three credible ways (...) to save the charge of infeasibility: by proposing an alternative account of feasibility; by proposing an alternative, more circumscribed interpretation of the subject-matter of feasibility claims; and by proposing a more expansive account of the addressees of the demand for open borders. The first fails to vindicate the claim that infeasibility is a normative argument-stopper. The second does not provide an argument against open borders at all. The third underestimates the power of at least some non-state actors. We conclude by drawing some lessons for the open borders view and the use of feasibility in politics more generally. (shrink)

Supporters of open borders sometimes argue that the state has no pro tanto right to restrict immigration, because such a right would also entail a right to exclude existing citizens for whatever reasons justify excluding immigrants. These arguments can be defeated by suggesting that people have a right to stay put. I present a new form of the exclusion argument against closed borders which escapes this “right to stay put” reply. I do this by describing a kind of (...) exclusion that has not been discussed in depth, which I call “territorial exclusion.” Territorial exclusion is the process according to which the group that wishes to exclude current citizens secedes from the territory in which those citizens reside. I argue that the wrongness of territorial exclusion explains why there is no pro tanto right for a state to exclude immigrants, because otherwise there would be a pro tanto right for the state to kick people out by seceding from the territory they inhabit. Because kicking people out like this is typically wrong, borders cannot be closed. (shrink)

This work explores the increasing militarization of borders throughout the world, particularly the United States border with Mexico. Rather than further rhetoric of "border security," this work views increases in guards, technology and the building of walls as militarized action. The goal of this essay is to place the onus upon states to justify their actions at borders in ways that do not appeal to tropes of terrorism. This work then explores how a logic of security infiltrates philosophical (...) discussions of "the right to exclude," thereby curtailing the ability to see borders in any other way than as a locale that must be militarized. Specifically, I analyze the work of Michael Blake and his juridical theory of immigration restrictions. I argue that his work necessitates the walling of borders and removal of those who create new obligations for current members of existing political institutions. (shrink)

A Border Disputeintegrates the latest work in logic and semantics into a theory of language learning and presents six worked examples of how that theory revolutionizes cognitive psychology. Macnamara's thesis is set against the background of a fresh analysis of the psychologism debate of the 19th-century, which led to the current standoff between logic and psychology. The book presents psychologism through the writings of John Stuart Mill and Immanuel Kant, and its rejection by Gottlob Frege and Edmund Husserl. It then (...) works out the general thesis that logic ideally presents a competence theory for part of human reasoning and explains how logical intuition is grounded in properties of the mind. The next six chapters present examples that illustrate the relevance of logic to psychology. These problems are all in the semantics of child language (the learning of proper names, personal pronouns, sortals or common nouns, quantifiers, and the truth-functional connectives) and reflect Macnamara's rich background in developmental psychology, particularly child language - a field, he points out, that embraces all of cognition. Technical problems raised by but not included in the examples in the main part of the text are dealt with in a separate chapter. The book concludes by describing laws in cognitive psychology, or the type of science made possible by Macnamara's new theory. Our energy systems are truly international, and yet even now, our energy policies tend to be grounded at the national level and in many instances, remain ill-equipped to tackle transboundary energy issues. Our energy policy systems are also largely detached from the concerns of ethics or justice. It follows that we must find new and innovative ways of not conceptualising these normative issues, but of operationalising response to them. This book stems from the emergent gap: the need for comparative approaches (...) to energy justice, and for those that consider non-Western ethical traditions. Opening the edited volume, this chapter begins by giving context to the concept of “energy justice” itself and outlines our comparative philosophical approach to it, focusing specifically on “global philosophy” for its role in dialectically engaging with philosophies from around the world. We then show how the different chapters of the volume contribute to this purpose in four parts: setting the scene, practice, applying theory to practice and theoretical approaches. The final section of this chapter concludes with reflections on the contribution of global philosophy approaches to energy justice as with a set of future research recommendations. Through these recommendations, and all of those within, we position the book as one that contributes to energy justice scholarship across borders of nations, borders of ways of thinking and borders of disciplines. Ayelet Shachar's The Shifting Border deploys a powerful map metaphor to support rethinking of borders and their functions. I interrogate this metaphor, developing some of the representational, constructive, and normative functions of maps, along with their connections to legal mechanisms for decoupling migration from territory. I survey three responses to the extra-territorialization of migration: a cynical response that rejects the possibility of migration justice, an abolitionist response (...) connected to open borders, and a revisionist response that advocates for widescale institutional reform. The revisionist response illuminates how Shachar's essay challenges us to reflect on what sorts of maps and accompanying social and political organizations would best support migrant justice. In order to delimit the realm of social phenomena, sociologists refer implicitly or explicitly to a distinction between living human beings and other entities, that is, sociologists equate the social world with the world of living humans. This consensus has been questioned by only a few authors, such as Luckmann, and some scholars of science studies. According to these approaches, it would be ethnocentric to treat as self-evident the premise that only living human beings can be social actors. The methodological (...) consequence of such critique is a radical deanthropologization of sociological research. It must be considered an open question whether or not only living human can be social actors. The paper starts with a discussion of the methodological problems posed by such an analysis of the borders of the social world, and presents the results of an empirical analysis of these borders in the fields of intensive care and neurological rehabilitation. Within these fields it must be determined whether a body is a living human body or a symbol using human body. The analysis of these elementary border phenomena challenges basic sociological concepts. The relevant contemporary sociological theories refer to a dyadic constellation as the systematic starting point of their concept of sociality. The complex relationship between at least two entities is understood as the basis of the development of a novel order that functions as a mediating structure between the involved parties. Based upon empirical data, I argue that it is necessary to change this foundational assumption. Not the dyad but the triad must be understood as the foundational constellation. This implies a new understanding of the third actor, which is distinct from the concepts developed by Simmel and Berger and Luckmann. (shrink)

This article develops a systematic philosophical account of violence by shifting the analysis from normative and empirical definitions to the ontological conditions that make violence possible. The analysis proceeds through three levels: terminological, denotative, and essential. First, the semantic history of the concept reveals an intrinsic indeterminacy linking violence with force, power, and authority across linguistic traditions. Second, the denotative scope of violence expands from criminal acts to systemic and structural phenomena, making a stable definition impossible. These difficulties indicate that (...) violence cannot be understood as a property of particular actions. The article, therefore, proposes a shift to the generic level of the intentional application of force. Force is interpreted as a practice that produces and transforms social space through the establishment of hierarchies between agent and object. Violence emerges not as an autonomous phenomenon but as an evaluative designation applied when the application of force truncates another’s space by incorporating it into the space of the acting subject. Violence is thus understood as a structural feature of world-formation rather than an anomaly within it. The ethical and political problem is not the elimination of violence but the determination of its direction and measure. (shrink)

While citizens of developed countries enjoy lives of unmatched affluence, over a billion people struggle to subsist on incomes of less than $1/day. Can't we conclude that their poverty constitutes a glaring injustice? The answer almost certainly is yes—but not because some countries are rich, nor because of inadequate levels of redistribution. Liberal political theory traditionally maintains that persons are rights-holders, and the primary duty owed them is noninterference. Corrupt and tyrannical governments flagrantly violate the liberty rights of their captive (...) populations. External governments conspicuously fail to respect noninterference, however, when they erect barriers to trade between foreign nationals and their own citizens, subsidize domestic industries, prevent innocent movement across borders by would-be workers, and when they tender assistance to abusive states (such as foreign aid that lines the pockets of kleptocrats and enhances their power). The theory advanced here is similar to that of Rawls in rejecting an international difference principle, but unlike Rawls it advances an account of international justice as continuous with domestic principles of justice. Certain states in the Global North have responded to refugees seeking safety on their territories through harmful practices of border violence, detention, encampment and containment that serve to prevent and deter refugee arrivals. These practices are ostensibly justified through an appeal to a right to control borders. This paper therefore assesses whether these harmful practices can indeed be morally justified by a state’s right to control borders. It analyses whether Christopher Heath Wellman’s account of a state’s right to (...) freedom of association, which represents the most restrictive account of a state’s right to control borders available in the literature, can extend to justify current harmful practices against refugees. If not, then no available justification will be able to do so, and thus contemporary harmful practices used against refugees cannot be justified by a state’s right to control borders. (shrink)

Although the borders themselves have always been symbolically important for the kind of world view that does not recognize them, this new review of their relationship seems necessary, because in the 2020s it seems increasingly that cosmopolitanism itself is “on the border”, or at a turning point. After increased interest in the idea of cosmopolitanism at the end of the 80’s and the beginning of the 90’s of the 20th century, “fatigue” with the topic has been felt more and (...) more in recent years, even before the pandemic and the emergence of the new cold and less than cold war’s dealt blows to the cosmopolitan idea. In this unfavourable global political climate, it is not at all surprising that the idea of celebrating “shared humanity” across borders has lost some of its appeal. Thus, the focus of this review will be on: whether cosmopolitanism, which has long argued that borders are irrelevant and that all people share certain qualities that should be acknowledged by all, still has a place in the modern global political environment of border wall construction, escalating economic and war conflicts – or has it once again been left to oblivion? In Promoting Justice Across Borders, Lucia Rafanelli develops an ethical theory of ‘reform intervention’: a deliberate attempt to promote justice in a foreign society. The theory specifies which types of interventions are justified under what circumstances and who is justified in intervening where. Rafanelli’s theory eschews nation-states and instead makes its main actors societies with capacity for self-determination. This, I argue, can make the theory hard to apply, because different societies can overlap or intersect, and the theory’s implications change (...) depending on how one draws boundaries around groups. So the theory can give contradictory directives for the same event, depending on how one envisions the subject of intervention. The move away from states, however, may be inevitable, because contemporary problems in international relations (such as those related to climate change) cannot be easily contained within the framework of independent sovereign states in the international system. On Borders asks when are borders legitimate, and it offers a new theory to answer the question. The book challenges critical and normative theories that criticize or justify borders solely in terms of identity, and instead frames borders and border legitimacy from the perspective of place and presence. Instead of thinking of borders as the exclusionary limit of identity groups, the book develops a theory of territorial jurisdictions grounded on place-specific relations, giving central roles to (...) urban settings and the environment. This article examines the development of modern nursing education in China through a case study of the Xiangya School of Nursing in Changsha between 1909 and 1926. Founded in 1911 by the Yale‐in‐China Association, a non‐denominational mission, Xiangya was among the earliest nursing schools in China to promote undergraduate nursing education and public health nursing. Drawing on archival materials, published primary sources, and Chinese and English historiography, we analyze the cultural, political, and gendered challenges that shaped the school's development under (...) the leadership of American nurse Nina Gage. While Gage initially sought to implement an Americanized model of nursing education, she and her colleagues adapted admission policies, educational goals, and curricula to local social and cultural conditions. Recognizing the need for Chinese nursing leadership, they prioritized the establishment of a Bachelor of Science degree to prepare nurses for teaching, administration, and public health roles. By 1926, Xiangya had trained approximately 16% of China's qualified nurses and had become one of only two schools in China offering university‐level nursing education. This history highlights the interplay of transnational influence, cultural adaptation, and gendered reform in the professionalization of nursing in early 20th‐century China. (shrink)

Establishing biotic borders was part and parcel of empire building. The question of which kinds of biological species were permitted to make their way into North American and West European territories shaped transregional border control in the imperial age. Biotic borders were intensely biocultural in that stereotypes around race and ethnic differences shaped them. Drawing on examples from the history of white ants (also known as termites) in the American and British empires, this essay argues that insects had (...) a sustained and global presence in modern imperial imaginations of borders and frontiers. According to Joseph Carens, ‘[i]f it is so important for people to have the right to move freely within a state, isn’t it equally important for them to have the right to move across state borders? Every reason why one might want to move within a state may also be a reason for moving between states’. This argument, called ‘cantilever’, is perhaps the strongest argument for a human right to immigrate. Despite various attempts, critics have been at pains to (...) refute it. In this article, I argue that if we want to refute the cantilever argument, we must point to a claim people have against their own state to allow them to move freely within and across its borders that they lack against other states to allow them to move freely across their borders. The article explores different rationales for this claim and finds that the only one that can justify a human right to domestic freedom of movement but not to international freedom of movement is protection against state domination. Biologists studying short-lived organisms have become aware of the need to recognize an explicit temporal extend of a population over a considerable time. In this article we outline the concept and the realm of populations with explicit spatial and temporary boundaries. We call such populations “temporally bounded populations”. In the concept, time is of the same importance as space in terms of a dimension to which a population is restricted. Two parameters not available for populations that are only spatially defined (...) characterise temporally bounded populations: total population size, which is the total number of individuals present within the temporal borders, and total residence time, which is the sum of the residence times of all individuals. We briefly review methods to estimate these parameters. We illustrate the concept for the large blue butterfly (Maculinea nausithous) and outline insights into ecological and conservation-relevant processes that cannot be gained without the use of the concept. Under what conditions is it ethically acceptable for corporations to market consumer products in foreign countries in order to circumvent domestic safety and health regulations? In this paper, I argue that the standards of consumer product safety that corporations should follow can vary from one country to another and are largely determined by the levels of risk that each country's consumers may reasonably accept in order to own or use those products. I develop my conclusions in part by analyzing the (...) case of an American corporation’s selling children’s clothing in Africa that domestic regulations prohibit selling in the United States. The increased—even intrusive—use of digital means and “artificial intelligence” has the effect of disintegrating social relationships, whether at work or in personal life. It tends to reduce human intelligence to the binary logic of the machine, making any effort to reconcile points of view and any form of genuine creativity impossible. Moreover, quantitative data is valued to the detriment of qualitative data. All in all, human hubris finds itself trapped in an artificial world, and reality as it stands is forgotten.

Contextuality is a key feature of quantum mechanics. We present the sheaf-theoretic approach to contextuality introduced by Abramsky and Brandenburger, and show how it covers a range of logical and physical phenomena “at the borders of paradox”.

This article argues that there is no human right to cross borders without impediment. Receiving states, however, must recognize the procedural rights of those unable to protect their human rights in the place where they currently reside. Asylum claims must be properly investigated, and in the event that the state declines to admit them as refugees, it must ensure that the third country to which they are transferred can protect their rights. Both procedural and substantive rights apply while refugees (...) are physically present in the state’s territory and their immigration status is being investigated. The state’s obligation to protect these rights arises from the power it exercises over them. In contrast, the state does not exercise equivalent power over those it declines to admit in the first place, even though its immigration criteria – if discriminatory in the negative sense – can be faulted on other grounds. Beneath these arguments lie two basic assumptions: one is the need to separate human rights claims from other claims of justice, especially those deriving from citizenship; the other is the need to determine who bears the obligations that correspond to these rights. Attention to the different relations in which prospective immigrants may stand toward the state they hope to enter can help us understand how border regimes may comply with, or violate, human rights. We examine the effect of the cross-border merger and acquisition (M&A) activities of Chinese firms on their corporate social responsibility (CSR) performance. We find that Chinese acquirers significantly increase CSR performance and CSR spending following cross-border M&As. The legal origins and social norms of host countries are found to positively affect the acquirers’ CSR performance and CSR spending in the post-M&A period. The results are consistent with Chinese acquirers signaling their commitment toward CSR through cross-border M&As to respond to diverse (...) stakeholder demands and strengthen corporate reputation. We also provide evidence that Chinese firms’ knowledge acquisition through cross-border M&As boosts green innovation. In addition, we show that the financial performance of Chinese acquirers does not suffer in the long term, indicating that strategic CSR investments can be integrated with other corporate investment activities. Our study demonstrates how cross-border M&As affect stakeholder value beyond value for shareholders. (shrink)

Understanding the complex effects of globalization is essential to moving beyond the single stories that often arise on both sides of the immigration debate, allowing us to reflect more responsibly on immigration policy. So berücksichtigen die hier gesammelten Beiträge eine doppelte Fragestellung: nach der Differenz und Überschreitung von Normen. Beide Begriffe werden zueinander in Beziehung gesetzt, um jeglichen Übergang in kulturell-sozial-historische Kontexte einbetten zu können. Die in chronologischer Reihenfolge präsentierten Analysen und Interpretationen von ausgewählten Texten deutscher, französischer, polnischer, russischer sowie antiker Literatur zeigen exemplarische Akte der Transgression in (...) verschiedenen Kulturen und unter sich verändernden Zeitumständen und dokumentieren ästhetische Versuche, die bestehende Ordnung zu revidieren und eine neue zu schaffen. This trilingual volume focuses on acts of transgressive acting/writing in selected texts of European literatures whose authors differ in gender, nationality and time frame. Thus, the contributions collected here consider a double questioning: of difference and transgression of norms. Both concepts are set in relation to each other in order to be able to embed any transition in cultural-social-historical contexts. The analyses and interpretations of selected texts from German, French, Polish, Russian and ancient literature, presented in chronological order, show exemplary acts of transgression in different cultures and under changing time circumstances and document aesthetic attempts to revise the existing order and create a new one.
