Science du sens et du questionnement, la sémiotique propose des méthodes pour interroger le sens des pratiques sociales et des productions culturelles humaines. Elle est donc en mesure d’appréhender sous quelles formes et avec quels effets sémiotiques les choix technologiques, politiques et de modèle social transforment nos cultures conçues comme des totalités porteuses de sens et comme des foyers d’identité pour chacun de nous. Il nous faut pour cela proposer un niveau de questionnement adéquat et de portée suffisante, un « (...) plan d’immanence » qui soit approprié à la nature et au niveau des problèmes à traiter. Ce plan d’immanence sera celui des formes de vie, définies en première approche comme des ensembles signifiants composites et cohérents qui sont les constituants immédiats des cultures. Les formes de vie sont elles-mêmes composées de textes, de signes, d’objets et de pratiques ; elles portent des valeurs et des principes directeurs. Elles disent et déterminent le sens de la vie que nous menons et des conduites que nous adoptons ; elles nous procurent des identités et des raisons d’exister et d’agir en ce monde. L’objectif de cette réflexion en cours est donc de redéfinir les formes de vie comme le plan d’immanence principal d’une sémiotique des cultures, pour rendre compte à la fois de leur cohérence, de leurs déformations et de leurs transformations. Après un examen de la conception des formes de vie chez Wittgenstein, cette étude proposera une reconfiguration conceptuelle, en passant notamment par la prise en considération de la dimension phénoménologique, sensible et subjective des formes de vie culturelles. Elle proposera d’abord une définition de leur cohérence syntagmatique, ainsi que de leur congruence paradigmatique. Elle montrera que la quête du sens de la vie dans les formes de vie a pour origine l’expérience sensible de leur « imperfection », et elle aboutira à la caractérisation des « états d’âme élémentaires » issus de cette expérience, et sur lesquels reposent les formes de vie humaines. This chapter engages with Roger Cotterrell's characterisation of the trust as 'ideological.' However, rather than agreeing with Cotterrell that the trust disguises the true ownership of the beneficiary, it shows that the family trust subverts this idea of a one-sided ownership relation altogether by effecting a reversal in the hierarchical distinction between persons and things. Under the appearance of wealth, beneficial owners are serving the very things they own by ensuring their protection and continuous reproduction.

This chapter looks at the way in which critical theory has been applied to trusts law. Its main question is why the critique of trusts law, or critical trusts law, has not been more successful, given the prevalence of critical approaches in legal scholarship. To this end, it describes some of the elements that critical trusts law as a normative project involves, before pointing to two factors that limit its success: the unruliness of trusts law and the judgment that normative (...) critique often entails. It finally outlines a way in which to read and write critical trusts law that may not only avoid some of the identified problems but may also open up new paths to the understanding of property outside of the confines of liberal thought. Carl Schmitt's notion of nomos is commonly regarded as the international equivalent to the national sovereign's decision on the exception. But can concrete spatial order alone turn a constellation of forces into an international order? This article looks at Schmitt's work The Nomos of the Earth and proposes that it is the process of bracketing war called Hegung which takes the place of the sovereign in the international order Schmitt describes. Beginning from an analysis of nomos, the ordering function of (...) the presocratic concept moira is explored. It is argued that the process of Hegung, like moira, does not just achieve the containment of war, but constitutes the condition of possibility for plural order. (shrink)

Bourdieu’s thought is disturbing. Provocative. Scandalous even, at least for those who do not easily tolerate the unmitigated truth about the social. Nonetheless his ideas, among the most important and innovative of our time, are here to stay. This thought has taken form in the course of a career and through works on diverse subjects that have constructed a far-reaching analytical model of social life, which the author calls more readily an anthropology rather than a sociology. In their totality, they (...) constitute today an original and powerful proposal to explain human practices. In the face of criticisms commonly leveled at Bourdieu’s thought (notably the charge that it reduces everything to a single schematic model), it is important to identify the spirit of his enterprise. Early on, it is true, his thought drew on a few fundamental concepts—the trilogy habitus, field (champ), practice (pratique)—to which it constantly returned, and followed a clearly defined trajectory. At the same time, however, he continually reformulated, adapted, and refined his analytical model, depending on the operations to which he subjected new objects of inquiry. The regenerative and transformative force of his thought was supported by two convictions. First, that there being nothing more vain than theory for theory’s sake, it is preferable that theoretical production originate in the study of concrete and occasionally very specific cases. Second, that in order to escape stereotypical classifications, boundaries separating disciplines are best transgressed, thereby favoring new constructions of the object of inquiry. (shrink)

This article takes as its subject matter the juridico-political space of the prisoner of war (POW) camp. It sets out to determine the nature of this space by looking at the experience of war captivity by Jewish members of the Western forces in World War II, focusing on the experience of Emmanuel Levinas, who spent 5 years in German war captivity. On the basis of a historical analysis of the conditions in which Levinas spent his time in captivity, it argues (...) that the POW camp was a space of indifference that was determined by the legal exclusion of prisoners from both war and persecution. Held behind the stage of world events, prisoners were neither able to exercise their legal agency nor released from law into a realm of extra-legal violence. Through a close reading of Levinas’s early concept of the ‘there is’ [il y a], the article seeks to establish the impact on prisoners of prolonged confinement in such a space. It sets out how prisoners’ subjectivity dissolved in the absence of meaningful relations with others and identifies the POW camp as a space in which existence was reduced to indeterminate, impersonal being. In nature validation for physiological and emotional bonding becomes a mode for supporting social connectivity. Similarly, in the blockchain ecosystem, cryptographic validation becomes the substrate for all interactions. In the dialogue between human and artificial intelligence (AI) agents, between the real and the virtual, one can distinguish threads of physical or mental entanglements allowing different modes of participation. One could even suggest that in all types of realities there exist frameworks that are to some extent equivalent and act as validation (...) mechanisms for behavioural interweaving. Relevant to our own experience as an Editorial Organism, in this issue of Technoetic Arts we explore modes of participation and collaboration through different lenses by including guest-edited sections and stand-alone articles. This article provides a property analysis of electronic money, showing that the issuance of electronic money cannot involve a trust. The analysis is also applicable to other digital assets that may be said to involve a trust, and as such provides a timely contribution to current discussions on the legal nature and categorisation of digital assets both in the UK and internationally.

During the Second World War, more than 60,000 Jewish members of the American, British and French armed forces became prisoners of war in Germany. Against all expectations, these prisoners were treated in accordance with the 1929 Geneva Convention, and the majority made it home alive. This article seeks to explain this most astonishing circumstance. It begins by collating the references to the experiences of Western Jewish POWs from the historical literature to provide a hitherto-unseen overview of their treatment in captivity. (...) It then asks what made their protection from persecution possible. To this end, it explores Germany’s wider motivations for its selective application of the Geneva Convention and highlights the role that military identity played in making its application seem necessary for all POWs from the Western front, including Jewish POWs. Within a liberal, ‘law of things’ understanding of property, the donative trust is seen as a species of gift. Control over trust property passes from the hands of settlors to beneficiaries, from owners to owners. Trust property, like all other property, is silent and passive, its fate determined by its owners. This article questions this understanding of the trust by showing how beneath the facade of ownership, the trust inverts the relation between owner and owned, person and thing. It analyses (...) the relation that trustees, beneficiaries and settlors have to the trust property and argues that the role of each of these parties can be shown to consist in furthering the interests of the trust property rather than their own. It claims that this protects things from their owners at the same time as it ensures these owners’ ongoing care towards the things they own. This raises questions about the trust’s status within the institution of private property, justified as it is by the human autonomy it is said to enable. (shrink)

Does the perceptual processing of faces flexibly adapt to the requirements of the categorization task at hand, or does it operate independently of this cognitive context? Behavioral studies have shown that the fine and coarse spatial scales of a face are differentially processed depending on the categorization task performed, thus suggesting that the latter can influence stimulus perception. Here, we investigated the time course of these task influences on perceptual processing by examining the visual N170 face‐sensitive Event‐Related Potential (ERP), while (...) observers categorized faces for their gender and familiarity. Stimuli were full spectrum, or filtered versions that preserved either coarse or fine scale information of the faces. Behavioral results replicated previous findings of a differential processing of coarse and fine spatial scales across tasks. In addition, the N170 amplitude was larger in the Gender task as compared to the Familiarity task for LSF faces exclusively, thus showing that task demands differentially modulated the spatial scale processing on faces. These results suggest that the diagnosticity of scale‐specific cues in categorization tasks can modulate face processing. (shrink)

What does it mean to act politically? This paper contributes an answer to this question by looking at the role that necessity plays in the political theory of Carl Schmitt. It argues that necessity, whether in the form of existential danger or absolute values, does not affect the sovereign decision, which must be free from normative determinations if it is to be a decision in Schmitt’s sense at all. The paper then provides a reading of Schmitt in line with Weber’s (...) ethics of responsibility, according to which the political actor decides not arbitrarily and irresponsibly, but actively assumes responsibility for the decisions he takes. The essence of the method of physics is inseparably connected with the problem of interplay between local and global properties of the universe. In the present paper we discuss this interplay as it is present in three major departments of contemporary physics: general relativity, quantum mechanics and some attempts at quantizing gravity (especially geometrodynamics and its recent successors in the form of various pregeometry conceptions). It turns out that all big interpretative issues involved in this problem point towards the necessity (...) of changing from the standard space-time geometry to some radically new, most probably non-local, generalization. We argue that the recent noncommutative geometry offers attractive possibilities, and gives us a conceptual insight into its algebraic foundations. Noncommutative spaces are, in general, non-local, and their applications to physics, known at present, seem very promising. One would expect that beneath the Planck threshold there reigns a "noncommutative pregeometry", and only when crossing this threshold does the usual space-time geometry emerges. (shrink)

This article describes the conceptual framework within which knowledge about Africa was legitimized in eighteenth-century French philosophy. The article traces a shift or rupture in this conceptual framework which, at the end of the eighteenth century, led to the emergence of new conditions for knowledge legitimation that altered Europe's perception of Africa. The article examines these two conceptual frameworks within the context of a discussion of the social theory of the time, which categorized Africans first as savages, and then, with (...) the advent of our modern "style of reasoning," as primitives. The argument used to demonstrate this change in categorizations is historical. The greater part of the article analyzes in detail the principal social theory of Enlightenment philosophy, the stadial theory of society, with the aim of demonstrating how it determined what could be affirmed about Africa. The shift in the perception of Africans from savages to primitives involved an epistemological change in how societies were grasped. The article provides a greater understanding of the constitution of Africa as a cognitive construct, which is not only of theoretical concern; this construct shaped Europe's intervention in Africa, and continues to influence what we believe Africa is and should become. Résumé Cet article explore le processus de déshumanisation et ses effets sur les individus et plus particulièrement sur leur corps. Pour approcher l’univers de la déshumanisation, les auteurs se sont plongées dans l’irreprésentable des violences génocidaires survenues dans la région des Grands Lacs au Burundi. Deux grandes interrogations constituent le fil rouge de la réflexion : le corps et le paradoxal. Le cas de Nemesa, jeune ex-rebelle burundaise, a permis de penser la souffrance paradoxale liée aux violences extrêmes et inhumaines.

Buscamos, com o presente artigo, investigar o impacto da práxis de um Projeto de Extensão Universitária, que consiste em oficinas de música para crianças e adolescentes com o que designamos autismo ou outras neurodivergências, sobre a formação discente, levando em consideração as dimensões clínica e ético-política da ação extensionista. Dividimos a metodologia em duas partes: a primeira corresponde à revisão bibliográfica tipo narrativa, por meio da qual abordamos textos da fenomenologia da vida e das éticas da alteridade, comunitária e da (...) libertação; a segunda parte diz respeito aos relatos de experiência feitos pelas/os discentes participantes do Projeto e coautoras/es do presente artigo. Os/as discentes responderam a questões relacionadas a dois eixos temáticos construídos a priori: o impacto da Oficina de Música sobre sua formação e a percepção sobre as dimensões clínica e ética do Projeto. Avaliamos as narrativas por meio da análise de conteúdo, a partir da qual construímos as seguintes categorias de análise: impacto transformador da práxis da Oficina; e modelo biomédico e pensamento crítico, referentes ao eixo 1; arte, acolhimento e potencial terapêutico; pessoas que não cabem em um diagnóstico; e uma clínica ético-política, referentes ao eixo 2. Concluímos que a ação extensionista tem tido um impacto positivo sobre a formação discente, contribuindo para uma clínica estética, ética e política não normalizadora, que possibilita a liberação das forças da vida, a afirmação da vida em sua multiplicidade, sobretudo daquelas pessoas que tiveram e continuam tendo suas vidas negadas e invisibilizadas pelo sistema de produção (econômico e discursivo) dominante. Patient self-disclosure is essential to the work of health professionals, and this is even more critical in mental health where speech is a reflection of the content of thought. Self-disclosure is then about invisible symptoms that are associated with health problems where discrimination and stigmatization are still very prevalent. This article explores the ethical issues of this phenomenon which has received very little study. Disclosure as a decision-making, interpersonal, dynamic and complex process will be defined and deepened with the help (...) of examples from research. Subsequently, the vulnerability of the person who discloses will be addressed, followed by issues of quality of care and related to the standards of professional practice associated with patient disclosure and their associated responsibility. These elements highlight many ethical issues and ultimately lead us to a proposal to situate the professionals involved. (shrink)

Scholars in nonhuman animal studies and criminology have argued that more attention should be paid to the violence sanctioned by society, that of animal slaughter for industrial food production. Slaughterhouses and the communities surrounding these facilities present ideal sites for investigating how the violence of nonhuman animal slaughter work impacts individuals and society. The main research questions addressed in this study were whether the presence of a slaughterhouse in a rural community had an effect on violent crime arrest rates and (...) what impact these facilities have on social disorganization in the community. Previous research on slaughterhouse communities has established a correlation between slaughterhouse employment and violent crime. This research examined the relationship between the presence of a slaughterhouse in the community and violent crime rates. Findings indicated that the location of a slaughterhouse in a county was associated with increases in the total arrest rate, arrests for rape, and arrests for offenses against the family in comparison to counties without a slaughterhouse, pointing to a relationship between the violence of killing nonhuman animals and violence towards humans. En 1972, Pierre Clastres trouve chez Deleuze et Guattari la théorie du marquage qui sera déterminante dans l’élaboration de sa thèse de la société-contre-l’État. Huit ans plus tard, ces derniers développent une théorisation du nomadisme dans Mille plateaux où tient une place importante la thèse de l’anthropologue. Eduardo Viveiros de Castro, fin lecteur de Mille plateaux, y (...) puise pour sa part des outils conceptuels, notamment le concept de devenir, lui permettant de dépasser le clivage entre nature et culture en anthropologie et développer une interprétation du perspectivisme et du cannibalisme amazonien. Il relit en retour Clastres pour décentrer la thèse de la société-contre-l’État de son “sociocentrisme” et l’ouvrir à une cosmopolitique “par-delà nature et culture” qui se dessine clairement à l’horizon de Mille Plateaux. ». The discussion about the concept of enlightenment runs through the conception of Immanuel Kant, who thematized it as an exit from the individual from his condition of intellectual minority and guardianship of those who prevent the exercise of thinking for himself, impelling the achievement of autonomy that requires freedom and to make public use of reason. Such problematization about the difficulties interposed to the process of enlightenment can be related to the problem of estrangement in Marx, making the necessary considerations (...) in relation to the historical and social context of both philosophers. In this way, through philosophical investigation, it is possible to establish correlations of complementarities, differences and counterpoints between the different conceptions of Kant and Marx. Thus, we realize that the search for enlightenment depends on overcoming the material determinations of the set of alienations produced by the capitalist mode of production, aiming at the achievement of human emancipation understood as effective autonomous freedom. This article presents the perspective of Karl Marx and Friedrich Engels on the concept of the State. It is divided into three parts, the first addressing the emergence of the State as a result of the expropriation of the means of production suffered by direct producers, giving rise to private property with the State; the first section also addresses the State in slave and feudal society. The second section explains the functions of the bourgeois state, that is, the attributions of (...) the State which, situated in the capitalist mode of production, represents the wishes of the ruling class; as well as, it points to the illusory form of democracy in the bourgeois State, that limits itself to reforming and does not envisage overcoming it. Finally, the third section treat with the State under the control of the working class, that is, in the period of transition to classless society, and the consequent dissolution of the State after the firmament of this society free from exploiters and exploited. It is intended to summarize the main characteristics that these simplified models have when applied to dark matter searches at the LHC, and to provide a number of useful expressions for reference. The list of models includes both s-channel and (...) t-channel scenarios. For s-channel, spin-0 and spin-1 mediations are discussed, and also realizations where the Higgs particle provides a portal between the dark and visible sectors. The guiding principles underpinning the proposed simplified models are spelled out, and some suggestions for implementation are presented. (shrink)

Attirés par l’explosion des usages de ces plateformes participatives et leurs millions d’utilisateurs, ces éditeurs numériques s’intéressent aux marchés des joueurs occasionnels en ligne. Nous proposons dans cet article d’explorer deux phénomènes (...) contemporains émergeant de ces pratiques : la convivialité et la gratuité. This article explores two contemporary phenomena that have emerged from online gaming practices: conviviality and free access.
