The fifth volume of __The Complete Works of William Howard Taft__ presents two publications Taft wrote as Kent Professor of Constitutional Law at Yale University, the position he assumed in 1913 after he was defeated in his bid for re-election as U.S. president. The first, _Popular Government_, was prepared for a series of lectures, but was motivated by Taft’s passion over the issue of constitutional interpretation, which had been hotly contested during the campaign. Organized around the preamble of (...) the Constitution, the lectures and later the book were opportunities for Taft to restate his opposition to the direct democracy movement and to reveal the workings of a conservative mind. In the second, The Anti-trust Act and the Supreme Court, Taft articulates his position in the ongoing debate over the conventional nineteenth-century notion of “laissez faire” and the provisions of the Sherman Antitrust Act. Taft had pursued a policy of vigorous antitrust enforcement during his presidency. In this book he intended to demonstrate that restraint of trade was part of the common law, thereby arguing to good effect in favor of reasonable restraint of trade in his own time. Taft's careful distinction between predatory monopolistic practices and the reasonable business practices of well-behaved corporations continues to inform today's chambers of government. (shrink)

The inaugural volume of __The Collected Works of William Howard Taft__ is composed of two of his earliest books, _Four Aspects of Civic Duty_ and _Present Day Problems_._ Based on a series of lectures delivered at Yale in 1906, _Four Aspects of Civic Duty_ is an attempt by then Secretary of War Taft to bring to the attention of his audience the importance of civic duty from the perspective of the university graduate, the judge on the bench, the colonial (...) administrator, and the national executive branch of government. His remarks were drawn from his own experience, while at the same time he laid down the principles of citizenship with which all people could identify. In _Present Day Problems_, William Howard Taft demonstrates the depth of his knowledge and the seriousness of his reflections on a wide range of topics including Sino-American relations and the ongoing contest between capital and labor in America’s increasingly industrial socioeconomy. The problems he takes up are met head-on and discussed in a fashion likely to persuade his audience that he is well prepared to tackle the burdens of the presidency. _ The Collected Works of William Howard Taft__, in eight volumes, will include Taft’s complete published works as well as his presidential and state addresses and selected court opinions from his days as chief justice of the Supreme Court. There are two intriguing paradoxes in molecular biology-the inconsistent relationship between organismal complexity and (1) cellular DNA content and (2) the number of protein-coding genes-referred to as the C-value and G-value paradoxes, respectively. The C-value paradox may be largely explained by varying ploidy. The G-value paradox is more problematic, as the extent of protein coding sequence remains relatively static over a wide range of developmental complexity. We show by analysis of sequenced genomes that the relative amount of non-protein-coding sequence increases (...) consistently with complexity. We also show that the distribution of introns in complex organisms is non-random. Genes composed of large amounts of intronic sequence are significantly overrepresented amongst genes that are highly expressed in the nervous system, and amongst genes downregulated in embryonic stem cells and cancers. We suggest that the informational paradox in complex organisms may be explained by the expansion of cis-acting regulatory elements and genes specifying trans-acting non-protein-coding RNAs. (shrink)

From his earliest writings as a student in the Evangelical Stift in Tübingen to the last years of his life as a professor in Berlin, art played a major role in Hegel’s various philosophical formulations. It is important to note, however, that although Hegel remained convinced of the general importance of art for his own philosophical endeavors, the particular details of his interpretation of its significance changed quite markedly over the years as he developed his own unique philosophical position and (...) as his firsthand experience of works of art increased. In this paper I will concentrate on some of Hegel’s earliest efforts toward developing his own philosophical system, and will show how this development is reflected in a fundamental transformation of his interpretation of the significance of art. More specifically, I will establish in what follows that one major consequence of Hegel’s evolving systematic philosophy is an “impoverishment” of the artistic in the sense that art comes to lose a certain fertility which it had had in his earlier views. This impoverishment is in effect the price exacted if art is to assume a place within Hegel’s system, precisely because the role and significance of art now come to be defined by and expressed in terms of its place in that system. Although this paper will be concerned with only the first stages in a process of development which continues all the way up to his Berlin lectures on beautiful art, it will nonetheless become apparent that Hegel’s early understanding of art has to have been radically altered for such a development even to begin. Aware of these problems, some North Americans choose to disengage from transnational work. But the reality is that we cannot avoid participating in global networks that affect people in many countries, and there are vast inequalities in access to resources that need to be addressed. Through philosophical insights, narrative accounts, and testimony from community members, we can discover a path between development and disengagement, (...) through which relational morality and meaningful action can enrich intercultural collaboration and yield many fruits. This is a book symposium on Kevin Krein’s Philosophy and Nature Sports. Gunnar Breivik, Jim Parry and Irena Martínková, and Rebekah Humphreys provide critical commentary on the text. The critical comments are followed by a response from Krein. The discussion covers a broad range of topics. These include the definition of “sport,” comparisons between nature sports and friluftsliv, the role of risk in nature sports, the experience of flow and the sublime in nature sports, and the understanding of nature. They came from an old world to a new land. The Yiddish speakers from Eastern Europe brought few material possessions but clung to a language and a culture that defined who they were, a way of life that had endured pogroms, persecution and a genocide that pushed them to the brink of extinction. Melbourne gave them a second chance at life, an opportunity to rebuild a secular Yiddish world that sat at the core of their existence. Hardship had taught these (...) Jews to be resilient, fiercely independent and great institution builders. A community centre quickly became the beating heart of Yiddish Melbourne. The arts flourished, newspapers were launched and schools were established. But these immigrants also brought their competing political ideals and hotly contested notions of what it meant to be a Jew in this corner of the world. Their arrival in Melbourne was not always welcomed. Australian authorities only grudgingly accepted them as immigrants, in restricted numbers and under the sponsorship of Jews already living here. Yiddish speakers, with their boisterous demeanour and high visibility, challenged the authority of the established Jewish community, which traced its origins to the first settlement and which believed that ‘blending in’ was the antidote to antisemitism. Using the voices of the immigrants themselves, along with archival sources, Taft and Markus give a compelling account of how these Yiddish speakers came to shape, change and define an entire community. Kevin Scharp proposes an original theory of the nature and logic of truth on which truth is an inconsistent concept that should be replaced for certain theoretical purposes. He argues that truth is best understood as an inconsistent concept, and proposes a detailed theory of inconsistent concepts that can be applied to the case of truth. Truth also happens to be a useful concept, but its inconsistency inhibits its utility; as such, it should be replaced with consistent concepts that (...) can do truth's job without giving rise to paradoxes. To this end, Scharp offers a pair of replacements, which he dubs ascending truth and descending truth, along with an axiomatic theory of them and a new kind of possible-worlds semantics for this theory. He goes to develop Davidson's idea that truth is best understood as the core of a measurement system for rational phenomena (e.g., belief, desire, and meaning), and offers a semantic theory that treats truth predicates as assessment-sensitive (i.e., their extension is relative to a context of assessment) and solves the problems posed by the liar and other paradoxes. The editors, both former students of Lynch, provide a cogent summary of his career and of the role he played in shaping and transforming the American urban design profession during the 1950s, the 1960s, and the 1970s. Each of the seven thematic groupings of writings and projects that follow begins with a short introduction explaining their content and their background. The essays in part I focus on the premises of Lynch's work: his novel reading of large-scale built environments and the notion that the design of an urban landscape should be as meaningful and intimate as the natural landscape. In part II, excerpts from Lynch's travel journals reveal his early ideas on how people perceive and interpret their surroundings—ideas that culminated in his seminal work, The Image of the City. This part of the book also presents Lynch's experiments with children and his assessment of environmental-perception research. The examples of both small-scale and large-scale analysis of visual form in part III are followed by three parts on city design. Philosophical logicians proposing theories of rational belief revision have had little to say about whether their proposals assist or impede the agent's ability to reliably arrive at the truth as his beliefs change through time. On the other hand, reliability is the central concern of formal learning theory. In this paper we investigate the belief revision theory of Alchourron, Gardenfors and Makinson from a learning theoretic point of view.
