Opponents of male circumcision have increasingly used human rights positions to articulate their viewpoint. We characterize the meaning of the term “human rights.” We discuss these human rights arguments with special attention to the claims of rights to an open future and to bodily integrity. We offer a three-part test under which a parental decision might be considered an unacceptable violation of a child's right. The test considers the impact of the practice on society, the impact of the practice on (...) the individual, and the likelihood of adverse impact. Infant circumcision is permissible under this test. We conclude that infant circumcision may be proscribed as violating local norms, even though it does not violate human rights. (shrink)

Li 禮 (translated variously as “ritual”, “etiquette”, or “propriety”) plays a central role in early Confucianism, but its complexity is not always fully understood. At first glance, it may seem as if li behaviors are merely attempts to promote conservative practices from the idealized Chinese past. However, by examining the nature and function of li, as described the Analects (Lunyu 論語) and the Xunzi 荀子 (two key texts in the early Confucian tradition), it becomes overwhelmingly apparent that li is (...) a much more complicated phenomenon. Li actually plays key roles within the interconnected fields of Confucian ethics, religion, and politics and often adds aesthetic elements to these areas of thought. As such, it is as much a source of Confucian innovation as it is a tool for promoting reverence for the past. (shrink)

Confucians think ritual propriety is extremely important, but this commitment perplexes many Western readers. This essay outlines the early Confucian Xúnzǐ’s defense of ritual, then offers a modified defense of ritual propriety as a real virtue, of value to human beings in all times and places, albeit one that is inescapably indexed to prevailing social norms in a non-objectionable way. The paper addresses five likely objections to this thesis, drawing on but going beyond recent Kantian defenses of (...) courtesy and civility. The objections concern cultural relativity, insincerity, separating style from substance, elitism, and possible incoherence in the virtue itself. (shrink)

Everyone, with the possible exception of those who are really good at it, is personally familiar with the phenomenon of self-deception. Anyone who has been conscious of struggling with a temptation to do what goes against her own better judgment and has then found justification for yielding to temptation is familiar with self-deception. So if I may be allowed to begin with the assumption that most of us have experienced a phenomenon that we would identify as some form of self-deception, (...) what I shall try to do in this paper is to examine how one particular theory of personal identity can account for the phenomenon. Having done that, I shall look into the question of one of the mechanisms of self-deception and then into the question of whether there are occasions in which the mechanisms of self-deception may be regarded as producing more positive results. This postulation leads Freud to conclude that "the beginnings of religion, morals, society and art converge in the Oedipus complex,"1 and, accordingly, most readers, regardless of their argument, presuppose that the text depicts a "fundamental oedipal revolt."2 This is how Peter Gay characterizes the action of Totem and Taboo in his short introduction to the Norton Standard Edition, (...) and this is how the text is generally remembered. Gestures in religious rites are a key issue for the believer who sits in front of the Deity to supplicate and adore. Among the most common religious gestures are kneeling and putting the hands together in a vertical position. Far from being simple positioning and posture without any symbolical meaning, they express intense inner feelings of the (...) human emotionally and mentally directed from the profane dimension towards the endless extensions of the sacredness in a total approach of worship and mystical confession. . Human ceremonial ritual is considered as an evolved behavior, one of the principal effects of which is the promotion of intragroup cohesion by decreasing or eliminating intragroup aggression. It is seen as a major determinant of what Victor Turner calls communitas in human social groups of varying extension. The frequent paradoxical effect of ritual's promoting extragroup aggression at the same time that it diminishes intragroup aggression is considered.
